Morton presiding. ,PRESENT: Councilmen: Dickerson, Temple, Corbin, Dunnum, Morton ALSO PRESENT: Oren L. King, City Manager Royal M. Sorensen, City Attorney A. C. Gain, Fire Chief Ivan A. Robinson, Chief of Police Ray Lake, Director of Building Guy Brown, Sr. Building Inspector Delia Doyle, City Clerk Alberta Pfeiffer, Deputy City Clerk Reverend Milton Gould of the First Baptist Church delivered the invocation. Mayor Morton asked Reverend Gould if he would like to say anything about the new church building and Reverend Gould extended an invitation to all to visit their new church facility. Mayor Morton announced the time and place for the continuation of the public hearing on the proposed vacation of Paramount Boulevard and Imperial Highway. The City Manager reported the applicant, Gulf Oil Company, has requested further con - tinuation of this hearing. It was moved by Councilman Temple, seconded by Councilman Dickerson and so ordered to continue the hearing on the Resolution of Intention to vacate a portion of Paramount Boulevard and Imperial Highway to 8:00 A.M., May 25, 1965, in the Council Chamber of the Downey City Hall. It was moved by Councilman Corbin, seconded by Councilman Temple and so ordered to approve the minutes of the meeting of April 12, 1965, as corrected. The City Clerk reported on the following correspondence: A letter from Thomas M. Rees thanking the City for the resolution opposing the extension of partisan politics into local government with the prediction that there will be no action on the assembly bill involved during the current session. A letter from Santa Monica and copy of their resolution supporting AB 2050. The Mayor reminded Council that they had had a similar request from the City of Torrance for protection of the beach areas. The City Attorney reported that the Santa Monica officials are most anxious to have the bill enacted to avoid, if possible, the freeway's cutting the city in half. It was moved by Councilman Dunnum, seconded by Councilman Temple and so ordered that City Council adopt a resolution supporting AB 2050. Council Minutes - 4/27/65 -1- 2293 RESOLUTION NO. 1549 A RESOLUTION SUPPORTING ASSEMBLY BILL NO. 2050 AND URGING THE PASSAGE OF SUCH BILL BY THE ASSEMBLY AND THE SENATE AND THE APPROVAL THEREOF BY THE GOVERNOR OF THE STATE OF CALIFORNIA The resolution was read by title only. It was moved by Councilman Temple, seconded by Councilman Corbin and so ordered that further reading be waived. An acknowledgment letter from Assemblyman George A. Willson for the City's requests for support of AB 1218 and AB 1461, stating he would give full consid- eration to their position on these measures when they are before him. A financial report from the Downey Civic Chorus for the third quarter, January 1, 1965, through March 31, 1965. A letter from Leslie V. Olson requesting that Lot Split #372 be considered at the same time as Zone Exception No. 568, which was set for hearing May 10. It was moved by Councilman Temple, seconded by Councilman Dunnum and so ordered to include for consideration, Lot Split ##372 at the same time as the hearing on Zone Exception #568. A letter from City Attorney Sorensen reporting that the architect's con- -' tract for the hospital has been changed and the warranty clause is not as stringent as the one desired by Council, but appears to be satisfactory. The City Attorney reviewed the contract and recommended approval by Council. It was moved by Councilman Corbin, seconded by Councilman Dunnum-and passed by the following vote to authorize the City Attorney to proceed to finalize the contract for signature of the Mayor and /or the City Manager, and authorize the signing of the contract when it is in final form with amendments. Martin & Associates accepts the warranty clause as it now stands and the contract may be finalized. A letter was received from Supervisor Kenneth Hahn outlining the program for consolidation of municipal court districts. A copy of a resolution from the Downey Chamber of Commerce favoring the proposed beautification plans of the Santa Ana Freeway and requesting that the City install sidewalks under the Freeway at Paramount Boulevard. Mr. Spindel stated that it was due to the fact that there were no sidewalks under the Santa Ana Freeway which encouraged the construction of the pedestrian overpass, and that to encourage crossing Paramount Boulevard at the off -ramp would be quite hazardous. This was the reason the pedestrian overpass was sup- ported-. A study, however, can be made of the possibility of installation of sidewalks as suggested. It was moved by Councilman Dickerson, seconded by Councilman Temple and so ordered that the Department of Public Works study the possibility of installation of sidewalks under the Santa Ana Freeway at-Paramount Boulevard. Council Minutes — 4/27/65 -2- 2204 A claim for damages from Ohio Casualty, Croup of Insurance. Companies, asking reimbursement for their insured's.vehicle which was damaged by police bullets during an attempted holdup. It was moved by Councilman Temple, seconded by Councilman Dickerson and passed by the following vote to deny the claim and refer to the City's insurance carrier. Preston, whose tree was damaged when American Tree Service was doing a job for the City. It was moved by Councilman Temple, seconded by Councilman Dickerson and passed by the following vote to deny the claim and refer it to the City's insurance carrier. Humphrey, inviting the Mayors of all cities to a conference_in Wa.shington,,D.C. May 5 to exchange views on problems facing the cities. It was moved by Councilman Dickerson, seconded by Councilman Corbin and passed by the following vote to authorize the Mayor or representative to attend the Vice President's conference in Washington, D.C. S. Conference of Mayors is to be held May 29 to June 2 in St. Louis, Missouri,.and reminded that action had already been taken by_Council to authorize the Mayor to attend. At this time, the Mayor presented the matter of the conference held by the Downey,Park Board and the City on April 25 where dissolution of the Park District and making it a part of the City was discussed. Councilman Corbin asked the City Manager if the City would be able to finance the purchase of property (known as Site 8) without additional tax levy. The City Manager replied that it could be accomplished without any raise in taxes. The Mayor reviewed for Council the various matters, financial, etc, brought up at the Monday morning conference. Councilman Dunnum remarked she felt there were two issues: (1) Use of the tax dollar; (2) The best service possible to the citizens. It was moved by Councilman Dunnum, seconded by Councilman Corbin to endorse the action of the Lions Club in circulating the petitions to place on the ballot, the question as