MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
FEBRUARY 8, 1965
The City Council of the City of Downey held a regular meeting in the
Council Chamber of the Downey City Hall at 7:30 P.M., February 8, 1965,
Mayor Thomas H. Morton presiding.

Reverend Al Johnson of the First Baptist Church delivered the invocation.
The Mayor announced the hour of 7:30 P.M. having come and gone, the public
hearing on Puritan Avenue,.AD #84, would be held at this time.,
The Mayor asked the City Clerk if she had the Affidavits of Mailing,
Publication and Posting. The City Clerk replied she had the affidavits.
It was moved by Councilman Temple, seconded by Councilman Dickerson and
so ordered that the affidavits be received and filed.
The City Clerk read a letter bf protest to AD #84 from Daniel J. Antonelli,
8240 Puritan Avenue.
There being no further written protests and no oral comments or objections,
it was moved by Councilman Temple, seconded by Councilman Dickerson and so
ordered that the hearing on Assessment District No. 84, Puritan Avenue, be closed.
It was moved by Councilman Corbin, seconded by Councilman Dickerson and
passed by the following vote that the protest to the assessment district be
overruled.

RESOLUTION NO. 1514
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
CONFIRMING THE ASSESSMENT FOR THE IMPROVEMENT OF PURITAN
AVENUE (AD #84)
It was moved by Councilman Corbin, seconded by Councilman Temple and
so ordered that further reading be waived. '
It was moved by Councilman Temple, seconded by Councilman Dickerson and
passed by the following vote that Resolution No. 1514 be adopted.

Mayor Morton announced at this time there would be a presentation of
commendation for community service to Paul Wilson, one of the outstanding
young men of the City of Downey, bringing world -wide recognition to his
school and to the City of Downey, in his position as pole vaulter, and his
coach Mr. Mitchell. Coach Mitchell was asked by the Mayor to give some of
the achievements of Paul Wilson.
Mr. Mitchell reported that Paul Wilson had broken a record which
existed for 7 years, and not only once, but 8 times; highest height was 16'
which Wilson broke in a group of about 15 men throughout the world who have
ever broken as a champion, and this feat was accomplished by Paul as a high
school junior. Paul Wilson defeated one man who was on the United States
Olympic team, took third in Los Angeles meet and again defeated a member of
world -wide vaulters.
The Mayor presented a plaque for his outstanding community service to
the national high school pole vault champion on behalf of the City Council,
with congratulations.
The Mayor then announced the time of 7:30 P.M. having come and gone,
the public hearing on Downey Improvement Project #502, Site 9A, Imperial
Highway, was to be held at this time. The City Clerk was asked if she had
the Affidavit of Posting. The City Clerk stated she had the affidavit.
Mr. Spindel reviewed the improvement project improvement which was
requested under Chapter 27 of the Improvement Act of 1911 of the Streets and
Highways Code of the State of California. Mr. Spindel reported that the
-property owner had requested matching funds and, although Chapter 27 pro-
ceedings had been introduced prior to the present property owners' acquiring
the property, matching funds were granted.
There being no oral comments or objections to the improvement project,
it was moved by Councilman Corbin, seconded by Councilman Temple and so ordered
that the hearing on Downey Improvement Project #502, Imperial Highway, be
closed.
It was moved by Councilman Temple, seconded by Councilman Corbin and
passed by the following Crote that the Director of Public Works be authorized
to proceed under Chapter 27 with improvements in Downey Improvement Project
#502, Imperial Highway.

The Mayor announced the time and place for the hearing on the appeal to
Zone Exception #542, W. M. Lehman, and inquired if the City Clerk had the
Affidavit of Publication. The City Clerk replied she had the affidavit.

The Director of Planning reviewed the case, stating there were to be
two apartment buildings, each containing 4 units and 12 automobile parking
spaces located on Downey Avenue on the west side of the Street at Alameda.
Eleven conditions had been placed on the zone exception as part of the
Planning Commission's approval. The applicant is appealing some of the
conditions, his major concern being the 11th condition added which con-
cerned entrance into the buildings.
Mr. Bill Lehman, 8615 Florence Avenue, applicant, present revised
plot plans and pictures of other apartment buildings located throughout
the City with similar entrances, with doorways and stairways opening
directly onto an 8' driveway. Mr. Lehman stated the added Item #11 was the
only item which he was appealing.
It was moved by Councilman Temple, seconded by Councilman Dickerson
and so ordered that the hearing on the appeal to Zone Exception #542 be
closed.
After discussion, it was moved by Councilman Dunnum, seconded by Council -
Maw.,Gb:rb!n and passed by the following vote to grant the appeal to Zone
Exception #542, W. H. Lehman, eliminating Condition #11, incorporating the
revised plan presented to Council with a 36" solid guide rail between
entrances and driveway; and that the matter be referred to the Planning
Commission for review of the revised plot plan and report to Council.

