MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
SEPTEMBER 22, 1964
The City Council of the City of Downey held a regular meeting in the
Council Chamber of the Downey City Hall at 8:00 A.M., September 22, 1964,
Mayor Thomas H. Morton presiding.

In the absence of a scheduled minister, Mayor Morton delivered the
invocation.
Mayor Morton announced that he was proud to present 5 -year awards to
employees who have served the City that length of time, and he complimented
them for being apart of the City program for that period. He stated
Council always brags on the City's employees to other City officials as he
feels Downey employees are second to none.
The City Manager stated that this was the third year 5 -year awards
had been made, and that it is not an automatic honor but is earned through
continued merited performance.
The following employees received their 5 -year awards:

ant; Richard Dunn, Ronald Foster, Police Officers; Madolyn Groover,

Terence Middlebrooke, Chief License Inspector; Donald Robison
Assistant to City Manager; Hershel Smith, Police Officer, Donald
Stoddard, Sr. Maintenance Man; Caroline Strutz, Typist Clerk
(Absent); Wayne Wallace, Fireman; Madeline Tomlinson, Executive
Secretary; and Dick Redmayne, Jr. Civil Engineer (armed services).
It was moved by Councilman Temple, seconded by Councilman Dunnum and
so ordered that the minutes of the Council Meeting held on September 14,
1964, be approved as written.
The City Clerk reported on the following written correspondence:
1. Financial Reports from the Downey Museum of Arts. Received and
filed.
2. Letter of appreciation of service rendered by the Downey Youth
Band at their Youth Rally from Rev: J. T. Chase of First
Christian Church. Received and filed.
3. Letter from Larry L. Davis, in behalf of owners of Registered
and Banded Homing Pigeons, with submission of a proposed ordi-
nance.

After discussion, it was moved by Councilman Dunnum, seconded by
Councilman Dickerson and so ordered that this matter be taken under sub-
mission until the next Council Meeting.
4. Requests for parade permits: a. Christmas Parade (Chamber of
Commerce); b. Olympic Torch Parade (Downey Jnnior Chamber of
Commerce). It was reported that both parades had been approved by
the City Manager and Chief of Police.
It was moved by Councilman Temple, seconded by Councilman Dickerson
and so ordered that the parade permits be approved as requested.
Director of Public Works introduced Miss Public Works, Penny Atkinson,
senior class of Earl Warren High School. This was in conjunction with
National Public Works Week to be proclaimed later by Mayor Morton.
Because of the delay in the second reading of the proposed bed tax
ordinance at the Council Meeting of September 14, the City Attorney advised
that since it showed an effective date for transient occupancy tax of
October 1 and, if passed today, the ordinance would not itself be in effect
until after 30 days, it would be advisable to change the effective date to
January 1, 1965, and have another first reading at today's meeting.
Edward d'Loretto, 10923 Little Lake Road, Downey, spoke in opposition
of such a tax.
Councilman Temple remarked that many other cities are anticipating
adoption of such a tax. Councilman Corbin stated that the League of
California Cities has passed a resolution favoring the bed tax.
Councilman Dunnum remarked that she feels taxation should be based on
need and that although this type tax would be the least detrimental, she
does not feel it is necessary.

The resolution was read by title only. Maxine Mock, 8234 E. 2nd
Street, requested that the loading zone be moved from one end of the
block to the other to alleviate a loading problem at her place of business.

RESOLUTION NO. 1456

RATIFYING AN AGREEMENT BETWEEN THE DEPARTMENT OF PUBLIC
WORKS OF THE STATE OF CALIFORNIA, COUNTIES OF LOS ANGELES,
ORANGE, SAN BERNARDINO, RIVERSIDE, VENTURA, SOUTHERN
CALIFORNIA RAPID TRANSIT DISTRICT, RATIFYING CITIES, ET AL.

