MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
AUGUST 25TH, 1964
The City Council of the City of Downey held a regular meeting in the
Council. Chamber of the Downey City Hall.at 8:00 A.M., August 25, 1964,

Ray Lake, Director of the Building and Safety Department, delivered the
invocation'in the absence of the minister.
Mayor Morton announced that this is the time.and place set for the
hearing on Barlin Avenue assessments, AD #85, and inquired of the City Clerk
if she had the Affidavits of Posting, Mailing and Publication. The City
Clerk replied she had the affidavits. Ordered received and filed.
The Mayor asked if there were any written communications relative to
the hearing. The City Clerk replied there were none.
The Mayor then asked if anyone wished to speak on the matter. There was
no one.
It was moved by Councilman Corbin, seconded by Councilman Dickerson and
so ordered that the hearing on assessments in AD #85, Barlin Avenue, be closed.
RESOLUTION NO. 1426
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
CONFIRMING THE ASSESSMENT FOR THE IMPROVEMENT OF BARLIN
AVENUE AND GARDENDALE STREET (AD 85)
The resolution was read by title only. It was moved by Councilman
Corbin, seconded by Councilman Dickerson and so ordered that further reading
be waived.
It was moved by'Councilman Corbin, seconded by Councilman Dickerson and
passed by the following vote that Resolution No. 1426 be adopted.

Mayor Morton announced that this is the time and place set for the
hearing on the assessments in AD #98,.Stanbridge Avenue, and inquired if the
City Clerk had the Affidavits of Posting, Mailing and Publication. The City
Clerk replied she had the affidavits. Ordered received and filed.
Mayor Morton asked if there were any written communications in protest
to AD #98. The City Clerk replied there were none.

The Mayor then inquired if anyone wished to speak on the matter.
No one came forward.

so ordered that the hearing on assessments in AD #98, Stanbridge Avenue.
RESOLUTION NO. 1427
A RESOLUTION.OF THE CITY COUNCIL OF THE CITY OF DOWNEY
CONFIRMING THE ASSESSMENT FOR THE IMPROVEMENT OF
STANBRIDGE AVENUE (AD #98)
The resolution was read by title only. It was moved by Councilman
Corbin, seconded by Councilman Dickerson and so ordered that further reading
be waived.
It was moved by Councilman Corbin, seconded by Councilman Dickerson
and passed by the following vote that Resolution No. 1427 be adopted.

Mr. Spindel advised that it will be necessary to transfer funds to
cover the City's contribution of $6,510.74 to pay incidental costs, and that
approval be given to issue a warrant to Sully- Miller for $141.85 for costs
over and above incidental expenses.
It was moved by Councilman Corbin, seconded by Councilman Dickerson
and passed by the following vote to approve payment to Sully- Miller Con-
tracting Company in the amount of $141.85, and the following transfer of funds:

It was moved by Councilman Corbin, seconded by Councilman Dickerson and
so ordered that the minutes of the Council Meetings held August 10 and 17, 1964,
be approved as written.
The City Clerk reported on the following written correspondence:
(1) and (2). Letters from John & Paul#ie�Stokes and Arthur A. Chenes
relative to the traffic signal at Woodruff and Firestone, acquiescing to payment
by them of their 1/2 for this installation, and thanking Council for their
action toward installation of the signal. Letters ordered received and filed.
3. Letter from James Storti requesting a city contribution toward
incidental expenses for AD #40, Margaret Street. Mr. Spindel reported that
in accordance with past City policy, there has been no City contribution
toward incidental expenses for improvements within an area where the street
had not been dedicated; however, in most of the assessment districts where
public street is now in existence and partially improved, the City Council
has authorized City contribution in the amount of the incidental expenditures.
It was recommended that the City's portion of incidental expenses in the ap-
proximate amount of $5,000 be authorized for AD #40.
It was moved by Councilman Corbin, seconded by Councilman Dickerson and
passed by the following vote that the City participate in AD #40, Margaret
Street, in the amount of $5,000.00.

