AF THE CITY OF DOWNEY
NOVEMBER 8, 1965
The City Council of the City of Downey held a regular meeting at 7:30 P,M.,
November 8 1965, in the Council Chamber of the Downey City Hall, Mayor Scott Temple
presiding.

Reverend John Chase of the First Christian Church delivered the invocation.
Mayor Temple introduced Harry Polgar, reporter from the Herald American,
attending his first Council Meeting.
A presentation was then made by Mayor Temple to Mr. Charles Wheeler who had
served on the Personnel Advisory Board from December 1956 to April, 1958 and
from 1958 to September 1965 on the Planning Commission. Mayor Temple offered con -
gratulations to Mr. Wheeler for the fine job performed by him in these two capacities.
Council expressed their thanks and appreciation for the very outstanding job for
the cammunity, his personal dedication to the community.
The City Manager stated it was as a result of Mr. Wheeler's assistance in set-
ting up the recruitment program and establishment of the policies that the City, now
has one of the finest personnel departments in the State of California, and he
thanked Mr. Wheeler for the employees of the City.
Planning Director Sherman Griselle expressed his feeling that if all the
Planning Commissions had a member such as Charles Wheeler, they could rest assured
of the future of all the cities.
The City Attorney stated he was quite impressed with Mr. Wheeler's ability to,
express conditions which should be placed on certain matters and to pick put the
necessary restrictions that should be placed upon the various actions. He added
that Charles Wheeler did an excellent job and should be commended.-
Chief Ivan A. Robinson of the Police Department, assisted by Mayor Temple,
made presentations of certificates of outstanding citizenship from the Department
to Mrs. Freda Hendrickson, who volunteered her services to Officer R. Brockman at
an automobile accident scene, giving valuable first aid. Mrs. Hendrickson accepted
the commendation on behalf of all nurses in Downey who are committed to community
service.
Certificates were then presented to John Harper and Gary K$derman who had
assisted Officers Nunnally and Doyle in apprehending a suspect when he attempted
to flee.
Mayor Temple announced the time and place for the public hearing on Zone
Exception Case #606, Shubin of 10253 Hopeland Avenue, and inquired of the City'
Clerk if she had the affidavit of publication and mailing. The City Clerk replied
she had the affidavits.

Mr. Sherman Griselle, Director of Planning, presented a resume of the case.
Speaking first in favor of the appeal to Zone Exception #606 was appellant,
Nick Shubin. Exhibits A and B were handed to Council, drawings of the proposed
plan for constructing a wall on his property.
It was moved by Councilman Dunnum, seconded by Councilman Corbin and so
--� ordered that the Exhibits A and B be received and filed.
Mr. Shubin then presented 14 pictures of corner lots in the tract in which his
property is located.
It was moved by Councilman Dunnum, seconded by Councilman Dickerson and so
ordered that the pictures be received and filed.

After Mr. Shubin's rebuttal, it was moved by Councilman Morton, seconded by
Councilman Dunnum and so ordered that the hearing on the appeal to Zone Exception Case
#606 �e closed.
Councilman Morton stated he believed the presentation by both appellant and
those speaking for and against his appeal were one of the best presentations made
before Council.
Councilman Dunnum stated it is her feeling that this is one of those areas where
it was not intended by the developer that sidewalks be installed. Councilmen Morton,
Corbin and Dickerson also stated they do not believe sidewalks are essential in this
area.
It was moved by Councilman Corbin, seconded by Councilman Dunnum and passed by
the following vote to modify the Planning Commission's recommendation by eliminating
therefrom the requirement of sidewalks; that no other plantings be put in the right
of way; and to approve Planning Commission's decision in all other respects, referring
the matter back to the Planning Commission for report.

Mayor Temple announced the hearing on the Debt Limit Report for Assessment _Dis-
trict No. 41, Pomering Road, and asked the City Clerk if she had the Affidavit of
Mailing. The City Clerk replied she had the affidavit.
It was moved by Councilman Corbin, seconded by Councilman Dickerson and so
ordered that the Affidavit of Mailing be received and filed.
Mr. Ervin Spindel presented the factRal data of the Debt Limit Report and read
it at this time. Ordered received and filed.
The Mayor asked if there were any written prote

seconded by Councilman Dickerson and so ordered that the hearing on the Debt Limit

by the following,vote to authorize intention to appropriate $6400 from Operating
Reserves to Account No. 14426 for engineering costs and incidental expenses for
AD #41, Pomering Road.

