MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
DECEMBER 14TH, 1964
The City Council of the City of Downey held a regular meeting in the
Council Chamber of the Downey City Hall at 7:30 P.M., December 14, 1964,
Mayor Thomas H. Morton presiding.

Reverend John T. Chase of the First Christian Church delivered the
invocation.
Captain Ralph Hamilton of the Downey Fire Department, assisted by
Mrs. Scott Temple, Chairman of the Women's Civil Defense Council, presented
red cross certificates to 27 persons recently completing a course in first
aid. Mayor Morton thanked Captain Hamilton on behalf of Council for helping
out in this program.
Councilman Dunnum arrived at the Council Meeting at 7:40 P.M.
Mayor Morton announced that this is the time and place set for the
hearing on Planning Resolution No. 90, Zone Change #102 (Paul Yokota).
Mr. Griselle, Director of Planning, reviewed the matter, stating that at the
request of Mr. Paul Yokota, the hearing on Zone Change #102 had been con-
tinued as he might want to withdraw the application. The continuance was to
give him time to discuss the matter with the Planning Department before mak-
ing a decision.
After discussing the matter with the Director of Planning, he stated he
wished the zone change to go through as recommended by the Planning Depart-
and Planning Commission, who have recommended that the Stewart and Gray
frontage be rezoned to an R3 zone with a 46' P zone behind, and the rear
portion of the property to remain in an R1 -5000 single family residence zone.
This recommendation conforms with the General Plan and creates a compatible
and uniform development with properties to the east. It was therefore rec-
ommended that the City Council approve the rezoning as recommended by the
Planning Commission in Planning Resolution #90.
Mr. Paul Yokota, 7107 Stewart and Gray Road, stated he is willing to
abide by the Planning Commission's recommendations.

so ordered that the hearing on Zone iChange #102, Planning Resolution #90,
be closed.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AMENDING THE ZONING MAP ADOPTED BY SECTION 9107 OF THE
DOWNEY MUNICIPAL CODE (PLANNING RESOLUTION NO. 90,
ZONE CHANGE CASE #102)
The ordinance was read by title only. It was moved by Councilman
Temple, seconded by Councilman Dickerson and so ordered that furtherreading
be waived.
It was moved by Councilman Temple, seconded by Councilman Dickerson
and passed by the following vote that it is the finding of Council that the
evidence presented meets the findings required by Section 9129.2 of the
Downey Municipal Code.

The Mayor announced the hearing on the Abandonment of Areas 1 and 3,
Zone 4 of the Downey City Lighting District and inquired if the City Clerk
had the Affidavit of Publication. The City Clerk replied she had the
affidavit.
Mr. Spindel presented his report, stating the only payments in the
future will be for the energy,and the maintenance costs. There are no
lights eliminated and the cost for operation will be cut.
There were no written and no oral comments, or protests, so it was
moved by Councilman Corbin, seconded by Councilman Temple and so ordered
to close the hearing on the abandonment of Areas 1 and 3 of Zone 4 of the
Downey City Lighting District.
RESOLUTION NO. 1490
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ORDERING THE ABANDONMENT OF AREAS ONE AND THREE OF ZONE
FOUR OF THE DOWNEY CITY LIGHTING DISTRICT
The resolution was read by title only.- It was moved by Councilman
Corbin, seconded by Councilman Temple and o ordered that further reading
be waived.

and passed by the following vote that Resolution No. 1490 be adopted.

The Mayor announced the time and place for the hearing on the annexation
of Areas 1 and 3, Zone 4 to the Downey City Lighting District and asked the
City Clerk if she had the Affidavit of Publication, which she stated she did
have.
Mr. Spindel reported that now that Areas 1 and 3 of Zone 4 have been
abandoned, they must be annexed to Zone 1 pf the Downey City Lighting
District, for maintenance of the lights.

