Morton presiding. PRESENT: Councilmen: Dickerson, Temple, Corbin, Dunnum, Morton ALSO PRESENT: Royal M. Sorensen, City Attorney A. C. Gabriel, Director of Finance Sherman Griselle, Director of Planning Ervin Spindel, Director of Public Works LeGrande Leavitt, City Engineer Donald Robison, Assistant to the City Manager Ray Lake, Director of Building and Safety Robert W. Gain, Fire Chief Ivan A. Robinson, Chief of Police Della Doyle, City Clerk Alberta Pfeiffer, Deputy City Clerk Reverend John Kreider, Faith Mennonite Church, delivered the invocation. Mayor Morton announced there would be a presentation and commendation from the City to Mesdames Jeri Lippert and Betty Kilpatrick for their outstanding community service while serving as members of the Downey Rose Float Commitee. He stated that he believes no other citizens committee spends as much time as the Rose Float, and that the two women probably had spent more time than any other members. On behalf of the City Council Mayor Morton stated he extended wholehearted appreciation to them. Council added their comments in apprecia- tion of the fine service which they rendered as members of this committee. Members of the Downey Children's group headed by Queen Janelle Yancey then presented a proclamation, requesting that the Mayor proclaim the month of June as Children's Theater Month as part of their Tenth Anniversary celebration. Mayor Morton read the proclamation in full. It was moved by Councilman Temple, seconded by Councilman Corbin and so ordered that the Mayor be authorized to sign the proclamation setting forth the month of June as Children's Theater Month. Mr. John Hume, Theater Director, also made a few comments on the progress of the Downey Children's Theater and expressed high hopes for further progress in the coming years. Mayor Morton announced the time and place for the public hearings on Planning Resolution No. 92 amending the Downey Municipal Code relative to off street parking requirements. The Mayor inquired if the City Clerk had the Affidavit of Publication of the Notice of Hearing. The City Clerk replied she had the affidavit. The affidavit was ordered received and filed. There being no written and no oral comments, it wa moved by Councilman Corbin, seconded by Councilman Temple and so ordered that the hearing on Planning Resolution No. 92, off street parking requirements, be closed. ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE ZONING MAP ADOPTED BY SECTION 9107 OF THE DOWNEY MUNICIPAL CODE (PLANNING RESOLUTION NO. 92, AMEND- ING SECTIONS 9116.8 AND 9127.1) The ordinance was read by title only. Mr. Spindel gave a resume of this vacation.and a letter was read from the Gas Service Company which stated it is unnecessary to retain the gas easement on the property in question. It was moved by Councilman Temple, seconded by Councilman Dickerson and so ordered that the correspondence be received and filed. There being no oral and no written comments, it was moved by Councilman Temple, seconded by Councilman Corbin and so ordered that the hearing on the intention to vacate a portion of Farm and Myrtle Streets in Tract #21227 be closed. RESOLUTION NO. 1538 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING VACATION OF A PORTION OF FARM STREET AND MYRTLE STREET AS SHOWN ON TRACT NO. 21227 The resolution was read by title only. It was moved by Councilman Corbin, seconded by Councilman Temple and so ordered that further reading be waived. It was moved by Councilman Corbin, seconded by Councilman Dickerson and passed by the following vote that Resolution No. 1538 be 'adopted. There being no written and no oral comments, it was moved by Councilman Corbin, seconded by Councilman Temple and so ordered that the hearing on the intention to vacate a portion of Downey Avenue at Lexington Road was closed. RESOLUTION NO. 1539 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING VACATION OF A PORTION OF DOWNEY AVENUE AT THE -- SOUTHEAST CORNER OF THE INTERSECTION OF DOWNEY AVENUE AND LEXINGTON ROAD The resolution was read by title only. There being no written and no oral comments, it was moved by Councilman Corbin, seconded by Councilman Temple and so ordered that the hearing "be_ closed. RESOLUTION NO. 1540 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWISE Y ORDERING VACATION OF THE SOUTH SIDE OF EVEREST STREET WESTERLY OF BROOK- SHIRE AVENUE, AS SHOWN ON OFFICIAL MAP FILED IN BOOK 4, PAGES 62 AND 63 OF OFFICIAL RECORDS The resolution was read by title only. It was moved by Councilman Corbin, seconded by Councilman Temple and so ordered that further reading be waived. The Mayor inquired if the City Clerk had the Affidavit of Publication of the Notice of Hearing. The City Clerk replied she had the affidavit. It was ordered received and filed. Mr. Spindel reported that the developer of the southeast corner of Paramount Boulevard and Imperial Highway had not placed bonds to cover the cost or recon- struction in this area and the vacation of the right of way without assurance of reconstruction would present considerable problems. It was recommended that the hear- ing be continued. It was moved by Councilman Temple, seconded by Councilman Dickerson and so ordered that the hearing on the intention to vacate a portion of Imperial Highway and Paramount Boulevard at the southeast corner of the intersection be continued to 8:00 A.M., April 27, 1965, in the Council Chamber of the Downey City Hall. The Mayor announced the hearing on the intention to vacate an easement for pipe lines, and incidental purposes across property located at 10404 Western Avenue, et al., and inquired if the City Clerk had the Affidavit of Publication and Posting. The City Clerk replied she had the affidavits and they were ordered received and fi led. Mr. Ervin Spindel reported on the intended vacation. There being no written and no oral comments, it was moved by Councilman