OF THE CITY COUNCIL
OF THE CITY OF DOWNEY FOR
SEPTEMBER 13, 1965
The City Council of the City of Downey held a regular meeting in the Council
Chpmber of the Downey City Hall at 7:30 P.M., September 13, 1965, Mayor Scott E. Temple.

Reverend Albert Epp of the Immanuel Mennonite Church delivered the invocation.
Mayor Temple read a proclamation setting September 13, 1965, as World Law Day,
then presented the proclamation to John Bunnett, President of the Southeast Bar
Association.
�-. It was moved by Councilman Temple, seconded by Councilman Corbin and so ordered
that the proclamation be adopted.
Mr. Bunnett stated that, having a law day, U.S.A., there is hope that a World
Law Day might be established.
Chief of Police Ivan A. Robinson, assisted by Mayor Temple, presented Basic
Certificates from the Commission on Peace Officers Standards and Training to
Officers William Courtney, Dennis Morton Chelstrom and Harold Daniel Hugo. Officers
on vacation not receiving their certificates at the meeting were Franklyn Tim Doyle,
W. 0. Simmons and Bud Junior Walters.
Mayor Temple announced the time and place for the public hearing on the appeal
filed against Zone Exception #592 (9931 Tweedy Lane) and inquired if the proper
notice had been published and mailed. The City Clerk replied proper notification
had been given.
The City Clerk reported there were no written comments or protests other than
the original petition of appeal.
Sherman Griselle, Director of Planning, gave a resume of the Zone Exception
Case #592 which was granted by the Planning Commission for an 18 -unit apartment
building at 9931 Tweedy Lane.
Speaking in support of the appeal and in protest to Zone Exception #592 were:

There then followed the rebuttal by Mrs. Beatrice B. Axton and Mr. Russell Beach.
A traffic report on the area in question was presented by Mr. Ervin Spindel,
Director of Public Works.
It was moved by Councilman Corbin, seconded by Councilman Dickerson and so
ordered that the hearing on Zone Exception Case #592, 9931 Tweedy Lane, be closed.
Councilman Morton requested the City Attorney to refresh the minds of Councilmen
on the considerations for the granting of zone exceptions by the Planning Commission
as contained in the code.
Councilman Morton suggested it might be well that the report from the Quality
Advisory Committee be presented relative to the study of a possible requirement of
two parking spaces per unit and that the zone exception be taken under submission
until this study has been completed. Mr. Griselle, Director of the Planning De-,-
p &rtmea�,advised that it might be months before the study completes the various
channels of study and could be reported to Council.
It was moved by Councilman Morton, seconded by Councilman Dickerson and passed
by the following vote to take Zone Exception 4592 undet submission until the next
night council meeting, October 11, 1965, for further study by the Council and a
field trip to the location.

Mayor Temple announced the public hearing on Planning Resolution No. 97,
Extension of Patton Road, and inquired if proper notification had been given. The
City Clerk replied proper notice had been given.
There were no written comments or protests.
Mr. Sherman Griselle, Director of Planning, gave a report on the matter.
Mrs. Betty Kilpatrick, 8603 Meadow Road, inquired about possibilities of the
extension of Patton Road causing a traffic hazard for school children with added
traffic on Patton Road when it is opened and extended.
There being no further oral comment and no protest, it was moved by Councilman
Morton, seconded by Councilman Corbin and so ordered that the hearing on Planning
Resolution No. 97 of the Planning Commission for the extension of Patton Road be
closed.
RESOLUTION NO. 1608
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ADOPTING AN AMENDMENT TO THE GENERAL PLAN (EXTENSION OF
PATTON ROAD)
The resolution was read by title only. It was moved by Councilman Corbin,
seconded by Councilman Morton and so ordered that further reading be waived.
It was moved by Councilman Corbin, seconded by Councilman Dickerson and passed
by the following vote that Resolution No. 1608 be adopted.

Mayor Temple announced the time and place for the hearing on Downey Improvement
Project #513, Site No. 1, 11637 Patton Road, and asked if proper notices had been
given. The City Clerk replied they had. There were no written nor oral comments
or protests.

Mr. Ervin Spindel, Director of Public Works, stated that all work required under
Chapter 27 of the 1911 Act of the Streets and Highways Code of the State of California
has been satisfactorily completed and the hearing is on the cost involved.
It was moved by Councilman Morton, seconded by Councilman Dickerson and so
ordered that the hearing on Downey Improvement Project #513, 11637 Patton Road, be
closed.
It was moved by Councilman Corbin, seconded by Councilman Dickerson and passed
by the following vote to affirm the assessment for Site No. 1 of DIP #513 in the
amount of $1,112.25 (11637 Patton Road).