Councilman Temple suggested that the code be brought up to date as soon
as possible relative to entrances leading directly onto driveways.
The City Clerk reported on the following written correspondence:
1. Letter from Culver City urging opposition to AB # #334 (amendment to
Brown Act) accompanied by resolution adopted by them.
It was moved by Councilman Corbin, seconded by Councilman Dickerson and
so ordered that the City Attorney prepare a resolution similar to the one
adopted by Culver City.
2. January report from Downey Chamber of Commerce. Ordered received and
filed.
3. November and December 1964 Financial Report from Downey Art Museum.
Ordered received and filed.
4. Letter from Kermit M. Bill, Director of the Southern California
Rapid Transit District, reporting on the tax base backup for Rapid Transit.
It was moved by Councilman Dickerson, seconded by Councilman Temple and
so ordered that the matter be taken under submission for study and that the
City Manager bring a report and recommendation to Council.
5. Letter of appeal from Mr. Ralph H. Woodmansee to Lot Split #340,
12507 Dolan Avenue.
It was moved by Councilman Dunnum, seconded by Councilman Corbin and
so ordered to set a public hearing on the appeal to Lot Split #340, to be
held at 7:30 P.M., March 8, 1965, in the Council Chamber of the Downey City
Hall.
6. Claim for damages for Herbert E. Workman.
It was moved by Councilman Temple, seconded by Councilman Dickerson and
so ordered that the claim of Mr. Workman be denied and referred to the City's
insurance carrier.

7. A petition from property owners. on Phlox Street for street improve-
ments for rolled curbs, gutters and paving.
It was moved by Councilman Temple, seconded by Councilman Dickerson and
so ordered that the Director of Public Works be authorized to proceed with a
study of the area to see what might be done to solve the problem in the Phlox
Street area.
8. A letter from Bruce Moore, Downey Unified School District, offering
Site #8 for sale to the City of Downey.
Councilman Dunnum brought Council up to date on this matter.
It was then moved by Councilman Dunnum and seconded by Councilman Temple
that a letter be directed to the Downey Unified School District, advising
that the City Council would be interested in having an opportunity to consider
the matter in the event the Park and Recreation District rejects the offer to
buy Site #8; authorize the Director of Finance to make a study and be pre-
pared to make recommendations relative to financing such a purchase, prefaced
on the condition that the Downey Recreation and Park District does not elect
to purchase this site.
Noyes Alexander, 10505 Arrington, Downey, Park Board member, advised
that the Board voted 3 to 1 to reject the offer to buy Site #8 from the
Downey Unified School District.
Mr. Lloyd Stromberg, 9515 Lubec, Downey, of the Unified School District,
advised Council that the City will be given until March 1 to make its decision
regarding purchase of Site #8.
Milton Curshbaum, 12925 Sandy Lane inquired to what use the City would
put Site 8, should it be purchased by the City.
Councilman Corbin stated the City intends to reserve the site for recrea-
tional. purposes.

9. Letter from Downey Savings and Loan Association praising the Downey
Police Department on its guide to robbery prevention booklet.
It was moved by Councilman Corbin, seconded by Councilman Temple and
so ordered to approve the minutes of the Council Meeting of January 26, 1965,
as written.
Mayor Morton reported on additional, correspondence received in his office
too late to be included on the agenda.
1. A report and recommendation from the Los Angeles County Division of
the League of California Cities relative to health license fees.
2. A note in connection with Mrs. Mathilda Hagen, thanking the City
Council for honoring her on her 99th birthday.
3. Letter from City of Hawthorne urging opposition to amalgamation of
Independent Cities along with Contract Cities. The letter was ordered re-
ceived and copies to be distributed to each councilman for analysis.
4. A letter from the City of Hawthorne stating they had adopted a
resolution urging ballot voting at the United States Conference of Mayors.

