Mayor Thomas H, Morton presiding. --- PRESENT: Councilmen: Dickerson, Temple, Corbin, Dunnum, Morton ALSO PRESENT: Royal M. Sorensen, City Attorney A. C. Gabriel, Director of Finance Sherman Griselle, Director of Planning Ervin Spindel, Director of Public Works LeGrande Leavitt, City Engineer Don Robison, Assistant to ".the City Manager and Deputy Director of Civil Defense Robert Gain, Fire Chief Ray Lake, Director of Building and Safety Ivan A. Robinson, Chief of Police Della Doyle, City Clerk Alberta Pfeiffer, Deputy City Clerk Reverend Claude W. Young of the Downey Methodist Church delivered the invocation. Students from the high schools within the City of Downey were intro- duced by Mayor Morton as part of the program for Youth Recognition Week sponsored by the Downey Rotary Club: Danny Lou Pflieder, Warren Richard Rowland, Downey Randy Mulley, Downey Jim Doroshow, Downey Mark McClary, Downey Guyla Maletta, Downey Bob Kurisu, Downey Charlotte Korneff, Downey Mayor Morton wished to recognize Fred Dodge who had served on the Citizens Fire Committee since its inception and had done a very fine job. Fire Chief Robert Gain stated it was a great privilege and a pleasure to have worked with Mr. Dodge and that his loyalty to the department and the City was outstanding. The Fire Chief assisted Mayor Morton in presenting a plaque of commendation to Mr. Fred Dodge. Mr. Dodge expressed his appreciation for the recognition and presenta- tion and stated that it was his pleasure to serve on the Fire Cotrmnittee. He thanked Council for their constant support of the various ideas from the committee and added that he feels the City of Downey has one of the best Fire Departments in the entire State of California. A member of the Board of the American Red Cross introduced Mrs. Schuyler P. Strang, President of the Downey District, who presented awards to Engine Co. #5 of Rancho Los Amigos and to Unit #1 for saving ' the life on January 30, 1965, of 18' =month old Paul St. Germain. The members of the units receiving the citations were introduced by Chief Gain`. Mayor Morton announced that the absence of the City Manager at the Council Meeting is due to his appearing before the Senate Subcommittee in Washington, D. C. for the purpose of establishing a heliport in the City of Downey. It was moved by Councilman Dunnum, seconded by Councilman Temple and passed by the following vote to approve necessary and reasojoble expenses for the City Manager's trip to Washington, D. C. Council Meeting - 3/ "8-/65 -1- AYES: 5 Councilmen: Dickerson, Temple, NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Corbin, Dunnum, Morton The Mayor announced that this is the time and place for the public hearing on the Debt Limit Report prepared pursuant to Division 4 of the Streets and Highways Code for the improvement of Margaret Street, AD #40. The Mayor inquired if the City Clerk had the affidavit of mailing. The City Clerk replied she had the affidavit. It was moved by Councilman Temple, seconded by Councilman Dunnum and so ordered that the affidavit of mailing for the public hearing on the Debt Limit Report for AD #40, Margaret Street, be received and filed. Mr. Ervin Spindel, Director of Public Works, presented and read the factual data report giving the total estimated amount to be assessed to the district as $96,659.76. With $40,000 being credited against dedication of the right of way by the majority of the members of the district, the net amount will be possibly somewhere between $57, and $60,000. The Mayor asked if there were any written protests to AD #40. The City Clerk replied she had received protests from the following persons: Rose Showalter Mrs, Nell V. McClellan, 9037 Margaret Street M. F. Smith - 10728 Pico Vista Road Bessie Morton, 11426 Lakewood Boulevard Samuel and Catherine Van Derhoef, 9048 E. Margaret Street Mayor Morton inquired if there were any oral protests or objections. There were none. It was moved by Councilman Corbin, seconded by Councilman Temple and so ordered that the hearing on the Debt Limit Report of AD #40, Margaret Street, be closed. RESOLUTION N0, 1524 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY MAKING FINDING OF FEASIBILITY OF ACQUISITION OF NECES- SARY RIGHT OF WAY AND THE CONSTRUCTION OF CURBS, GUTTERS, AND PAVEMENT IN ASSESSMENT DISTRICT NO. AD -40 (MARGARET STREET) It was moved by Councilman Corbin, seconded by Councilman Temple and so ordered that all protests received be overruled. The resolution was read by title only. It was moved by Councilman Corbin, seconded by Councilman Temple and so ordered that further reading be waived. It was moved by Councilman Corbin, seconded by Councilman Temple and passed by the following vote that Resolution No. 1524 be adopted. AYES: 5 Councilmen: Dickerson, Temple, Corbin, Dunnum, Morton NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None The Mayor stated the hour of 7:30 having come and gone, it is now the time for the hearing on the Resolution of Intention on Margaret Street, AD #40. The Mayor inquired