Temple ,presiding. PRESENT: Councilmen: Corbin, Dickerson, Morton, Temple ABSENT: Councilmen: Dunnum ALSO PRESENT: Oren L. King, City Manager A. C. Gabriel, Director of Finance Ervin Spindel, Director of Public Works Sherman Griselle, Director of Planning Lee Leavitt, City Engineer Royal M. Sorensen, City Attorney Don Warren, Assistant Fire Chief Ivan A. Robinson, Chief of Police Ray Lake, Director of Building and Safety Don Robison, Assistant to the City Manager Della Doyle, City Clerk Alberta Pfeiffer, Deputy City Clerk Reverend Claude Young of the Methodist Church delivered the invocation. Mayor Temple announced that John H. Whatley of the Float Committee of the Tournament of Roses was present to make a.presentation to the City. Mr. Whatley introduced Mr. J. Randolph Richards, President of the Rose Float Committee of the Tournament of Roses who stated he was very grateful for the participation in the Rose Float Parade by the City of Downey and other cities, and reported on plans for next year's Tournament of Roses. Mr. Richards then presented the Mayor with Downey's trophy for First Place Award in its .class. Mayor Temple reported Councilwoman'Dunnum - as still being ill but that she hopes, to attend the next meeting. Mayor Temple announced the time for the hearing on the vacation of a portion of Seventh Street and inquired if the hearing had been duly advertised and proper notices posted. The City Clerk replied there had been proper notification. The Mayor inquired if there were any written protests or comments. The City Clerk replied there were none. Mr. Ervin Spindel, Director of Public Works, reported on the proposed vacation. There were no oral comments or protests, therefore it was moved by Councilman Morton, seconded by Councilman Corbin and so ordered that the hearing on the Resolution of Intention to vacate a portion of Seventh Street be closed. RESOLUTION NO. 1582 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF D.OWNEY ORDERING VACATION OF A PORTION OF 'SEVENTH STREET LYING WESTERLY OF LAKEWOOD BOULEVARD The resolution was ,read by title only. It was moved by Councilman Corbin, seconded by Councilman Morton and so ordered that further reading be waived. AYES: 4 Councilmen: Corbin, Dickerson, Morton, Temple NOES: 0 Councilmen: None ABSENT: 1 Councilman: Dunnum Mayor Temple announced the hearing on Downey Improvement Project #528, Bellflower Boulevard between Priscilla Avenue and Ratliffe Street and inquired if proper notification was made of the property owners. The City Clerk reported the proper notices had been posted and mailed. The Mayor inquired if there were any written protests or comments. Mr. Spindel reported on the improvements to be carried out under Chapter 27 of the Streets and Highways Code of the State of California for curbs, gutters and paving. There being no oral comments or protests, it was moved by Councilman Morton, seconded by Councilman Dickerson and so ordered that the hearing on DIP #528 be closed. It was moved by Councilman Corbin, seconded by Councilman Dickerson and passed by the following vote to authorize the Department of Public Works to proceed under Chapter #27 Improvements Act of 1911 of the Streets and Highways Code of the State of California on the east side of Bellflower Boulevard between Priscilla and Ratliffe and that if the property owners do not complete the improvements, it be included in the City's contract to widen and improve Bellflower Boulevard between Imperial Highway and Foster Road. AYES: 4 Councilmen: Corbin, Dickerson, Morton, Temple NOES: 0 Councilmen: None ABSENT: 1 Councilman: Dunnum Mayor Temple reported on the hearing on Downey Improvement Project #529, Sites I and 2 (8055 and 8061 Florence Avenue) for sidewalk installation. The City Clerk reported proper posting and mailing was made. There were no written protests or commun%ations. Mr. Spindel reported on the improvements proposed under DIP #529 on Florence Avenue. Mrs. Mildred Fox of Santa Paula, owner of the property at 8061 Florence Avenue, protested the cost and asked for the reason for requirement of the improve- ments. Proceedings under Chapter 27 of the Streets and Highways Code Act of 1911 were fully explained to Mrs, Fox by Director of Public Works Ervin Spindel. Mrs. Fox was unable to recall a question she had of Council on the matter It was moved by Councilman Morton, seconded by Councilman Corbin and so ordered that the hearing be closed on DIP #529, granting permission to Mrs. Fox to make her inquiry later in the meeting, should she call it to mind. It was moved by Councilman Morton, seconded by Councilman Corbin and so ordered that the minutes of the meeting of June 22, 1965, be approved as distributed. The City Clerk reported on the following correspondence: 1. Letter from the Downey Community Fair in appreciation of the city's coop- eration in this endeavor. Ordered received and filed. 