Skinner, Jr. presiding. PRESENT: Councilmen: Temple, Morton, Dickerson, Corbin, Skinner ALSO PRESENT: Oren L. King, City Manager Sherman Griselle, Director-of Planning Ervin Spindel, Director of Public Works A. C. Gabriel, Director of Finance Lee Leavitt, City Engineer Ray Lake, Director of Building and Safety Robert Gain, Fire Chief Ivan A. Robinson, Chief of Police Don Robison, Senior Administrative Assistant Della Doyle, City Clerk Alberta Pfeiffer, Deputy City Clerk Reverend Curtis Puryear, Immanuel. Baptist Church delivered the invocation. City Manager Oren King introduced students from Pius X, Earl Warren and Downey Senior High Schools who were participating in Youth Recognition Week being observed by the Rotary Club and Business and Professional Women's Club. Students "replaced" City Councilmen and other city officials for the day. Those present at the Council Meeting and holding various offices were: Ed Summers, Mayor Brian Barnwell, Councilman replacing student Mike Coe Mik6­Ward;,City Manager John Armstrong, Director of Finance Steve Kroll, Councilman - District #4 Virginia Rupp, Councilman - District #3 and #5, at Large The Mayor commended Mr. Harry Sloane for his valuable and distinguished public service for the City's betterment while serving on the Personnel Advisory Board and presented him with a plaque of commendation from the City Council. Mr. Sloane thanked the Mayor and stated that he appreciated very much the association of five wonderful years with the City's fine public - spirited people, the wonderful high level of professional employees of the City and that it was especially a privilege to have the employees, members of the City Employees Association, Department Heads present at their personnel board meet- ings. He stated that the Board had been advanced by their presence. Mr. Sloane thanked them for the opportunity to have served with them. Bert DuMars stated that he deeply regrets losing such a gentleman as Mr. Harry Sloane as it was through his efforts and those of another member who could not be present at this meeting, that considerable progress has been made in the activities and accomplishments which have been made today. He can only say that he deeply regrets that they have to lose a member such as Harry Sloane. Mr. King stated on behalf of the employees that they have enjoyed working with him the last few years. Certificates of Completion of the Municipal Finance Administration course were presented the following employees: Betty Christiansen, Bob DeSio, Stacy Guard, Lee Leavitt, Terry Middlebrook and Jim Grissom by the Mayor, assisted by A. C. Gabriel, Director of Finance. Mr. King then presented certificate to Mr. Gabriel. Council Minutes - 4/14/64 -1- Mayor Skinner announced that this is the time and place set for the hearing of protests or objections on the assessments for improvements as shown in Report on Downey Improvement Project No. 50231 Bellfl.ower'$oulevard. He inquired if the Street Superintendent had the Affidavits relative to the hearing. The Street Superintendent replied he had the Affidavits. It was moved by Councilman Corbin, seconded by Councilman Temple and so ordered that the Affidavits be received and filed. Mr. Spindel presented the factual data of the Engineer's Report. It was moved by Councilman Morton, seconded by Councilman Temple and so ordered that the Engineer's Report be received and filed. Mayor Skinner inquired if there were any written reports. The Street Superintendent replied there were no written protests. The Mayor than asked if there was anyone wishing to make oral protest or objection. Angelo Perry, 12024 Bellflower Boulevard,. Project 502 -6, stated he feels the paving should be done through gasoline tax as the property is across the street from the North American Aviation plant and their employees are using the front of this on which to park their automobiles. There being no further oral comments, it was moved by Councilman Temple, seconded by Councilman Dickerson and so ordered that the hearing on DIP No. 502 be closed. Mr. Spindel stated that the paving on Bellflower having been completed, even though a secondary street, could hardly have funds requested from gaso- line tax as it appears to be too late. �ay Knesek, 9203 Washburn Road, wished to comment on DIP 502 -7. It was moved by Councilman Morton, seconded by Councilman Temple and so ordered that the hearing on Downey Improvement Project 502 be reopened. Councilman Morton stated that inasmuch as there may be a question as to the use of gasoline tax funds, he moved, it was seconded by Councilman Temple and passed by the following vote to continue the hearing to 7:30 P.M., May 11, 1964. It was moved by Councilman Temple, seconded by Councilman Dickerson and so ordered that the Affidavits relative to the hearing on DIP 503 be received and filed. It was moved by Councilman Corbin, seconded by Councilman Temple and so ordered that the hearing on DIP 503 be closed. RESOLUTION NO. 1351 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY CONFIRMING THE ASSESSMENTS FOR THE IMPROVEMENTS UNDER DOWNEY