(4) A letter from the Coro Foundation relative to internship in Public
Affairs by college students in Public Administration. Mr. Ring explained
that Downey and Pasadena have been chosen for this program. It was suggested
that a letter be sent to the Foundation thanking them for their interest in
the City of Downey participating and approving their request.
(5) Financial statement from the Downey Symphonic Society, Inc.
Ordered received and filed.
(6) A letter from Jack J. Harris, Feature Department, Herald American,
with an enclosed letter and brochure from the publisher giving a resume of
what is planned for a forthcoming Leadership Edition. The City of Downey was
requested to participate with one page of publicity at the cost of $1,900.00,
with the newspaper adding another page adjacent to the page of paid publicity.
It was moved by Councilman Dickerson, seconded by Councilman Corbin and
so ordered to take the matter under submission.
(7) A letter from the Downey Unified School District ratifying the
wording of Section 800 of the proposed city charter. Ordered received and
filed.
(8) A letter from the City Manager of the City of Long Beach advising
that through the mutual efforts of their city and the City of Downey, among
other neighboring cities, Western Airlines have established service to
San Francisco from the Long Beach Airport with connecting flights to the
Pacific Northwest, effective September 8.
(9) A letter from Kathryn R. Van Willigan protesting county health tax
on apartment buildings, copckes of letters directed to two members of the
Board of Supervisors, requesting their assistance in rescinding these health
inspection fees.
It was moved by Councilman Corbin, seconded by Councilman Dickerson and
so ordered to submit a letter outlining the City Councils objection to these
fees to the County Board of Supervisors.
Mayor Morton reported he had received a letter from the American Municipal
Association relative to preserving American landmarks throughout the nation,
and announcing a forthcoming American Landmarks Celebration. It was suggested
that any such landmarks existing in the City of Downey be reported to this
committee.
(10) A letter from Mrs. Marjorie Phelan relative to appropriation from
the City for the Downey Mixed Chorus. Mrs. Phelan suggested that the beginner
group known as the Downey Mixed Chorus, be transferred to a larger, more
aOvanced group called "Voices of Phelan ", making it a large civic chorus.
It was moved by Councilman Corbin, seconded by Councilman Dickerson and
passed by the following vote to appropriate funds in the amount of $600.00
to the Downey Civic Chorus for the fiscal year July 1, 1964 to June 30, 1965.
ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING
THE DOWNEY MUNICIPAL CODE BY ADDING TO ARTICLE VI THEREOF A NEW
CHAPTER TO BE DESIGNATED CHAPTER 1 -A CONSISTING OF SECTIONS
6125 THROUGH 6137, WHICH SAID SECTIONS RELATE TO A TAX UPON THE
PRIVILEGE OF TRANSIENT OCCUPANCY.

Leslie Olson, 8129 Florence Avenue, stated he feels proposal of this
bed tax merits further study.
Lewis D. Cowan, Whittier, owner of the Cowan Hotel at 8352 E. Second
Street, inquired about whether or not the tax applied to the first 30 days'
rental. The City Attorney advised it would apply if there was no agreement
at the time of rental that the occupancy would be for longer than 30 days.
It was moved by Councilman Corbin, seconded by Councilman Dickerson
and passed by the following vote that the ordinance be introduced.

The City Attorney advised Council that they may adopt the ordinance at

Mr. King reported on the continuance of the contract with the Los
Angeles County Pound Department and of a proposed change in the City ordinance
relative to impounding fees.

RESOLUTION NO. 1433

ADOPTING AND SUBMITTING A BUDGET FOR EXPENDITURE OF STAT
ALLOCATED EBGINEERING FUNDS

Mayor Morton called for a ten - minute recess with Council reconvening
at 9:10 A.M. with roll call:
PRESENT: Councilmen: Dickerson, Corbin, Morton
Mr. King read a communication from the League of Women_,Voters relative
to proposed changes in the city charter to add a section'6tating that the
agenda of the City Council meetings shall be published in the newspapers
within the City of Downey and clarification of amending the charter.
The City Attorney advised Council that this would not seem practicable
in view of the fact that the number of newspapers printed and published in
the City of Downey could change within the next 10 to 15 years and if
Council desired to have the agenda published, it could do so by adoption of
an ordinance and that a section was being proposed regarding amending of the
charter.
City Attorney Royal Sorensen then read the changes proposed for the
City Charter:
Section 517: To show the words "newspaper 'printed and' published
in paragraphs 1 and 3.
It was moved by Councilman Dickerson, seconded by Councilman Corbin and
passed by the following vote to approve the change in Section 517 as stated
by the City Attorney.

