HomeMy WebLinkAboutMinutes-07-13-64-Regular MeetingMINUTES OF THE CITY COUNCIL OF THE CITY OF DOWNEY JULY 13, 1964 The City Council of the City of Downey held a regular meeting in the Council Chamber of the Downey City Hall at 7:30 P.M., July 13, 1964, Mayor Thomas H. Morton presiding. PRESENT: Councilmen: Dickerson, Temple, Corbin, Dunnum,, Morton. ALSO PRESENT: Oren L. King, City Manager Royal M. Sorensen, City Attorney Sherman Griselle, Director of Planning A. C. Gabriel, Director of Finance Ray Lake, Director of Building & Safety Ivan A. Robinson, Police Chief Robert Gain, Fire Chief Ervin Spindel, Director of Public Works Lee Leavitt, City Engineer Della Doyle, City Clerk Alberta Pfeiffer, Deputy City Clerk Reverend George Wood, First Assembly of God Church, delivered the invocation. Mayor Morton announced the presentation by the Chief of Police of certificates to Sgts. Vance Reynolds. and Al Soule which are the 1st certifi- cates to be received by supervisory officers for specialized training under the standards of the Peace Officers Association. The Mayor assisted Chief Robinson in presenting these certificates.. The Mayor then called upon Emmitt #illiams, Chairman of the Sister City ...., Committee the past year,. who reported: on the Fift h Annual Conference in Washington, D. C. relative'to the People -to- People Program. He reported that no one, in his estimation, equalled Downey's Sister City program and particu- larly laxl in their student exchange project. He thanked Council to have been allowed to represent Downey in the conference. Council praised Mr. Williams for the excellent job he is doing. Mayor Morton mentioned that Congressman Del Clawson had taken time to have dinner with Downey representatives and that the certificate to the City of Downey for the Readers Digest Award had been received and would.be brought to the next Council Meeting. Mayor Morton announced that the time of 7:30 having come, the hearing on Zone Exception #478 which had been continued to that time would now be heard. He inquired of the City Clerk if she had the Affidavit of Publication. The City Clerk replied she had the affidavit. Mr. Griselle reported on Zone Exception #478. The Mayor asked if there was any correspondence relative to the zone exception. The -City Clerk replied there was none. The Mayor then asked, for oral comments in favor of the zone exception. Speaking in favor of the zone exception #478 were Leslie Olson, 10022 Tristan Drive, representing applicant, Downey Ford Agency, and the owner, Ralph Graham. Speaking in opposition were: Walter Frederickson, 9017 Suva Street Mr. Garcia, 9509 Arrington Mrs. James Oliver, 9545 Arrington Miles Fernald, 9555 Arrington Leslie Olson and Ralph Graham then spoke to rebuttal. Council Minutes - 7/13/64 -1- 2077 It was moved by Councilman Corbin, seconded by Councilman Temple and so ordered that the hearing on Zone Exception #478, 9500 -9606 Lakewood Blvd., Downey Ford Agency, be closed. It was moved by Councilman Temple, seconded by Councilman Dunnum and passed by the following vote to uphold the Planning Commission with addition of Conditions #6 and #7, that the P.A. system shall be separated and the rear portion turned off after 9:30 P.M., and that the body and paint operation shop shall close and cease operation at 6:00 P.M. He inquired of the City Clerk if she had any correspondence on the intention to vacate the sewer easement. The City Clerk replied there were none. There were no oral comments. It was moved by Councilman Corbin, seconded by Councilman Dickerson and so ordered that the hearing on the intention to vacate a sewer easement easterly of Tweedy Lane be closed. RESOLUTION NO. 1408 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING THE VACATION OF A SEWER EASEMENT EXTENDING EASTERLY FROM TWEEDY LANE The resolution was read by title only. It was moved by Councilman Corbin, seconded by Councilman Dickerson and so ordered that further reading be waived. It was moved by Councilman Corbin, seconded by Councilman Dickerson and passed by the following vote that Resolution No. 1408 be adopted. The City Clerk replied there was none. There was no oral comment. It was moved by Councilman Temple, seconded by Councilman Dickerson and so ordered that the hearing on the intention to vacate a portion of Nada Street be closed. RESOLUTION NO. 1409 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING VACATION OF A PORTION OF NADA STREET BETWEEN SUSAN AVENUE AND OLD RIVER SCHOOL ROAD The resolution was read by title only. It was moved by Councilma nC Corbin, seconded by Councilman Temple and so ordered that further reading be waived. It was moved by Councilman Corbin, seconded by Councilman Dickerson and passed by the following vote that Resolution No. 1409 be adopted. AYES: 5 Councilmen: Dickerson, Temple, Corbin, Dunnum, Morton NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Council Minutes - 7/13/64 -2- 20'78 Mayor Morton announced the time for the hearing on Zone Exception #487 on Telegraph Road and asked the City Clerk if she had the Affidavit of Publication. The City Clerk replied she had the affidavit. The Mayor asked if there was.any written correspondence. The City Clerk replied she had one letter from Dr. Octavio Arana in protest of the zone exception. Speaking in favor of the zone exception case #487 was David Shore ,..