MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
MAY 11TH, 1964
The City Council of the City of Downey held a regular meeting in the
Council Chamber of the Downey City Hall at 7:30 P.M., May 11, 1964,
Mayor Thomas H. Morton presiding.
PRESENT: Councilmen: Dickerson, Temple, Corbin, Dunnum, Morton

Reverend Albert Epp of the Immanuel Mennonite Church of Downey delivered
the invocation.
Mayor Morton announced Dr. Denny, President of the Heart Association,
was to make a presentation to Dr. Joseph M. Oyster commending him on his
heart health education, research and community service. Dr. Denny ex-
plained this is an annual service award and shows eight years' service and
effort however the total time would actually amount to twelve years.
Dr. Denny stated that there were two awards, the second one being for ex-
ceptional service and a special token of the Association's esteem for time,
efforts and skills which went into the Heart Associations general practice
and symposiums.
The Mayor commended Dr. Oyster on his outstanding service in this field.
Dr. Denny then introduced the 1964 Heart Princess who had undergone heart
surgery, Mary Ann Samson.
The Mayor announced the time and place for the hearing set on Zone Case
#458 would be taken out of order on the agenda at this time. He inquired
of the City Clerk if she had the Affidavit of Publication. City Clerk
Della Doyle replied she had the affidavit.
Mr. Sherman Griselle, Director of Planning, presented a report on
Zone Change #458.
Mayor Morton inquired of the City Clerk if there was any correspondence
on Zone Case #458. The City Clerk replied there was none. The Mayor then
inquired if there was anyone wishing to speak in favor of the case.
Ralph Giffin, Attorney -at -law, spoke on behalf of appellant, Ray Noxsel.
Mr. Giffin brought out some changes where the fence would be raised and more
buffer provided.

passed by the following vote to deny the appeal on Zone Exception #458 and
uphold the action of the Planning Commission.

RESOLUTION NO. 1365
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ORDERING VACATION OF A PORTION OF BYERS STREET, "FUTURE
STREET ", EXTENDING WESTERLY FROM MARBEL AVENUE AT THE
WESTERLY END OF BYERS STREET, AS SHOWN ON TRACT NO. 15999
The resolution was read by title only. It was moved by Councilman
Temple, seconded by Councilman Dickerson and so ordered that further reading
be waived.
It was moved by Councilman Temple, seconded by Councilman Dunnum and
passed by the following vote that Resolution No. 1365 be adopted.

Mayor Morton announced the hearing on Downey Improvement Project #502,
Sites #6 and #7 which had been continued from a previous meeting.

Mr. Ervin Spindel, Director of Public Works, reported the property
owners relative to these two sites, had requested paving be paid by gas
tax funds and stated that this could not be done as the construction work
was already done. If the City were to pay for the paving, it would require an ap-
propriatibn cYf $698 from unappropriated reserves to Account #15502, and that the
Street Superintendent be directed to modify the assessments: DIP -502 -6 from
$847.15 to $371.32, a difference of $475.83; DIP -502 -7 from $412.29 to $190.12,
a difference of $222.17.
It was moved by Councilman Temple, seconded by Councilman Corbin and so
ordered that the hearing on DIP #502 be closed.
It was moved by Councilman Temple, seconded by Councilman Corbin and
passed by the following vote to authorzie an appropriation of $698 from unap-
propriated reserves to Account No. 15502 and that the Street Superintendent be
directed to modify the assessments in Item 6 from $847.15 to $371.32, and in
Item #7 from $412.29 to $190.12.

Mayor Morton announced the hearing on Downey Improvement Project #502,

FOR DOWNEY IMPROVEMENT PROJECT NO. 502, BELLFLOWER
BOULEVARD
The resolution was read by title only. It was moved by Councilman
Temple, seconded by Councilman Dickerson and so ordered that further
reading be waived.

Speaking for the Planning Resolution #86, Zone Change #99, were Mr. Hughes
and Mr. Carl Woodall, 9508 Brookshire.

ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AMENDING THE ZONING MAP ADOPTED BY SECTION 9107 OF THE
DOWNEY MUNICIPAL CODE (PLANNING RESOLUTION NO. 86, ZONE
CHANGE CASE #99)
The ordinance was read by title only. It was moved by Councilman Temple,
seconded by Councilman Dickerson, and so ordered that further reading be
waived.

