OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
JULY 20TH, 1965
The City Council of the City of Downey held a regular adjourned meeting _
in the Council Chamber of the Downey City Hall at 8:00 A.M „ July 20, 1965,
Mayor Scott E. Temple presiding. The meeting of July 12, 1965, which was a
regular meeting, was adjourned to this time and date by Council . The City
Clerk reported that a copy of the notice of adjournment was posted as required
by law and that there is on file proper affidavits covering the foregoing.

Mr. King submitted a report on the results of surveys made of various cities
who had adopted a cigarette tax and none of them has shown a loss in sales tax
due to passing a cigarette tax and a letter from the City Attorney was read which
stated that he was of the opinion an emergency ordinance extending the effective
date of the tax would not be valid,
It was moved by Councilman Dickerson, seconded by Councilman Morton and
passed by the following vote to ratify the previous action of Council relative to
adopting a cigarette tax.

The City Clerk reported on the following correspondence:
A letter from the Civil Aeronautics Board notifying of the hearing set relative
to the heliport. It was recommended that the City Manager represent the City at
this hearing, and that the Mayor and City Council attend, if possible.
It was moved by Councilman Morton, seconded by Councilman Dickerson a"7d passed
by the following vote to approve attendance of the Mayor and City Council to the
Civil Aeronautics hearing on July 26 and authoriaethe City Manager to act as rep-
resentative of the City of Downey.

A letter from the California Association of Life Underwriters relative to
Downey Municipal Code Chapter 4 which presently requires that a licensed life
insurance agent apply for and be granted a police permit before engaging in
residential solicitation. The matter was referred to the City Manager for
review and report to the City Council,
A letter from the Downtown Downey Business Association recommending a
"Founders Day Celebration with a Street Dance, a Carnival and a Parade using
the oldest Downey Resident as Grand Marshall" (sic) for the Parade." (October

ordered to approve plans for a Founders Day Celebration subject to approval of
parade route and street dancing by the Police Chief.
ORDINANCE NO. 275

REPEALING SECTION 4300 OF THE DOWNEY MUNICIPAL CODE AND
ADDING SECTION 4131 TO THE DOWNEY MUNICIPAL CODE WHICH
SAID SECTIONS RELATE TO FORTUNE TELLING

TION OF THE CALIFORNIA STATE EMPLOYEES' RETIREMENT SYSTEM

ORDINANCE NO. 279
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AMENDING THE DOWNEY MUNICIPAL CODE BY ADDING THERETO
SECTION 8328.1 RELATING TO BUILDING CODE REGULATIONS
The ordinance was read in full by the City Manager, and had been approved
by the Citizens Advisory Control Board according to Mr. King.
It was moved by Councilman Morton, seconded by Councilman Dickerson and
passed by the following =note that the emergency clause contained in Ordinance
No. 279 be adopted as follows:
"SECTION 2. This ordinance is an emergency ordinance and
shall take effect immediately upon its adoption. The facts
constituting the emergency are:
'The City Council finds that there are proposed to be con-
structed and developed within the City apartments or
multiple - dwelling units containing a large number of
individual apartments with minimum square footages of
less than those provided herein.
"The Council finds further that the construction, develop-
ment and maintenance (.f apartment units of such minimum
size will overburden the Nand and create a density of the
populatio^ which will endanger the public peace, safety
and general. welfare and will tend toward creating slum
areas."

It was requested that Council authorize convention expenses for member of
City Council, City Manager and the president of the Sister City Committee to
attend the Mexican North American Sister City Affiliation Convention in Santa
Monica, August 6 - 9, 1965. Council stated it would be establishing a precedent
which they did not deem advisable.
It was moved by Councilman Dickerson, seconded by Councilman Morton and
passed by the following vote to appropriate funds in the amount of $250 for
sister city purposes to be used as the committee sees fit.

below in the total amount of $49,800 as part of the General Fund Project
during the coming fiscal year:

It was moved by Councilman Dickerson, seconded by Councilman Morton and
passed by the following vote to approve Section 186.1 State Gas Tax Funds for
1965 -66 for projects listed below as recommended by the Public Works Division
in order for the Engineering Department to proceed with engineering studies
on these programs. Total cost on these six projects amounts to $175,000.

