Temple presiding. PRESENT: Councilmen: Corbin, Dickerson, Dunnum, Morton, Temple ALSO PRESENT: Oren L. King, City Manager Royal M. Sorensen, City Attorney Robert Gain, Fire Chief Loren Morgan, Deputy Chief of Police Ray Lake, Director of Building & Safety A. C. Gabriel, Director of Finance Bill Goggin, Assistant Director of Planning Don Robison, Assistant to the City Manager Ruth Miller, City Librarian Della Doyle, City Clerk Alberta Pfeiffer, Deputy City Clerk Lee Leavitt, City Engineer Reverend Ford Miller of the Downey Methodist Church delivered the invocation. It was moved by Councilman Morton, seconded by Councilman Corbin and so ordered that the minutes of the meeting of June 14, 1965, be approved as corrected. City Clerk Della Doyle reported on the following correspondence: A letter from Mrs. Rolf Arno Peet, 9309 Gainford, in appreciation of the beautification of the median strip along Firestone Boulevard. Received and filed. A claim for damages from Heldegard Sandoval for alleged false arrest. It was moved by Councilman Corbin, seconded by Councilman Morton and so ordered that the claim be denied and referred to the City's insurance carrier. A letter from the Coca Cola Bottling Company in appreciation of cooperation of all departments in the City of Downey assisting in the completion of their Downey Production expansion program. Ordered received and filed. A letter from the County of Los Angeles Rancho Los Amigos Hospital requesting the City of Downey to join in construction of a bridge for Horton Avenue to enable patients and vehicular crossing of Imperial Highway. It was moved by Councilman Dickerson, seconded by Councilman Morton and so ordered that an investigation be made by the City Manager with a report of his findings to Council. Mayor Temple reported that he had received a letter from the Downey Women's Club requesting that they be permitted to cooperate in the landscaping of the proposed Municipal Hospital. Received and filed. ORDINANCE NO. 270 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE DOWNEY MUNICIPAL CODE BY ADDING SECTION 9105.64 A AND AMENDING SECTION 9127.3. EACH OF SAID SECTIONS RELATE TO PARKING REQUIREMENTS The ordinance was read by title only. AYES: 5 Councilmen: Corbin, Dickerson, Morton, Dunnum, Temple NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None ORDINANCE NO. 272 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE DOWNEY MUNICIPAL CODE BY ADDING CHAPTER 1B TO ARTICLE VI CONSISTING OF SECTIONS 6140 THROUGH 6153 RELATING TO A CIGARETTE TAX The ordinance was read by title only. It was moved by Councilman Corbin, seconded by Councilman Morton and so ordered that further reading be waived. It was moved by Councilman Corbin and seconded by Councilman Dickerson that Ordinance No. 272 be adopted. Speaking against imposing this cigarette tax were the following: Robert Sasine, representing the Downey Chamber of Commerce Sal Lorenzetti Phil Ortiz, 12432 Parrot Willis Green, President, Stonewood Merchants Association Janet Shipman, 8570 Meadow Road Speaking for the ordinance relating to a cigarette tax was Mr. Wendell Wiser, 11215 Woodruff Avenue Mayor Temple stated that the Citizens Tax Committee had studied the proposed cigarette tax very carefully and that it had carried by that committee by a vote of 7 to 1. The Mayor inquired if other cities adopting a cigarette tax had noticed any decrease in their sales tax. Mr. A. C. Gabriel, Director of Finance, stated that the cities of Torrance and Burbank had been contacted and had informed him that they have noted no decrease in their sales tax revenues since enaction of a cigarette tax in their cities. Mayor asked for the vote on the motion that the ordinance enacting a cigarette tax be approved and adopted. AYES: 5 Councilmen: Corbin, Dickerson, Dunnum, Morton, Temple NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None It was pointed out by Councilman Dunnum that the tax will be used for civic purposes only, going for civic improvements, and that the tax is strictly. a luxury tax. The item of the request of the Chamber of Commerce for an appropriation from the City of Downey for the 1965 -66 fiscal year was taken out of order on the agenda with President Elect Bill Ritchie, presenting a financial report to Council, setting forth a budget of $63,598.00 for the year 1965 -66. He outlined the program of action proposed, the total membership, and asked that their Treasurer Elect be called upon to discuss the item of business brought into the City of Downey. Council Minutes - 6/22/65 -2- 2348 Councilman Morton asked for an explanation of the term "review" of several of the items listed in the program of action, and asked for more detail on each item listed. Mr. C. W. Barrett, Manager of the Chamber of Commerce, gave a rundown of the budget items. It was reported that at the Chamber's last meeting, a resolution had been unanimously adopted reaffirming their stand of being in favor of dissolution of the Downey Park and Recreation District and have appointed, :a Board to be directly responsible to the City Council. He announced the next meeting to be held jointly with the City Council, Chamber of Commerce and Park District will be at 7:30 P.M. on July 15, 1965. Mr. Maurice McAlister, Treasurer Elect, read a letter written in 1963 to Cadillac Corporation inviting them to locate in Downey and he stated that sub- sequently