Mr. Griselle reviewed Zone Change Case #100. The Mayor inquired if
there was any correspondence relative to Zone Case #100. The City Clerk
replied there was none.
Speaking for the Planning Resolution No. 87, Zone Change #100 was
Mr. Leslie Olson, 11022 Tristan Drive, representing applicant in the case.

Mayor Morton announced the hearing on the appeal to Zone Exception IP469
filed by;Mr. Mendel Friedman, operator of a sanitarium on Lakewood Boule-

Mr. Griselle reviewod the zone case.
The Mayor asked the City Clerk if she had any correspondence on the
matter. The City Clerk replied she had five letters which related mainly
to the services supplied by the rest home.

so ordered that the letters be received and filed.
Speaking for appellant was Attorney Bill Willson, 10833 Downey Avenue,
Everett B. Mansur, Consultant, 505 Segoria Avenue, San Gabriel, Albert
Kriss, A.I.A. and Phill Silver, Attorney. Attorney Silver submitted
letters to Council for evidence of need for this zone exception.
It was moved by Councilman Temple, seconded by Councilman Corbin and
so ordered that the letters be received for the record.
Speaking against the Zone Exception #469 were:

Attorney Willson presented his rebuttal and, in answer to inquiries
relative to the type occupants in seven residences on the grounds of the
Lebanon Sanitarium, Dr. Leonard Krause was called upon.
It was moved by Councilman Temple, seconded by Councilman Dickerson
and so ordered that the hearing on Zone Exception #469 be closed.
As others indicated a desire to speak further, It was moved by Councilman
Dunnum, seconded by Councilman Temple and so ordered that the hearing be
reopened.
Mrs. Casey Baracz, 11909 and 11911 Marbel, spoke against the zone
exception.
Speaking for the Zone Exception #469 were Mendel Friedman, 10223 Lakewood
Boulevard, Lillian Smith, 11945 Lakewood Boulevard and Mrs. Cleveland, 12034 Marbel.

It was moved by Councilman Temple, seconded by Councilman Dickerson
and so ordered that the hearing on Zone Exception #469 be closed.
It was moved by Councilman Dunnum that Zone Exception Case #469 be
taken under submission. Motion died for lack of a second.
It was then moved by Councilman 'Corbin, seconded by Councilman Dickerson
and passed by the following vote that Zone Exception #469 be'granted including
^ the seven houses on Marbel, but that the effective date of the approval be
delayed until such time as conditions are submitted by the Planning Com-
mission, Planning Department, Building Department and Fire Department and
final approval of such conditions by the City Council.

Mayor Morton declared a recess at 11:10 P.M. with Council reconvening
with roll call:

It was moved by Councilman Temple, seconded by Councilman Dickerson
and so ordered that the minutes of April 28, 1964 be approved as corrected,
and May 6, 1964 be approved as written. Councilman Morton requested the
minutes be further corrected, to show that Mr. Wendell Wiser stated on the
matter of Florence Avenue development, he was amenable to C -H development
rather than C -4.
The City Attorney was asked to review the agreement between the
Chrysler Corporation and the City of Downey, along with Attorney Leary
representing Chrysler.

passed by the following vote to authorize the Mayor to sign the agree -ment
between Chrysler Corporation and the City of Downey as outlined by the City
Attorney.

Chief of Police Ivan Robinson complimented the press on their coverage
on the recent commendable action upon the part of Officer 'He
stated it was due to the excellent police techniques, courage in line of
duty, good training and good judgment which permitted Officer YAW%e V
accomplish what he did in complete safety to himself and fellow officers in
the capture of men involved in the robbery of Boys Market.
The City Clerk reported on the following written correspondence:
(1) A letter from the Independent Cities relative to nominations.
Ordered received and filed.
(2) A letter of appreciation for action taken relative to the Gainford
Street drainage from Mr. & Mrs. F. D. Stevenson. Ordered received and filed.
(3) A letter from the Free Methodist Church in appreciation of extension
r-ft of the sewer line to their church building site. Ordered received and filed.
(4) Downey Chamber of Commerce April report of activities and financial
statement. Ordered received and filed.
(5) Budget request from the Sister City Committee. Ordered received
and filed.
(6) An appeal from Mr. M. A. Baker on Lot Split #323. It was moved
by Councilman Temple, seconded by Councilman Dickerson and passed by the

following vote to grant the request of Mr. Baker and modify Condition #3
of the Planning Commission approval to allow applicant to retain the
existing residence, except for the garage which must be removed, provided
all other conditions are complied with.