It was moved by Councilman Corbin, seconded by Councilman Dickerson and so
ordered that the minutes of the meeting held on August 27, 1965, be approved as

The City Clerk reported on the following correspondence:
A letter from the Board of Supervisors relative to the Flood Control Program.
Ordered received and filed.
A letter from Leland R. Weaver, Chairman of the Resolutions and ByLaws Commit-
tee of the Independent Cities submitting changes in By -Laws to be presented at the
Seminar in Palm Springs September 17, 18 and 19, 1965. Ordered received and filed.
A letter from Mr. Freeman Henry, President, Downey Guadalajara Sister City
Association, suggesting changes in their By -Laws.
It was moved by Councilman Morton, seconded by Councilman Dickerson and so
ordered that the City Attorney be instructed to amend Resolution No. 1489 pertaining
to the Sister City organization, in accordance with the suggested changes in their
By -Laws.
A letter of appeal from Ann Ruth Grant, Attorney on behalf of Joe Diliberto on
Zone Exception Case, #597 (Phlox Avenue). It was moved by Councilman Corbin,
seconded by Councilman Dickerson and so ordered to set a hearing for 7:30 P.M.,
October 11, 1965, in the Council Chamber of the Downey City Hall.
Letter from Dale Baker, Chairman of the Water Board, recommending that planning
for a separate water department be done simultaneously with negotiations for pur-
chase of the Park Water Company. Ordered received and filed.
An appeal from Marcum & Salmon, Attorneys, by Richard A. Donnelly for revoca-
tion of Melody Room's entertainment license.
It was moved by Councilman Morton, seconded by Councilman Dickerson and so
ordered that a hearing be set for 8:00 A.M. in the Council Chamber of the Downey City
Hall, September 28, 1965.

Mr. .john Hume, Director of the Downey Children's Theatre, Inc., announced the
10th anniversary celebration of the theater and invited Council to have a representa-
tive at their birthday celebration on September 19 and requested Council's support of
the drive for a Downey Children's Theatre and Downey Community Center for the Perform-
ing Arts.
Mayor Pro Tempore Charles Dickerson was designated the official representative
from City Council to attend the birthday celebration.

COMMENDING THE DOWNEY CHILDREN'S THEATRE ON ITS TENTH
ANNIVERSARY

It was suggested that the Mayor Pro Tem present a copy of the resolution to
the Children's Theatre at its celebration on Sunday.
The City Clerk continued with the correspondence:
A letter from the Southern California Rapid Transit District requesting
appointment of a City Selection Committeeman in order for the City of Downey to
have a vote at the September 23 meeting.
It was moved by Councilman Morton, seconded by Councilman Dickerson and so
ordered to appoint Councilman Ben Corbin to the Southern California Rapid Transit
District City Selection Committee.
Claim for damages from Maxine King. It was moved by Councilman Corbin, seconded
by Councilman Dickerson and so ordered that the claim be denied and referred to the
City's insurance carrier.
Downey Chamber of Commerce Monthly Report was ordered received and filed.
Financial report from the Downey Museum of Art was received and filed.
Announcement of September 23 meeting at 9:00 A.M., Room 1138, New State Building,
107 South Broadway, Los Angeles of the Southern California Rapid Transit District
City Selection Committee Members.
A letter from Mr. Phil Ortiz, President of the Downey Tavern and Restaurant
Owners Association, requesting they be allowed to give their views on a proposed
raise of their license. Mr. Ortiz presented a petition and expressed a desire
that Council give complete study and consideration to maintaining the present liquor
license fees. The petition was ordered received and filed.
Councilman Morton stated clearly there is no proposal to increase fees for
liquor licenses, however, the Council did request a study of fees in surrounding
areas.
It was moved by Councilman Morton, seconded by Councilman Dickerson and so
ordered that City Council request Mr. Ortiz and other representatives of the Tavern
and Restaurant Owners Association to discuss with Police Chief Ivan A. Robinson
the situation of liquor establishments and possible solutions on the matter.
A letter from Downey Chamber of Commerce requesting City Council to attend
their September 23 meeting of the combined zoning committee to pursue its estab-
lished policy of assisting in the long -term orderly physical development of the
City of Downey. Ordered filed.

