MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
AUGUST 10TH, 1964
The City Council of the City of Downey held a regular meeting in the
Council Chamber of the Downey City Hall at 7:30 P.M., August 10, 1964,
Mayor Thomas H. Morton presiding.

Reverend John Kreider, Faith Mennonite Church of Downey, gave the invocation.
Mayor Morton announced at this time he would like to make a presentation
to Mr. Bert DuMars, stating that it was with deep regret that he had read a
letter indicating it was necessary for him to resign from the Personnel Advisory
Board. Bert DuMars was lauded by Mayor Morton and all Council Members, City
Clerk Della Doyle, and City Manager Oren L. King for the tremendous efforts he
had put into the chairmanship of the Personnel Board and for his community
service from 1956 through August 10, 1964. It was stated that his was a
valuable and distinguished service toward civic betterment and his help in
shaping and developing the mould for the City of Downey was sincerely appreci-
ated.
Mayor Morton presented a plaque to this effect to Mr. Bert DuMars, after
which Sgt. Orbry Duke, President of the Downey City Employees Association,
presented a plaque from that group.
Bert DuMars thanked Council for giving him this period to be a part of the
City development.
Mayor Morton announced the time having come acd'gone the hearing on the
appeal of Ray Ibanez on Zone Exception #491 would now be heard. He inquired
of the City Clerk if she had the Affidavit of Publication. The City Clerk
replied she had the affidavit.
Zone Exception case IP491 was reviewed by Mr. Griselle, Director of
Planning.
The Mayor asked if there was any correspondence on the case. The City
Clerk replied there was none. The Mayor asked for comments in favor of
the zone exception.
Mr. Billy L. Norton, 10310 Wiley Burke and Raymond Ibanez, Jr., appellant,
7556 Irwingrove Drive, spoke in favor of the zone exception.
Mayor Morton asked if there was anyone wishing to speak in opposition of
the case. There was no one.
It was moved by Councilman Corbin, seconded by Councilman Temple and so
ordered that the hearing on Zone Exception #491 be closed.
After discussion, it was moved by Councilman Dickerson, seconded by
Councilman Dunnum that applicant be permitted to put in a block wall fence as
requested, to establish a 45° cutoff on the corners, and that the removal of
the rail fence not be required as a condition of the zone exception.

The City Attorney advised Council that the matter of the fence should
not be contained in the zone exception as it does not come under the regula-
tions of the zoning ordinance but is contained under Section 7100.1 of the
street section„of the Downey Municipal Code.
Mayor Morton, with no objection from Council, ordered the condition
relative to the fence deleted.
^` Councilman Dickerson withdrew his second and Councilman Dunnum, her
motion. It was then moved by Councilman Dunnum, seconded by Councilman
Dickerson, and passed by the follo4 ng vote that the applicant be permitted
to construct a concrete block wall 5k to 6' in height extending from the
house to the garage and from the garage to the rear property line 12k'
from the property line, according to the plot plan and including 5' corner cut-
offs at a 450 angle for safety sight distance.

It was moved by Councilman Temple, seconded by Councilman Dickerson and
so ordered that the minutes of the meeting of July 28, 1964, be approved as
written.
The City Clerk reported on the following correspondence:
1. A letter of resignation from Mr. Bert DuMars from the Personnel
Advisory Board.
It was moved by Councilman Corbin, seconded by Councilman Dunnum and so
ordered to accept Mr. DuMar's resignation with regrets with a letter being
sent to him.
2. & 3. Letters of appreciation for sidewalk installations from Pius -X
and Spencer V. Williams Schools. Ordered accepted and filed.
4. A letter from Mr. Harold L. Smith was read in full by City Clerk
in appreciation of services of the Planning Director and his department.
Letter accepted and filed.
5. A letter from Western City Magazine requesting advertising from the
City. Received and filed.
6. A letter from Independent Cities announcing the Seminar, September 19-
20 in Palm Springs. It was moved by Councilman Temple, seconded by Councilman
Dickerson and passed by the following vote to authorize anyone of the Council
and the City Manager who are able to attend to be allowed necessary and
reasonable expenses.

7. A letter from Coca Cola Bottling Company relative to declaring
Patton Road a primary street. The letter was held for consideration along
with the City Manager's report on the matter.
8. A letter from Atty. Harry C. Williams relative to the time table for
placing the charter proposal on the November ballot.
Mr. Elwayne E. Smith, Vice Chairman of the City Charter Committee,
presented the report from the committee in the absence of Mr. Mel Quigley,
Chairman, who was out of town. It was recommended that the proposed revised
charter be placed on the November 3 election for consideration by the voters
of the City.
Mayor Morton expressed appreciation and thanks for a job well done. The
City Manager also thanked the committee for its very arduous efforts. He

advised that if Council feels that a hearing should be held in preparation
for certification by the City Clerk on or before September 4, such hearing
should be set at this time.
It was moved by Councilman Temple, seconded by Councilman Corbin and
passed by the following vote to set a hearing on the proposed revised
charter for 7:30 P.M., August 17, 1964, in the Council Chamber of the
Downey City Hall.