(7) A letter of appeal and required $50 deposit to Zone Exception
#483 from Mr. Roy Reed, Imperial Highway.
It was moved by Councilman Corbin, seconded by Councilman Temple and
so ordered to set a hearing on Zone Exception #483 for 7:30 P.M., June 8,
1964, in the Council Chamber of the Downey City Hall.
(8) A letter from the Downey Civic Chorus requesting secretarial
assistance on formulating the history of the City. It was suggested that
the schools might be able to assist in obtaining this secretarial service.
Ordered received and filed.
(9) A request from Ralph E. Wittick of The Golden Cue for amendment
to the ordinance relative to billiard halls.
It was moved by Councilman Temple, seconded by Councilman Dunnum and
so ordered that this request be referred to the Youth Advisory Committee
and Police Advisory Committee.

ESTABLISHING RATES FOR THE SERVICE OF WATER BY THE CITY,
AND RULES AND REGULATIONS FOR THE SERVICE OF WATER BY
THE CITY
The resolution was read by title only. The Director of Public Works
submitted to Council, charts upon which the rates are based in a comparison
of rates existing with other agencies in the City.

be rejected.

After a summation of bids for slurry seal, Cash Contract #113, it was
moved by Councilman Corbin, seconded by Councilman Dickerson and passed by
the following vote that the bid be awarded to the lowest and best bidder,
Slurry Seal Corporation, in the amount of the unit price submitted, and that
all other bids be rejected.

After a summation of bids on Cash Contract #114, Paramount Boulevard,

bid be awarded to the lowest and best bidder, Griffith Company, in the
amount of the unit prices in the bid proposal and that all other bids be
rejected.

It was reportod by Mr. Spindel, Director of Public Works, that prior to
opening of the bids on Cash Contract #129, Firestone Boulevard Center Island
Excavation, a discrepancy in quantities was disic`bvered too late to be
brought to the attention of all prospective bidders. Therefore, it was rec-
ommended that all bids be rejected and authority granted to readvertise.
It was moved by Councilman.Corbin, seconded by Councilman Temple and
passed by the following vote that all bids be rejected on Cash Contract #129,
excavation of center island on Firestone Boulevard, Marbel to Woodruff, and

It was reported by the Director of Public Works that the Division has
received requests from several owners along Clark Avenue between Foster Road
and Lakewood Boulevard for matching funds for construction of sidewalks
adjacent to their property. Estimated cost to.the city is $455. Since both
streets are major streets, heavily traveled, they meet the criteria estab-
lished by Council's policy for matching funds for installation of sidewalks.

passed by the following vote to approve use of matching funds for sidewalks
on specified locations, Project #22, Clark Avenue, including extension ardund
one property on Clark Avenue onto Foster Road.

Mr..Spindel reported that a letter had been submitted from property
owner located at 12130 Old River School. Road, requesting City participation
in the construction of pavement adjacent to his property. The work is
included within the limits of work being constructed under Cash Contract #121,
Old River School Road improvement between Quill Drive and Stewart and Gray
Road. The estimated cost of the paveout as requested by the property owner
is approximately $700. There is presently the sum of $19,500 budgeted for
the improvement along Old River School Road between Quill Drive and Stewart
and Gray Road and based on more recent estimated costs of the construction
of these improvements, it is felt that sufficient monies are available to
include the cost of paving adjacent to the subject property under Cash Con-
tract #121, if Council so desires.

passed by the following vote to authorize paving construction at City expense
adjacent to 12130 Old River School Road and authorize appropriating funds in
the approximate amount of $700 to do the work.

It was reported by Mr. Spindel that a property, owner on Priscilla
Avenue has pointed out in a letter that more than 50% of the improvements
in the 8200 block have been completed. He therefore requested that the City
invoke Chapter 27 of the 1911 Act of the Streets and Highways Code to cause
the balance of the improvements to be competed.

passed by the following vote to authorize the Director of Public Works to
proceed under Chapter #27 of the 1911 Act to require property owners on
Priscilla Avenue to complete improvements under Downey Improvement Project
No. 514.