� 8540 DaCosta, representing Dr. Morris Griffin. Herbert Keith Mann, 9342 Telegraph Road also apoke in favor. Speaking against the Zone Exception was Mr. H. S. Peterson, 9266 Telegraph Road who was the appellant. At this point the Mayor stated that Mr. Peterson, as the appellant, should have been allowed to speak first and advised that he would have the opportunity for rebuttal. Also speaking in favor of the appeal were: Lee Jordan, 9178 Cedartree Raymond Novotny, 9362 -64 -66 Telegraph Road Frank Slanka, 9040 Lemoran Avenue Speaking against the appeal was Dr. Morris Griffin, 10634.Pica Vista Rd., who owned the property in question at 9330 Telegraph Road. Mr. Peterson presented his - rebuttal. Due to a controversy over the construction of a masonry wall set forth in Condition #7 of the Planning Commission's recommendation, the City Attorney was asked to clarify this condition. He stated that at such time as the property owner desires to avail himself of the zone exception and to develop the property as he seeks under the exception,the wall will then be required. If he does not desire to develop the property as indicated under the zone ^-� exception, he would not then be required to place the wall upon the property because he would not be using the exception. This wall is only a condition of the exception - -if he does.not use the exception, there is no way in which the City can compel him to install the wall. It was moved by Councilman Dunnum, seconded by Councilman Temple and so ordered that the hearing on Zone Exception #487 be closed. The Mayor declared a recess with Council reconvening at 9:25 P.M. with roll call: PRESENT: Councilmen: Dickerson, Temple, Corbin, Dunnum, Morton Tne Mayor requested the Director of Planning to review the conditions of Zone Exception #487 as compared to the basis of the appeal. It was moved by Councilman Corbin, seconded by Councilman Dickerson and passed by the following vote that the appeal of Zone Exception #487, 9330 Telegraph Rd.., Dr. Morris Griffin property, be denied and the decision of the Planning Commission upheld. The Mayor asked if there was any written correspondence. There was none. There were no oral comments. Mr. Spindel reported that since notices had been sent to the property owners in DIP #514, all improvements required had been completed with the Council Minutes - 7/13/64 -3- 20"7: exception of 8209 Priscilla Avenue, and requested authority from Council to proceed to improve this property under Chapter #i27 of the Streets and Highways Code. It was moved by Councilman Dunnum, seconded by Councilman Temple and so ordered that the hearing on Downey Improvement Project #514, Priscilla Avenue, be closed. It was moved by Councilman Corbin, seconded by Councilman Temple and passed by the following vote to authorize the - Department of Public Works to �--, proceed under Chapter #2/ of the Streets and Highways Code for improvements at 8209 Priscilla Avenue. She stated that the City Attorney had advised that there are some problems relative to dedication and that.the matter should be taken under submission until these problems.are cleared up. It was moved by Councilman Dunnum,, seconded by Councilman Dickerson and so ordered to take under submission until the next regular Council Meeting Zone Exception #483, Roy Reed (Imperial Highway and - Brookshire Avenue). The City Clerk reported on the following correspondence: 1. Letter from Ray Ibanez,. appealing Zone Exception #491. It was moved by Councilman Dickerson, seconded by Councilman Temple and so ordered that a hearing be set at 7:30 P.M., August 10, 1964, in the Council Chamber of the Downey City Hall on Zone e Exception #491. 2. Letter from the Greschner Investment Corporation. The City Attorney had reviewed the letter and he stated that under the Streets and Highways Code Parking Law of 1943 the City Council may sell any property acquired for parking places which is pot needed for that public use. The property,in question -was acquired in Vehicle Parking District No. 1. If the Council finds that the portion of the property.in question is not required for parking purposes, it may then dispose of it under the provisions of this section by cause of. certain conditions. A resolution taking this action was read by the City Attorney: RESOLUTION NO. 1410 A RESOLUTION. OF THE CITY COUNCIL OF THE CITY OF DOWNEY DETERMINING THAT CERTAIN PROPERTY IN VEHICLE PARKING DISTRICT NO. 1 IS NOT NECESSARY FOR PUBLIC.PARKING The City Attorney also read an agreement conveying an easement of light and air. Quarterly report from the Downey Junior Chamber of Commerce. Councilman Corbin requested a report on Item 1 in the amount of $210. Ordered accepted and filed. 