There being no written and no oral comments or protests, it was moved
by Councilman Temple, seconded by Councilman Dickerson and so ordered that
the hearing on the annexation of Areas l and 3 of Zone 4 to the Downey City

RESOLUTION NO. 1491
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ORDERING ANNEXATION OF CERTAIN AREAS TO THE DOWNEY CITY
LIGHTING DISTRICT AND TO MAINTAIN AND FURNISH ELECTRICAL
CURRENT TO THOSE STREET LIGHTING FIXTURES LOCATED ON THE
STREETS AND PUBLIC PLACES WITH THOSE AREAS UNTIL JANUARY
31, 1983 (ANNEXATION B,— ZONE 1)

The Mayor announced the time and place for holding the hearing on the
appeal of Mr. Robert F. Durkee to Zone Exception Case #521, 8565 Everest
Street.
Mr. Griselle presented a resume of the case, stating he was appealing
the condition requiring sidewalks and dedication on Eve °tt st Street.
The Mayor asked the City Clerk if she had the Affidavit of Publication.
The City Clerk replied she had the affidavit.
The Mayor asked if there was any written comment or protest. The City
Clerk replied there was none.
Mr. Robert F. Durkee, appellant and owner of 8563 and 8565 Everest
Street, spoke in ,favor of the appeal.
Also speaking in favor of the appeal were the following persons:

It was moved by.Councilman Temple, seconded by Councilman Corbin and
so ordered that the hearing be closed on the appeal to Zone Exception Case
# 521.
As Mrs. Sarah Arentz wanted to make some additional comments relative
to this matter, it was moved by Councilman Dunnum, seconded by Councilman
Dickerson and so ordered that the hearing -be. reopened.

Mrs. Arentz then stated if the sidewalks were installed, she would prefer
that they be put at the curbline. Mr. Bill Beach, 8555 Everest St. also spoke
again favoring the appeal and requesting that the sidewalks be installed at
the curbline.
It was moved by Councilman Temple, seconded by,Councilman Dickerson and
so ordered that the hearing be closed.
It was moved by Councilman Dunnum, seconded by Councilman Corbin and
passed by the following vote that Zone Exception #521 be granted with the
condition of 5' of dedication being deleted, that MV sidewalks be
put in next to the curb and that the sidewalks need not be installed until
50% of the property owners are obligated to put in the sidewalks, being'con-
ditioned upon the matter's being referred back to the Planning Commission for
a report.

to hear any protests on the construction of curb and
9424 Firestone Boulevard.
There were no written and no oral protests to Downey Improvement Project
#521, so it was moved by Councilman Temple, seconded by Councilman Dickerson
and so ordered that the hearing be closed.
It was moved by Councilman Temple, seconded by Councilman Corbin and
passed by the following vote to dirertthe Director of Public Works to proceed
with improvements in accordance with Chapter 27 in Downey Improvement Project
#521, 9418 and 9424 Firestone Boulevard.

Mayor Morton announced the time for the hearing on Downey Improvement
Project #522 for construction of curb and gutter and driveway approaches at
9041 -49 Unperial Highway under Chapter 27.
Mr. Spindel, Director of Public Works, reported that the driveway
approaches were to be deferred for one year.
There were no oral and no written comments. It was moved by Councilman
Temple, seconded by Councilman Corbin and so ordered that fhe':hearing "be; closed
on'.Downey Improvement Project #522.
It was moved by Councilman Corbin, seconded by Councilman Dickerson and
passed by the following vote.to- authorize the Department of Public Works to
proceed under Chapter 27 for construction of curb and gutter for Downey
Improvement Project #522.

It was moved by Councilman Temple, seconded by Councilman Corbin and
so ordered that the minutes of November 24, 1964, be approved as submitted.
The City Clerk reported on the following correspondence:
1. A claim for injuries from Mrs. Lucille T. Hoskins. It was moved
by Councilman Corbin, seconded by Councilman Temple and so ordered that the
claim be denied and referred to the insurance carrier.
2. A monthly report from the Downey Chaipberof Commerce. Ordered re-
ceived and filed.
3. A letter of commendation from former_ councilman, Hollis Peavey,
relative to the new City Charter which was recently approved by the voters.
It was requested that the City Clerk read the letter in.full. Ordered re-
ceived and filed.
4. A letter from Mr. & Mrs. Roland R. Boege, 9312 Samoline Avenue,
resolution from the Downey Republican Women Federation, Youth Advisory
Committee, Coordinating Committee, Petition with 7 signatures, two letters from
A. C. Lundberg, relatitve to.sngpression of indecent and pornographic liter-
ature.
Mrs. Nellie Horner, President of the Coordinating Council, commended the
various groups working on this problem, such as the PTA, ministerial groups,
civic and service clubs, and the Junior Woman's_ Club, the last being the group
which had originally brought the matter to the attention of the Downey Coordi-
nating Council.
Mrs. Nellie Horner then presented Mr. Mike Hajjar, Chairman of the
Citizens for Decent Literature Committee.
Mike Hajjar, 9447 Buell Street, Downey, presented a resume of the circum-
stances leading up to the present drive against indecent and pornographic
literature available on the local newsstands. He submitted to Council, books
as samples of the types available and a petition bearing approximately 4,000
signatures.
Mayor Morton commended Mike Hajjar for doing such a thorough job in
making the presentation and stated that the City Council shares his sentiments.
Mrs. Willard Merrill, 7834 6th Street, of the Republican Women's
Federation, read the resolution presented Council by them to,go on record as
applauding the action.taken by,the Police.Chief to stop the sale of smut and
requesting the City Council to assist the effort with all means at its
command.

