MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
JULY 28TH, 1964
The City Council of the City of Downey held a regular meeting in the
Council Chamber of the Downey City Hall at 8:00 A.M., July 28, 1964,
Mayor Pro Tempore Scott E. Temple presiding.

Jim Lacey of the Downey Y.M.C.A. delivered the invocation.
Mayor Pro Tem Temple declared the hearing open on assessments for weed
abatement throughout the City and inquired of the City Clerk if she had the
Affidavit of Publication. The City Clerk stated she had the affidavit.
The Mayor Pro Tem inquired if there were any written protests. The
City Clerk replied there were no written communications.
There were no oral comments.
It was moved by Councilman Corbin, seconded by Councilman Dunnum and
so ordered that the hearing on weed abatement assessments be closed.
It was moved by Councilman Corbin, seconded by Councilman Dunnum
and passed by the following vote to confirm the assessments for the weed
abatement program in the City of Downey.

It was moved by Councilman Dunnum, seconded by Councilman Corbin and
so ordered that the minutes of the Council Meeting of July 13, 1964, be
approved as written.
The City Clerk reported receipt of one piece of correspondence at
4:30 P.M. the day before the Council Meeting. Mr. King read the letter
which was from Mr. S. T. Ziler, requesting paveout at 10400 -10418 Downey
Avenue adjacent to improvements being constructed by him at that location.
Mr. Spindel, Director of Public Works, stated that. the request is in
accordance with Council's policy in providing paveouts on select system
of streets and recommended that the request be granted.
It was moved by Councilman Dunnum, seconded by Councilman Corbin and
passed by the following vote to grant Mr. Ziler's request for a 50' paveout
at 10400 -10418 Downey Avenue.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AMENDING SECTION 3179 OF THE DOWNEY MUNICIPAL CODE AND
REPEALING SECTION 3180, WHICH SAID SECTIONS RELATE TO
TRUCK ROUTES WITHIN THE CITY

RESOLUTION NO. 1413
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY,
CALIFORNIA, APPOINTING A MEMBER OF SAID COUNCIL OF SAID
CITY SELECTION COMMITTEE PURSUANT TO PART 3 OF DIVISION
10 OF THE PUBLIC UTILITIES CODE
The resolution was read by title only. It was recommended that
Councilman Ben Corbin be appointed to the committee. The City Manager
outlined the purpose of the committee and reported that thefirst meeting
is to be held sometime in September. It was moved by Councilman Corbin, sec-
onded by Councilman Dunnum and so ordered that further reading be waived.

and passed by the following vote that Resolution No. 1413 be adopted.

AVENGE AND O'T'HER STREETS)
The resolution was read by title only. The Director of Public Works
read the debt limit report and presented the factual data of the proposed
improvements for AD #73. It was moved by Councilman Corbin, seconded by
Councilman Dunnum and so ordered that further reading be waived.

DECLARING ITS INTENTION TO IMPROVE BIXLER AVENUE AND
OTHER STREETS IN THE CITY OF DOWNEY, DETERMINING THAT
BONDS SHALL BE ISSUED TO REPRESENT THE COST THEREFOR,
DECLARING THE WORK TO BE OF MORE THAN LOCAL OR ORDINARY
PUBLIC BENEFIT, AND THAT THE EXPENSE THEREOF SHALL BE
ASSESSED UPON A DISTRICT (AD 73)

It was reported that all work required by the contractor in the
improvement of Telegraph Road between Serapis and Passons under Cash Con-
tract #124 has been satisfactorily completed. There was additional work
required of the contractor in the construction of a storm drain culvert
and as a result additional time was necessary to complete the project.
It was recommended that Council authorize an extension of time of 10 work-
ing days as requested by the contractor, and that the improvements be
accepted with responsibility of the maintenance thereof.
It was moved by Councilman Dunnum, seconded by Councilman Corbin
and passed by the following vote to approve an extension of 10 days'
working time on Cash Contract #124, accept the work, authorize the filing
of a Notice of Completion, and assume the responsibility of the maintenance
thereof.

It was reported that an extension of time of 10 working days has been
requested by the contractor for Cash Contract #121, Old River School Road,
as the result of extra work required of the contractor because of curb,
gutter, sidewalk, construction being paid for by the property owners, in
order to complete the improvements in this area.
It was moved by Councilman Corbin, seconded by Councilman Dunnum and
passed by the following vote to approve the request for an extension of 10
working days for Cash Contract #121, Old River School Road.

