OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
AUGUST 24, 1965
The City Council of the City of Downey held a regular meeting in the Council
Chamber of the Downey City Hall at 8:00 A.M., August 24, 1965, Mayor Scott E. Temple
presiding.

Councilman Thomas H. Morton delivered the invocation in the absence,of a
minister.
Mayor Temple announced the matter of Lot Split 4#90 which was appealed by
Mr. Ray P. Biby, held from the last Council Meeting, will be-considered at this
time.
Speaking on behalf of Mr. Biby was Abner M. Fritz, Attorney, 518 W. Phila-
delphia Street, Whittier, California.
Speaking against the appeal were: Mr. Woodrow Christensen

After much discussion, it was moved by Councilman Morton, seconded by
Councilman Corbin and passed by the following vote to uphold the action of the
Planning Commission denying the Lot Split #90 as set out in the minutes of
the Planning Commission dated July 21, 1965.

It was moved by Councilman Morton, seconded by Councilman Corbin and
passed by the following vote to grant the Lot Split #90, Ray P. Biby, in
accordance with all the conditions as set forth by the Subdivision Committee
as listed below:
1. This approval is based upon an approved revised plot plan. Deviations
or exceptions from said approved plot plan shall not be permitted without the
approval of the City Planning Commission.
2. That a zone exception reducing the lot sizes to less than 7,500 square
feet shall first be approved before this lot split becomes valid.
3. That a description of each lot shall be ,recorded with the Los Angeles
County Recorder and a copy filed with the Planning Department.

4. That building setback lines adjacent to Street "A" may be modified
to ten feet (101).
5. Public Street Improvement:
a. Construction of concrete curb and two foot gutter on south side
and concrete header on north side of proposed Dacosta Street,
with 35' right -of -way and 30' paved width.
b. Construction of concrete sidewalks (minimum 5' wide) along
Brookshire Avenue.
c. Construction of cement driveway approaches wherever curbs are
depressed for driveway entrances.
d. Pavement to consist of minimum 4" thick section Class "A"
aggregate base and a minimum 2" thick section plant mix surfacing.
e. Street tress shall be planted to the standards of the City Forester.
f. That the cul -de -sac shall have a right -of -way radius of 25' and
a curb to curb radius of 22 -1/2'.
g.. That three street lights shall be installed to the standards of
the Department of Public Works.
h. That Street "A" shall be dedicated in fee to the City of Downey and
the City shall authorize use of the street for street purposes ex-
cepting the northwesterly one foot (l').
J. The standards of improvement, construction materials, and methods
of construction, shall be accomplished in conformance with the
standard plans and specifications as outlined by the City of Downey.
k. All necessary drainage structures and street grading plans shall
be approved by the Department of Public Works.
6. Sewer and Water-
a. That a public sewer and 4" water lines shall be provided in the pro-
posed street "A" with laterals running to the property line of all
lots, to the standards of the Department of Public Works.
b. The design and improvement of sewers shall be to the standards of
the Department of Public Works.
7. An engineered grading plan for all lots shall be submitted by the
developer for approval of the Department of Public Works and the Department of
Building and Safety, and all lots shall drain to a street and have not less than
a 1% grade, and where a grade differential, exceeds one foot (1') a retaining wall
shall be provided.
8. That proper compaction of fill in the swimming pool area shall be com-
pleted to the standards of the Departments of Public Works and Building and Safety.

It was moved by Councilman Corbin, seconded by Councilman Dickerson and so
ordered that the minutes of the meeting of August 9, 1965, be approved as corrected.
The City Clerk reported on the following written correspondence:
A letter from Mr. J. Daniels in apology for his liter pre$riously objecting to
the increase in sanitation rates. Ordered received and filed, with letter of com-
mendation to Mr. Daniels for his letter of apology.