IMPROVEMENT PROJECT NO. 503, PATTON ROAD, ET AL. The resolution was read by title only. It was moved by Councilman Corbin, seconded by Councilman Temple and so ordered that further reading be waived. It was moved by Councilman Corbin, seconded by Councilman Dickerson and passed by the following vote that Resolution No. 1351 be adopted. AYES: 5 Councilmen: Temple, Morton, Dickerson, Corbin, Skinner NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None The Mayor announced that this is the time and place set for the hearing on Downey Improvement Project #513, at al., 11637 Patton Road. Mr. Spindel reported that at the southwest corner of the intersection of Patton Road and Manatee Street, signs have been posted, notices have been mailed for construction of curb, gutter, paving and driveway approach on the Manatee frontage. Mr. Spindel requested authority to proceed under Chapter 27. There being no written protests nor oral comment, it was moved by Councilman Corbin, seconded by Councilman Dickerson and so ordered that the hearing be closed. It was moved by Councilman Corbin, seconded by Councilman Temple and so ordered that the Department of Public Works be authorized to proceed on DIP 513, Patton Road, et al., under Chapter #27. It was moved by Councilman Corbin, seconded by Councilman Dickerson and so ordered that the minutes of the meeting of March 24, 1964, be approved as corrected. The City Clerk read letters from the Hospital Development Commission signed by Mr. Maurice McAlister, Chairman of the Hospital Development Commission, in which it was stated the Commission unanimously voted to recommend a specific hospital site; and from Reverend Rodney V. Cogswell, Chairman of the Downey Com- munity Hospital Foundation, stating they concur with the recommendation of the Hospital Commission in respect to the location of the new Downey City Hospital, and further, approved in form the proposed lease agreement with the understanding that detailed financial arrangements are yet to be worked out. The approval included the proposed amendment to the lease relative to transfer of title. Introductions were made by Chairman McAlister of the Hospital Commission of members thereof and by Reverend Cogswell of the members of the Community Hospital Foundation. Mr. Maurice McAlister outlined the various items upon which the decision was based for the site selection of the proposed Downey Municipal Hospital. Mr. J. A. Mann, Appraiser, delineated on a map, the area to be recommended to Council for the hospital site which was located on the east side of Brookshire Avenue to Manatee Street. Reverend Cogswell stated that the selection of the hospital site was the most difficult decision to make and he felt it was an appropriate compromise. Council Minutes - 4/13/64 -3- x.994 It was moved by Councilman Corbin, seconded by Councilman Dickerson and passed by the following vote to approve the recommendation of the Hospital Commission and the Downey Community Hospital Foundation in the site selection. AYES: 5 Councilmen: Temple, Morton, Dickerson, Corbin, Skinner NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None The City Attorney advised that he had prepared a resolution relative to condemnation of properties for acquisition for hospital purposes and that Parcels #1, 8 and 9 are to be deleted in order to conform with the recommendation of the Commission and the Council. The Attorney then read the title only of the Resolution. RESOLUTION NO. 1352 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY FINDING AND DETERMINING THAT THE PUBLIC INTEREST, CONVEN- IENCE AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN PROPERTIES FOR HOSPITAL PURPOSES It was moved by Councilman Temple, seconded by Councilman Dickerson and so ordered that further reading be waived. It was moved by Councilman Morton, seconded by Councilman Corbin and passed by the following vote that Resolution No. 1352 be adopted. AYES: 5 Councilmen: Temple, Morton, Dickerson, Corbin, Skinner NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None The Mayor requested the City Attorney to review the draft of the pro- posed lease of the hospital to the Downey Community Hospital Foundation. Mr. Kemper, Administrator of the Downey Community Hospital Foundation, was asked to define various terms contained in the lease such as "acute" general hospital, Groups 1, 2 and 3 equipment. It was deemed advisable that some arrangement be made in the lease to cover the problem of depreciation. It was moved by Councilman Temple, seconded by Councilman Morton and passed by the following vote to approve in substance the proposed lease subject to the final approval of the final draft to include Amendment #2. The Mayor declared a recess with Council reconvening at 9:15 P.M. with roll call. Letter from the General Services Administration acknpwledging receipt of check as deposit to be applied toward purchase of the old post office property and advising it will take approximately 45 to 60 days before the fully executed copy of the Contract of Sale can be forwarded to the City. Ordered received and filed. Council Minutes - 4/13/64 -4- 2. Letter of resignation from the Personnel Board from Harry Sloane. Received and filed. 