their wholehearted support, as follows:

Councilman Dunnum commended the individual_ groups and thanked them for
letting Council know their views.
Mrs. B. Axton wished to state that it was Don Robison who had started
the movement against indecent literature when he was president of the
Downey _Coordinating Council, and Councillman Dickerson who had followed it
through when he was serving on that committee.

Councilmen stated they were appreciative of the citizens' interest in
coming to Council and meeting to work out a problem together.
Councilman Corbin stated he would like for the City Attorney to be
instructed to formulate the strongest ordinance possible.
The City Attorney advised that any local legislation would be deemed
to be contrary or as being preempted in the field by state legislation.
The Mayor stated that one cannot legislate morality into the hearts
of people. He stated that he is proud of the citizens who have come to
the meeting to express their views. The burden is upon the adults of the
City to lead out and do their utmost to carry out the dictates of those who
have expressed themselves.
It was moved by Councilman Temple, seconded by Councilman Dickerson
and so ordered to authorize the Mayor to designate a committee of two from
the City Council to see what can be done to combat the problem and that
they work with the Police Chief, City Attorney and Chairman of the Youth
Advisory Committee.
Chief Robinson pledged all necessary enforcement action to his ability
to give and that the courts interpret it. He stated he feels there should be
a special agency in the District Attorney's Office. He hopes to assign
another detective to work with the detective assigned to narcotics in order
to have a special detail working on that and pornographic literature.
Chief Robinson stated that this is about the proudest night he has had.
The Mayor introduced Don Wilson, Chairman of the Youth Advisory Committee
which has been formed primarily to help young citizens find themselves for
good citizenship.
Don Wilson stated that they would like to know problem areas and that the
Cor�amittee has compiled questionnaires for the purpose of finding out as much
as possible for this program.
It was moved by Councilman Dickerson, seconded by Councilman Temple and
passed by the following vote to approve the recommendations of Don Wilson as
contained in his letter submitted to Council.

The Mayor declared a ten - minute recess at this time with Council recon-
vening at 9:15 P.M. with roll call, all members of Council being present.
The City Clerk continued with the correspondence as follows:
A letter from the Los Angeles County Democratic Central Committee relative
to objections by them to the choice of the design for the City of Downey's
entry in the Tournament of Roses. Mayor Morton asked if there was anyone in
the audience wishing to speak relative to this communication. No one came
forward. After stating the question several times, with no one coming forth,
it was moved by Councilman Temple, seconded by Councilman Dickerson and
so ordered that the letter be received and filed and the matter closed.
5. A notice from the American Municipal Association of the change in the
name to "National League of Cities" and change in amending or repealing the
constitution of the-group. Ordered received and filed.
6. Resolution from the City of Hawthorne urging that provisions be made
for ballot voting at the annual United States Conference of Mayors. The City
Attorney was requested to prepare a similar resolution.

7. .Letter from Olson Surveying Service, Inc., relative to Tract 28456
requirements. Mr. Spindel, Director of Public Works, respectfully requested
that the matter be referred_to the Subdivision Committee.
It was moved by Councilman Temple,,seconded by Councilman Corbin and so
ordered that the letter relative to requirements for Tract 28456 from the
Olson Surveying Service, Inc. be referred.to the Subdivision Committee.
8. A letter of appeal to Zone Exception #6538, from Leslie V..Olson for
property at 10620 Parrot Avenue, accompanied by-$50 deposit.
It was moved by Councilman Temple, seconded by Councilman Dunnum and
so ordered to set a public hearing for 7:30 P.M., January 11, 1965, in the
Council Chamber of the Downey City Hall on the appeal to Zone Exception Case
#6538,
The Mayor read a letter from the State of California Justice Commission
of Peace Officers stating that every eligible officer in the Downey Police
Force has applied and received the award and that Downey is the first city
in which all members of the police force in the state have achieved this
goal. He congratulated the Police Chief and his staff. Chief Robinson
stated that the next step is to certify all the supervising officers.

and approve transfer of $5,000 from the contingency fund as budgeted from
State Gas Section 2107 fund money.