The City Manager reviewed the minutes of the Hospital Commission meeting
held on April 30, wherein they recommended that the City Council authorise
negotiations for acquiring Parcels 8 and 9 to provide an additional 189 feet
of frontage on Brookshire Avenue. The City Attorney informed Council it
would require abandoning condemnation procedure of the properties to the
south and preparation of a new resolution to include the properties proposed
to be acquired.
After discussion, it was moved by Councilman Temple, seconded by
Councilman Dickerson and passed by the following vote to authorize negotia-
tions for acquisition of Parcels #8 and #9 as recommended by the Hospital
Development Commission and that a further study be made before any action
is approved.

The City Manager also reported that the Hospital Development Commission
has appointed a committee for setting up requirements for selection of the
architects for the hospital. Council suggested that there be a minimum of
three and more, if possible, selo.ctions to choose from.
It was moved by Councilman Temple, seconded by Councilman Corbin and
so ordered to follow the policy used in setting up the Hospital Development
Commission that they shall act in an advisory capacity in submitting three
or more architects.
Lot Split No. 326 relative to the All American Nut Company improvements
and expansion was reviewed by Mr. King.
It was moved by Councilman Temple, seconded by Councilman Dickerson
and so ordered to hold this Lot Split No. 326 for further study.
It was reported that Assembly Bill #67 recently has been passed at the
Special Session of the Legislature, which authorizes the consolidation of
up to six rather than three precincts in Municipal elections and removes the
600 registered voter limitation.
A proposal for paving the City- owned lot immediately south of Fire
Station No. l for use as a temporary parking lot, with stalls being leased
on a monthly basis was held for further study to determine the number of
lots which might possibly be leased.
It was reported to Council that the installment agreement for the
sale of land entered into between Downey Towers and the City of Downey
provides that the buyer shall pay all assessments levied against the
property (Parcels #60, 62, 69 and 80 of the Downtown Vehicle Parking District
No. 1, AD #fO)..

Downey Towers has been notified that the assessment on the Third and
LaReina site amounts to $6,792 63 and the assessment on Parcels in
Nargaret Court amounts to $1,730.09. It is agreeable that these assessments
be paid by Downey Towers, however it is necessary that the assessments be
paid immediately prior to the Dale of the bonds. The recommendation is that
the City pay these assessments and that this amount be added to the remaining
principle to be received from the sale of the properties in escrow, and
that authority be given to appropriate the $8522 from the Unappropriated
Reserve Fund (to be replaced at the close of escrow from the sale of property
of the named parcels).

ReBerve Funds be appropriated to pay assessments on Parking District bonds to
be replaced at the close of escrow between Downey Towers and the City of

Vehicle Parking District No. 1, AD #66.

bid opening on the sale of bonds for A.D. #66, Downtown Vehicle Parking

It was reported by the City Manager that copies of the proposed General
Services Agreement between the City of Downey and the County of Los Angeles
for the ensuing five years, beginning July 1, 1964, is up for renewal, making
it possible for the City to continue with such services from the County as
deemed necessary. As stipulated under current procedures, it is recommended
^+ that approval be granted so that the contract may be forwarded to the Board
of Supervisors for their approval prior to May 31, 1964. No action was
taken at this time as Council wished to review the contract.
It was reported by the Street Superintendent that notices have been
issued for the 1964 Weed Abatement Program::
Chief of Police Ivan Robinson announced Police Week May 10 -16 with the
Citizens Committee officially hosting the Open House on Saturday, May 16,
from 12:00 noon to 4:00 P.M.
Councilman Temple reported that he has received numerous complaints
about the architecture of the many apartment buildings throughout the City.
It was recommended this problem of aesthetic beauty of multiple dwellings
be referred to the Downey Beautification Committee.
Police Chief Robinson recommended that Council recognize and commend
J. Edgar Hoover.
It was moved by Councilman Temple, seconded by Councilman Dickerson
and so ordered that a resolution be prepared for adoption at the next
Council Meeting to commend J- Edgar Hoover.