Section 606: MANAGER PRO TEMPORE. "The City Council may direct the
City Manager to appoint a City Manager Pro Tempore. If there is no Manager
Pro - Tempore and the position of City Manager becomes vacant, or the City
Manager is absent, is incapacitated to such an extent he cannot perform his
duties, then the Mayor, or if he is absent or unable to act, the senior
member of the City Council, temporarily shall act as the administrative
head of the City until the City Council fills the position of City Manager
or appoints a City Manager Pro - Tempore."
It was moved by Councilman Dickerson, seconded by Councilman Corbin
and so ordered to approve the change in Section 606 as stated by the City
Attorney.
Section 608: NON- INTERFERENCE WITH ADMINISTRATIVE SERVICE. Addition
of the three words in the second sentence, Except for the purpose of
inquiry, "investigation or reports" . . .
It was moved by Councilman Corbin, seconded by Councilman Dickerson
and so ordered to approve the change in Section 608 as stated by the City
Attorney.
Section 1503 for amendments of the charter to be added as follows, and
for the index to show this addition:
"Section 1503. AMENDMENTS. Any amendment of this charter shall be
made pursuant to and in accordance with the applicable provisions of the
Constitution of the State of California."
It was moved by Councilman Corbin, seconded by Councilman Dickerson and
so ordered to approve the addition of Section 1503 as recommended by the City
Attorney, and that it be shown in the index.
It was moved by Councilman Corbin, seconded by Councilman Dickerson and
so ordered that the City Attorney prepare a resolution carrying out the
request of the League of Women Voters for publication of City Council agenda.
It was moved by Councilman Morton, seconded by Councilman Corbin and so
ordered to approve change in Section 800 relative to the Board of Education by
adding at the end of section "on August 1, 1964."
It was moved by Councilman Corbin, seconded by Councilman Dickerson and
so ordered.to approve change in Section 900. APPOINTIVE BOARDS AND COMMISSIONS.
IN GENERAL. Addition of "Hospital Commission" after Municipal Water Board.
Mr. King then read the following letter from Councilman Scott E. Temple,
which Councilman Temple requested be incorporated into the minutes:
"Honorable Mayor and Members of the City Council:
"This letter is written in support of the proposed City Charter
and placing it on the ballot at the General Election on November 3,
1964. It is my sincere belief that this Charter will give the
City more stability and more autonomy in local affairs. It is
also my thinking that it will provide a measure of insurance for
continued good government in our City. Good government should be
kept as close to the people as possible. There is no better way
of insuring this than by having a Charter particularly tailored
for our City.
"Due to the current comment of so many of our citizens as to the
necessity and importance of our City having a Charter, in my
opinion, it is the moral obligation of our City Council to offer
the opportunity for our citizens to make a choice on this most
important issue.
"This letter is written because I will be absent from the Council
meeting on Tuesday, August 25. due to my attendance at the Mexican-

Northamerican Conference in Guadalajara.
I feel the :- .mr►portance of the Charter is such that my position
should be known at the time it comes up at your meeting on
August 25. Although I will not be there to vote on it, I would
like to have this letter recorded in favor of placing the pro -
posed( "harter on the November ballot for the future benefit and
stability of our City."

It was reported by Mr. Spindel that Mr. Wm. H. Brining has requested
that the City reimburse the amount of $3,768.00 for a portion of sewer
construction which benefits properties other than his own. If Council
approves this request, it will be necessary to appropriate additional funds
to the Sewer Reimbursement Account since this particular account has been
depleted. It was recommended that $10,000 be transferred from Unappropriated
Reserves to the Sewer Reimbursement Account, covering not only the above
request, but other costs of sewer lateral construction which is required prior

It was reported by Mr. Spindel that before City incorper ation,
Tract #16691, Lakewood Boulevard, was developed under the jurisdiction of the
County of Los Angeles. As a part of the requirement of this subdivision,
the subdivider was required to deposit $631.00 with the County for possible
future extension of the service road along the westerly side of Lakewood
Boulevard which presently extends northerly from Lubec Street. Because of the
manner in which the area to the north of this subdivision is and has de-
veloped, it has been determined that the extension of the service road would
not be desirable. It was recommended that the Director of Public Works be
given authority to direct the County of Los Angeles to release this money
which has been held on deposit.