5. Notice of Independent Cities Meeting on February 17. (Councilman
Dunnum will attend as representative from City of Downey,
6. Paramount Chamber of Commerce inviting the Mayor to attend and
participate in their 4th annual Flag Parade, February 20, at 1:00 P.M.,
paying tribute to the Flag and Country. (Estimated attendance, 35,000.)
The Mayor would represent the City of Downey at this parade.
7. Invitation from the City of Bellflower to the City Council and
Department Heads to be guests in honorpng the banks of Bellflower, Thursday,
February 18, at the opening of the National Bank of Bellflower. Also stated
in the letter was that the week was being set aside as Bank Week. Those
who will be able to participate are to notify the City Manager who, in turn,
will advise the City of Bellflower.
8. Invitation from the City of Pico Rivera to attend the 3rd Community
Annual Development Conference, Saturday, April 3.
9. A request from Southern California Rapid Transit District, request-
ing a mutually convenient time for meeting. Councilman Corbin was asked to
be the spokesman from this area.
10. The City Clerk was asked to read a communication from the City of
Lynwood, signed by Mayor McMillan, in appreciation of the oustanding work
performed by the Downey Fire Department on Sunday, January 31, 1965, in
combating a fire at Western Gear Corp.
11. A communication from the City of South Gate transmitting a resolution
in opposition to a merger of Independent and Contract Cities within the
framework of the League of California Cities. Ordered received.and filed.
ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AMENDING THE DOWNEY MUNICIPAL CODE BY AMENDING SECTION
3186 RELATING TO RESTRICTED SPEED LIMITS AND REPEALING
SECTION 3186.5
The ordinance was read by title only. Councilman Temple requested
deletion of changing of speed limits on Rives Avenue until sidewalks are
installed.
Councilman Corbin called attention to the many changes and variances of
speed limits along Florence Avenue, from city limits to city limits and felt
a uniform speed limit to be more practical.
It was moved by Councilman Temple that sections e, f, g, h, i, and q
be deleted from the ordinance for further study.
The City Attorney advised that since the ordinance amends certain
section of the municipal code and repeals certain section, certain areas
Involved in the proposed deletions, might omit entirely certain desired areas.
He advised that the entire ordinance be revised prior to introduction.
Councilman Temple therefore withdrew his motion and the matter was
referred to the Director of Public Works and the Traffic Engineer.

Specifications for Select System Project No. 86, Unit #2, Telegraph Road,
Rio Hondo Channel to Lowman Avenue, and authorize advertising for bids.

It was moved by Councilman Dunnum, seconded by Councilman Corbin
and passed by the following vote to accept the offer of the property owner at
12112 Woodruff Avenue for the amount of the appraisal for his right of way
and to authorize the Department of Public Works to proceed with the necessary
improvements in Select Systems Project No. 89, paying the difference between
the construction cost and the cost of the right of way to the property owner.
(This project is budgeted from Gas Tax Funds.)

The Director of Public Works reported that the bid price on Cash
Contract No. 137, Parking Lot at the Old Post Office site, was $11,517.509
final construction cost as a result of actual work completed amounted to
$11,545.05, the primary difference being the poor subgrade materials en-
countered and the necessity to require the contractor to excavate below the
normal grade in order to properly construct the parking area. In addition,
the contractor has requested additional compensation for extra heavy,rein-
forced concrete encountered in the subgrade area. The contractor has
requested an additional compensation of $89.70 because of the unforeseen
concrete removal required under the contract.

tractor in the amount of $89.70 as compensation for additional work for
Cash Contract #137, parking lot at old post office site, and accept com-
pletion.

It was moved by Councilman Dickerson, seconded by Councilman Temple

Mayor Morton requested the City Attorney to submit his report on
Downey Improvement Project #523, southwest corner of Orizaba Avenue and
Stewart and Gray Road; however, Councilman Dunnum stated she believed
the matter had been resolved inasmuch as Mr. Roger LeClaire's hardship,
about which he had spoken at a recent Council Meeting, had been resolved
and he is now ready to have the City proceed under Chapter 27 for instal-
lation of improvements.
Roger LeClaire, 7640 Brunache, stated there is no longer a hardship
to him and that he is ready to proceed with the improvements required
under Chapter 27.
The Mayor requested that Mr. LeClaire submit a letter to this effect.
The Director of Public Works was requested to proceed under Chapter 27
to install improvements adjacent to 8142 Stewart and Gray Road ( Orizaba
Avenue frontage).
Robert M. York, 11923 Orizaba Avenue, stated he is very happy to hear
the report on Downey Improvement Project #523 and inquired how soon such
improvements may begin.
Mr. Spindel stated bids will be advertised immediately and construction
may begin in approximately two weeks.
It was moved by Councilman Temple, seconded by Councilman Dickerson
and passed by the following vote to authorize the Director of Public Works
to proceed with Chapter 27 adjacent to 8142 Stewart and Gray Road, and
authorize advertising for bids.
It was reported by the Director of Public Works that in order that
drainage of the area of Old River School Road and Nada Street can be com-
pleted properly, it is necessary that a cross gutter spandrel be constructed
at the intersection of Old River School Road and Nada Street. Since Old
River School Road is on the Select System of Streets, and since the cost of
cross gutter spandrel is of general importance to all the owners on the
street, it was recommended that the City Council consider appropriation of
$300 for the proposed improvement. (Select System Project No. 98)

