Temple presiding. PRESENT: Councilmen: Corbin, Dickerson, Dunnum, Morton, Temple ALSO PRESENT: Oren L. King City Manager Royal M. Sorensen, City Attorney A. C. Gabriel, Director of Finance Ervin Spindel, Director of Public Works Sherman Griselle, Director of Planning Lee Leavitt, City Engineer Don Robison, Assistant to the City Manager Robert W. Gain, Fire Chief Ivan A. Robinson, Police Chief Della Doyle, City Clerk Bill Fritsche, Assistant Director of Bldg. & Safety Alberta Pfeiffer, Deputy City Clerk Reverend Gregg Churchill of the St. Mark's Episcopal Church delivered the invocation. Mayor Temple announced the time and place set for the hearing on the appeal of the revocation of permit for the Melody Room and asked the City Clerk if necessary notices had been sent. The City Clerk replied they had. Mayor Temple asked if a representative of appellant was present. Upon it being reported that the representative had not yet arrived, the hearing was held over until later in the meeting. It was moved by Councilman Corbin, seconded by Councilman Morton and so ordered that the minutes of the meeting of September 13, 1965, be approved as written. The City Clerk reported on the following correspondence: A letter of appreciation from the First Christian Church relative to the Council's courtesies with relative to their Youth Parade and Rally. Ordered received and filed. A letter from the National Safety Council announcing their conference in Sacramento November 18 and 19 and inviting Police Chief Robinson and the traffic engineer to attend the conference. It was moved by Councilman Dickerson, seconded by Councilman Dunnum and so ordered to authorize representation through the Chief of Police for attendance to this conference. A letter from Mrs. Ivan D. Fewkes requesting matching funds for sidewalks at 8738 Tweedy Lane although the improvements had been a requirement of a lot split, unknown to her at the time she purchased the property. It was moved by Councilman Dunnum, seconded by Councilman Dickerson and motion was defeated by the following vote, that matching funds be authorized for sidewalks at 8738 Tweedy Lane. r-. Received and filed. Letters from Milton M. Stern and Miss Gypsy R. Johnson relative to appointment on the Planning Commission. Received and filed. Council Minutes — 9/28/65 -1- 2117 A letter of appeal from Mrs. Beatrice B. Axton to Zone Exception #601, for establishment of a Milk Drive -In Depot. It was moved by Councilman Corbin, seconded by Councilman Dickerson and so ordered to set hearing for 7:30 P.M., October 18, 1965, in the Council Chamber of the Downey City Hall. A letter from Ann Ruth Grant representing Joe Diliberto in Zone Exception Case #597 requesdng the date for hearing be moved up to another date due to her absence from the City on the date which was set. The City Attorney advised the hearing can be continued on October 11. A letter from the West Coast Leasing Company relative to having a representative appear at the Council Meeting to discuss the proposed establishment of an airport bus limousine service which would service the City of Downey in addition to adjacent areas. Mr. Fred Sommerfeld, 14737 Bellflower Boulevard, the representative from the West Coast Leasing Company of 3238 E. Gage Avenue, pointed out two obstacles which need to be overcome in order that they can establish a paying limousine service for the local and adjoining areas, and requested any recommendation or support which the City Council can give. It was moved by Councilman Morton, seconded by Councilman Dunnum and passed by the following vote to authorize the City Manager to draft a letter of recommendation of such airport bus limousine service, and supporting the application of the West Coast Leasing Company; and in addition, that a representative of the City of Downey attend the Public Utilities Commission hearing set for October 18, 1965, at 10:00 A.M. It was moved by Councilman Corbin, seconded by Councilman Dickerson and so ordered that the claim be denied and referred to the City's insurance carrier. A claim for damages from Randal E. Peterson on behalf of Elwood C. Peterson. It was moved by Councilman Corbin, seconded by Councilman Dickerson and so ordered that the claim be denied and referred to the City's insurance carrier. A letter of appeal from Robert L. Mayer in appeal to Zone Exception #604. Councilman Corbin left the room. It was moved by Councilman Morton, seconded by Councilman Dunnum and so ordered that a hearing be set for 7:30 P.M., on October 18, 1965, in the Council Chamber of the Downey City Hall. A letter of appeal from John Y. and Wanda F. Young for Zone Change #107. It was moved by Councilman Morton, seconded by Councilman Dickerson and so ordered to set a hearing for 8:00 A.M., October 26, 1965, in the Council Chamber of the Downey City Hall. A letter of appeal from William Camil on behalf of Louis Sackler to Zone Exception #605. It was moved by Councilman Corbin, seconded by Councilman Morton and so ordered to set a hearing for 7:30 P.M., October 18, 1965, in the Council Chamber of the Downey City Hall. A letter from Mrs. Oscar J. Dunphy relative to removal of trees and drainage problem in the vicinity of 9328 S. Brock Avenue. Mr. Spindel reported this *natter is to be considered along with an item appearing later on the agend's. A letter from the Downtown Downey Business Association requesting time to appear before Council to present requests for Christmas lighting; approval of area selected for carnival location during Founder Days Celebration and street dance. After discussion of the proposed location for the carnival during Fonnder Days Celebration, it was moved by Councilman Morton, seconded by Councilman Dunnum and passed by the following vote tg authorize setting aside Nance Street from Downey Avenue through to LaRaina, October through the 17th with adequate insurance liability naming the City of Downey also as an assured. AYES: 5 Councilmen: Corbin, Dickerson, Dunnum, Morton, Temple NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Mayor Temple announced appellants are now ready to hold the hearing relative to the Melody Room. Witnesses for the City were sworn in by the Mayor. Those testi- fying on behalf of the City were: George D. Snyder, police officer Sgt. Alfred Soule Officer Roland H. Benson The City Attorney remakred that the representatives of the Police Department would first place before Council the evidence relative to the reasons leading to the revoca- tion of the permit; that it be stipulated that the permit was issued to the Melody Room located at 12161 -65 Paramount Boulevard on May 14, 1965. A copy of Notice of Revocation was received and filed for the record. It was verified that the attorney for appellant had received a copy of the revocation dated August 26, 1965. The City Attorney remakred that there had been handed to each of the City Councilmen a copy of the Police "Rules and Regulations Governing Cafe Entertainment in Addition to City Ordinances." Police Chief Ivan A. Robinson verified that it was a true copy of the police rules and regulations governing cafe entertainment. The City Attorney stated it was a green sheet with "Downey Police Department, I. A. Robin- son, Chief of Police" printed at the bottoT. It was stipulated a copy of the permit and a copy of the Police Department Rules and Regulations could be placed in evidence as City's exhibits #1 and 2, respectively. Cross examinations were by Attorney Dinccard A. Donnelly of Marcum & Salmon, representing plaintiff, the Melody Room. Witness Harold Marco was sworn in by the Mayor. Harold Marco of Whittier then offered his testimony, after which time he was cross - examined by City Attorney Royal M. Sorensen. This was followed by the summing up of the evidence by the City Attorney and Attorney Donnelly's rebuttal. It was moved by Councilman Corbin, seconded by Councilman Dickerson and so ordered that the hearing on the appeal to the revocation of permit by the Melody Room be closed. After disucssion and weighing of the evidence, it was moved by Councilman Morton, seconded by Councilman Corbin and passed by the following vote that the appeal be denied and the action of Chief of Police be upheld in this regard. There was some question as to the matter of exception to the 400' of no parking on the north side of Florence to assist a cleaning establishment to carry on a curbside business during peak hours. It was moved by Councilman Morton, seconded by Councilman Dickerson and so ordered that the resolution be tabled until the next council meeting in order to allow Councilman Dickerson to discuss the various questions arising:relative to parking restrictions in this area.