to whether or not the Park District should be dissolved and the service then become a part of the mnnicipal'structure. Mayor. Morton recommended and suggested that a Park Commission be established on the basis of one representative to be elected from each of the councilmanic districts to have representation from each of the areas throughout the City, and to maintain a stable financial structure. Councilman Temple stated that the City, should it absorb the Park District, should endeavor to maintain as much service, if not more, as it already has. He stated he does not feel there should be any less of a program. Council Minutes - 4/27/65 -3- 2295 Mayor Morton stressed the point of maintaining the present personnel, com- paring it with the incorporating of the Downey County Water Company under municipal direction, keeping it within the financial structure. Councilman Morton ascertained from the City Attorney.that the City would assume the liabilities of the Park District when and if it may be absorbed by the City of Downey. It was also brought out by the Mayor that there may be a need for a study of the personnel structure of the Park District. Mayor Morton asked for roll call on the motion to endorse the Lions Club's circulation of petitions to put on the ballot, the matter of whether or not the Downey Park District should be dissolved and made a part of the municipal structure of the City of Downey. AYES: 5 Councilmen: Dickerson, Temple, Corbin, Dunnum, Morton NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Council Minutes - 4/27/65 -6- 2298 It was reported by the Director of Public Works, Mr. Ervin Spindel, that several years ago when construction was first being considered on Downey Avenue, the City Council had indicated a desire to save the palm trees along Downey Avenue. Plans and Specifications for Downey Avenue between Cherokee Drive and Florence Avenue have been substantially completed and most of the right of way in this area has been acquired. All of the property owners through the course of the acquisition of right of way have been contacted and the subject of the trees discussed. None of the owners in the area have indicated any objection to the removal of these trees. Now that the engineering has been completed, it becomes apparent that there is a considerable problem in relocating the trees in this area so that they do not interfere with the overhead utilities. A tree contractor has been contacted in regard to cost for this relocation and have advised they could be relocated to the Public Works Yard at a cost of $190 per tree, the same cost as for the relocation on Downey Avenue. It is thought that perhaps the Council may wish to allow the trees to be moved to the Public Works Yard and perhaps used in the future landscaping of the hospital site. If the City were to purchase palm trees of this size, the cost would be between $1,300.00 and $1,400.00. Council deferred this matter in order to make a field trip and conduct further study on relocation of the palm trees on Downey Avenue between Cherokee Drive and Florence Avenue under Select System Project #38. After the bid summation for Cash Contract No. SS 77 for installation of signals and highway safety lighting on Suva Street at Foster Bridge Boulevard and Bluff Road, it was moved by Councilman Dickerson, seconded by Councilman Temple and passed by the following vote to award the contract to the lowest and best bidder, William R. Hahn, in the amount of $11,678.00 for Cash Contract No. SS 77, and that all other bids be rejected. Council Minutes — 4/27/65 -7- 2299 AYES: 5 Councilmen: Dickerson, Temple, Corbin, Dunnum, Morton NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None It was requested that the following transfers be made for additional personnel hired for the Water Division to supply funds to pay their salaries for the balance of the fiscal year: $1,434 from the Unappropriated Water Reserve to Account No. 8100 -1 and $1,121.00 from Unappropriated Water Reserve to Account No. 8410 -1, totaling $2,555.00. The appropriation was approved by the Water Board at its meeting of April 19, 1965. Another hearing was set for April 29 but he does not know if there is anything in particular going to happen to it, and the bonding firm which originally initiated this bill is not in favor of any amendments. It also has strong opposition from the League of California Cities, for it was felt a limited bill would be worse than what they have now. The other bill, specifically AB 2309, which would allow the City to pur- chase the portion of the Lakewood Water System within the limits of the City of Downey was set for hearing on May 5 and is exceedingly important to the City. Lakewood City Attorney, John Todd, is planning to attend and it is up to Council whether it is wished that its City Attorney, too, attend this hearing, or any other representative, such as the Mayor or the City Manager. The City Manager reported that most all of the people in the area proposed for a Parking Lot west of Third Street on LaReina Avenue have received notifica- tion of the City's intent to acquire this property and authority was requested for the Mayor and City Manager to proceed to enter into escrow on any of these properties they may be acquired through stipulation from the owners as was pre- viously done on the hospital site and other sites. Invoices also have been received from the legal firm of Burke, Williams and Sorensen which have been charged to this fund. It was requested that authority be granted for an additional loan of $75,000.00 (to be repaid when bonds are sold) from Unappropriated Reserve to the Hospital Fund. The advance and loan to the Hospital Fund would then total $454,500.00. Mrs. Mary Lou Woods, Chairman of the Library Advisory Board, stated that she appreciates all the help given by the Council in establishing the fine library now existing in the City of Downey. Don Robison was instructed to give names and addresses to Council of those persons attending that meeting. Mayor Morton reminded Council of an unfinished item from the last Council Meeting relative to right of way encroachments. Councilman Temple suggested that everything.possible be done toward estab- lishment of sidewalks, particularly in Select System of Streets, and that the Traffic Committee take under study, the areas where children are walking in the streets to schools due to encroachments in the right of way. He added that he is happy to see the City has taken a move on the matter of the Southern Pacific Railroad right of way, and that he is grateful for the progress being made by the City. Richard F1utts,owner- operator of the franchise of MacDonalds on Paramount Boulevard stated he is opposed to establishment of a beer bar in the shopping area adjacent to his drivein.
