I .� MINUTES OF THE CITY COUNCIL OF THE CITY OF DOWNEY NOVEMBER 9TH, 1964 The City Council of the City of Downey held a regular meeting in the Council Chamber of the Downey City Hall at 7:30 P.M., November 9, 1964, Mayor Thomas H. Morton presiding. PRESENT: Councilmen; Dickerson, Temple, Corbin, Dunnum, Morton ALSO PRESENT: Oren L. King, City Manager Royal M. Sorensen, City Attorney Sherman Griselle, Director of Planning A. C. Gabriel, Director of Finance Ray Lake, Director of Building & Safety Don Robison, Deputy Director of Civil Defense Loren Morgan, Deputy Chief of Police Robert Gain, Fire Chief Ervin Spindel, Director of Public Works Della Doyle, City Clerk Alberta Pfeiffer, Deputy City Clerk Reverend John Kreider, Faith Mennonite Church of Downey, delivered the invocation. Mayor Morton announced the passing of one of Downey's leading citizens, Mr. Isaac Shakarion, and stated that the City Council would adjourn in his memory. It was then requested by the Mayor that there be a moment of silent prayer in memory of this man. A plaque was presented to Mr. Ray Herman, member of the Personnel Advisory Board, serving from April 14, 1958 to November 9, 1964, who had tendered his resignation. He was commended for his outstanding community service and recognized for his valuable and distinguished service toward civic betterment. Council and the City Manager praised Mr. Herman and extended best wishes for the future. Mr. Herman Thanked Council and stated that he has never served with a finer group of men and that he will always remember those years. Mayor Stated that commendations were to have been presented to Ronald Crawford and Leslie Bleamaster for the great honor achieved by them during the Olympics in Tokyo, however these young men were unable to appear person- ally. The Mayor announced the time and place for the public hearing on the vacation of the alloy north of Stewart and Gray Road and asked the City Clerk if she had the affidavit of publication. The City Clerk replied she had the affidavit. Mr. Ervin Spindel, Director of Public Works, reviewed the case. There being no written and no oral comments or protests, it was moved by Councilman Corbin, seconded by Councilmen Temple and so ordered that the hearing be closed, RESOLUTION NO. 1472 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING VACATION OF A PORTION OF THE ALLEY ADJACENT TO EXISTING ALLEY LOCATED NORTH OF STEWART AND GRAY ROAD AS SHOWN ON TRACT NO. 14810 The revolution was read by title only. ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE ZONING MAP ADOPTED BY SECTION 9107 OF THE DOWNEY MUNICIPAL CODE (PLANNING RESOLUTION NO. 89, ZONE CHANGE #101) It was moved by Councilman Temple, seconded by Councilman Corbin and so ordered that further reading be waived. It was moved by Councilman Corbin, seconded by Councilman Dicks son and passed by the following vote that the ordinance be introduced. "Required Findings for Zone Change. In a change of sons proceedings it shall be shown (1) There are changed con - ditions since the existing zoning became effective to warrant other or additional zoning. (2) The proposed change of zononwill not adversely affect adjoining property as to value or precedent, and will not be detrimental to the area. (3) A change of zone will be in the interest or futherance of public health, safety and general welfare. (4) The approval of such change of zone will not adversely affect the Comprehensive Zoning Plan being prepared for the City or as adopted." It was moved by Councilman Temple, seconded by Councilman Dickerson and passed by the following vote that Zone Change #101 meets the findings con- tained in Section 9129.2 of the Downey Municipal Code. The City Clerk replied she had the affidavit. Mr. Griselle reviewed the case. Mr. Paul Yokota, property owner, stated that ttie Planning Commission had approved a zone change on only a portion of the property and that he feels it would be better to have the same zoning on the entire property. After discussion, it was moved by Councilman Temple, seconded by Councilman Dunnum and passed by the following vote that the hearing be continued to 7 :30 P.M., December 14, 1964, in the Council Chamber of the Downey City Hall, to allow Mr. Yokota time to determine if he wishes to withdraw the request for zone change. Mr. Griselle reviewed the case. Council Minutes 11/9/64 -3- 2-1 G Speaking in favor of the zone exception was Mr. Wm. J. Zacker, Jr., 8320 - 30 Stewart and Gray Road. He stated that the sign in question was a pattern of the roof and really not a sign. No one spoke in opposition and there were no written comments or protests received. It was moved by Councilman Temple, seconded by Councilman Corbin and so ordered that the hearing be closed. It was moved by Councilman Dunnum, seconded