Mr. King requested that Council authorize the Chrysler Corporation

It was moved by Councilman Corbin, seconded by Councilman Temple and
so ordered to send a letter of appreciation to Mr. Ned Young, Realtor,
9435 Firestone Boulevard, for donation of auditorium chairs to the City which
chairs have been placed throughout various areas in the City Hall and the
Council Chamber.
Since October 12, 1964, the Fire Department has been working short one
authorized Fire Captain due to the incapacity of Captain William Babbitt,
who suffered a heart attack on that date while on duty, according to the
City Manager's Report. Although Capt. Babbitt is recovering nicely, it is
possible that he will desire to retire rather than return to work after his
recovery.
His loss seriously hampers fire company activities, including training,
district inspections and the necessary direct line supervision of the fire
company under emergency conditions. It was therefore requested that Council
authorize the replacement of Capt. Babbitt from the existing Fire Captain
promotional list through the elevation of another qualified member to fulfill
his position for such time as the vacancy exists. If Capt. Babbitt returns
to work, his replacement will be returned to his previous position. No ap-
propriation of funds is necessary and members of the Personnel Board concur
in this recommendation.

The City Manager reported the Personnel Advisory Board is recommending
for the 1965 salary survey, the inclusion of the use of 12 chartered cities
within the population group of 73,000 to 138,000 as a basis for salaries,
fringe benefits and working conditions in comparison to be used in the
1965 -66 salary survey. Los Angeles County and the City of Long Beach would
be noted for comparison purposes only and not for averages. Councilman
Dunnum suggested that the cities of Huntington Park and South Gate be
included in the survey with the chartered cities. It was so ordered.
It was also reported by the City Manager that in compliance with the
request from the Downey City Employees Association, the Personnel Advisory
Board recommended that permission be obtained to secure a summary of
benefits and related costs of survivorship benefits under the State Retire-
ment System for those employees who did not elect Social Security coverage.
It was so ordered.
It was reported by the City Manager that in order to set up IBM data
processing equipment for use in water billong, payroll,, Accounts Receivable
and Payable, budgetary accounting and reporting and Public Works job costing,
it will entail a contractual agreement with the IBM Company for a rental fee
of $1201 per month. Paper and supplies are purchased separately by the City
upon a competitive basis. There is an amount of $10,000 included in the cur-
rent budget of the Finance Department for this purpose. If these procedures
and contractual agreements are approved by the Council, approximately three
months' rental would be paid this current fiscal year out of the ten thousand
dollar allocation.
Inst4llation of this equipment is estimated to save approximately $61,500
in salaries and replacement of existing accounting equipment, as well as a more
efficient and current overall bookkeeping, accounting and reporting system. To
effect these savings, it is necessary to ask for approval to consolidate the
Accounting Division, presently located in the City Hall, into the Water Division
office for more effective and efficient use of personnel, equipment and office
space.

agreements necessary to set up the operation of the IBM data processing system, and

Mayor Morton read a letter from Ni-.' George Agnesi announcing that their
Red Cross Queen would be the princess to ride on the Downey Rose Float with
the Downey girls in the rose parade and that photographs were being submitted.

had been translated into Spanish. The letter was referred to the Sister City
Committee for proper handling and coordination between them and the visitors
from Guadalajara during the Tournament of Roses Pageant.

It was reported by Fire Chief Robert W. Gain that the resignation of
Wesley Short, Fire Prevention Battalion Chief-, will become effective January 2,

H. 0. Van Petten, 10218 Lesterford, spoke in protest to the Downey Rose
Float.
Stephen Santangelo, 10045 Chaney, brought a report from the President
of the Tournament of Roses stating that the float was most acceptable and
that he also approves the Downey Rose Float, and he complimented the Rose
Float Association very highly.

Frank Perez, 9227 Card, requested that a letter of commendation and
thanks be directed to Dr. Arnold O'Toole, Chairman of the Rose Float
Association, for the work he has done sofar.
Phil Ortiz, 12432 Parrot Ave., Downey, inquired if the City intends
to clean the lot adjacent to his property which had been disced during
the weed abatement program. He was informed'by the Director of Public
Works that it would be taken care of in due time.
Harry Garo, 7738 Allengrove Street, stated as a point of information
he would like to know if any definition had been arrived at as to just
what is meant by decent literature.
