Temple presiding. PRESENT: Councilmen: Corbin, Dickerson, Dunnum, Morton, Temple ALSO PRESENT: Oren L. King, City Manager Royal M. Sorensen, City Attorney A. C. Gabriel, Director of Finance Sherman Griselle,, Director of Planning Ervin Spindel, Director of Public Works Lee Leavitt, City Engineer Robert Gain, Fire Chief Ivan A. Robinson, Chief of Police Ray Lake, Director of Building & Safety Walter Wanke, Water Superintendent Ruth Miller, City Librarian Don Robison, Assistant to the City Manager Robert De Sio, Administrative Assistant Della Doyle, City Clerk Alberta Pfeiffer, Deputy City Clerk Reverend Wade Armstrong of the Trinity Baptist Church delivered the invocation. Mayor Temple called on Chief of Police Ivan A. Robinson for a special presentation of a Community Service Award to Mr. Wendell Ehret for his new booklet and color slides on "Happy Cycling ". Chief Robinson reported that the booklet will be presented to all classrooms in the local schools. Mayor Temple assisted in the presentation of the plaque to Mr. Ehret. Mr. G. J. Weiss of the Allstate Insurance Company also presented a special safety award to Mr. Ehret on behalf of Allstate. Mr. Ehret thanked both the City and Allstate Insurance Company for honoring him with the two awards. Mayor Temple announced the public hearing on confirmation of assessments for Assessment District No. 73, Bixler Avenue, and asked if the City Clerk had the Affidavits of Publication, Posting and Mailing. The City Clerk replied she had the affidavits. Ordered received and filed. Mayor Temple asked if there were any written protests received. The City Clerk replied she had received a written protest from Mrs. Elizabeth L. Thrailkill. Mr. Ervin Spindel, Director of Public Works, presented a report on the assessments.. There ',eing no oral comments or protests, it was moved by Councilman Morton, seconded by Councilman Corbin and so ordered that the hearing on confirmation of the assessments for AD #73, Bixler Avenue, be closed. The City Engineer reported that the one protest received does not constitute a majority protest. It was moved by Councilman Corbin, seconded by Councilman Morton and passed by the following vote that the protest be overruled. It was moved by Councilman Corbin, seconded by Councilman Dickerson and so ordered that further reading be waived. It was moved by Councilman Corbin, seconded by Councilman Dickerson and passed by the following vote that Resolution No. 1646 be adopted. Mr. Spindel presented a resume of the basis for the proposed abandonment of the County Lighting District and annexation to the Downey City Lighting District. The City Manager also presented the facts and explained the effects and cost if such actions were taken. There were oral comments, questions and protests from the following persons: T. C. Councilman Morton recommended postponment of the action to abandon the Downey County Lighting District and annexing to the Downey City Lighting District for a year for further study, with emphasis on possible City contribution and a master plan to show where safety lighting would be installed. Councilman Morton remarked that inasmuch as safety lighting of dangerous intersections would benefit persons outside the City of Downey, such cost might be borne by the City's general funds.. Councilman Dunnum stated she is of the opinion that it is premature at this time to consider the abandonment of Downey County Lighting District to annex to the Downey City Lighting District. It was moved by Councilman.Morton, seconded by Councilman Dunnum and passed by the following vote that Downey County Lighting District not be abandoned and that there be no annexation in accordance with the Resolution of Intention to the Downey City Lighting District. It was moved by Councilman Corbin, seconded by Councilman Dickerson and so ordered that further reading be waived. Council Minutes - 12/13/65 -2- AYES: 5 Councilmen: Corbin, Dickerson, Dunnum, Morton, Temple NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None It was moved by Councilman Morton, seconded by Councilman Dunnum and so ordered that the City Manager prepare a comprehensible detailed study and master plan next year for overall City safety lighting, including recommendations as to use of funds, source of funds, prior to abandonment of the district and expiration of the agree- ment next June 30, 1966, for the Downey County Lighting District. The Mayor announced the hearing to be held on Downey Improvement Project #536, 8014 Telegraph Road. Mr. Ervin Spindel presented a resume of the case. There were no written and no oral comments or protests. It was moved by Councilman Corbin, seconded by