July report from the Chamber of Commerce. Received and filed.
Letter from Messrs. Donald S. Riggs and Russell Barr relative to cost of
removal of power pole adjacent to their property on Tweedy Lane and Samoline Avenue.
The City Manager stated there is a problem relative to excessive cost for the Edison
Company to remove their power pole at the location in question, and that he will
check into the matter further and submit a repott at the next Council Meeting.
A letter from Burke Williams and Sorensen, relative to World Law Day, and
^ suggesting that a representative of the local Bar Association be contacted and
invited to participate in observance of this World Law Day. Ordered received and
filed.
A letter from the C.ty of South Gate relative to refuse disposal. As a member
of the Sanitation District, it was moved by Councilman Morton, seconded by Councilman
Corbin and so ordered to authorize delegate Mayor Temple to exercise his own discretion
in voting on the matter to change the use of the disposal site when the site is com-
pletely filled.
Letter from the Mayor of Guadalajara and one from Governor of Jalisco relative
to the Independence Day celebration to be held in Guadalajara September 16, and the
October Festival to be held on October lst.
It was moved by Councilman Dickerson that the Mayor be authorized to use his
own discretion as to which event he wishes to attend, but the motion died forlack pf
a second.
It was then moved by Councilman Corbin, seconded by Councilman Dickerson and
passed by the following vote to authorize City Councilmen and their wives to attend
the Independence Day celebration in Guadalajara on September 16, with reasonable
expenses allowed.

A letter from the Los Angeles Airways thanking Mr. King for his appearance
as a witness at the hearing before the House Small Business Subcommittee relative
to preservation and expansion of helicopter service. Ordered received and filed.
The City Attorney reported that Chapter 2043, the District Reorganization Act
of 1965, goes into effect under which all changes of boundaries, annexations, reor-
ganizations, dissolutions of certain districts with certain exceptions shall be
governed by the new act with the provision that any proceeding which is pending at
the effective date of the act will not be controlled by the new act. Mr. Sorensen
stated that he had talked to Attorney Gill of the Park and Recreation District and
advised that it was their opinion that if a petki on was filed,or a resolution adopted
to submit the dissolution matter to a vote of the people prior to September 17, it
would constitute a pending matter, to be governed.under the former provisions rather
than the new bill.
Mrs. Betty Kilpatrick, 8603 Meadow Road, Acting Chairman of the Board of the
Park District, inquired if the matter under the new Act might then be decided by the
Board of Supervisors and was advised this would be the case and that it would be at
the recommendation of the local Formation Commission. Mrs. Kilpatrick recommended
that all petitions possible be brought to the Park District's Board Meeting this
evening in order to give them some idea of the amount of interest being shown by the
cititene of Downey on the matter of dissolution of the Park District. The City
Manager stated he could contact the person in charge of circulation of these peti-
tions in order to grant the request of Mrs. Kilpatrick.
A letter from Von E. Corstedt regarding cleaning of alley at 7802 8th Street.
Mr. Spindel reported the Department of Public Works will check out this request.
The City Clerk reported receipt of a petition of appeal and requea =to hold a public
hearing on Zone Exception Case #592, 9931 Tweedy Lane. It was moved by Councilman
Dickerson, seconded by Councilman Morton and so ordered to set a hearing on Zone Ex-
ception Case #592 for 7:30 P.M., September 13, 1965, in the Council Chamber of the
Downey City Hall.

It was moved by Councilman Morton, seconded by Councilman Dickerson and so
ordered to grant the request of Councilman Dunnum to be excused from attending
Council Meetings the month of September due to illness.
A letter from Ron Stone, Chairman of the Downey Christmas Parade Board of
the Chamber of Commerce,. requesting $50 in support of the parade fund and stating
funds totaling $350 toward their goal of $1,250 has been pledged.
It was moved by Councilman Morton, seconded by Councilman Dickerson and
passed by the following vote to authorize mnxpendit b--- of $600 from Community
Promotion Account for the Christmas Parade and that any additional funds
obtained through the efforts of the Christmas Parade Board be reserved toward
next year's parade expense. Councilman Morton complimented Mr. Stone on his
energy, effort and initiative in obtaining funds in the manner set forth.in his
letter.