10. A copy of memorandum from the City Manager advising some progress
is being made in endeavors to establish a 200fbed emergency hospital
under the Federal Emergency Hospital program for civil defense and local
disaster hospital facilities. Mr. King stated it is proposed to use the
quonset but of Downey Unified School District at the Downey High School for
this purpose, provided the City participate in cleaning, painting and
repairs necessary to put the building into operation for this purpose.

11. & 12. Claims for damages from Donn Sauter and James E. Mann.
It was moved by Councilman Temple, seconded by Councilman Dickerson and so
ordered that the claims be denied and referred to the insurance carrier and
the City Attorney.
13. Memorandum from Councilman Corbin appointing Mrs. Dorothy Spearman
to the Rose Float Association. It was moved by Councilman Corbin, seconded
by Councilman Temple and so ordered that the appointment be approved as
recommended.

It was moved by Councilman Corbin, seconded by Councilman Dickerson

A report was made by Mr. Ervin Spindel relative to various tree removals
throughout the City. After discussion, it was moved by Councilman Dunnum,
seconded by Councilman Corbin to hold this item over to the next regular
night meeting, however Mr. Spindel advised there was an urgency of having this
work done before bad weather. Thus Councilman Corbin withdrew his second and
Councilman Dunnum, her motion.
It was then moved by Councilman Dunnum, seconded by Councilman Dickerson
and passed by the following vote to :approve plans and specifications for
removal of trees in various locations throughout the City under Cash Contract
#132 and authorize advertising for bids.

of completion being filed.

Mayor Morton declared a 5- minute recess, with the meeting reconvening
at 9:15 P.M. with roll call:

Mr. Jim Hartley, 12027 Paramount Boulevard, requested of Council that
the matter of Zone Exception #483, Roy Reed property, be continued-to
August 17, 1964.
It was moved by Councilman Corbin, seconded by Councilman Dickerson and
so ordered that Zone Exception #483 be continued to August 17, 1964, follow-
ing the hearing on the charter.

and passed by the following vote to accept improvements in Tract #27778,
Morning Avenue and Quill Drive, and responsibility for maintenance thereof.

It was reported by the Director of Public Works that property owners on
Alameda Street have requested City participation in construction of pavement
adjacent to the newly constructed curb and gutter. Since Alameda Street
is included in the Select System of Streets, it was recommended that the
City Council authorize construction of pavement adjacent to the above im-
provements in accordance with City policy, and transfer of funds in the amount
of $360 from Capital Improvement Miscellaneous Unbudgeted Account No. 13789
to Account No. 13788.
It was moved by Councilman Dickerson, seconded by Councilman Temple and
passed by the following vote to authorize City participation for paving at
8538 -46 Alameda Street, and approve the following transfer of funds:

It was moved by Councilman Dunnum, seconded by Councilman Temple and
passed by the following vote to accept improvements completed under
Downey Private Contract No. 38, for sanitary sewer between Lakewood
Boulevard and Arrington. Avenue, and approve the cost distribution.

Mr. Griselle reported that the applicant in Zone Change #62,
Mr. Bradish, is agreeable to changing the zone change to a zone exception,
and that there are 13 conditions set by the Planning Commission, should the
case be changed to a zone exception.

passed by the following vote to accept the recommendations of the Planning
Commission and report of the Planning Department, changing Zone Change #62
to Zone Exception #507, and approve granting of the zone exception upon the
conditions contained in the minutes of the Planning Commissionq of August 5,
1964.

Mr. King announced the resignation of Dean Boone of the Water Division.
The City Manager reported that after conferences with Mr. Newton and
Mr. McGee of the Coca Cola Company, and with Mr. Jerry Syverson and
Mr. Rod Royer of North American Aviation, the following recommendations are
being submitted for consideration by Council.
A. Authorize the City Manager and the Director of Public Works to
request that Patton Road be included in the select system of
streets from Stewart and Gray to Firestone Boulevard.
B. Authorize the City Manager and the Director of Public Works to
negotiate with the Southern Pacific officials for the crossing
of Patton Road over the Southern Pacific tracks to connect to
Firestone Boulevard.
C. Authorize the City Manager and the Director of Public Works to
request permission from the State Division of Highways for
proper signals and left -hand bays necessary for complete traffic
movements at the intersection of Patton Road and Firestone
Boulevard, and the intersection of Bellflower and Lakewood
Boulevards.
D. Authorize the paving of Patton Road, 44' curb to curb, with the
understanding that the property owners would install curbs, gut-
ters and sidewalks, and dedicate their property, with the City
installing the pavement under current City policies, if Patton
Road is designated in the select system of streets.
E. Approve the installation of a traffic signal, under early
priorities, at Patton Road and Stewart and Gray Road.