by Councilman bickerson and passed by the following vote to grant the appeal and approve Zone Exception #513 as meeting the findings of Section 9130.2 of the Downey Municipal Code and to refer Zone Exception #513 to the Planning Commission for report. There being no oral and no written comments or protests, it was moved by Councilman Temple, seconded by Councilman Dickerson and so ordered that the hearing on Downey Improvement Project #519 be closed. It was moved by Councilman Temple, seconded by Councilman Corbin and passed by the following vote to direct the Director of Public Works to proceed with improvements under Chapter #27 for installation of curb, gutter and driveway on the north side of Nods Street westerly of Old River School Road. There being no written and no oral comments or protest, it was moved by Councilman Corbin, seconded by Councilman Dickerson and so ordered that the hearing on Downey Improvement Project #520 be closed. It was moved by Councilman Corbin, seconded by Councilman Temple and passed by the following vote to direct the Director of Public Works to proceed under Chapter #27 to install improvements at 8103 and 8111 Cheyenne Avenue. Council Minutes - 11/9/64 .4- ;-'A 07 The City Clerk reported on the following correspondence: I. A letter of appreciation from Maxine Mock for courtesy in designation of a loading zone in front of her business located on Second Street. Accepted and filed. 2. A letter of appreciation from the Bank of Downey for quick action of the Downey Police Department in apprehending responsible for the robbery at their bank. Received the men and filed. 3. Letter addressed to the Southeast News with a copy directed to the City Mangger from Robert S. Brazelton, Chairman of the Citizens of Downey for Charter Government. The Mayor reported that letters had been sent to all members of the committee to promote the Mr. Brazleton. He remarked that the newspapersaswell asa the rcaommittee had done a magnificent job. 4. A statement from the City Attorney covering cost of filing and distribution of Amicus Brief in the case of Prival vs. Mooney in the amount of $50 to be paid M. Tellefson as the City of Downey's share. A monthly report from the Downey Chamber of Commerce. Received and filed. 7. A letter from the Coordinating Council announcing a special show- ing of the film, "Perversion for-Profit" to which all City officials and civic leaders are being invited. Received and filed. (8 PM, Nov. 17.) 8. Letters from various cities with sample resolutions endorsing home rule, requesting the City of Downey to,adopt a similar resolution. It was moved by Councilman Temple, seconded by Councilman Dickerson and so ordered to direct the City Attorney to prepare a resolution supporting the stand taken by the City of Torrance and other cities relative to home rule. 9. An appeal from Robert F. Durkee to Zone Exception Case #521 with necessary $50 deposit. It was moved by Councilman Dunnum, seconded by Councilman Temple and so ordered to set a hearing on Zone Exception #521 for 7:30 P.M., December 14, 1964, in the Council Chamber of the Downey City Hall. 10. A letter of approval of Select System Map from the Division of Highways. Received and filed. 11. Quarterly report from the Downey Civic Chorus. Received and filed. Councilman Dunnum reported a request had been received from Mrs. Helen Howe of: 11445 Paramount Boulevard who has a parking problem in front of her property due to cars being parked by patrons of the Pink Carousel directly across the street from her property. RESOLUTION NO. 1473 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY REGULATING PARKING ON PARAMOUNT BOULEVARD IN FRONT OF 11445 SOUTH PARAMOUNT BOULEVARD The City Attorney read the resolution in full, which prohibited parking at the subject address between the hours of 6:00 P.M. and 6 :00 A.M. and the posting of appropriate signs. RESOLUTION NO. 1476 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DECLARING ITS INTENTION TO VACATE THE SOUTH - EASTERLY 20.00 FEET OF THE NORTHWESTERLY 62.00 FEET OF PROPERTY KNOWN AS 9900 LAKEWOOD BOULEVARD The resolution was read by title only. Mr. Spindel reported that the property owner at 9900 Lakewood Boulevard, in accordance with requirements of a lot split, dedicated additional street frontage for a service road. Due to an error in the legal description it has been discovered that a strip 20 feet too wide was dedicated. This causes the new building to be in the dedicated right of way. In order to alleviate the hardship on the property owner, it is recommended that the portion of street right of way dedicated by error, be vacated as soon as possible. The City Attorney advised Council that the statute of limitations is about up on the suit filed in the matter of the Lucci property.