Councilman Morton and so ordered that the hearing on DIP #536 be closed. It was moved by Councilman Morton, seconded by Councilman Corbin and passed by the following vote to authorize the Department of Public Works to proceed with Downey Improvement Project #536, 8014 Telegraph Road. The City Clerk replied she had the affidavits. Ordered received and filed. The Director of Public Works submitted a report on the matter. Mr. William F. Moore, 8813 -15 Lakewood Boulevard, protested the cost of the improvements as it was higher than the original estimate presented to him. It was moved by Councilman Morton, seconded by Councilman Dickerson and so ordered that the hearing on Downey Improvement Project #527 be closed. RESOLUTION NO. 1647 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY CONFIRMING THE ASSESSMENT FOR CHAPTER 27 PROCEEDINGS FOR DOWNEY IMPROVEMENT PROJECT NO. 527, ALLEY WESTERLY OF LAKEWOOD BOULEVARD, NORTH OF VISTA DEL ROSA AVENUE The resolution was read by title only. It was moved by Councilman Dickerson.., seconded by Councilman Morton and so ordered that further reading be waived. The City Clerk reported on the following correspondence: November report from Downey Chamber of Commerce was ordered received and filed. A letter from the Associated Student Body of Warren High School expressed appreciation relative to a swimming pool and offering their support, was ordered received and filed. Council Minutes — 12/13/65 -3- A letter from Rodney V. Cogswell, President, Downey Community Hospital Board, requested an increase of City's participation from a maximum of $750.00 a month to $900.00 per month for the emergency hospital as it has been necessary to increase the minimum income guarantee to the physician for professional services. It was moved by Councilman Morton, seconded by Councilman Dickerson and passed by the following vote to refer the contract agreement to the City Attorney for amendment to approve the requested increase to a maximum of $900.00 per month, for the Downey Community Hospital's emergency unit. AYES: 5 Councilmen: Corbin, Dickerson, Dunnum, Morton, Temple NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Reverend Cogswell reported that the recommendation of the Downey Community Hospital Foundation after study of the Master Plan for the proposed municipal hospital is that the additional nursing shell be included, bringing total beds from 152 to 196. Dr. Leonard Burton reported pledges are being signed to cover the cost of the additional nursing floor. Councilman Morton commended Reverend Cogswell and Dr. Burton on their efff�:)rts toward inclusi6n of the additional nursing floor. It was moved by Councilman Dunnum, seconded by Councilman Morton and passed by the following vote that the City Attorney prepare an amendment to the agreement between the City and the Downey Community Hospital Foundation to submit to Council to include the increase in approximate number of beds for the proposed new T.-nunicipal hospital, to include the additional financial responsibility for the additional nursing floor -- AYES: 5 Councilmen: Corbin, Dickerson, Dunnum, Morton, Temple NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None It was moved by Councilman Dunnum, seconded by Councilman Corbin and passed by the following vote to authorize the City Attorney and the City Manager to submit a revised architectural contract changing 150 to 196 beds and the additional cost to whatever the amount will be. The City Clerk continued with the correspondence: A letter of appreciation from the Southern California Gas Company in appreciation of Mr. Ray Lake, Director of Building and Safety, in his presentation to a group of potential remodelers was ordered filed. A letter of appreciation from the Downey City Employees Association for the additional holiday at Thanksgiving was ordered filed. A request from the Downey Recreation and Park District for sidewa"l"k matching funds was submitted as the County of Los Angeles had dedicated the necessary areas to the City. It was moved by Councilman Dunnum, seconded by Councilman Morton, that the City undertake the responsibility of matching funds for sidewalks at Imperial and Furman Parks, Councilman Morton stating the School District does have a certain percentage of their funds allocated for sidewalks, the Park District does not. Councilman Dunnum remarked that the City would be setting a precedent, however the Park District has a smaller tax base from which to work than the School District. Council Minutes - 12/13/65 -4- 2490 Councilman Morton stated he seconded the motion, realizing that previously money would have been put into county property, however