he had approached Mr..Spreen of Spreen Cadillac Agency, who are presently being established in the City. Councilman Morton suggested that one of the members of Council be made a liaison member with the Chamber to attend all their meetings. Mayor Temple asked for anyone wishing to volunteer to do so, whereupon Councilman Morton volunteered and it was so ordered that he would act as the liaison member of Council to the Downey Chamber of Commerce. The Mayor also urged other Councilmen to attend meet- ings of the Chamber as often as possible. Councilman Dickerson suggested that the Chamber meet with the Mayor and himself to review a plan of action which had been presented at the Mayors' Confer - ence as the plan contained many uo rthwhile items. After a review of the contractual agreement with the Chamber of Commerce, it was moved by Councilman Dunnum, seconded by Councilman Corbin and passed by the following vote to approve an appropriation of $19,800.00 for the fiscal year 1965 66 and to authorize the Mayor to sign the agreement. After discussion, it was moved by Councilman Dickerson, seconded by Councilman Dunnum and so ordered that the item of Christmas Lighting be taken under submission for further study. The Mayor declared a 10- minute recess with Council reconvening at 9:45 A.M. with roll call,.all members of Council being present. Deputy Chief of Police Loren Morgan reported that these barricades have been used for several years with no problems. It was moved by Councilman Morton, seconded by Councilman Corbin and passed by the following vote to award the contract for gasoline dispensing to L & S Service for dispensing on week days, including Saturday and Sunday, from 6:00 a.m. to 12:30 a.m. with holidays arranged for servicing cars from 7:00 a.m. to 9:00 a.m. and from 3:00 p.m. to 5:00 p.m., for a price of $0.043 per gallon. It was recommended that the bid be awarded to the two towing services formerly used, and establishing United Towing Service as an alternate for either zone within Downey. It was moved by Councilman Morton, seconded by Councilman Corbin and passed by the following vote to renew the towing and impounding service contract with Ray's Automotive Service and Doug's Tug, with United Towing Service being used as an alternate to fill in for the coming year, and authorize amending the agree- ment to include the United Towing Service. The City Attorney reported the County Counsel would not approve Alternate #2 contained in the City Manager's report. It was moved by Councilman Morton, seconded by Councilman Corbin and passed by the following vote to approve renewal of agreements with the three disposal companies with the recommended rate increases to become effective October 1, 1965. The City Manager commended the contractors for rubbish collection for their expeditious handling of various problem areas when reported to the Department of Public Works. Mr. King stated he had a report from the City of Salt Lake relative to its drinking fountains which was in response to a request for installation of a drink - ing fountain on Paramount Boulevard which was held from the previous Council Meeting. It was reported that the Salt Lake City water fountains are maintained by the Water Division of the City and that they have litter baskets close or adjacent to these fountains, and that they have no trouble with the fountains. A letter directed to Mr. Eldon D. Young from his insurance carrier, was submitted which stated the limits of liability on a policy covering his building situated at 12036 through 12039 S. Paramount Boulevard, and that a copy of the policy would be forwarded to the City. The City Attorney advised that the policy should include the City as a named assured insofar as the maintenance of the drinking fountain. Eldon D. and Harold Young to construct and main - tain a water fountain at a specified location in accordance with the following conditions: insurance policy in form and of an amount approved by the City; fountain to be constructed and maintained in accordance with standards of the Department of Public Works, the permit to be revokable by the City at any time. Mundy, representing Downey Memorial Christian Church, re- quested approval of extension of a sewer approximately 200' east of Florence Council Minutes = 6/22/65 -10- 23b6 Avenue to provide connection for a new sanctuary building being proposed. It was proposed that an assessment district be initiated to provide required sewers economically and expeditiously to the church and adjacent property owners. The church is desirous of beginning construction immediately and requested that the City approve extension at the earliest possible time. It was moved by Councilman Morton, seconded by Councilman Corbin and so ordered to approve extension of sewer adjacent to Downey Memorial Church approximately 200' east on Florence Avenue. This is relative to the matter which was taken under submission at the last Council Meeting, for 30 days. The Mayor also reported receipt of a resolution from Assemblyman Willson to guarantee free press and fair trial which was being referred to the Police Department for recommendation. The City Manager reported that a few weeks ago at a meeting of the Harbor City Hospital Planning Association where the need for a 150 -bed hospital for the City of Downey was discussed, Ilse request had been unanimously approved.