if the City Clerk had the Affidavits of Publication, Posting and Mailing. The City Clerk replied she had the affidavits. It was moved by Councilman Temple, seconded by Councilman Dickerson and so ordered that the affidavits be received and filed. Council Minutes - 3/8/65 -2- 2252 The Mayor inquired if there were any protests received. The City Clerk replied there were five protests from the following persons: Rose Showalter Mrs. Nell V. The Director of Public Works submitted and read the factual report for AD #40, Margaret Street. It was moved by Councilman Temple, seconded by Councilman Dunnum and so ordered that the report be received and filed. There were no oral protests. It was moved by Councilman Dunnum, seconded by Councilman Dickerson and so ordered that the hearing on the Resolution of Intention for AD #40, Margaret Street, be closed. The Mayor requested the Director of Public Works to report on the matter contained in the protests, not relative to the assessment district improvements and amount of assessments itself, but relative to taking out of the sidewalks. The Public Works Director indicated the sidewalks would be reconstructed. It was moved by Councilman Temple, seconded by Councilman Corbin and so ordered to overrule all protests received on AD 440, Margaret Street. RESOLUTION NO. 1525 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING WORK TO BE DONE ON MARGARET STREET (AD -40) IN ACCORDANCE WITH RESOLUTION OF INTENTION NO. 1510 The resolution was read by title only. It was moved by Councilman Temple, seconded by Councilman Dickerson and so ordered that further reading be waived. It was moved by Councilman Corbin, seconded by Councilman Temple and passed by the following vote that Resolution No.1125 be adopted. Mr. Sherman Griselle, Director of Planning reviewed the zone exception Speaking in favor of Zone Exception #549 were: Leslie Olson, 10222 Tristan Drive, representing applicant John McMichael, 1018 E. Virginia, Fullerton (applicant) The Mayor inquired if there was anyone wishing to speak against the case. There was no one. Council Minutes - 3/8/65 -3- It was moved by Councilman Temple, seconded by Councilman Corbin and so ordered that the hearing on Zone Exception #549 be closed. The Mayor inquired of the Director of Planning if he was of the opinion the General Plan was in need of review at this time for this particular area in question in Zone Exception #549. The Director of Planning stated that he feels there has been no change in this area to warrant a review at this particular time, but that perhaps in the future, when it becomes apparent other areas may be in need of review, this could be included at that time. After discussion, it was moved by Councilman Corbin, seconded by Councilman Dickerson and passed by the following vote that the appeal to Zone Exception #549 be denied and the decision of the Planning Commission upheld. AYES: 5 Councilmen: Dickerson, Temple, Corbin, Dunnum, Morton NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Mayor Morton reported this is the time for the hearing on Zone Change Case #105 appealed, and he inquired of the City Clerk if she had the Affidavit of Publication. The City Clerk replied she had the affidavit. Mr. Griselle reviewed the case. Speaking for the appeal to Zone Change #105 was Vernon Blythe, 10911 Old River School Road. There was no one speaking against the appeal. It was moved by Councilman Temple, seconded by Councilman Dickerson and so ordered that the hearing on Zone Change #105 be closed. After discussion, it was moved by Councilman Dunnum, seconded by Councilman Dickerson that the appeal relative to the corners other than the northeast corner be deleted with consideration being given only to the one corner. The City Attorney advised that the appeal is pertaining only to the area shown in the application and in this case is the north side of Stewart and Gray Road only, and that Council has the authority to grant the zone change as requested or any portion thereof, and that Council cannot hear an appeal on any less area without acting upon it. Councilman Dickerson withdrew his second to the motion and Councilman Dunnum withdrew her motion. The City Attorney advised that the City Council can grant rezoning upon one portion of the property and take the balance under submission, if it so wishes, or it can affirm the decision of the Planning Commission. It was moved by Councilman Dunnum, seconded by Councilman Dickerson and passed by the following vote to deny the appeal on the northwest corner of Zone Change #105 on the basis that Mr. Blythe has no interest in that property. Mr. Ralph H. Woodmansee, applicant in the case, requested that Council review what he considered to be an unreasonable requirement for a 6' dedication for the public right of way on Everest Street. After discussion, it was moved by Councilman Dunnum, seconded by Councilman Corbin and passed by the following vote to grant Mr. Woodmansee's request for a 3' dedication instead of the 6' previously required in Lot Split #340, 12507 Dolan Avenue. It was moved by Councilman Temple, seconded by Councilman Dickerson and so ordered that the minutes of the Council Meeting of February 23, 1965, be approved as written. The City Clerk reported on the following correspondence: 1. February report from the Downey Chamber of Commerce was received and filed. 