MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY —
OCTOBER 13TH, 1964
The City Council of the City of Downey held a regular meeting in the Council
Chamber of the Downey City Hall at 7:30 P.M., October 13, 1964, Mayor Thomas H.
Morton presiding.

In the absence of the scheduled minister, Councilman Scott Temple delivered
the invocation.
Mayor Morton announced at this time the presentation of an award to Mrs. John
Abbott who had done a very outstanding job on the City Beautification Committee,
borne out throughout the City and particularly as to what has been done on Firestone
Boulevard. A plaque of commendation was presented Mrs. Abbott by the Mayor for this
outstanding service to the community. Mrs. Abbott had served as chairman of the
Beautification Committee.. Other councilmen added their comments and thanks to
Mrs. Abbott.
Mayor Morton introduced Mr. Joseph Nylander, teacher of U. S. History and
Government. Mr. Nylander presented the senior students from Warren High and
thanked the City officials for the seminar held at their school recently and for
also being allowed to share in City government and attend a City Council Meeting.
Mayor Morton stated the hour of 7:30 P.M. having arrived, it was time for the
hearing on the Debt Limit Report prepared pursuant to Division 4 of the Streets and
Highways Code for the improvement of Bixler Street, A.D. #73. The Mayor inquired
of the City Clerk if she had the Affidavit of Mailing relative to the hearing. The
C.;.ty Clerk replied she had the affidavit.
It was moved by Councilman Temple, seconded by Councilman Corbin and so
ordered that the Affidavit of Mailing be received and filed.

RESOLUTION NO. 1457
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY MAKING
FINDING OF FEASIBILITY OF ACQUISITION OF NECESSARY RIGHTS OF
WAY AND THE CONSTRUCTION OF CURBS, GUTTERS AND PAVEMENT IN
ASSESSMENT DISTRICT NO. AD -73 (BIXLER AVENUE AND OTHER STREETS)

Mayor Morton stated there would be a presentation by Mr. Joseph O'Grady of
the Pasadena Tournament of Roses Association. Mr. O'Grady presented to Council
the trophy, a picture of Downey's 1964 Rose Float, which had won first place
award in Class 10 -A cities.
The City Manager thanked the Rose Float Association for another job well
done last year.
The Mayor announced the hearing on the Resolution of Intention for Bixler
Street, A.D. #73 and asked the City Clerk if she had the Affidavits of Publica-
tion, Posting and Mailing. The City Clerk replied she had the affidavits.
It was moved by Councilman Corbin, seconded by Councilman Temple and so
ordered that the affidavits be received and filed.
The City Engineer presented and read the factual data of the Debt Limit
Report to Council and it was received and filed.
There being no written and no oral comments, it was moved by Councilman Corbin,
seconded by Councilman Temple and so ordered that the hearing be closed.
RESOLUTION NO. 1458
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING
WORK TO BE DONE ON BIXLER AVENUE AND OTHER STREETS IN ACCORDANCE
WITH RESOLUTION OF INTENTION NO. 1415 (AD 73)

seconded by Councilman Dickerson that further reading be waived.

Mr. George Staid of the State Compensation Insurance Fund complimented the
City of Downey on realizing a savings of $14,217.61 on its safety policy for the
year ending December 20, 1963, and presented a check in that amount representing
34% of the premium paid. The return, he stated, was in addition to the 11%
reduction in premium rates which the City enjoyed during the year under the
Experie nce Rating Plan. As a result, it was reported, the City's combined savings
for the policy period amounts to 42% of the premium at basic rates. He compli-
mented the City on its very excellent record and offered sincere congratulations
on behalf of his organization for the wonderful safety record of the past year
and the wonderful calibre of the employees working for the City of Downey.
The City Manager stated the City has a 5 -man safety committee for employees
safety, meeting the first Monday of each month in an endeavor to see if accidents
can be corrected, to promote the safety among employees. Mr. King stated that the
City has benefited greatly from this committee's continued efforts in preventing
accidents, resulting in this very successful safety program of the City of Downey.
The Mayor reported the public hearing on Planning Resolution No. 88, Zone
Change Case #103, Murata, would be held at this time and asked the City Clerk if
she had the Affidavit of Publication relative to the hearing. The City Clerk
replied she had the affidavit. ffhe affidavit was received and filed.