After a summation of bids for Cash Contract #104 -A, Gardendale Street
between Brookshire Avenue and Dolan Avenue, it was recommended that the bid
be awarded to the lowest and best bidder, Geis.ler Construction, Inc., at the
unit prices of the bid proposal, and that the discrepancies in the bid
proposal due to incorrect extension of figures be waived, with rejection of
all other bids.
It was moved by Councilman Dunnum., seconded by Councilman Corbin and
passed by the following vote that the bid for Cash Contract #104 -A,
Gardendale Street, be awarded to the lowest and best bidder, Geisler
Construction, Inc. at the unit prices of the bid proposal, that the dis-
crepancies in the bid proposal due to incorrect extension of figures be
waived and that all other bids be rejected.

After a summation of bids on Cash Contract #112, modification of
traffic signal at Imperial Highway and Ardis Avenue, it was moved by
Councilman Corbin, seconded by Councilman Dunnum and passed by the follow-
ing vote that the bid be awarded to the lowest and best bidder, C.T. & F.,
Inc., in the amount of $5,790, and that all other bids be rejected. (Mr. Spindel
reported this work is being paid completely by North American Aviation, Inc.)

After a summation of bids on Cash Contract #135, demolition of Old
U. S. Post Office Building (parking lot), it was moved by Councilman

It was moved by Councilman Dunnum, seconded by Councilman Corbin
and so ordered to table the matter relative to the easement for walkway
on LaVilla Street until requested by Council to be placed on the agenda,
at a future time.
Bill Willson, representing Pius X High School, requested matching
funds for construction of sidewalks 9 feet wide, approximately 960 feet
long, and a 20" high retaining wall. Mr. Spindel pointed out that in
the past, half of the normal size construction on this type of street for
5' sidewalk has been contributed by the City, and that granting of this
request for 4k feet of sidewalk matching funds would set a dangerous
precedent.

and passed by the following vote to approve recommendation of the Department
of Public Works for matching funds in the amount of $800 for sidewalk
construction under MF #27, Gardendale Street.

Walter H. Young, Attorney, 215 W. 5th Street, Los Angeles, representing
Roy Reed in Zone Exception Case #483, requested a continuance of the case
to the next Council Meeting.
It was moved by Councilman Dunnum, seconded by Councilman Corbin and so
ordered to continue Zone Exception Case #483, Roy Reed, to the night meeting
of Council to be held on August 10, 1964.

passed by the following vote to release funds to Dr. Morris Griffin covering
the cost of street improvements in Tract #14395, in Lot Split 316 at 9330
Telegraph Road in the amount of $500 to insure construction cost of curb,
gutter and paving on the northerly half of Cedartree Road.

It was moved by Councilman Corbin, seconded by Councilman Dunnum and
passed by the following vote to authorize the Director of Public Works to
attend the Annual American Public Works Conference in Atlantic City, New
Jersey, October 4, through 7, 1964, and also for the City Manager to attend
the International City Managers Association Meeting in Chicago from
September 27 to October 1, 1964, with reasonable expenses allowed.

Councilman Corbin inquired of the Director of Finance just what decision
had been made by the Los Angeles County Tax Assessor Watson relative to the
City of Downey's assessed valuation. Mr. Gabriel stated that the preliminary
figures show a decrease in assessed valuation for the City of Downey of
approximately $3,000,000.00.
Mr. King stated that the ordinance relative to card rooms had been reviewed
and it is felt that with proper administration it will not adversely affeC-t
the women's clubs and organizations in the City. The Chief of Police will
have a more detailed report to submit at the next council meeting. Also, these
will be resolutions presented for Council's consideration of legislation to
be considered along these lines at the next meeting.
Mr. Spindel reported that the General Telephone Company is today starting
construction of underground telephone cables on Gallatin Road.

Mr. King reported on a petition from property owners adjacent to
property at 8400 Orange Street immediately east of 12270 Dolan Street,
requesting it be cleaned up. Assistant Director of Building and Safety
Bill Fritsche reported that the property is now in escrow and that the
property owner is agreeable that the approximate $400 cost to clean this
area, be paid out of escrow.