4. Memorandum of committee appointments from Councilman Dickerson. It was moved by Councilman Dickerson, seconded by Councilman Corbin and •—ft so ordered to approve the citizens committee appointments as recommended: ROSE FLOAT COMMITTEE - Ray Grimes SISTER CITY COMMITTEE - Mrs. Ella Nelson Mrs. Doris Clark Mr. Ray Orlich TRAFFIC COMMITTEE - Mr. Lynn Pace 5. Request for parade permit from the First Christian Church of Downey to be held at 7:30 P.M. September 11, 1964. It was moved by Councilman Temple, seconded by Councilman Dickerson and so ordered that approval for the parade be granted as requested. 6. A copy of a resolution submitted from the Independent Cities Asso- ciation of Los Angeles County for information only. 7. A letter from Lucille T. Hoskins, 11735 Patton Rd., Downey, object- ing to zoning exception #494 on C1eta Street, requesting Council to have the Planning Commission reconsider the case. The City Attorney advised that the only remedy is an appeal. Councilman Dunnum stated she felt that persons interested in planning and zoning matters should be informed of the procedures relative to public hearings and advised when it is possible to speak at the public hearings, as well as being advised of limits of filing appeal, procedures, etc. Mr. Griselle, Director of Planning, advised that there is a cover sheeton agenda available to all who attend Planning Commission hearings, although there is no pro- vision made for advising of appeal procedures, other than to merely advise persons of the privilege of appealing. Council directed the Planning Director to send a letter to Mrs. Hoskins within the time limit for filing an appeal in order to advise her of this procedure. Letter ordered received and filed. Mayor Morton requested the City Clerk to read in full a letter (8) from Mr. Ken Wright of Rialto, California expressing appreciation of the beautification of Firestone Boulevard by the planters. It was recommended that a copy of this letter be submitted to the City Beautification Committee. ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING SECTION 3179 OF THE DOWNEY MUNICIPAL CODE AND REPEALING SECTION 3180, WHICH SAID SECTIONS RELATE TO TRUCK ROUTES WITHIN THE CITY The ordinance was read by title only. AYES: 5 Councilmen: Dickerson, Temple, Corbin, Dunnum, Morton NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None ORDINANCE NO. 250 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE DOWNEY MUNICIPAL CODE BY ADDING TO CHAPTER 5 OF ARTICLE VI A NEW PART TO BE DESIGNATED PART 8 THEREOF CONSISTING OF SECTIONS 6575 THROUGH 6580 AND RELATING TO CARD ROOMS The ordinance was read in full by the City Attorney. Then a statement from the Chief of Police, showing the urgency of the passage of the ordinance on an emergency basis, was made. Councilman Dunnum moved that the ordinance be taken under submission for further study, due to the fact it may inadvertently affect women's clubs, charitable organizations and the Park District which would involve_ teaching of bridge classes and social card playing. The City Attorney recommended a section being added to the ordinance to read as follows: "No permit shall be required for any non- profit organization operating within the City at the time of the adoption of this ordinance and which has been in operation for two years prior thereto, nor to any card school or club operated by any governmental agency." Councilman Dunnum's motion to take the ordinance under submission died for lack of a second. Philip Smith, in the amount of $4,332 which is substantially above the Engineer's estimate for Cash Contract #104, Gardendale Street, it was moved by Councilman Temple, seconded by Councilman Dickerson and so ordered that the bid be rejected and authority granted to readvertise for construction bids. It was moved by Councilman Corbin, seconded by Councilman Temple and so ordered that a ten -day extension of time be granted to the contractor for AD #17, Rutgers Avenue, as requested. It was moved by Councilman Temple, seconded by Councilman Dickerson and so ordered to authorize circulation of petition for improvements on Manzanar Avenue, et al. as had been requested by the property owners. It was moved by Councilman Dickerson, seconded by Councilman Corbin and passed by the following vote to authorize the following transfer of funds relative to the