the problem has been overcome by the dedication of areas adjacent to the ,parks. Letter from Mr. W. G. Kreuter requested adjustment of assessment for cleaning of his property located at 5639 E. Imperial Highway. It was moved by Councilman Corbin, seconded by Councilman Dunnum and passed by the following vote to confirm assessment of $500 to Mr. W. G. Kreuter, 12141 Roseglen Street, E1 Monte, California, for cleanup at his property located at 8639 E. Imperial Highway. It was moved by Councilman Corbin, seconded by Councilman Dickerson and so ordered that the claim be denied and referred to the insurance carrier for the City. A report from Don Robison relative to a meeting with the Bellflower Council concerning dissolution of the Downey Park and Recreation District stated it was the feeling of Bellflower councilmen that their city should independently request dis- solution of the Park District and actively publicize the benefits they would derive in terms of local control and increased facilities. Ordered filed. A letter from George Binder requesting that the City take over the parking area at the rear of buildings between LaReina and Downey Avenues was referred to the Board of Parking Place Commissioners for further study and report at the next council meeting. A letter from Mr. Roy Q. Strain requested that the City assume the cost of removal of the Edison power pole at 7802 Adwen Street. It was moved by Councilman Morton, seconded by Councilman Dickerson and passed by the following vote to assume cost of $135 for removal of Edison pole at 7802 Adwen Street where improvements had been required of the property owner under Chapter 27 proceedings (DIP #530). Porter had advised that there may be a delay in ascertaining whether the City of Downey may acquire the 14 acres of excess right of way from the San Gabriel Freeway at its intersection with Florence Avenue and that the City shall follow up and keep abreast of this matter. A report from Albert C. Martin and Associates was ordered received and filed. Bill Coaches, 7522 E. Phlox, Chairman of the Community Attitude Committee of the Downey Jaycees, distributed questionnaires and stated those returned would be run through a computer and the results made public the end of January. He re- quested that the Councilmen each fill out one and return to the Committee. Council Minutes - 12/13/65 -5- 2491 ORDINANCE N0. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING SECTION 5101 OF THE DOWNEY MUNICIPAL CODE, WHICH SAID SECTION RELATES TO GARBAGE AND REFUSE COLLECTION ZONES The ordinance was read by title only. The City Attorney added an amendment to become Section 2: "This ordinance shall become operative upon March 1, 1966." The City Attorney remarked this was an appeal by those who were opposed to the granting of the zone exception; therefore, he would think a motion of the nature as stated above would in effect deny the appeal and would affirm the action of the Planning Commission. Councilman Morton remarked that he had not seconded the original motion about a delay as he was under the impression that the delay the last time was to obtain a commitment as to when the streets would be improved, including curbs, gutters, and it appears that the Public Works Department has come forward with the City Council's ,request when it was reported by Mr. Spindel that all dedication has been obtained and improvements are scheduled to begin in April, 1966. Councilman Dickerson stated his intent was not to deny the building of the apartments but to delay them until the streets are a, reality and that this is the wish of the people in that area. Mr. Griselle reviewed for Council that there were 15 conditions imposed on the zone exception, none of which were predicated upon street improvements other than at the property involved in the zone exception case. The improvements are scheduled Council Minutes - 12/13/65 -11 249 to begin in April, according to the Director of Public Works, which would mean that all the street improv®ments would be in prior to the time any of the units would be ready for occupancy. Mr. Spindel reported that if the improvements begin in April, they would be completed by the end of June according to the schedule of the.Public Works Department. It was suggested that there might be a condition #16 denying the appeal and approving the Zone Exception #592 as granted on the condition .-that it will not be effective until such time as all of the improvements are in along Tweedy Lane from Florence Avenue to Suva Street with curbs, gutters and paving installed to the standards of the Department of Public Works, or until September 1, 1966, whichever occurs first.