2. Lettersfrom Assemblymen Carley V. Porter and (3) George A. Willson in reply to requests from the City of Downey relative to legislation dealing with partisanship in local elections were received and filed. 4. Letter from Assemblyman George A. Willson in reply to the City's request for his consideration for continued Federal subsistence for helicopter service in the Los Angeles metropolitan area from Downey to the International Airport and other destinations was received and filed. 5. Letter from S. T. Ziler and Sons relative to a request for paveouts at Florence Avenue and Haledon Avenue. Mr. Spindel recommended that the City Council consider appropriation of sufficient funds for construction of pavement adjacent to the proposed curb and gutter construction, the estimated cost for Florence Avenue being $550.00; Haledon Avenue, $700.00. He reported that these ^streets, being on the Select System, are eligible for matching fund credit. It was moved by Councilman Corbin, seconded by Councilman Dunnum and passed by the following vote to authorize the following transfer of funds: $1,250 From Account No. 13789 to Account No. 13788 AYES: 5 Councilmen: Dickerson, Temple, Corbin, Dunnum, Morton NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None 6. Letter from United Towing Service, a new operation in the City. It was moved by Councilman Temple, seconded by Councilman Dickerson and so ordered that the letter be referred to the City Manager and Police Chief. 7, Letter from Supervisor Warren M. Dorn accompanied by a resolution adopted by the Los Angeles County Board of Supervisors, asking that President Johnson call a White House conference on air pollution control. It was moved by Councilman Corbin, seconded by Councilman Temple and so ordered to endorse Supervisor Dorns' request and inform him of the Council's action. 8. Mayor Morton reported on a letter which was sent to the Aviation Subcommittee of the Senate Committee on Commerce relative to the meeting on the helicopter being held in Washington, D.C. 9. Mayor Morton reported upon a request which was received from Mr. Howard Vleerick for an extension of 127 additional days to May 7. After discussion by Council, it was moved by Councilman Temple, seconded by Councilman Dunnum and passed by the following vote to grant the extension requested by Howard Vleerick to March 24, 1965, with a request to submit a report on the reasons for his request at the next Council Meeting. Council Minutes - 3/8/65 15- 2255 AYES: 5 Councilmen: Dickerson, Temple, Corbin, Dunnum, Morton NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None The Mayor reported receipt of a resolution from the City of Beverly Hills, relating to enactment of legislation authorizing a one per cent state telephone tax. It was moved by Councilman Temple, seconded by Councilman Dunnum and so ordered that a recap of tax revenues from utilities and reference of the above resolution to the Citizens Advisory Tax Committee. The City Attorney reported on a suggested amendment to the Public Utilities Code which would permit the sale by Lakewood of a portion of its water system to the City of Downey without advertising for bids. The City Attorney recommended that this legislation be submitted to the legislature and copies of the legislation be sent to Todd, Assemblymen Kennick, 44th District, Joe Gonsalves, 66th District, State Senator Rees, Carley V. Porter and George A. Willson, requesting that they do all they can to obtain passage of this legislation. It was moved by Councilman Corbin, seconded by Councilman Temple and so ordered that the legislation amending the Public Utilities Code as out- lined by the City Attorney be submitted to the legislature with copies going ALtf, J.611, n Todd, Assemblymen Kennick, Joe Gonsalves, Carley V. Porter, George A. Willson and Senator Rees, requesting they do all they can to obtain passage of the legislation. ORDINANCE NO. 262 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE DOWNEY MUNICIPAL CODE BY AMENDING SECTION 3186 RELATING TO RESTRICTED SPEED LIMITS AND RESCINDING SECTION 3186.5 The resolution was read by title only. .Karl Grahn, Business Manager for the Downey Unified School District, 11627 Brookshire Avenue, requested delaying the change of speed limits on streets adjacent to schools. The Chief of Police, Ivan Robinson, stated that speed limits will remain at 25 miles per hour for school zones. It was moved by Councilman Dunnum and seconded by Councilman Dickerson to delete the portion of the ordinance changing speed limits on Woodruff between Washburn Crossing Road and Imperial Highway. The Dirdctor of Public Works reported that each side of the edge of the school