Robert S. Brazelton presented a letter requesting reappointment of
Mr. Charles Wheeler to the Planning Commission. His term had expired on June 30.
Ordered filed.
Mayor Temple reported receipt of a letter from Mayor William McCann of Santa
Fe Springs asking that the City Council designate September 27 to October 3 as
"Lock Your Car Week ". Mayor Temple so ordered "Lock Your Car Week" be proclaimed
for September 27 to October 3.
Mayor Temple reported on receipt of a letter from the Mayor of the City of
Racine,,Wisconsin, who stated he had talked with Dr. Ralph Christensen and
inquired about the progress of the City of Downey, who had commended them on
their special cancer film a few years ago.
A letter from S. J. Turner of East Los Angeles College was read by the Mayor
c amending Firemen Pearce, O'Toole, Jones and Perry for completion of the Firemen's
Science program at their college, which is but one of many courses attended by
Fire Department personnel. Chief Gain was commended for the inspiration and work
in the educational programs for fire personnel. A copy of the letter was ordered
submitted to Fire Chief Robert Gain.
Mayor Temple declared a 10- minute recess with Council reconvening at 9:45 P.M.

After summation of bids for Cash Contract #164, Miscellaneous Repairs of curb,
gutter and sidewalks at various locations throughout the City, it was moved by
Councilman Dickerson, seconded by Councilman Corbin and passed by the following vote
to award the contract to the lowest and best bidder, Allcon, in the amount of the
unit prices as submitted in the bid proposal and that all other bids be rejected.

with street and parking lot improvements, it was moved by Councilman Dickerson,

the lowest and b4st bidder, Geisler Construction, Inc., in the amount of unit
prices submitted in the bid proposal, and all other bids be rejected.

proposal, and all other bids be rejected.

A report by Ervin Spindel was presented on the hazards submitted by the School
Board and the City Manager advised it had been suggested that a representative from
the School District be requested to work with the Department of Public Works on the
study of protection of school children. So ordered.
It was moved by Councilman Morton, seconded by Councilman Temple and passed by
the following vote to accept improvements completed in Tract #29627, Downey Avenue, and
responsibility for maintenance thereof.

A report by Ervin Spindel was presented on the hazards submitted by the School
Board and the City Manager advised it had been suggested that a representative from
the School District be requestted to work with the Department of Public Works on the
study of protection of school children. So ordered.

The City Manager advised that the City is again setting forth the previous
recommendation relative to its proposed and desired senatorial district which will
be presented to the State Legislature after it convenes on September 21, and he
recommended contacting Assemblyman Carley V. Porter to reaffirm the position of the
City of Downey.

Mayor Temple advised he had received an announcement from Supervisor Warren Dorn
of District 5 of the Moral Rearmament Conference to be held in Los Angeles with a
preview on September 16 - 19 at the Hollywood Bowl and announced complimentary tickets
are available for members who might be able to attend.
Announcement from Charles Bates of the Civil Defense Area E office of the
Civil Defense Disaster Conference to be held at Disneyland Hotel September 16 and 17.

Announcement of League Meeting Thursday, September 16, at the Huntington
Sheraton Hotel in Pasadena.
Mayor Temple read a letter from Shirley Shipman and the Democratic Club which.
protested the rose float design for the coming year.
Cora Rowe, 9435 Borson Street, requested Council consider a design other than
the Rose Float Association's proposed Rose Float design for the 1966 float, choosing
one which would not be embarrassing to anyone or cause undue publicity.
Councilman Dickerson requested an investigation of the condition of the alley
at 7512 Second Street which is in nea:d of cleaning, paving and repair.
Councilman Dickerson stated he wished to appoint Mr. Jim W. Hartley to fill
the existing vacancy on the Planning Commission.
Councilman Morton stated it was unfortunate the matter was not in the agenda
file when presented for tonight's meeting in order that the appointee might be
evaluated. He stated that he feels the appointments on the Planning Commission are
perhaps the most important the Council can make as any appointment seriously affects
each district. Councilman Morton stated he feels strongly that anyone put on the
Commission should not have vested interests in the City. He favored taking the
matter under submission.
Councilman Dickerson stated he felt every confidence that Mr. Hartley would do
a fine job and that he was well qualified to serve on the Planning Commission.
It was moved by Councilman Corbin, seconded by Councilman Dickerson and so
ordered to take under submission the proposed appointment to fill the existing
vacancy on the Planning Commission with a possible interview and evaluation of the
candidate.
Councilman Dickerson requested a field trip to the various locations where
removal of trees is proposed.
Councilman Morton voiced an objection to the solid doors which are being
installed throughout the City Hall.
Councilman Morton requested submission to the Council for evaluation, the
estimated costs of enlacing the right wing to the west of the City Hall, giving
more space to the Accounting Department and Fire Department.
It was suggested that two members of the City Council represent Council at
a Downey Coordinating Council Meeting relative to Park District Dissolution for
a constructive and- objective debate.
Mr. Wendell Wiser, 7816 Seventh Street, Downey, again inquired about the
report on the study of parkways and sidewalks across the railroad tracks at
Paramount Boulevard; objected to postponement of the Woodruff Avenue realignment
to the Stonewood Shopping Center; and commended Councilman Dickerson on his
proposed appointment to the Planning Commission.