RESOLUTION NO. 1636
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY MAKING
FINDING OF FEASIBILITY OF ACQUISITION OF NECESSARY RIGHTS OF
WAY AND THE CONSTRUCTION OF CURBS, GUTTERS, AND PAVEMENT IN
ASSESSMENT DISTRICT NO. AD -41 (POMERING ROAD AND OTHER STREETS)
The resolution was read by title only. It was moved by Councilman Corbin,
seconded by Councilman Dickerson and so ordered that further reading be waived.
Mr. Spindel reported that the petition represented 47.8 percent of protests
of the area and 46.6% of the front footage.
It was moved by Councilman Morton, seconded by Councilman Dunnum that Council
finds that the percentage of protests to AD #41, Pomering Road, is less than 50 %.
So ordered.
It was moved by Councilman Corbin, seconded by Councilman Dickerson and passed
by the following vote that Resolution No. 1636 be adopted.

Mayor Temple announced the hearing on the Resolution of Intention for AD #41,
Pomering Road, and asked the City Clerk if she had the Affidavits of Publication,
Posting and Mailing. The City Clerk replied she had the affidavits.
It was moved by Councilman Corbin, seconded by Councilman Dunnum and so ordered
that the Affidavits of Publication, Posting and Mailing be received and filed.
Mayor Temple inquired if there were any written protests. The City Clerk
replied there were none other than those indicated on the petition which was filed.
It was moved by Councilman Corbin, seconded by Councilman Dunnum and so ordered
to receive and file the petition.
The Director of Public Works presented and read the factual report for AD #41,
Pomering Road.
It was moved by Councilman Dickerson, seconded by Councilman Corbin and so
ordered that the report be received and filed.

It was moved by Councilman Morton and seconded by Councilman Dickerson that
the hearing.be closed. As another person wished to comment, Councilman Morton
rescinded his motion, Councilman Dickerson, his second to the6motion.

moved by Councilman Corbin, seconded by Councilman Dickerson and so ordered to close
the hearing on the Resolution of Intention for AD #41, Pomering Road.

RESOLUTION NO. 1637
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING
WORK TO BE DONE ON'POMERING ROAD AND OTHER STREETS IN ACCORDANCE
WITH RESOLUTION OF INTENTION NO. 1626 (AD -41)

Mayor Temple announced the hearing on Downey Improvement Project #533, 7952 Cole
Street, Chapter 27 proceedings for construction of sidewalks.
Mr. Spindel presented a report on the matter..
The Mayor asked if the City Clerk was aware of proper notification of the
hearing having been done.. The City Clerk replied the necessary mailing of notices
and posting had been handled.
Vernon Blythe, 10911 Old River School Road., owner of the property in question,
requeapd d an extension of 30 days in order to secure competitive bids for con-
struction of the sidewalks required under Chapter 27.
It was moved by Councilman Morton, seconded by Councilman Dickerson and passed
by the following vote to grant an extension of 30 days before proceeding under
Chapter 27 on DIP #533, 7952 Cole Street.

If bids are not, in at the end of 30 days, the matter is to be brought back to
Council.
Mr. Albert C. Martin, Architect., submitted for City Council approval, --recom-
mendation which was presented November 1, 1965, at the meeting of the Hospital
Foundation Committee and Medical Advisory Committee. The recommendation included:
1. Revised Master Plan Illustrating Diagrams.
._ 2. Revised Program of Area Report dated Revised November 5, 1965.
3. Revised Construction Budget for the first phase of hospital program
including the items listed under the attached Summary of Master Plan
Recommendations dated Revised November 5, 1965.
Mr. Martin stated that this plan supersedes the Master Plan material presented for
City Council approval on 10/18/65, and provides a Nursing Unit containing 44
nursing beds; the new grand total gross area for "the hospital of 95,793 square feet
which includes a basement area, expanded to provide direct access from the service
facilities housed in the basement of the nursing tower located directly above the