2. Communication from the League of California Cities relative to Youth Opportunity Campaign. Ordered received and filed. Council Minutes — 7/12/65 -2- 235: 3. Letter from Avice H. Kerr relative to infestation of City -owned trees. The letter was referred to the Department of Public Works for investigation. 4. Copy of a resolution of the Downey Recreation and Park District No. 7 pertaining to dissolution of the district by election in November, 1966. Ordered received and filed. 5. Copy of a resolution of the Downey Recreation and Park District No. 7 setting the tax rate for the 1965 -66 fiscal year. It was moved by Councilman Corbin, seconded by Councilman Dickerson and so ordered that the resolution be received and filed. 6. Financial Report from Downey Museum of Art was received and filed. 7. Claim for damages from Lucille T. Hoskins. It was moved by Councilman Corbin, seconded by Councilman Dickerson, and passed by the following vote to deny the claim and refer it to the insurance carrier for the City of Downey. A letter from the League of Women Voters of Downey proposing voter regis- tration at the local fire stations, with reports from the City Clerk and Fire Chief attached. Mrs. Johnson stated that the request was made upon the recommendation of the Registrar's office and the League of California Cities. Council did not accept the recommendation for registration of voters at Fire Stations at this time. 9. Request from First Christian Church for use of City parking lot between New and- LaReina Streets for assembly of a youth rally September 10, between the hours of approximately 6:15 to 7:00 P.M. It was moved by Councilman Morton, seconded by Councilman Corbin and so ordered to approve the request with "hold harmless clause" to the City for liability purposes. 10. A letter of complaint from Donald A. Divvens relative to inadequate service by the A. V. Hohn Disposal Company was referred to the Sanitation Committee. Director of Public Works Ervin Spindel reported that he had notified the disposal company that no further violations will be tolerated and that a report would be made regarding this matter at a later date. 11. Letter from the Downey Unified School District relative to the Citys pro- posal to purchase Site 8. The City Manager reported that Golden Park (Site 8) is divided into two parcels and is so recorded in the County Recorder's Office- - Parcel A consisting of 2.45 acres with a valuation of $75,760, and Parcel B consist- ing of 5.57 acres with a valuation of $172,240.00 for a total of 8.02 acres to cost $248,000.00. The City Attorney advised that the City may purchase this property under the following procedure, which also meets State Codes relating to the sale of property by the School District according to Article II, Section 18 of the State Constitution. Parcel A - Cash - $75,860, payable at end of escrow by September 1965 Parcel B - Leasing for one year at $1.00 with option to purchase on or before September 30, 1966, at a cash price of $172,240.00 upon execution of the option. It was moved by Councilman Corbin, seconded by Councilman Dickerson and passed by the following vote to authorize approval of the agreement to purchase Parcel A -and the Mayor to sign with a.clause for leasing for $l a year, Parcel B with option to purchase at $172,240.00, and that the Mayor and Vice Mayor personally appear before the School Board to answer any questions they might have relative to this transaction. An invitation from.the Masonic Lodge to, attend the corner stone laying ceremonies on August 21 at 11:00 AM at the corner of Third Street and Downey Avenue. Received and filed. 