OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
OCTOBER 20, 1965
The City Council of the City of Downey held a regular adjourned meeting in
the Council Chamber of the Downey City Hall at 8:00 A.M., October 20, 1965, Mayor
Scott Temple presiding. The meeting of October 18, 1965, was adjourned by minute
action and the City Clerk reported that a copy of the notice of adjournment was
posted as required by law and further reported that notice of the adjournment was
given as provided by law for notice of adjourned meetings, with proper affidavit
covering the foregoing being in the file in the City Clerk's office.

Councilman Thomas H. Morton delivered the invocation.
The acting City Attorney, Carl Newton, advised that at the hearing on the appeal
to Zone Exception Case #592 which was considered at the last adjourned meeting
Monday evening, October 18, Council had taken action which, as he recalled, was to
take the matter under submission until the widening of Tweedy Lane. After reviewing
the code section relative to the action which Council may take when a matter is
brought under appeal following action of the Planning Commission, he stated there
are three things which Council could do;' 1. Order that the appeal be denied; 2. Order
that the appeal be approved; or 3. Modify the decision of the Planning Commission.
The attorney stated he does not believe taking the matter under submission is proper in
this instance. Also, one of the three aforementioned actions must be taken within 40
days of the hearing. In this case, the hearing had been held on 3eptetber 13,, 1.965'
therefore, there should be Council action in one of these three manners at this time -,
He suggested that the matter be brought up again for action and one of these three
actions taken.
Mayor Temple inquired of the attorney if he deemed it advisable to rescind the
Ceou,ncil.'s previous action and it was recommended that the matter be withdrawn from
submission and brought for action at this time
It was moved by Councilman Temple, seconded by Councilman Dickerson and so ordered
that Zone Exception #592 be withdrawn from submission.
The attorney remarked that one of the prhblems concerning Council was the
widening of Tweedy Lane and if Council desires further information in this situation
as modification of the conditions of this zone exception case, it could be referred
to the Planning Commission for further information on the question as to when Tweedy
Lane is likely to be widened. The Planning Commission is required to refer the matter
back to the City Council with a report, modifying or submitting whatever information
r- it may have.
After further discussion as to what action be taken on Zone Exception #592
('Axton- Bo.and, Tweedy Lane) it was moved by Councilman Dickerson, seconded by Councilman
Morton and passed by the following vote to refer the matter back to the Planning Core -
mission for further study and report in conjunction with the Public Works Department
in establishing the uniform width and extent of improvements from Gallatin Road to
Florence Avenue with a report to City Council at the earliest possible time.

It was recommended by Councilman Morton that a joint study meeting be set up
between the members of the Planning Commission and the City Council, City Manager,
with the City Attorney acting as chairman for a session in a review of the code as
to some of the problems the Commission is confronted with, as well as problems
the Council is faced with. The City Manager was directed to set up this joint
meeting.
Councilman Morton advised he was in receipt of a letter from Mr. Maurice
McAllister to restudy the General .Plan for Lakewood Boulevard and Florence Avenue area.
It was moved by Councilman Morton, seconded by Councilman Dickerson and passed
by the following vote to direct the Planning Department to restudy specifically
the Lakewood Boulevard --Florence Avenue area as against the General Plan..

It was moved by Councilman Dunnum, seconded by Councilman Corbin and so ordered
that the Planning Department be directed to submit to Council, a map of the City which
shows all zone exceptions granted since the adoption of the General Plan.
The attorney stated there had been a point .raised with regard to the hearing on
the Reliance Drive,-In Dairy regarding zoning ordinance and the fact that the uses are
outlined under each of the zones as to uses permitted under the code- In addition,
the•Planning Commission does have discretion as to other uses which are comparative
to the enumerated uses and the attorney read from Section 9122.1 of the code.
It was moved by Councilman Corbin, seconded by Councilman Dickerson and so
ordered to approve the minutes of the Council Meetings of September 28 and October 5
as corrected, and the minutes of October 11, 1965 as written..
The City Clerk reported on the following correspondence:
A letter from Los Angeles County advising of annual adjustment in rates covering
care of City prisoners in the Los Angeles County jail. It was moved by Councilman
Morton, seconded by Councilman Dickerson and passed by the following vote to approve
the increased amounts as indicatbd in the letter dated October L, 1965, from the
Chief Administrative Officer, County of Los Angeles, and authorize the Mayor to sign
the acknowledgment on the letter.

Financial report from the Downey Civic Chorus was ordered received and filed.
A letter from Mr. William J. Kreuzer requesting immediate action to lengthen
the left turn lane northbound on Lakewood Boulevard at the intersection of Florence
and Lakewood.
It was moved by Councilman Morton, seconded by Councilman Dunnum and so ordered
to refer this matter to the Traffic Committee for study.
Councilman Morton inquired about possible synchronization of traffic signals
along Florence Avenue and was informed by Mr. Spindel that a study is being made,
advising that the project will be an expensive one. Mr. Spindel was directed to
proceed with the study relative to the cost of such a project.

A letter from Leon J. Mayer, 8557 Raviller Dr., relative to Zone Change at
Birchdale and Raviller not being complied with. It was, moved by Councilman Morton,
seconded by Councilman Dunnum and so ordered to refer the matter to the Planning
Commission for a report.
Financial report from the Downey Chamber of Commerce was ordered received and
filed.
Councilman Dunnum suggested that the Chamber of Commerce be designated to
coordinate a master calendar for City events with organizations and citizens of
Downey in order to avoid a repetition of several events occurring at the same time
within the City.
Mr. C. W. Barrett, Mangger of the Chamber of Commerce advised he is willing to
attempt such a master calendar.
It was moved by Councilman Dunnum, seconded by Councilman M,0.r,.tM.)n and passed
by the following vote to designate the Chamber of Commerce as the official agency
to establish and maintain a master calendar of events concerning citizens of the
City, that they work with the Office of the Mayor in notifying the various organiza-
tions and citizens of the Chamber's activities in this respect.