The case was reviewed by the Director of Planning.
Mr. Sherman Griselle stated the Planning Commission recommends the zone change
with one reservation; that one foot remain in R -1 zone with a twofold purpose:
1. Where the 1 -foot strip of R -1 zone abuts a C -4 zone this requires a
five and one -half foot to six -foot wall when the properties develop
commercially.
2. The one -foot strip cannot be crossed for commercial purposes..it can
be crossed only for residential purposes.
The Clerk presented a letter from Carol and Warren Blossom in favor of the zone
change.
Leslie Olson, 10022 Tristan 44ive, representing applicant in Zone Change Case
#103, spoke in favor of the request.
There being no written and no oral protests or comments, it was moved by
Councilman Temple, seconded by Councilman Dickerson and so ordered that the hearing
be closed on Zone Change Case #103, Planning Resolution No. 88 /Murata.
ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING
THE ZONING MAP ADOPTED BY SECTION 9107 OF THE DOWNEY MUNICIPAL
CODE (PLANNING RESOLUTION NO. 88, ZONE CHANGE CASE NO. 103)

The Mayor announced the hearing on Downey Improvement Project #515, Old River
School Road northerly of Firestone Place, would be continued at this time, being
held over from the September 14 meeting.
The City Engineer reported the property owner has advised that the City
proceed with the improvements.
There being no further comments relative to the hearing on DIP #515, it was
moved by Councilman Temple, seconded by Councilman Dickerson and so ordered that
the hearing be closed.
It was moved by Councilman Dickerson, seconded by Councilman Temple and
passed by the following vote to authorize the Department of Public Works to
proceed with the improvements under Downey Improvement Project #515 under
Chapter #27.

Mayor Morton announced the hearing on Rutgers Avenue, AD #17 assessments
would be held at this time and asked the City Clerk if she had the Affidavits

ordered that the affidavits be received and filed.
The City Engineer presented the assessment roll to Council and it was
received and filed.

RESOLUTION NO. 1459
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
CONFIRMING THE ASSESSMENT FOR THE IMPROVEMENT OF RUTGERS
AVENUE (AD #17)

The City Clerk reported on the following written correspondence:
The first letter had been acted upon the first part of the meeting.
(2) Monthly report from Downey Chamber of Commerce. Received and filed.
(3) Memorandum from Ruth Miller, Librarian, and accompanying letter from
Mrs. Fred C. Mintie in appreciation of the phonograph record file kept in the
library. Received and filed.
(4) Jimmie Wood, 17425 Nordhoff, Northridge, California, in appreciation of
assistance given him by Planning Department personnel.
(5) Riviera Beach Park Committee, Torrance, California, requesting support
of the City of Downey in preservation of the Los Angeles County Beach area. The
City Manager was authorized to investigate and present a proper resolution for
consideration by Council at the next meeting.
(6) Letter from Rev. George J. Parnassus, Pius X High School, in apprecia-
tion of the newly installed sidewalks on Gardendale Avenue adjacent to the school.
(7) Los Angeles County Heart Association requesting permission to solicit
funds during the month of February, to be proclaimed Heart Fund Month.
It was moved by Councilman Temple, seconded by Councilman Corbin and so
ordered to approve the request to solicit funds for Heart Fund in February and
authorize the Mayor to sign a proclamation for Heart Fund Month.
(8) A letter from the County -City Coordinator in Los Angeles relative
to the agreement for the care of city prisoners in the County Jail.
It was moved by Councilman Dunnum, seconded by Councilman Temple and so
ordered that the City Manager be authorized to sign the receipt of acknowledgment
of notification of rates established for care of prisoners in the county jail.
(9) A memorandum from the Director of Finance with accompanying letter
from Mr. Howard Vleerick relative to the agreement for purchase of the northwest
corner of Second Street and LaReina Streets, requesting a 3 -month extension on
the contract to pay off the balance. The letter was read in full by the City
Manager which outlined the agreement to purchase Downey Towers.
It was moved by Councilman Corbin, seconded by Councilman Dickerson and
passed by the following vote to grant the 3 -month extension on the agreement to
purchase Downey Towers from the City of Downey as requested by Mr. Howard Vleerick.

(19) A letter from Sgt. Orbrey L Duke, President of the Downey City
Employees Association, announcing the Publicity Scrap Book first place award had
been given to the City of Downey for the second time. Council remarked this
shows outstanding achievement for the year.
(21) Report on Water Rates from the Water Advisory Board. Mr. Dale Baker,
accompanied by Frank Beckner, Clifford Hiemforth and Ed Williamson stated the old
rates were below cost and there was no other way to operate on a balanced budget
but to raise the rates. It was felt that at least a year's experience would
be needed to get a fair evaluation of the rates. Mr. Baker stated the Water
Advisory Board feels it has established fair and equitable rates as of this time
and that water consumption had been unusually high, however the water bills should
begin to level off.
It was moved by Councilman Corbin, seconded by Councilman Temple and
so ordered to approve the recommendations of the Water Advisory Committee (Board)
and that a breakdown of the cost of operation be submitted to the Water Advisory
Board.
The Mayor declared a ten - minute recess with Council reconvening at 9:05 P.M.
with roll call:

A resolution passed by the Downey Chamber of Commerce endorsing the City
Charter was read in full by the Mayor but the Chamber requested Council to take
two measures, as follows: That an ordinance be drawn specifying that only in
cases of emergency would a special council meeting be called, with notices pub-
lished in the newspapers; and that it be set out in an ordinance the manner of
selection and filling of future vacancies on the City Council.
It was moved by Councilman Temple, seconded by Councilman Dickerson and so
ordered to refer the two matters recommended by the Downey Chamber of Commerce
to the City Attorney with a copy of their resolution.

that the Social Security office sent representatives to meet with City Employees

The City Attorney advised that the change was in substance that the Council

Mr. Spindel reported that the Chrysler facility on the south side of
Telegraph Road adjacent to the westerly City boundary is under construction
at the present time. A water distribution main extension is required to
serve this property. Under the main extension rule adopted by the Council,
the applicant is eligible for one -half matching by the City, of the cost of
the main installation. Ordinarily an 8" main would be required to serve this
property for which the estimated cost is $4200 with the Chrysler Corporation
paying $2100 and a like amount by the City. However, in Telegraph Road, based
on plans for future expansion, a larger transmission main will be required -
16" in diameter. This will be to serve the future reservoir to be built
westerly of this property. The estimated cost of the 16" water main, including
engineering, contingencies, is $8,000. Under its policy, the City also bears
the additional cost of excess main capacity. The Water Advisory Board has
approved the construction of the 16" main in place of the 8" main. It was

The City Manager read a letter directed to Mr. Louis Frahm relative to
Firestone Boulevard improvements between Old River School Road and the city limits,
informing him that gas tax funds can be utilized, subject to availability of funds
and approval of City Council under current policies.
It was moved by Councilman Temple, seconded by Councilman Corbin and so
ordered to authorize transmittal of the letter to Mr. Frahm as recommended by the
City Manager.
Under Cash Contract #106, widening and paving of LaReina Avenue, Firestone
Boulevard to Third Street, Mr. King reported the Edison Company has outlined a
program for laying underground cable after the first of the year and it was
recommended that the work under Cash Contract #106 be deferred till that time.
Mr. King read a letter of transmittal to the Sheets Construction Company, asking
that they delay their construction until such time as Edison Company will have
finished their program, at verified costs for any increase in labor or for removal
and dumping of asphalt paving.

ordered that the City Manager be authorized to send a letter to Sheets Construction
as recommended by Mr. King.
Upon Mr. King's request, it was moved by Councilman Temple, seconded by
Councilman Dickerson and so ordered to grant permission for leave, if necessary,
to go to Colorado for illness in the family.

A recommendation for Emergency Communication Explorer Posts under the
Civil Defense program was referred to the City Attorney for his review and held
until the next Council Meeting.
Mr. Spindel requested that notices of completion for Cash Contracts be filed
after completion of the work rather than holding off until the next Council Meet-
_ ing, and to then have them formally accepted by City Council at the first meeting
following filing of the notice. The pertinent change in the specifications cov-
ering this item was read by Mr. Spindel, who advised that this earlier filing of
notices of completion had been approved by the City Attorney.

Councilman Temple stated that the Deputy Director of Civil. Defense has been
highly commended by the Women's Civil Defense Group. Mayor Morton stated that
representatives from his district on the Civil Defense Committee hake also
commended Don Robison on results he is achieving in the Civil Defense Program
activities. Commendation on the leadership provided the Civil Defense Program
by Don Robison was also expressed by Councilman Dickerson.
Councilman Corbin stated the Rose Float Committee has requested per-
mission to hold a "Sing -A- Long" in front of the City Hall on Monday night,
November 16, as a fund - raising event, with celebrities present.
It was moved by Councilman Dunnum, seconded by Councilman Temple and
so ordered that the Rose Float Committee may proceed with plans for a Sing -A -Long
and that they work with the Police Department.
Councilman Dunnum stated that the League of Women Voters is again
inquiring about the matter of publication of Council agenda. Mr. King stated
that he would advise Mrs. Helen Ziler of the action which was taken by the
Council on this matter.
At the request of the Park and Recreation Board for a meeting with the
Council or their representatives, Mayor Morton appointed Councilmen Corbin and
Temple.
There being no further business to come before Council, the meeting adjourned,
at 10:45 P.M.