passed by the following vote to accept improvements completed on Paramount
Boulevard northerly of Brunache Street under Downey Private Contract #41,
sewers on the east side of Paramount Boulevard, and responsibility for
maintenance thereof.

Downey Private Contract No. 45, Ryerson Avenue north of Pellet Street for
sewers, and cost apportioning when adjacent property connects with the
newly constructed sewers, and accept responsibility of maintenance thereof.

The Director of Public Works reported that the owner at 9440 Gallatin
Road was required under a lot split to construct curb, gutter, paving and
sidewalks adjacent to his property; however, in order that this construction
can be completed and that it will function properly from the standpoint of
drainage, it is necessary to grade several hundred feet easterly of this
property at an excessive cost to the property owner.
Since the cost for the grading beyond the subject property involves
considerable amount of work, and since this grading benefits other prop-
erties along this street, it is recommended thatthe City Council authorize
City forces to perform the necessary grading or reconstruction, as necessary,
beyond the limits of this property.
After discussion, it was moved by Councilman Dickerson that the matter
be taken under submission for further negotiation with the property owner.
The motion died for lack of a second.
It was moved by Councilman Corbin, seconded by Councilman Dickerson
and passed by the following vote to proceed with city forces to improve
9440 Gallatin Road westerly of Downey- Sanford Bridge Road to assist in the
grading for drainage easterly for this property.

The Director of Public Works reported that the property owner at
9823 Sanford - Bridge Road has requested city contribution in connection
with improvement to his property. Right of way was dedicated and permit
taken out for construction of curb and gutter; however, in order that this
improvement can be drained properly, it is necessary to construct a cross
gutter across Downey = Danford Bridge Road. The construction of such improve-
ments is beyond the normal requirements for an individual property owner
and benefits other properties along the street. Since this improvement is
beyond the limits of this particular property, the cost being excessive and
beneficial to other properties, it was recommended that City Council
appropriate $900 from Account No. 13789, Miscellaneous unbudgeted to Account
No. 13788, Miscellaneous Paveouts for construction of cement concrete
gutter and incidental work adjacent to 9823 Sanford - Bridge Road.

Mr. Spindel reported that Cash Contract #133, slurry seal project on
various streets within the City, was terminated before the actual completion
of all the streets outlined in the contract,, the termination being because
the contractor was unable to complete the work in the manner as outlined by
the contract specifications: many streets were posted as many as 4 different
times but the contractor was unable to perform the work as scheduled due to
improper functioning of his equipment; quality of workmanship in many
instances was not acceptable; proportion of materials as required by specifi-
cations was not met in many instances. Mr. Spindel recommended that no
further contracts be awarded to this contractor, Slurry Seal of 4353 Heather
Road, that $1,000 be withheld from the total amount of $7,460.02 due the
contractor to cover cost of repairing these portions of the streets upon
which slurry seal was not acceptably applied.
The City Attorney advised that a blanket refusal to award bids to this
contractor cannot be specified but that the council certainly could be put
on notice at the time of advertising for bids.

passed by the following vote to assess liquidated damages against the con-
tractor for Cash Contract #113, Slurry Seal, in the amount of $1,000.