Corbin, seconded by Councilman Dickerson and so ordered that the hearing on the intention to vacate an easement for pipe lines at 10404 Western Avenue, at al., be closed. Council Minutes - 4/12/65 -3- F RESOLUTION NO. 1541 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING VACATION OF AN EASEMENT FOR PIPE LINES, AND INCIDENTAL PURPOSES ACROSS PROPERTY LOCATED AT 10404 WESTERN AVENUE, ET AL., AS RECORDED IN BOOK 14344, PAGE 200, OF OFFICIAL RECORDS The resolution was read by title only. Mr. Spindel reported notices had been posted in the area. Mr. Ray Rann, 9277 E. Florence, questioned why he had received a notice when improvements are already in on his property. It was explained by the Director of Public Works that notices are sent to all property owners iii the area to be improved as a matter of information. There being no written comments and no further oral comment, it was moved by Councilman Corbin, seconded by Councilman Temple and so ordered that the hearing be closed on D.I.P. #524, Florence Avenue easterly of Haledon Avenue. It was moved by Councilman Temple, seconded by Councilman Dickerson and passed by the following vote to authorize the Director of Public Works to proceed under Chapter #27 for improvements consisting of construction of curbs and gutters under D.I. P. #524, Florence Avenue easterly of Haledon Avenue. The City Clerk reported on the following correspondence: Report and budget request from the Downey Youth Band. Ordered received and filed and referred to the budget study at the time these matters are being considered. and Mr. Caesar Mattai was highly complimented by Council on his development of the Downey Youth Band. Mr. Mattai reported on the various activities of the band and gave reasons why additional appropriation is being requested of the City Council, being mainly due to travel expenses as well as expense involved in appearing in numerous parades. Letter of appreciation to the Fire Department from Dr. Jordan M. Phillips. Received and filed. Letter from the City of South Gate in appreciation to Fire Captain J. D. Hughes who participated in oral examinations for their city. Letter from the County Board of Supervisors supporting the L.A. Airways petition. Received and filed. Letter from Leslie V. Olson requesting final approval of tract map for Zone Case No. 94, Paramount Blvd., at Farm Street and reactivation of the zone change case. Council Minutes - 4/12/65 -4- 2283 It was moved by Councilman Temple, seconded by Councilman Dickerson and so ordered that Mr. Olson's request to reactivate Zone Change No. 94, Paramount Boulevard at Farm Street, be referred to the Planning Commission. A letter from the Mayor of Long Beach relative to legislation proposing a telephone tax. Ordered received and filed. A report from Supervisor Frank Bonellifavoring merger of municipal courts. Councilman Corbin suggested that a letter be directed to Supervisor Bonelli indicating the stand taken by the City Council. It was moved by Councilman Corbin, seconded by Councilman Dickerson and passed by the following vote to oppose the matter of a court merger until further information may be obtained and studied. A letter from the County Board of Supervisors advising that a hearing on the matter of Municipal Court consolidation and the matter of additional judges was being continued to Tuesday, April 13. Ordered received and filed. Stonewood Traffic Committee Report. The Mayor reviewed the report and stated that Councilman Corbin and he had established the Citizens Advisory Committee with Mr. John Zaby, Chairman, composed of representatives from various main streets adjacent to Stonewood area. Ervin Spindel, Director of Public Works, commended the citizens group on their study and stated he felt they had some excellent recommendations; that they had done a wonderful job and that the City will evaluate all the recommendations very thoroughly. It was moved by Councilman Dunnum, seconded by Councilman Temple and so ordered that the report of the Stonewood Traffic Committee be taken under submis- sion. The Mayor expressed his personal appreciation to the committee and Councilman Corbin for taking part in this study. It was reported by Mr. Gabriel that there were some unpaid water bills which were on the books when the City assumed the Water Division and he recommended that these be written off as bad debts. They amount to $4,887.37 and are considered uncollectable. It was moved by Councilman Corbin, seconded by Councilman Dickerson and passed by the following vote to write off the unpaid water bills as recommended by the Director of Finance. Chambers be denied and referred to the City's insurance carrier. Council Minutes - 4/12/05 -5- Aw282 A letter from the County Board of Supervisors advising assistance in the amount Of $100,000.00 for the cost of improving Downey Avenue between Fifth Street and the Southern Pacific Railroad has been approved, was ordered received and filed. Letter of appeal of Zone Exception #568, Lot Split No. 372 from Harry Boand, Jr. It was moved by Councilman Temple, seconded by Councilman Dickerson and so ordered to set a public hearing on the appeal to Zone Exception #568 for 7:30 P.M., May 10, 1965, in the Council Chamber of the Downey City Hall. Letter from the Downey Lion's Club stating they were undertaking to circulate petitions through the cities of Downey and Bellflower to place the question on the ballot of whether the parks should become a division of the city government or remain under the present Park District. It was moved by Councilman Temple, seconded by Councilman Corbin and so ordered to authorize circulation of petitions as requested by the Lion's Club. The Mayor reported that he had received a communication from KLAC Broadcasting Station thanking City Council for meeting with them to take some of their future broadcasts concerning the Downey Community Fair the 3 -week