Mayor Temple reported on receipt of a letter of complaint from Mr. d'Alessandro
regarding motorcycles racing in the flood control channel. The Chief of Police
Ivan Robinson reported the department has been patroling this problem area through
the years.
A letter from Mr. George Slater, 12621 Brock Avenue, requesting greater
restriction on establishment of beer parlors throughout the City adjacent to
residential areas. He objected specifically to a request for establishing a bar
at 8030k Imperial Highway.
ORDINANCE NO. 280
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AMENDING THE DOWNEY MUNICIPAL CODE BY ADDING THERETO
SECTION 9120.9 RELATING TO ALCOHOLIC BEVERAGES
The ordinance was read in full with emergency clause to make the ordinance
effective immediately upon its adoption.
Mr. George Slater, 12621 S. Brock, stated he would like to see Council
seriously consider adopting the ordinance.
It was moved by Councilman Morton, seconded by Councilman Dickerson and
passed by the following vote to adopt the emergency clause contained in
Ordinance No. 280 as read by the City Attorney.

Councilman Morton suggested an analysis be made of license fees required
for establishment of liquor businesses and comparison with other cities.and to
•— report the results of the analysis to Council in the near future.

Councilman Morton stated it should be pointed out that the City Council
has done everything possible over the years to reduce the tax burden to the
property owners, attempting to seek revenue from other sources and he thinks
the City Council has done a fine job to continue the fine services and also
commended the Chamber of Commerce for their efforts in bringing forth increased
sales tax. He is glad to see the City, for the first time in its history,
allocating funds specifically for civic purposes.
The.Mayor asked for the vote on Resolution No. 1597.

The City Manager reported that the League of California Cities have
reported that should the State cigarette tax have been approved by Governor
Brown as proposed, the City would not have benefited through this tax source -
Councilman Corbin reiterated Mr. King's statements, adding that the City would
have received 1p only and that the State would have directed for what expenditures
this tax would be used.

Mr, Spindel reviewed plans and specifications for information of the
Council on the improvements proposed for Golden Park paving of the south side
of Golden and west side of Castana, and parking lot which are currently,being
advertised for bid. Sanitary facilities will also be improved.

ESTABLISHING NO PARKING LIMITS ON FLORENCE AVENUE FROM

holding the matter for a field trip, due to the possible inconvenience such
parking restrictions might cause to businesses at this location. So ordered.

A discussion ensued relative to contingency ecsts and who would issue or
initiate the change orders and approve or sign same. Councilman Marton agreed
that the Director of Public Works would have the authority, provided it is with
the understanding that the costs will be nominal.
The City Attorney advised that a sentence could be added: "Any approval
or request made on behalf of the City under this paragraph be made by the
Director of Public Works."
It was moved by Councilman Morton, seconded by Councilman Dickerson and
passed by the following vote to appropriate $50,000 from 186.1 Gas Tax Funds
covering estimated extension costs and authorize the following transfer of funds
in the recommendation of the Director of Public Works dated August 18, 1965:

were submitted for Council approval. The question arose relative to furnishing
information for interested persons prior to public hearings before the Planning
Commission and Mr. Griselle reported the conditions which may be imposed on matters

of the City Council, and that also the application has printed on it that this

-- The City Manager reported on a letter from the Citizens for Decent Literature
relative to a question as to the legality of an ordinance recently passed. Accord-
ing to the Police Chief and the City Attorney, there is no difference in the way it
is effective and it will 'continue to be enforced; it is as strong as any other
ordinance.
The City Attorney stated there is a problem of pre - emption by the State. There
is a different procedure than the normal. procedure which can be followed- -the public
nuisance abatement procedures are available and if the occasion arises, they will
then be put into effect.
Councilman Morton stated an ordinance may be legal even though it is not
enf orceable,,,this would not change its legality.
Councilman Morton remarked that the records of the Council actions is very
clear that things are done on the basis of fact and judgment and the City Council
itself has been behind the indecent literatire problem from its very inception with
members supporting forums for discussion on this matter. Downey has been one of
the leaders and has received compliments from other communities. There is no
implication that cooperation is not being gained from merchants, for the program
followed in the past requesting merchants to ban indecent literature from their
shelves is to be followed in the future. The ordinance is to be used when cases
cannot be handled otherwise.
Councilman Dickerson stated all other cities are looking to the City of Downey
for leadership in the matter of indecent literature.
Mayor Temple asked Council to make its determination relative to appointment
to fill the vacancy on the Park Board.