3. Letter from O'Melveny & Myers requesting an order employing them on a fee schedule for a combination general obligation and revenue bond issue. Council felt the term " combination general obligation and revenue bond" issue needed clarifying; therefore, referred the letter to the City Attorney. 4. Letter from the Square and Compass Building Association of Downey, Inc. requesting cancellation of the parking lot agreement and submitting check for $177.27 refund of fee. It was moved by Councilman Corbin, seconded by Councilman Temple and passed by the following vote to cancel parking lot agreement, subject to removal of parking meters and light pole. Request from Jerry Monkarsh of funds to improve the street and sidewalk along Tweedy Lane frontage a distance of 284 feet, known as 8000 Telegraph Road. After discussion it was moved by Councilman Morton, seconded by Councilman Temple and so ordered that the request be denied. Mayor Skinner called upon Pete Kizerman, member of the Downey Civic Chorus at this time, who presented the plan to Council for the Chorus' presentation of the City's history in musical comedy form in conjunction with the City Library's plan to complete the City History for the Library. This presentation is planned for June 5 and 6 at the Rio Hondo School. r-• 6. Downey Chamber of Commerce report for the month of March. Received and filed. 7. Letter from Mrs. M. McCarty, President of Woodruff Jr. High School PTA requesting reinstatement of the position of Safety Education Officer in the Downey Police Department. The letter was referred to the City Manager for reply. 8. Letter from Jack D. Wickware, Assistant Legal Counsel for League of California Cities commending the City Manager for so ably relating to the Water Resources Committee the current situation in the City of Downey in connection with the merger of the Downey County Water District. Received and filed. 9. Letter from the City of Modesto's City Attorney, Allen Grimes, com- mending the City Attorney, Royal M. Sorensen, for the thorough and competent job done by him on the presentation at the recent City Attorneys' Conference in Monterey. Received and filed. 10. Letter from Bowdle, Booth and Drumm commending the personnel of the City of Downey who assisted them in gathering data required in the appraisal of a parcel of real estate in the City of Downey. 11. Letter from Laurence E. Brewster, Principal mn the Downey Unified School District, inviting members of City Council to visit the Rio San Gabriel Elementary School during the week April 20 - 24, in observance of Public Schools Week. Received and filed. 12. Letter from Russell J. Cooney, Deputy Director of the State of California Department of Public Works, advising that the landscaping of the Santa Ana Freeway between Florence Avenue and t e Lon1g Beach Freeway is scheduled over a 2 -year period starting with the Mar 1966 -67. Letter of application for appointment to the Downey Park District Board from Gloria Gene Heer. This letter was held for the item under C -23. 15. Memorandum of appointment from Mayor Stephen G. Skinner, Jr, r--. It was moved by Councilman Temple, seconded by Councilman Dickerson and passed by the following vote to approve the appointment as recommended of Mr. Gene Hub - bard, 8521 Orange Street, to the Hospital Development Committee. Received and filed. 19. Request for parade permit for the Downey Junior Athletic Association and Park District for 11:00 A.M., Saturday, April 25, 1964, for approximately 45 minutes' duration. '^ It was moved by Councilman Temple, seconded by Councilman Corbin and so ordered that the parade permit of the Downey Junior Athletic Association and Downey Park District be approved. 20. Letter of resignation from Betty Rupp from the Downey Rose Float Association. It was moved by Councilman Corbin, seconded by Councilman Temple and so ordered to accept the resignation of Betty Rupp and it was recommended that a plaque be presented commending Mrs. Rupp on her fine services on this committee. 21. Letter of appreciation from J. Jesus Bueno of Guadalajara. Received and filed. 22. Letter- relative to the recommendation of the Water Advisory Board. The City Manager read a copy of a letter dated March 27, 1964, addressed to Mr. Ben Day, in which it was stipulated that the Water Advisory Board had rec- ommended that the property between the Santa Ana Freeway and Telegraph Road owned by the Water Division of the City of Downey be approved for immediate sale or exchange by contract to the Chrysler Corporation. The Water Board felt it would be for the benefit of the City of Downey. It was moved by Councilman Temple, seconded and unanimously passed that the letter as submitted be ratified, with the recommendation that the property •-� revert back to the City of Downey within one year if the property is not developed as proposed. 