period from April 18 - May 9, with interviews with councilmen, at the fair, etc. being heard on April 18, 25 and May 2 at 6 :05 A.M. and 8:05 P.M. The Mayor read a request from Ventura relative to Downey's program on indecent literature. The communication was referred to Councilmen Dickerson and Corbin for considerbbion by the committee dealing with this subject. The Mayor reported he had been informed of AB 2174 being introduced on behalf of the Park Board of Directors through Assemblyman Carley V. Porter which authorizes under Section 5784.6 that "the amounts specified being set forth at 50� per $100 of assessed valuation" which would authorize a 25� increase in tax. No action was necessary on this item. A. C. Gabriel reported on the motor vehicle in -lieu fees due for the coming fiscal year 1965 -66 and also reported on the 64 -65 fiscal year. The fees are apportioned on a per capita basis -for the year 1964 -65 was $5.99 per capita and for 1965 -66 will be based on $6.01 per capital, on which figure the next year's budget will be predicated. The Mayor also reported on a letter from Lucille Kramer reporting a need for assistance to persons whose homes were washed down a cliff in the rains in Tijiana, Mexico. No action was taken. Since the cost of the land is considerably more than the cost of the improvements, it was recommended that Council authorize the improvements in exchange for the right of way acquisition. The property owner agrees to dedicate subject to conditions that the city construct curb, gutter, paving, sidewalk�,driveway apron, block wall, garage door lift, plus an additional $500.00 to compensate him for severance damage. An estimate of the cost of the Council Minutes - 4/12/65 -9- 2286 work, together with the compensation requested by the property owner is $3,000.00. The estimated value of the land being acquired is $5,000.00, which does not include improvements on the land or severance to the property owner, which, if included in the cost of the acquisition, would be considerably more than $5,000_00. Since the requests of the property owner are considerably less than the value of the land being offered in exchange, it was recommended that Council approve the conditions for acquisition of right of way. The final cost of the project has been determined at $10,352.43. The amount of money received from the Los Angeles County Flood District for the construction of these Catch Basins is $11,400.00. There is, therefore, a surplus of $1,047.57, which, in accordance with the Agreement with the Los Angeles County Flood Control District must be returned. The Alameda Street School has agreed to pay for this sidewalk construction, and we are now in the process of advertising for informal bids. However, before any work can be performed it will be necessary to appropriate funds for this project. It was recommended that Council appropriate $1,600.00 for this project. It was recommended that certain equipment as listed in Item 4 of the City Managers report which was formerly used by the Water Division, be declared surplus equipment. It was moved by Councilman Dunnum, seconded by Councilman Dickerson and so ordered that equipment which is now obsolete and beyond normal period of practical use be declared surplus and disposed of. Mr. Spindel recommended Council endorsement of the following legislation being proposed: SB 380 amending provisions of the Collier -Unruh Local Trans- portation Development Act, to clarify and simplify the administration of the 1� tax and liberalize matching fund provisions. AB 431 providing that maintenance cost of crossing protection at railroad grade crossings shall be borne entirely by the railroad, notwithstanding the fact that the local agency, such as the city, county, or state, has contributed to the construction, protecting the City from expenditures for maintenance on grade cross protection. Mr. Spindel reported there was a cross bill, AB 346 the opposite of AB 431 which would assign 50% of the cost of maintenance of grade crossing protection to either the cities or counties, set for hearing on April 14, 1965, before the Public Utilities Committee of the Senate Committee. It was recommended that Council oppose this bill and transmit a wire so advising of this action. AB 130, amending the existing bill concerning persons who tamper with wader mains or service connections was recommended to be endorsed. It was moved by Councilman Dunnum, seconded by Councilman Temple and so ordered to endorse AB 380, AB 431, AB 130 and oppose AB 346 as recommended by the Director of Publics. After discussion, it was moved by Councilman Dunnum, seconded by Councilman Temple and so ordered to approve the recommendation of the Planning Director that pre- liminary conditions for a zone exception, as prepared by the Planning Department, will be made available to anyone requesting this information, at 8:00 AM at the public counter on the day of the public hearing and not before; and the conditions are not available by telephone; are also tentative and not binding upon the Planning Commission which retains the authority to make changes by adding or deleting conditions at any time during the Planning Commission meeting. It was reported that the Board of Parking Place Commissioners have given thorough study of the present 50% requirement for parking in the downtown area and recommended a program making it permissive for property owners to pay $2,500.00 into the parking fund in lieu of each parking space they are unable to provide in their building program. Each parking space is based upon 500 square feet. It is the thinking of the Board that this will encourage the development of the downtown area and further enable a continued cooperative plan of off- street parking to serve the Parking District. The recommendation, it was reported, was confined to the Parking District. No action necessary at this time.