13. A .letter from the firm of Burke, Williams & Sorensen relative to the verdict on Parcels 20 and 21 of the Hospital Site in the case of the City of Downey vs. Gonzales. The difference between the appraisal for the City and the verdict was $1300, which was felt to be quite satisfactory. It was moved_by Councilman Dickerson, seconded by Councilman Corbin and passed by the following vote to authorize preparation of two warrants for settlement of the condemnation of Parcels 20 and 21 in the Hospital Site ... Parcel 20 — $26,000; Parcel 21 — $21,500 for a total of $47,500. AYES: 4 Councilmen: Corbin, Dickerson, Morton, Temple NOES: 0 Councilmen: None ABSENT: 1 Councilman: Dunnum A letter from the Downey Chamber of Commerce relative to passage of the cigarette taxing ordinance in Downey was submitted, along with a petition from various Downey merchants., by Mr. Robert G. Sasine, requesting that the City Council stay the effect - ive date of the ordinance until the effective date of a County ordinance. Other merchants making a,request to stay the effective date of the cigarette tax ordinance were: Irvin Gurtler, All American Home Center Bill Green, President, Stonewood Merchants Assn. Bob Paulson, Manager Von's Grocery Councilman Morton inquired of the City Attorney if an emergency ordinance would be valid. The City Attorney,read from the City Charter relative to emergency ordi- nances which may be adopted by the City Council. After much discussion, it was moved by Councilman Morton, seconded by Councilman Corbin and so ordered that the recommendation of the Chamber of Commerce dated June 23, 1965, be taken under submission until the Council has a chance to reevaluate, allowing the City Attorney to study the further legal aspects and evaluate, and the matter be considered at an adjourned meeting next week. Mike Hajjar, 9447 Buell, urged full consideration of the merchants' request for stay of the effective date of the cigarette tax ordinance. Corbin, Dickdrson, Morton, Temple NOES: 0 Councilmen: None ABSENT: 1 Councilman: Dunnum ORDINANCE NO. 274 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING SECTION 9116.4 OF THE DOWNEY MUNICIPAL CODE WHICH SAID SECTION RELATES TO ZONING The City Attorney read the ordinance in full. It was moved by Councilman Morton, seconded by Councilman Dickersbn and passed by the following vote that the emergency clause be adopted which reads as folLows: "The City Council finds the Planning Commission has held a hearing and has recommended to the City Council the Amendment of Section 9116.4 of the Downey Municibal Code to provide for a minimum of 1200 square feet of lot area per dwelling unit in the R -3 zone and it is necessary that pursuant to the provision of Section 65806 of the Government Code this ordinance be adopted as a temporary interim ordi- nance as an emergency measure prohibiting the construction or erection of any buildings or structures contrary to the provisions of this ordi- nance. This ordinance is necessary to protect the public safety, health and welfare and shall become effective upon its adoption." A letter directed by the City Manager to Ervin Spindel,,congratulating him on his election as Vice Chairman of the Metropolitan Transportation Engineering Board was read by the Mayor. Mr. Wendell Wiser, 11215 W6odruff Avenue, inquired about the status of various traffic problems upon which he had requested investigation by the City Council, particularly obstructions to right of way, opening of parkways adjacent to schools and sidewalk installation at the Southern Pacific railroad tracks at Paramount Boulevard. Mr. Wiser was informed all of these matters are being considered and that reports have been submitted to Council from the Traffic Committee. Mr. Wiser advised he is in favor of the cigarette tax and feels the merchants should be given every consideration to delay putting the tax into effect in order to keep ehe good will of the merchants. Mrs. Alice Goldberg, 9147 Stamps Road, requested action on cleaning of some vacant lots across from her property. Mr. C . W. Barrett, Manager of the Downey Chamber of Commerce, requested that Council take action on the Chamber's request for $1,250 for Christmas Parade, which matter had been taken under submission previously. The City Council indicated that the $1,250 should be included in the previous allocation of $19,800 and also that the $2,500 for Christmas Lights should be included. Councilman Morton requested a study of apartment structures and parking re- quirements relative to apartment dwellings. Council recommended that the Planning Department study parking in the City with regard to apartments and referred the matter to the Development Cotrtrol Committee for report and recommendation. It was suggested by Councilman Dickerson that a review be made of the duties and objectives of all Citizens Advisory Committees. Mayor Temple made announcements of various meetings coming up for attendance by any of the Council who might be able to attend.