basement. The Revised Master Plan provides enough additional space for horizontal
expansion of the Nursing Unit and future mechanical facilities for a future Nursing
Wing which will be a separate entity. Vertidal circulation elements have been pro -
vided in a "Vertical Transportation Core" located outside of the initial Nursing
Wing. Housed in this "core" will be elements such as stairs and other means of
high speed vertical transportation., i.e., elevators, dumbwaiters or trayveyors as
stated and will connect directly with the basement areas located under the Nursing
Tower to provide direct access to the vertical circulation elements. The basement
area would house su6h departments as dietary, central supply, possibly pharmacy,
housekeeping and shops.
If it is the decision of the City Council to approve the material which has
been submitted by Mr. Martin, it was then asked that the Architectural and Engineer-
ing Agreement be amended to reflect the new Revised Master Plan Scheme Construction
Cost Estimate for the initial phase as outlined in their report, and that the time
schedule for completing the next phase of the project be increased from 60 days to
a total of 120 days.
Basic Recommendations were as.follows:
1. Basic nursing unit of 44 beds_.
2. Three nursing floors 44 beds on each floor equals 132 beds.
3. Pospartum - 20 beds. Total hospital beds - 152.
4. Total of 4 elevators. Two service and two passenger.
5. Basement area to be located tinder the nursing tower_.
6. Pneumatic tube system of approximately 15 to 20 stations.
7. Exchange cart system for dispensing of food, supplies and linens to
the nursing floors, and a centralized dietary department.
8. One vertical dumbwaiter to be located in the nursing tower with direct
access to the basement level for use as emergency back -up for the
cart system.
Mr..Martin stated final cost estimates for the first phase total $3,261,169.00.
If an additional 4th floor should be shelled in, the cost would be an additional
$529,920.00 and 1,760 square feet of additional useage space.
Councilman Morton stated that he has been led to believe that sufficient funds
might be obtained to complete a fourth floor by private subscriptions.
Rodney V. Cogswell, President, Downey Community Hospital Foundation, presented
a letter to Council relative to their approval of the Revised Master Plan and
urging consideration of the economic feasibility of shelling in, one additional floor
on the nursing tower and even possibly completing the additional floor.
The City Manager stated the revised plan has combined all transportation
,phases and it was recommended the plan submitted be approved.
Leonard Burton, 9217 Gallatin Road, complimented Council for its forward - looking
progressive attitude, and Mr. Martin in working with the Downey Community Hospital and
medical staff; and requested an additional 30 days to study and evaluate the feasi-
bility of addition of a fourth floor.
It was moved by Councilman Morton, seconded by Councilman Dunnum and passed by
the following vote to approve the basic Master Plan as presented by the Architects
for the Downey Municipal Hospital.

The City Manager recommended revisions in the Agreement as follows:
Paragraph B -1. Change 45 days to 8 months. Change the sum of $2,600,000 to
$3,269,169.00.

It was moved by Councilman Morton, seconded by Councilman Dunnum and passed
by the following vote to amend the contract with Albert G. Martin and Associates
with respect to the changes enumerated by the City Manager and authorize the Mayor
to sign.

It was moved by Councilman Morton, seconded by Councilman Dunnum and passed
by,the following vote to extend an additional 30 days for the Downey Community
Hospital Foundation to study and evaluate the addition of a fourth floor.

Councilman Corbin inquired where additional money to pay for the proposed
fourth floor additional space would be forthcoming.
Reverend Cogswell stated there would be a gross increase of $792,000 with a
net increase of $110,171.70 in assets, and that an additional $85,000 to $90,000
in revenues per year from an added fourth floor could be expected to support an
additional debt of $1.,000,000.00.
It was moved by Councilman Morton, seconded by Councilman Dunnum and so
ordered that the Mayor appoint a five -man working committee composed of at least
1 Councilman and the other members to be designated from the Hospital Foundation
and Medical group.
Mr. Albert Martin stated he really believes they have come a long way for
the time involved and that he looks forward to speed and cooperation of the next
phase
Mayor Temple declared a 10- minute recess with Council reconvening at 10.15 P.M.
with roll call, all members of Council being present.

ordered to approve minutes of the Council Meeting of October 26, 1965, as written..
The City Clerk reported on the follx)*ing correspondence:
A letter of appreciation from Attorney Royal M. Sorensen relative to ex-
pressions of sympathy and courtesy extended to the memory of his father.
Ordered received and filed.
A letter from Dale Baker of the Water Board recommending establishment of the
position of Water Foreman and authority to recruit for this position.
It was moved by Councilman Morton, seconded by Councilman Dunnum and so
ordered to take the matter under submission for further study by Council.
Councilman Morton stated that Council needs to study the entire water program
as to an infinitive and reminded that there presently exists a working foreman.
Councilman Dunnum suggested a review of the previous action taken by Council to see
if there should be any change
The Junior Chamber of Commerce Quarterly report was ordered received and filed.
The League of California Cities' letter outlining committees in need of
appointees for the coming year, 1965 -66, was ordered received and filed.
It was moved by Councilman Corbin, seconded by Councilman Dickerson and
passed by the following vote that the claim for damages from Gladys R. and
Thomas E. Crigler be denied and referred to the City's insurance carrier.