23. (#14) Letter from H. J. Patrick Kearns, Clerk of the Board of Directors of the Downey Recreation and Park District recommending appointment by the Board of a successor to resigned Board member Mignon Caughran. Ordered received and filed and also any other appRtations received for appointment to the Park Board. Financial Report from the Downey Museum of Art. Ordered Received and filed. After a summation of bids for Assessment District #85, Barlin Street, it was recommended that the bid be awarded to the lowest and best bidder. It was moved by Councilman Corbin, seconded by Councilman Temple and passed by the following vote that the bid for AD #85, Barlin Street, be awarded to the lowest and best bidder, Sheets Construction Company, at the unit price as bid, and that all other bids be rejected. It was moved by Councilman Temple, seconded by Councilman Dickerson and so ordered that plans and specifications for Cash Contract #114, Paramount Boulevard from Lubec Street to the Santa Ana Freeway, be approved and authority granted to advertise for bids. It was moved by Councilman Temple, seconded by Councilman Corbin and so ordered to approve plans and specifications for Cash Contract #129, Firestone Boulevard Island excavation and planting According to the subdivision agreement, all work under Tract #28222, Orizaba Avenue and Brunache Street, should be completed by November 14, 1964. It was recommended that the subdivider be given until this date to complete sidewalk construction and that sufficient bond be maintained to cover the costs of this portion of the subdivision improvement. It was moved by Councilman Temple, seconded by Councilman Corbin and passed by the following vote to accept the improvements completed in Tract #28222, Orizaba Avenue and Brunache Street, and that the necessary bond be posted to cover costs of sidewalk construction and defer this installation until the end of the year. AYES: 5 Councilmen: Temple, Morton, Dickerson, Corbin, Skinner NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None It was requested by the property owner of 8320 and 8330 Stewart and Gray Road that the City complete the paving construction adjacent to the improvement. It was reported that as a condition of a zone exception, the Planning Commission required, among other things, that the property owner at 8320 and8330 Stewart and Gray Road complete the paving on Stewart and Gray Road. However, since Stewart and Gray Road is included in the City's Select System, the Council may wish to consider authorizing the City to perform this portion of the required improvement at an estimated cost of approximately $100. After discussion , it was moved by Councilman Temple, seconded by Councilman Dickerson and passed by the following vote to approve authorization of expenditure of funds not to exceed $100 for paveout at 8320 and 8330 Stewart and Gray Road. AYES: 5 Councilmen: Temple, Morton, Dickerson, Corbin, Skinner NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None The Director of Public Works reported that since July 1, 1963, money has been collected from individuals for cost of damages resulting from traffic col- lisions. Monies thus collected have been deposited in the General Fund, and the transfers tabulated which are required to offset the purchases of materials re- quired for repairs and replacements. In addition, five large parking lot signs and standards were purchased for erection at the City operated parking lots, not included in Vehicle Parking District No. 1. These signs were paid for from the Traffic Control Sign Account. Such a large expenditure was not provided for in the current budget from that account, therefore it is recommended that funds in the amount of $936.47 be transferred from Unappropriated Reserves to Account No. 4110 -3 to cover the cost of these materials. The project has been approved by the Water Advisory Board at its meeting on March 25, 1964, It is recommended that the sum of $23,000 be transferred from the Unappropriated Reserves of the Water Fund to:'Account #1 -5755. TO ACCOUNT NO. $23,000 Unappropriated Reserves 1 -5755 AYES: 5 Councilmen: Temple, Morton, Dickerson, Corbin, Skinner NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None The City Manager reported that at the regular meeting of the Water Advisory Board on Thursday, April 9, it was recommended that recruitment and proceedings be instigated to employ a Water Superintendent. This in no means has any bearing or relation on the current position occupied by Mr. Ed Williamson, now serving as Manager- Consultant. The recommendation is set forth so that the proper man may be recruited to work with Mr. Williamson and Mr. Spindel in the actual operations and administration of the Division of Water in the Public Works Department. Salary range is recommended to be set at Schedule 25 ($754- $918). It is suggested that Council authorize this position be established and referred to the Personnel Board for proper position description and classification and that recruitment begin immediately. After discussion, it was moved by Councilman Temple, seconded by Councilman Dickerson and passed by the following vote to authorize immediate recruitment of a Water