properties has a leeway for posting anywhere within a 500' limitation, and that it is planned to review all signing and speed limits for streets leading to schools. Councilman Dickerson withdrew his second to the motion above and Councilman Dunnum, the motion. The City Attorney advised that a separate action could be taken by the City Council to show the maximum area in a school zone which shall be posted beyond the limits of the school property Mr. Wendell Wiser, 11215 Woodruff Avenue, commended Council for the proposed ordinance covering speed limits within the City of Downey. He also requested that the City Council take action to provide use of parkways at railroad crossings for pedestrian walkways and enforcement of clearing of blind intersections with obstructing shrubbery, etc. Council Minutes - 3/8/65 -6- Mayor Morton directed the Director of Public Works to initiate a study relative to Mr. Wendell Wiser's request. Mr. Spindel reported a preliminary contact had been made with the Southern Pacific Railroad for dedication of the right of way at the location on Paramount Boulevard indicated in Mr. Wiser's request. It was moved by Councilman Temple, seconded by Councilman Dickerson and so ordered that further reading of Ordinance No. 262 be waived. It was moved by Councilman Dunnum, seconded by Councilman Temple and passed by the following vote that the contract for AD #73, Bixler Avenue, be awarded to Sully- Miller Contracting Company in the amount of the nnit prices submitted in the bid proposal and that all other bids be rejected. The resolution was read by title only. Mr. Spindel, Director of Public Works, reported that setting aside this portion of the Parking Lots is being recommended for right of way in order that sidewalks may be constructed within the public right of way. The City Attorney questioned the legality of this action. It was moved by Councilman Temple, seconded by Councilman Dunnum and so ordered to take the resolution under submission to be reported upon by the City Attorney after he has checked the legality of this procedure proposed. RESOLUTION NO. 1527 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DECLARING ITS INTENTION TO VACATE A PORTION OF DOWNEY AVENUE AT THE SOUTHEAST CORNER OF THE INTERSECTION OF DOWNEY AVENUE AND LEXINGTON ROAD The resolution was read by title only. It was moved by Councilman Temple, seconded by Councilman Dunnum and so ordered that further reading be waived. It was moved by Councilman Dunnum, seconded by Councilman Temple and passed by the following vote that Resolution No. 1527 be adopted setting hearing for 7:30 P.M., April 12, 1965, in the Council Chamber of the Downey City Hall. AYES: 5 Councilmen: Dickerson, Temple, Corbin, Dunnum, Morton NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None It was reported by the Director of Public Works that the property owner located at 8314 Lexington Road, which is at the southeast corner of Downey Avenue and Lexington Road, has agreed to dedicate the right of way at this corner, subject to the City's paying for the cost of clearing, grading, construction of curb, gutter, pavement and sidewalks, and reloca- tion of fence, and other improvements within the area to be dedicated. In order to avoid condemnation action and paying for the cost of land as well as a considerable severance costs it is recommended that the City Council accept the conditions of dedication as proposed by the property owner. Sufficient funds are available under the Downey Avenue Improvement Project to cover the cost of improvements as outlined by the Director of Public Works. Mr. Spindel was directed to submit a report on the costs actually involved in this transaction (SS Project #38, Downey Avenue). Mr. Spindel reported that it has been proposed to revert Tract #21.227 to acreage and develop the entire area as a single parcel, Thus, it becomes necessary to vacate the existing public right of way, retaining easements over areas where utilities now exist or where it is necessary to locate various utilities. Mayor Morton reported on the meetings attended regarding reapportionment and that the Council had not had an opportunity to discuss or evaluate the recommendation. He stated that the matter seems to be an entire state of flux. It is felt the area should be geographically defined. Council recom- mended that Councilmen Temple andMorton continue to work on the matter and bring back a report to the next Council Meeting along with a recommendation or alternate recommendation relat�ve to this matter of reapportionment. Mr. Irvin Phelan, member o� the Civic Development Committee, recommended that compiling of the history of Downey and its heritage be designated to deeply interested persons who would give it very serious attention and follow through with it. Chief Robinson commended members of Rotary A. C. Gabriel, Chairman of their Safety Committee, Ervin Spindel and Chief Robert Gain who cooperated with Officer Childers on a pamphlet on safe walking which will be distributed to school children.