Mayor Morton announced that the City Attorney had an item to be
presented Council at this time dealing with the hospital lease.
The City Attorney stated a proposed hospital lease had been submitted
to Council and changes were subsequently suggested. A final draft which is
agreeable to the attorney for the Downey Community Hospital Foundation is
now ready to be executed. The lease, he reported, is minus only "Exhibit A"
which sets forth the personnel and the date of execution.
It was moved by Councilman Dunnum, seconded by Councilman Temple and
discussion followed that the Mayor be authorized to execute the lease on
behalf of the City of Downey, with the Downey Community Hospital Foundation
and attach "Exhibit A" when completed.
Reverend Rodney V. Cogswell, President of the Board of Trustegs of the
Downey Community Hospital Foundation reported that the Board had authorized
the president and secretary to sign the lease at such time as the City
Council approved it.

Mr. Ron Stone, United States National Bank commended the Police
Department on their guide booklet on burglary prevention, and thanked
Chief Robinson, Lt. Childress and Officer Smith for allowing them to be
a part of the booklet prepared.
Chief Robinson stated he hopes the booklet helps in some way to
prevent loss to businessmen and prevention of burglary.
The Mayor dispensed with the City Manager's report at this time and
declared the meeting open to any discussion by the citizens.
Phil Ortiz, 12432 Parrot Avenue, Downey, requested that the City
Council reconsider the hospital site. After Mr. Ortiz' comments the Mayor
asked if there was anyone else who wished to speak on this subject. Hearing
none, he then recognized Mr. York on another subject.

Mr. Robert York, 11923 Orizaba Street, Downey, requested that all
property owners be notified in Downey improvements under Chapter 27 proceed-
ings.
It was moved by Councilman Temple, seconded by CouncilmaDickerson aand
so ordered to notify property owners involved in Chapter 27 projects
matter of policy and to authorize the Director of Public Works to report on
this matter.
The City Attorney advised that definite lines should be established
in order to know which procedures to follow in such notification of
property owners to be included in Chapter 27 proceedings. He stated also
that failure on the part of the Director of Public Works to send such
notice would not invalidate any such proceedings.
The Mayor stated that the City representative (Mayor) and Downey Com-
munity Hospital Foundation President and Secretary will sign the hospital
lease tonight.
The City Manager reported ttat the Division of Highways has awarded
contract for sign modification and new directional signs on the Santa Ana
Freeway to the firm of Steiny & Mitchel, Inc. on February 1. The proposed
new signs will have much more direction to Downey on the outbound Freeway
than exists now. More detailed information on this matter may be obtained
from the Director of Public Works.
The City Manager reported that in a combined effort to alleviate
problems relative to property acquisition on Brookshire from Alameda to
Eucalyptus, it is believed that shifting the center line of the street five
feet to the east would result in a benefit to all concerned.

Public Works.

The Mayor declared a 5- minute recess for signing of the Hospital Lease
with Council. (The signing of the hospital lease by the Mayor and Council
and President and Secretary of the Downey Community Hospital Foundation was
witnessed by all present and pictures taken.)
The City Council reconvened at 10:25 P.M. with roll call, all Council
members being present.
The City Manager reported that as the result of a savings to the City
realized from the award of work for remodeling of the Council Chambers, the
Public Works Department has requested the contractor to submit quotations
for additional work which would be desirable to perform at this time. The
work was considered when preparing the original drawing but it was felt
that the funds available would not be sufficient to cover it. The quotations
have.been submitted for the City Council's consideration so that the entire
Council Chamber will be in first class condition for use, rather than spotty
improvements here and there.

The City Manager reported that a traffic engineer has been recruited,
Mr. A. Glenn Smoot from Reno, Nevada.
A memorandum from the Civic Development Committee relative to a study
for feasibility of construction of a civic auditorium on school property
with long -term lease arrangements was submitted to Council. The matter was
referred to Councilman Corbin as chairman of the ad hoc Civic City Develop-
ment Committee and to Councilman Dunnum, Chairman of the ad hoc Recreation
Facilities Committee.
It was moved by Councilman Dickerson, seconded by Councilman Temple and
so ordered to authorize a study of the feasibility of construction of a civic
auditorium.
Mayor Morton asked Councilman Dunnum to spearhead the study on the Civic
Auditorium.
It was moved by Councilman Temple, seconded by Councilman Dickerson and
so ordered that a letter be directed to the Downey Unified School District
and, if they are interested, to meet with them at some future time to discuss
the City's interest in negotiating with the School District for property north
of the City Hall should the School District care to dispose of it.
Councilman Corbin appointed Alice Wisbar to the Civic Development
Committee.
The City Manager submitted to council a report relative to a study on
the matter of reapportionment (senatorial).
The City Manager submitted to council a proposal for the Annual Report
and requested approval and authority to advertise for quotations.