Mr. King stated renewal of leases for the parking lots at the rear of
the Avenue Theater between Second and Third Street with Messrs. Stamps and
Stecklein for a period of ten years based upon provisions for the previous
ten years have been prepared again with the express provision that the
premises will be used for off - street parking purposes. The rental is the
same as the previous years for Mr. Stecklein, sot at $208.34 a month, and
Mr. Stamps has requested that his be °taised from the previous $200 to
$208 which coincides with Mr. Stecklein's. The City would agree to pay for
furnishing of any utilities and the payinent':of taxes levied against the
premises, but shall not include the payment of any special assessments.
The City has retained a cancellation clause of ninety days' written notice,
and the City also would agree that if default be made in the payment or in
the agreements contained in the Lease on the part of the City, Lessor may
declare the lease terminated. In view of the continued efforts of the City

in the planning and development of the downtown area, it was recommended
that these leases be extended.

It was reported that bids were called for a three -year contractoD
service the City of Downey Police Department motorcycles and to purchase
replacement of units, with one bid only being received from S & J Harley -
Davidson of Bellflower. This is the same contractor who has been
maintaining the City's motorcycles and replacing them over the past few
years. The new maintenance,conttact will be .0275 per mile and the price
of new motorcycles will be based on $2,020.00 for the 1965 models. Sub-
sequent prices will be based on wholesale factory price adjustments.
Trade -in allowance will be $700.00. It was recommended the contract be
accepted, to become effective on September 1, 1964, and to remain in effect
through June 30, 1967, with a 60 -day right of cancellation by either party.

The City Manager reported that it has been called to his attention that
the owner of a 5 -unit apartment house at 8101 Fifth Street, purchased in
September 1961, purchased four adjoining units in February 1963, at 8103
Fifth Street, bringing them under Section 6248.1 of the Downey Municipal
Code, wherein they are subject to a tax of $15 per year for all apartment
houses having seven to twelve units. The unusual circumstances under which
the units were being purchased, being on different dates and from different
real estate agents, they were not advised, and the City did not know they
were operating more than the 6 units permitted without a license. Under the
present code, the owners would be subject to a penalty of $6.62, beginning
upon the date of the purchase of the second 4 units as of February 1963,
plus their proportionate share of the $15 fee for that year of $13.23, plus
a $6 penalty for the year 1964. Under the provisions of the Code, the City
Council has the power to compromise any claims as to the amount of license
tax due. In accordance therewith, it is suggested that the amount of
$12.62 be deducted from the present claim. Council chose to take no action
on this matter.
The City Manager reported on a recommendation from the Director of
Finance to establish data processing due to increased activity in the
Accounting Office beyond their capacity to maintain an up -to -date record
and produce a current report; and to transfer the Accounting Division to
the Water Division, relocating the Purchasing Office where the Accounting
Office had formerly been located and expanding the Revenue and Licensing
Division to the section vacated by the Purchasing Office's move. It was

pointed out that the acquisition of the Lakewood Water system would also
bring an added burden on the accounting department.
Council took the recommendation for moving the Accounting Office
under submission.
The Nash Insurance Agency had been requested by their supervising
underwriter to reduce the insurance coverage of the City water reservoir
at Stewart and Gray Road from $250,000 to $25,000; however, it was
reported that through continued negotiation, the City had been able.to
increase this coverage to $50,000 which, the insurance agency states,
is the maximum amount for which it will cover the existing reservoir.
Additional coverage can be obtained through another insurance company
at a cost of approximately $2,000 added cost, which- is felt to be ex-
cessive.
The reservoir has been analyzed structurally from an engineering
standpoint through the Department of Public Works, which informs Council it
is very improbable that extreme damage could occur to the tank exceeding
the $50,000 limit of liability. The existing policy, carried forward
with the transfer of the Water Division, does contain the right to reduce
the coverage in the manner stipulated and would effect a savings of
approximately $225.