Downey Chamber of Commerce Zoning Committee Report was ordered received and
filed.
A letter from Mrs. Walter Davidson, 12242 Richeon protested the conditions
existing at property at 12246 Richeon.
Speaking for the petitioners was Clara Goldstein, 12247 S. Richeon. The
matter was referred to the City Manager for handling.

committee be formed of two members from each City Council to work together and to
authorize the Mayor to appoint two members of the City Council to this liaison
committee to meet with two members of the City Council of the City of Bellflower
and to advise the Mayor that action was taken by Downey and for them to take like
action.

Mr. Griselle presented a report on Zone Change Case #107, John Y. Young,
11518 Koopman Avenue, which had been referred back to the Planning Commission to
furnish quch conditions as would be attached to the case, should it be considered
as a Zone Exception. Mr. Griselle reported that the applicant does not want a zone
exception, therefore the Planning Commission did not list the aforementioned condi-
tions which would be applicable.

Mr. Griselle, Director of Planning, reported on Zone Exception #592 which was
taken back to the Planning Commission. It was recommended that a Condition #16 be
added "That this zone exception will take effect at such time as all properties
on Tweedy Lane between Suva and Florence have been dedicated to the City for nec-
essary right of way on Tweedy Lane.
The City Attorney recommended revision of this condition to be that the zone
exception be operative and the effective date delayed until such time as the right
of way exists on Tweedy Lane.

right of way in this area.

Irvin Phelan, Member of Civic Development Committee, stated the various
Citizens Committees have expressed a desire to get together and discuss their
lives and services on these committees since no other activity has been planned
for the City's birthday, December 17th.
Councilman Corbin rec ommended Tom Collins' appointment to the Civic Development

so ordered that the appointment be approved.
Mr. Phelan's recommendation relative to the various Citizens Committees'
get — together be accepted, to work with the Mayor and the City Manager to arrange
for this to take place on the City's birthday.

The City Attorney reported there is a suit pending for severance damages
involving the northeast corner of Fifth and Brookshire. Originally $6,850 was
�aLd PTor $4,850. The property owner now is asking for
an additional $1- ,,000..00.
Councilman Morton recommended an additional award of $350.00. Councilman Corbin
inquired if there would be other properties in the area iaho would expect -the same
-- consideration. Mr. Spindel reported ;that there is one other at the southeast
corner which is a little different in that the garage can be moved.

The City Attorney.reported a lawsuit., McGough vs. City of Downey, which comes
under the Peace Officers policy; however, the plaintiffs have sought a little more
money than actually would be covered by the policy and the attorneys want a reserva-
tion of rights. They also have made a charge of negligence which does not seem very
plausible but as the policy covers only an intentional action in this particular
instance, they want a reservation of rights_.. It was recommended that Council author -
ize the City Manager to sign this and the City's insurance carrier be instructed that
there is a negligence .filed against the City under this title because they may want
to make some arrangements covering thea$peet of it.

Councilman Corbin reported that 80 cities have joined SCAG•and that it might be
well for the City of Downey to begin to consider joining this organization.
Councilman Dickerson stated he had been approached by three merchants on Fire-
stone Boulevard relative to the parking lot being constructed at Second Street and
Downey Avenue. They have voiced their fear that it will induce employees to park
all day. Mr.-Spindel reported the parking lot will be posted for two -hour limits
as soon as it is completed.
Councilman Dickerson reported .that the Lions Club wishes to donate a bulletin
board to show vital statistics as they happen week to week or month to month to the
Downey Safety Council.. The Lions Club will build and install it and it will be made
to the specifications compatible to the City Council. It was designed by Police
Lt. Ferice Childers. Chief Robinson stated that this has been considered for several
years to impress the public on problems which exist and he feels it will be an
addition ra -ther than a detriment. It will be placed on the lawn in front of the Police
Department and will be double -faced so that it can be read from either side..

to approve the placing of a glass display case, bulletin board as being offered by
the Downey Lions Club.
Mayor Temple reported that he has received several complaints from residents in
the area of the Melody Room who protest the transfer of a beer license to new owners
at this location. He stated he would report -further at a later date in order that
protests could be made from those in the area, if necessary.

Mayor Scott Temple reported receipt of an invoice in the amount of $75.00 for
Committee of Mayors dues but states that he has received no notices of their meeting
dates. The City Manager was directed to check into this to determine the meeting
dates for Mayor Temple.

Mr. Wendell Wiser, 11215 Woodruff Avenue,.reiterated his request to clear
parkways for pedestrian traffic,. Also., he stated he feels an emergency measure
should be introduced by Council for increasing parking requirements for multiple