Mr. King reported that if Patton Road is approved in the select system
of streets, as noted in Paragraph A, all of the City's share may be expended
from Gas Tax funds.

The City Manager reported that continued meetings with officials of
the City of Lakewood and the City of Downey have resulted in a suggested
present worth of $436,030.00 and Lakewood officials have indicated they
would agree to recommend the following payment basis for an offer to
purchase from them:
l.. $20,340. for 30 years - $:174,094.
(using City's average interest rate of 3k percent)
2. $21,750. for 3 years - $60,936.
(also using the 32 percent interest rate.)
The payments could be made from current revenues from the 1,205 connections
of the Lakewood Water System lying in the northwest portion of the City of
Downey. The Water Advisory Board reviewed this recommendation at their
meeting on Thursday, August 6, and unanimously recommended that this
purchase proposal be made to the City of Lakewood, and unanimously
recommended that the City Council approve this purchase agreement with the
City of Lakewood.

and passed by the following vote to authorize submission of an offer to
the City of Lakewood for the purchase of the water system in the northwest
portion of the City of Downey.

Mr. King reported several resolutions from other cities relative to
local control on gambling had been received and a proposed resolution for
adoption by the City of Downey prepared. No action was taken on the reso-
lution at this time.
It was reported by Mr. King that the Guadalajara Committee has
requested preparation of a brochure for the convention in the sister city
next week. This could be printed by City forces for approximately $50.
It was suggested that the brochure be printed in Spanish.

convention in Guadalajara next week not to exceed $75, to be printed in

Mr. King reported that a number of people have brought to his attention
the parking problem on the west side of Brookshire, north of Firestone Boule-
vard. It was recommended that the matter be referred to the Traffic Committee
for report and consideration of parking limits or restrictions between the
hours of 4:30 and 6:00.
It was reported that the Youth Advisory Committee, meeting in conjunction
with the Police Advisory Committee, considered the request of Mr. Ralph
Wittick, owner of the Golden Cue Billiard Hall, for a change in the municipal
ordinance pertaining to the use of a billiard hall by minors, recommends
that no change be made.

passed by the following vote that the recommendation of the Youth Advisory
Committee be accepted and that Mr. Wittick, owner of the Golden Cue Billiard
Hall be so advised by Council.

Mr. Mort Saltman, Chairman of the Citizens Tax Committee, presented a
report and recommendation for a 4% tax for less than 30 -day occupancy in
motels and hotels.
After discussion, it was moved by Councilman Dunnum, seconded by
Councilman Dickerson and failed to pass as shown by the following vote, to
take this matter under submission until the next regular council meeting.

The City Attorney advised that it would be necessary to rewrite the
ordinance to amend the Downey Municipal Code, therefore, it would not be
practical to introduce the proposed ordinance at this time.

bed tax to be rewritten by the City Attorney.

It was reported that two or three of the Sister Committee members will
be attending the Independence Day celebration in Guadalajara and it was
suggested that one or two members of Council attend. It was added that the
cost of the float to be entered from the City of Downey would approximate
$350.
Councilman Temple suggested that the Sister City Committee have a fund
raising project to raise the money for the cost of the float. It was also
suggested that Council extend its thanks to the Rose Float Association for
its offer to send the Queen to Guadalajara to ride on Downey's float.

so ordered to refer the matter of furnishing the necessary funds to enter a
float in the Independence Day Celebration in Guadalajara to the Sister City
Committee.

Mr. Saltman reported on remarks made by Mr. Phillip Watson,.Tax
Assessor, at a meeting held on Friday, August 7.
Councilman Corbin reported on the League of California meeting and
advised there will be four sections of league represenatives with one member
to be appointed from each section to serve on the M.T.A. Board, and that
Kermit Billy had been recommended by the section of which Downey is a
representative. This section will consist of 30 cities.

Councilmen Morton and Dickerson reported briefly on the AMA meeting held
recently in Miami Beach, Florida, with Mayor Morton urging Mr. C. W. Barrett,
Manager of the Downey Chamber of Commerce, to bear in mind the criteria for
future brochures as brought out at the meeting- -for the City of Downey to
consider parking first, then the community itself, showing schools, churches
and residential- -where the executives will be living.
Chief Robert Gain of the Downey Fire Department expressed his apprecia-
tion for Council's action in proposing the purchase of the :Lakewood Water
Division within the City of Downey.
There being no further business to come before Council, the meeting was
adjourned at 10:45 P.M. to 7:30 P.M., August 17, 1964, in the Council Chamber