Mayor Morton asked to digress from the agenda at this time and take
up the item of Zone Exception #483, Roy Reed. Mr. Sherman Griselle,
Director of Planning, reported the Planning Commission has recommended 20
conditions, with the following changes:
Condition 2. That before any apartment building permits are issued
for the Brookshire Avenue frontage, the five (5) single family homes pro -
posed along Everest Street shall be under construction.
Condition 9. That vehicular right of ingress and egress to Imperial
Highway and Brookshire Avenue, except the two (2) approved alley openings
as shown on the approved plot plan, shall be vacated and recorded with the
Los Angeles County Recorder and a copy filed with the Planning Department.
Condition 14. That a solid masonry wall not less than five feet six
inches (5'6 ") nor more than six feet (6') in height above the finished
grade shall be erected and permanently maintained along the westerly
property line of the ownership excepting the northerly 114 feet and
southerly fifteen feet (15') and along the northerly side of the alley
excepting the easterly ten feet (10'), as shown on the approved plot plan.
Where there is an existing wall along the property line the required wall
shall be constructed as outlined in Section 9126.43 of the Downey
Municipal Code.
It was moved by Councilman Dunnum, seconded by Councilman Dickerson to
approve Zone Exception #483 with the 20 conditions recommended and as
changed.
After question by Councilman Temple, Leslie Olson, 10022 Tristan
Drive, representing builder, remarked that the construction will be
quality and well over the minimum requirements under the code. This was
reiterated by Waler H. Young, Attorney representing Mrs. Reed.

After a summary of bids for CC #106, widening and reconstruction of
LaReina Avenue between Firestone Boulevard and Third Street, the City
Attorney advised the bid was not precisely in accordance with the require-
ments, but this defect could be waived if Council is in favor of awarding
bid to this bidder.
It was moved by Councilman Teeple, seconded by Councilman Dickerson
and passed by the following vote to waive defect in the bid bond and
award bid to the lowest and best bidder, Sheets Construction Company, in
the unit prices contained in the bid, and reject all other bids.

After a summation of bids on Cash Contract #139, Third Street water
main, it was moved by Councilman Temple, seconded by Councilman Dickerson

It was moved by Councilman Corbin, seconded by Councilman Temple and
passed by the following vote to approve plans and specifications for con-
struction of a parking lot at the southeast corner of the intersection of
Second Street and LaReina Avenue, Cash Contract #137, and authorize
advertising for bids.

After a summation of bids received for Cash Contract #83 -B, Heating
and Air Conditioning Council Chambers, it was moved by Councilman Corbin
that bids be rejected and authority granted to readvertise. Motion died
for lack of a second.
Councilman Dunnum excused herself from the Council Chamber at 9 :25 A.M.
Robert Henderson, 8112 Brookmill Road, owner of Hendy Engineering of
Downey, who had submitted the only valid bid, stated he felt that with
proper engineering the Carrier units would give satisfactory performance.
It was moved by Councilman Dickerson, seconded by Councilman Temple
and passed by the following vote to award the bid for Cash Contract #83 -B,
Heating and Air Conditioning Council Chambers, to the lowest and best
bidder, Hendy Engineering, in the amount of $7900.

It was reported that the property owner at the southeast corner of
Florence Avenue and Downey Avenue has offered dedication of right of way
on both streets in exchange for improvements as outlined in a letter to
the City Council. The estimated cost of the right of way being dedicated
is approximately $6400. Estimated cost of the improvements to be performed
by the City is $2500. Since the cost of the land is considerably in
excess of the improvements being requested, it is recommended that the costs
of these improvements be paid for by the City as part of Cash Contract #96.
Money has been budgeted for this project and there is sufficient money to
cover the costs of the improvements.

and passed by the following vote to authorize expenditures of $2500 for
the improvement at the southeast corner of Florence Avenue and Downey
Avenue as part of Cash Contract #96 in exchange for the dedicated right of
way.

It was moved by Councilman Temple, seconded by Councilman Corbin and
so ordered to authorize circulation of a petition for installation of
street lights on steelstandards with overhead wiring as furnished by the
Southern California Edison Company.

and passed by the following vote to award purchase of a 125CFM Air
Compressor to Southland Machinery Corp. of Montebello as recommended by
the Director of Public Works.