Mr. King reviewed the Capital Outlay program of the Water Division as
approved by the Water Board.
It was moved by Councilman Morton, seconded by Councilman Dickerson and
passed by the following vote to approve the Capital Improvements Projects as
recommended by the Water Division and approved by the Water Board, projects
totaling $105,300.00 for 1965 -66 budget and listed below:
24" transmission line, Woodruff Avenue from south of the S.P.R.R.
to Firestone Blvd., including pressure relief valve $37,000.00
20" transmission line in Third Street from Downey Avenue to
Brookshire Ave., and in Brookshire Ave. from 3rd St. to
the north property line of Downey High School 35,000.00

It was moved by Councilman Morton, seconded by Councilman Dickerson and
passed by the following vote to hold for further study and report, the matter of
negotiations for assignment of some of the pumping rights of B.F.S. Mutual Water
Company of La Mirada to the City of Downey.

The City Manager reported that completion of the trial on condemnation of
hospital site property is nearing finalization except for Mr. Trenery's property
and that settlement may be between the attorneys or by judgment rendered by the
court. Settlement will necessitate loaning the Hospital Fund additional monies
which will be paid back to the City upon sale of the bonds. The loan being con-
sidered from the Civic Development account would be predicated upon receiving
within the current year, the $180,000.00 from the cigarette tax.

It was moved by Councilman Morton, seconded by Councilman Dickerson
and passed by the following vote that Councilman Dunnum be excused from
attendance at Council Meetings in compliance with Section 503 of the City
Charter, due to illness.

Mayor Temple reported that the Downey Unified School District has agreed
to sell Site 8 (Golden Park) to the City and lease Parcel B with the option to
purchase.
It was moved by Councilman Morton, seconded by Councilman Corbin and passed
by the following vote to ratify action by the Mayor with regard to splitting
cost of escrow and insurance fees, authorize the Mayor and City Manager to execute
documents for the purchase of Site 8 property.

It was stated that the City could assume immediate possession of the
property at the time of entering into escrow proceedings.
Council requested a report on estimated figures for setting up a City Park
and Recreation Department. Figures were given by the City Manager for labor,
equipment and new sprinkler system. City Manager Oren King's report included
two laborers, side cutters for lawn mower and one truck. It was also suggested
by Council that a park consultant be employed at the rate of approximately
$7,500.00 for the balance of the year.
It was moved by Councilman Morton, seconded by Councilman Dickerson and
passed by the following vote to appropriate $25,000.00 to be used for maintenance
and development of a park at Site 8 by the following transfer of funds; authorize
the City Manager to statt interviewing for a Park and Recreation Consultant on a
contract basis with the City, contract to be prepared by the City Attorney with
scope of duties to be submitted to City Council for consideration; the City
Manager to bring an estimate of costs with regard to setting aside a parking
area with black top; the Park Consultant to formulate a master plan for Site 8
and area in the Downey Triangle, if and when acquired from San Gabriel Freeway
area; that the City Attorney be instructed to prepare an ordinance setting up a
Park and Recreation Board, setting forth that it shall consist of five members,
one each to be appointed by each councilman; authorize the necessary supervision
at the park site at the present time; and authorize two laborers, side cutters for
lawn mower and one truck:

Councilman Morton suggested that a name selection program be initiated for
Site 8 park; Councilman Corbin recommended holding for further study until the.
next Council Meeting.
Mayor Temple read a letter from the President of the Independent Cities urg-
ing serious support from all independent cities at their August 18 meeting; and
also at.their seminar to be held in Palm Springs September 17, 18 and 19.
It was moved by Councilman Corbin, seconded by Councilman Morton and passed
by the following vote to authorize the Council, City Manager and Department Heads
to attend the Independent Cities Seminar to be held in Palm Springs September 17,
18 and 19.

The Mayor asked what Council wished with regard to a letter received from
Patrick Kearns of the Downey Park and Recreation District.
It was moved by Councilman Morton, seconded by Councilman Corbin and so
ordered that the letter be received and filed.
There being no further business to come before Council, the meeting was
adjourned at 9:15 A.M.
Mayor Temple reopened the meeting for special presentation in connection
with a visit from Assemblyman Carley Porter to the immediate past Mayor stating
an official resolution, #452, had been passed by the Assembly during the 1965
session which was adopted unanimously on May 13, 1965. The resolution was read
in full by the Mayor, who congratulated Councilman Morton upon being the first
to receive such a commendation.
Councilman Morton stated it was one of the biggest surprises he has ever
received and that he appreciates it even more, not from a personal standpoint,
but for the City Council as a whole, for he just happened to be Mayor at that
particular time, and his commendation is of the entire City Council. He stated
he appreciates the Assembly's taking this action in his behalf.