Superintendent as recommended in Item.12 of the City Manager's Report. In accordance therewith, it has been included for Council's study the current report totaling $3,301,000 for primary arterials, $5,337,000 for secondary roads and collectors, and $3,102,000 for other local streets, presenting a grand total of $11,740,000. In accordance with Section 2156 of the Streets and Highways Code, it is recommended that Council approve this report. It was moved by Councilman Morton, seconded by Councilman Temple and so ordered that the Street and Road Deficiency Report be approved as submitted. It was Councilman Morton's recommendation that the Police Committee investigate and study the problem of the increase of juvenile delinquency in the City of Downey as shown on the Police Report and that the Downey Youth Committee also participate in an evaluation of this problem. It was sug- gested that in the next year's plans, the Youth Committee meet early and plan a more extensive program to include the Park and Recreation Directors and School Board to make the Public Schools Week a wider City function. Student Councilman from District #4, Steve Kroll, reported how much he appreciated the opportunity to participate in Student Government Day sponsored by the Rotary Club, and he stated that he had learned more about civics this day than he had learned at school all year..He also stated that he felt the other students as well as himself did not realize just what City government is. The Director of Pt ks suggested that if an assessment district for installation of curbs could be formed, the street would be easier to maintain. Councilman Corbin reported on the League meeting he attended. It was moved by Councilman Corbin, seconded by Councilman Dickerson and ^' passed by the following vote to approve the attendance of the Deputy Director of Civil Defense at the area meeting at the Edgewater Inn in Long:Be @ch,'to- gether with the City Manager and any Councilman who finds it possible to attend. This meeting will be May 20 -22, 1964. AYES: 5 Councilmen: Temple, Morton, Dickerson, Corbin, Skinner NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Mr. Ray Grimes, 11007 Downey Avenue, suggested an extension of the lighting north on Downey Avenue to Florence Avenue. Mr. Spindel reported that funds are budgeted to extend from Cherokee to Florence and his division is presently working on acquisition of right of way. He hopes that construction of the street will be carried out during the next fiscal year of the portion from Cherokee to Fifth Street. The City Attorney reported that relative to a false- arrest suit filed against the City of Downey and its police officers, the present insurance policies carried by the City do not cover the City for this type matter. Police officers have an individual policy which also does not cover the City as an entity. A rider can be attached to individual police officers' policies which will cover the City. The Chief of police, Ivan Robinson, reported that the rider offering the City as an entity would cost $10 per person. Thus, to add the City as an entity to a police officer's individual policy would be an additional $2 per person as they now pay $8. The City Attorney recommended as the cheapest method for the matter to be handled for the City, the use of services of the attorney handling the matter for the insurance carrier on the individual police officers' policies with a retainer fee of $200 and a $100 -per day charge at the time of trial, with a possible additional amount, should it be necessary to take depositions. It was moved by Councilman Temple, seconded by Councilman Dickerson and passed by the following vote to use services of Attorney Va Ueia in the suit filed against the City and police officers for false arrest.as it was recom- mended by the City Attorney. AYES: 5 Councilmen: Temple, Morton, Dickerson, Corbin, Skinner NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None The City Attorney stated that inasmuch as some bidders will not bid on bonds unless there is a ruling from O'Melveny & Myers, and that this firm will render an opinion for 1% of the total amount of the bonds assessed, it might be added in the call for bids for the Vehicle Parking District that the said successful bidder would be required to pay the fee for the opinion of O'Melveny & Myers. The City Manager stated that a lower and better interest rate might be obtained on the bonds if the suggested stipulation is placed on the bids. Action at this time was withheld until a final calculation of the assessment roll can be made. The City Attorney reported that in the case of Downang the zoning ordinance was held to be valid. Council Minutes - 4/13/64 -11- r-% Councilman Morton inquired about the straightening out of the street at the intersection of Stewart and Gray Road and Woodruff Avenue. The Director of Public Works informed Council that this is included in the Capital Improve- ment Program for the next fiscal year and that it needs acquisition of right of way. This is an item to be included in the next year's fiscal budget.