Councilman Morton advised he had received a call from an irate citizen com-
plaining that the most recent telephone directory listed his silent telephone number.
When it was pointed out that there are three such directories being published in the
City, it was suggested by A. C. Gabriel that possibly a franchise under which these
firms would operate should be considered.

The City Attorney /directed to bring a report to Council .relative to directory
businesses' having to operate under a franchise.
A letter from the City of Lakewood submitting their resolution approving the
agreement with the City of Downey for the lease and transfer of the Downey portion
of the Lakewood water system was ordered received and filed.
A letter from the Downey Unified School District relating Mrs.. Betty L,. Kilpatrick
and Mr. Lloyd L. Stromberg have been appointed by the school district as its representa-
tives to the City Traffic Safety Committee. Ordered received and filed.
Councilman Dunnum inquired about the time these safety meetings are held and was
informed they are usually at 10:00 A.M. the first Thursday of each month.
A communication from Mr. Wendell Wiser relative to his recommendations for
acquisition of Woodruff Avenue /Firestone Boulevard to Florence Avenue.
It was moved by Councilman Morton, seconded by Councilman Corbin and so ordered
that Mr. A -s'e nls communication be received and filed, and to wait at least one year
to determine if this particular intersection is in need of revision.
A letter from Rodney V. Cogswell, President of the Downey Community Hospital
Foundation Board of Trustees requesting they be allowed time to study the basic con-
,— cept of the architect for the new hospital, and communication from the architects
with regard to Council approval of their Master Plan as soon as possible in order
that they may proceed with the next phase of Schematic Plans.
It was moved by Councilman Corbin, seconded by Councilman Morton and so ordered
that the Downey Community Hospital Foundation -Board of Trustees be notified of the
arEhitects' presentation to be made at the next Council Meeting, October 26, 1965.
The City Clerk reported a letter was received from Ada C. Quill, 8316 Imperial
Highway, requesting paveout on Downey Avenue adjacent to her corner property.

the following vote that the City assume responsibility for the paveout on Downey
Avenue as requested in Mrs. Quill's letter.

Councilman Morton reported he was in receipt of -a letter from Mr. Ford A.
Dickerhoff -, 9248 Cecilia, original of which had been directed to Mr. Ray Lake,
in the matter of the property owners north of the Stonewood Shopping Center pro-
viding additional foundation ties to stabilize the wall on their property. It was
recommended that the Building Department, Department of Public Works, and Planning
Department investigate and coordinate a report to be submitted to Council as soon as
possible.
Mayor Temple reported on receipt of a letter from Mr. Jack Stewart which he
stated would be referred to the City Manager for investigation and report to Council.
Councilman Corbin reported receipt of three letters relating to proclaiming a
United States Day in lieu of United Nations Day. Mayor Temple advised he had pro-
claimed October 23 as USA Day.

RESOLUTION NO. 1633
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ADOPTING AND SUBMITTING A BUDGET FOR EXPENDITURE OF FUNDS
ALLOCATED FROM THE STATE HIGHWAY FUNDS TO CITIES
The resolution was read by title only. Councilman Morton urged expediting the
installation of a traffic signal at the intersection of Cherokee Drive and Lakewo =,d
Boulevard. Mr. Spindel reported the Division of Public Works has been working on
this project and hopes to obtain State approval which is necessary for this installa-
tion.
Councilman Corbin inquired about the widening of Cherokee Drive at Downey Avenue
and was informed this project will be handled under Chapter #27 proceedings and will
appear on the agenda for the next Council Meeting.

by the following vote to authorize renewal of extra liability insurance in excess
of $200,000 for $350 for water tower for 14 months, putting it on a calendar year
basis.

obstructions and installation of sidewalks on main arterials to schools, and

A further study and awaiting approval of the Park Commission was recommended
on a reciprocal a- greement.between the Downey Unified School District and the City
of Downey in joint recreation and park programs, civil defense facilities and other
areas of joint efforts beneficial to the citizens of Downey.
The Director of Public Works was asked to study the costs for construction
of a masonry building and proper location for a permanent building at Golden Park,
submitting to Council, and the temporary rental of $50.00 a month was approved
on the small building now being used until such time as other arrangements are made.

listed on the report from the Director of Public Works, amounting to $395,538.00..

Councilman Morton commended the Chief of Police for making such a good effort
toward keeping overtime hours to a minimum in his department.
After discussion, it was moved by Councilman Morton, seconded by Councilman
Dickerson and so ordered to authorize the police chief to make a study and report
to the City Council on the possibility of using two police science youth as library
monitors in limited authority and, if possible, the wearing of some type of police

Councilman Morton reported he had been subpoenaed to appear in the case
involving hospital site property still in litigation and it had been reported that
the City was successful in the case. He stated further that the opposition had
implied that the City is taking property from private persons for private use and
that he wished it brought out that the hospital is a municipal hospital venture;
the citizens voted it was to be a municipal hospital and the City Council has shown

maturity of initiative and discretion every step of the undertaking; the City
Council has maintained a full control of acquisition, plans and financing, the
establishing of the lease with the Foundation with certain authorities being
retained by the City - -it is clearly set out that the hospital is a municipal
hospital and the City Council fully intends to maintain control of the host ital
for the City.
Mr. Robert Mayer, Mayer Construction Company, asked for clarification on
the action taken on Zone Exception #604 (Mayer development) at the meeting held
on October l$. He was informed that the appeal was dedi<ad and a 20' easement
reserved, and that so long as the square footage of each lot totals 10,000, no
zone exception will be necessary.