It was moved by Councilman Dicke: oq,seconded by Councilman Temple and
so ordered that the week of September 28 - October 4, 1964 be proclaimed
National Public Works Week.
Councilman Dunnum returned to the Council Chambers at 9:35 A.M.
It was moved by Councilman Temple, seconded by Councilman Dickerson
and passed by the following vote to approve construction of curb,
gutter and paveout in the section of Alameda Street, 233 feet in length,
500 feet easterly of Birchdale, adjacent to Alameda Elementary School,
subject to construction of sidewalks by the School District.

Mr. King briefed Council on the advertising requested by the Herald
American relative to their Leadership Edition to be forthcoming in
December.at an approximate cost of $1900. Council referred the matter to
Mr. Red Barrett, Manager of the Chamber of Commerce; however, Mr. Barrett
stated there were no funds budgeted for an item such as this and it appeared
to him that to advertise in one newspaper would then give reason for other
papers in the City fo feel similar advertisements should be placed with them
as well.
After discussion, it was moved by Councilman Dickerson, seconded by
Councilman Dunnum and passed by the following vote, to accept the offer of
the Herald American for a feature article, one page to be paid by the City
not to exceed the sum of $2,000, with an additional page being provided by
the newspaper.

It was moved by Councilman Corbin, seconded by Councilman Temple and
so ordered that the Mayor and City Manager should work with the Herald
American, submitting proofs to Council on above mentioned advertising.

and passed by the following vote to authorize the Mayor to sign an
agreement as outlined in the City Manager's Report, with Los Angeles
Regional Transportation Study.

It was stated that no one in the proposed hospital site on Brookshire
Avenue has made any indication they are interested in relocating at the
Stewart and Gray property, therefore the Planning Commission can proceed
with the processing of the request for zoning the Stewart and Gray property
to R -3.
It was reported by the City Manager that negotiations are progressing
very rapidly for the acquisition of property within the future hospital
site. In order to have sufficient monies in the hospital fund for the
purchase of this property, it will be necessary for the General Fund,
unappropriated reserve, to loan to the Hospital Fund the amount of
'— $260,000, to be repaid upon the sale of bonds.

and passed by the following vote to authorize the Mayor or City Manager
to sign escrow proceedings for the acquisition of properties in the hospital
site.

The City Manager stated the Downey Civic Chorus group have requested
that their name be changed to "Voices of Downey "; however, Council pre-
ferred the name to remain "Downey Civic Chorus."
It was moved by Councilman Morton, seconded by Councilman Dunnum and
so ordered that City Councilmen and wives sponsor an open house and
reception December 24, from 10:00 A.M. to 1:00 P.M.
Mr. King presented a resume of the Coro Foundation reports given
last Friday and stated they were very well received.
It was reported that Ike Eisenhower plans to visit Guadalajara the
middle of October for a meeting ofi'the sister city program. It was sug-
gested that the Mayor be authorized to attend.
It was moved by Councilman Temple, seconded by Councilman Dickerson
and passed by the following vote to authorize the Mayor to attend the
meeting in Guadalajara in October when Eisenhower will be present, and
that reasonable and necessary expenses be allowed.

Councilman Dickerson gave a brief report on his visit to Guadalajara
and remarked that the prestige Downey has with Guadalajara is very over-
wlie lming .
Councilman Temple briefed Council on the Palm Springs meeting which
he recently attended.
Mr. Spindel reported on water lines being laid on Allengrove Street
between Tweedy Lane and Paramount Boulevard, to start today, and reported
that the Third Street water line will not be started until after the
first of the year.
Assistant Fire Chief Don Warren reported on the Mutual Aid agree-
ments between the various cities.
Mayor Morton reported on how very graciously Carol Gunnette, Miss
Downey presented herself throughout her stay in Guadalajara during the
Independence Day celebration and that she is an outstanding queen..
It was moved by Councilman Temple, seconded by Councilman Dunnum
and so ordered that vacation from September 28 to October 9 be approved
for City Clerk Delia Doyle, as requested.
There being no further business to come before the Council, the
meeting adjourned at 10:45 A.M.