Vehicle Parking District No. 1, as money from the sale of bonds has been received and deposited in the special account for that assessment district. AYES: 5 Councilmen: Dickerson, Temple, Corbin, Dunnum, Morton NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None It was moved by Councilman Corbin, seconded by Councilman Tem]?le and so ordered that the Department of Public Works be authorized to take the necessary action under Chapter #27 of the Streets and Highways Code to com- plete improvements on Paramount Boulevard between Lubec Street and Florence Avenue, Downey Improvement Project #517 and #518. After a summation of bids for annual trash pickup and disposal agreements for the City and Park District, it was moved by Councilman Corbin, seconded by Councilman Dickerson and passed by the following vote to award the bid to the lowest and best bidder, Capital Rubbish Disposal of Whittier at the cost of $120 per month and that all other bids be rejected. Council Minutes — 7/13/64 -8- 2084 It was moved by Councilman Dunnum, seconded by Councilman Temple and so ordered to take under submission the matter of the easement for walkway on LaVilla Street for further study. The City Manager reported that in compliance with a request from the Chief of Police, it is recommended the Council authorize two police technicians, instead of the two cadets previously approved in the 1964 -65 police budget, to be used in the field of general criminology, including crime scene searches, lie detection, fingerprinting, photography and general preventive police work, This transfer will enhance the training program in the schools and general safety programs throughout the City. A complete schedule for the safety programs is being developed under the supervision of Captain Roger Harmon and Lt. Ferice Childers. Authority from Council to employ two Police Technicians instead of the two cadets will result in °a difference in pay scales from $4,000 per year for the cadets to $6732 for the police officers. No additional funds are needed, however,. as this can be absorbed in the current budget of the Police Department. It was moved by Councilman Dunnum, seconded by Councilman Corbin and passed by the followhg vote to authorize employing of two police technicians as recommended by the Chief of Police and as set forth in Item 1 of the City Manager's Report. AYES: 5 Councilmen: Dickerson, Temple, Corbin, Dunnum, Morton NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None It was recommended that the members of the non - profit corporation of the Municipal Hospital be appointed soon; that O'Melveny & Myers be instructed to proceed with the Articles of Incorporation and the By -Laws for the non - profit corporation. It was suggested by Councilman Corbin that a duty sheet for the members of the corporation be prepared, also showing the responsibilities of terms of office. It was moved by Councilman Corbin, seconded by Councilman Temple and so ordered to instruct the firm of O'Melveny & Myers to proceed with the Articles of Incorporation and the By -Laws for .the non- profit corporation as set forth in their letter of November 19, 1963. The City Manager reminded Council he will be attending an Advance Administration Course at USC the week of July 20 -24 from 8 :30 to 9 :00 and will be available if needed. Mr. Spindel submitted to Council,.an Annual Report on Matching Funds, reporting that it is allowable under the new Collier -Unruh Local Transporta- tion Development Act to accumulate matching funds for 10 years in advance and that every effort is being made the first few years under the operation of the Act, to accumulate as much matching funds as possible, since unless the Act is amended, the matching requirement will increase in the future. To continually keep informed on the overall development of Downey with special references to industrial activity, Chamber of Commerce activity, and City Council programs and policies.relative to industry. 2. To study proposals of the Chamber of Commerce, other.groups and individuals for City action to improve Downey's industrial climate; to analyze pending legislation and policies,effecting business and industry; and to.make recommendations thereon to the City Council for the overall good of the Committee. 3. To consider the very long range character and needs of Downey's industrial areas, and recommend changes in City programs, policies, or qualities for the proper development of such areas. 4. To consider and make recommendations on such matters as may be referred by the City Council. and written reports to be presented to the City Council quarterly. Mrs. Betty Kilpatrick, 8603 Meadow Road, requested that Council complete the appointments to the Rose Float Association and officially appoint Dr. Arthur O'Toole at this time.
