OF THE CITY OF DOWNEY
FEBRUARY 10TH, 1964
The City Council of the City of Downey held a regular meeting in the
Council Chamber of the Downey City Hall at 7 :30 P.M., February 10, 1964,
Mayor Stephen G. Skinner, Jr. presiding.
PRESENT: Councilmen: Temple, Morton, Dickerson, Corbin, Skinner

Reverend Rodney V. Cogswell of the Presbyterian Church delivered the
invocation.
Mayor Skinner announced that this is the time and place set for the
hearing on Downey Improvement Project #511, Sidewalks on Guatemala Avenue
under Chapter #27 of the State Division of Highways. Mr. Spindel, Director at"
Public Works, reported that Downey Improvement Project #'511 is for installation
of sidewalks under the 1911 Act on the west side of Guatemala from Suva Street
to Bangle Road. He stated there are more than 50% of the sidewalks already
constructed along that block and a request had been received by one of the
property owners who has the sidewalks that Chapter #27 proceedings be insti-
tuted to have sidewalks installed on the remainder of the block.
Those speaking against the sidewalks were:
Attorney John Grudynski, 9215 Guatemala, who presented a petition with
24 signatures of the 26 property owners involved. It was moved by Councilman
Corbin, seconded by Councilman Temple and so ordered that the petition be accepted.

The main objections of those protesting were that they wished to maintain the
rural atmosphere, their present landscaping, the safety of the children, and
that they wished to avgi4 she expense of removal of costly landscaping.
There being no,4urther protests, it was moved by Councilman Temple,
seconded by Councilman Corbin and passed by the following vote that the hearing
be closed.

Councilman Morton stated that inasmuch as the majority of the property
owners object to installation of sidewalks on Guatemala under Chapter #27 of
the 1911 Act of the Division of Highways, the sidewalks not be installed.
It was moved by Councilman Corbin, seconded by Councilman Dickerson that
Downey Improvement Project #511 be denied,
Mr. Spindel was complimented on the handling of the meeting with the
property owners on Guatemala Street in their discussion of Chapter 27 proceed-
ings for installation of sidewalks on Guatemala.

Councilman Morton remarked that since not a single child walks to school
on Guatemala, installation of sidewalks would serve no purpose..,.the sidewalks
would not be leading directly to a school,.
Mayor Skinner asked for the vote on the motion to deny the project*

Mayor Skinner announced the hearing on Batrlin Street, A.D,r #85. He
inquired of the City Clerk if she had the affidavits of publication, posting
and mailing. The City Clerk replied she had the affidavits.
It was moved by Councilman Temple, seconded by Councilman Corbin and so
ordered that the affidavits be received and filed.
The Mayor asked if there were any written protests. The City Clerk stated
there were none,
Mr. Spindel gave a resume of the improvements proposed for Assessment
District #85, Barlin Street.

Councilman Corbin stated this is the first improvement which has come
about with all right of ways being dedicated.

so ordered that the affidavit of mailing for the hearing on the Debt Limit
Report for Rutgers Street, AD #17 be received ,Rind filed*
The City Clerk was asked if she had received any written protests* The
Clerk replied she had received five 'letters and a petition bearing 19 signa-
tures which represent 14 parcels in AD #17, Rutgers Avenue. The signatures
on the petition included the five from whom the letters were received*
The City Engineer reported that these protests represent 35.7 percent
of the area to be assessed.

factual data. The estimated cast of-the improvements to be assessed to the
district was set at $484920.99,

The main points in objection were that the property owners wished to keep
the rural atmosphere of the aurora, their Iarge tear yards, horses, wished to
avoid an overflow of traffic from the North Americana Aviation plant during
peak hours; feared the moving in of freemay houses from freeways being cur-
rently constru4ted in surrounding aregs close by. Some stated they are in
favor of keeping the properties as persionent residences rather than for

Councilman Morton inquired of the 31 lots in Rutgers Avenue, AD #17#

report of Mr. Maurice McAlister, Chairman of the Hospital Development Comp

Maurice McAlister, 9205 Dinsdsle, read the correspondence presented to
Council from the Hospital Development Commission after introducing the other
members who were presene;

The letter indicated that the Commission had unanimously adopted as ::..kotion
recommending that the City Council and the Hoigitall. Foundation instruct
their respective lejp.l counsel to draft a contract whereas a hospital could
be built by the 14esse-FinaRnce pl.m�n# subject to giving the voters another
opportunity to decide on the general obligation bonds, and then if the
general obli$ ttian bond vote fails, to proceed to the I,eatse -- Finance plan.
Council was requested to give favorable, consideration to this recommendation
of the Hospitatl Development Commission,.
Mr. McAlister stated that the interest rate for lease - financing may
eventually reach the same level as the general obligation bonds. He
reported that at 'their next meeting to be held on Wednesday moraing, two
committees will report on a recommended location for the proposed hospital
as well as how to consider the Garrett proposal.

The City Clerk proceeded with her report of the written correspondences
(1) A letter from Hom*rd R. lileerick offering to purchase the four
parcels of property known as Mar*aret Court, which the City had purchased last
year at the time it was felt that the Superior Curt world be included in the
downtown area.

Flag Ceremony at night Council meetings whenever feasible, and that sufficient

Programs between the State of California and Mexico, indicating that the
President will be unable to,sehedule even a brief time to do so*

After a summation of bids for Improvements in A.D. #98, Stanbridke Avenue,

by the following vote to award the bid to the lowest and best bidder, Sully-
Miller Contracting Company in the mount of the unit prices submitted in the
Bid Proposal, except 9 and 10, and that they be $5130 and $3423 respectively

Mr= ring stated that further study since the last meeting brought forth
suggestions for two changes in the select systm of streatetst one, that Second
Street be added from Rives Avenue to Brookshire, Avenue, and that Pangborn
Avenue be deleted from Florence Avenue to Firestone Boulevard,
In reply to a question by Councilmtn Temple.. Mr, Spindel stat=ed 'that the
select system of streets may be amended each year before October. The present
list was highly recommended by the Director of Public Works.

Mr. Spindel reported thst there has been at, request by property owners
on Myrtle and Nance Streets to circulate petitions for construction of curbs,
gutters* paving and sidewalks.

Mr Spindel reported the receipt of a request from Mr. Hughes, 8041
Cheyenne Avenue, for matching funds for sidewalk constructions There: is
presently no curb =4 gutter existing in front of this property, however
sidewalk could be constructed if Council so desires..
It was moved by Councilman Temple, seconded by Councilman Corbin and
so ordered that action be tabled on the request for Matching Funds Project #11,
Cheyenne Avenue, until such time as curbs are installed.
Mr. Spindel reported receiptaf letters from two separate property owners
on Studebtker Road in the vicinity of the new realighnoknt of Studebaker Road
within the City of Downey for use of match�ng funds fob 'sidewalk con-
struction, The Cityks estimated share of the,,cost of these two combined
locations amounts to approximately $98.

in the Council Chamber of the Downey City Hall, for atmendnmeuts to zoning
ordinance related to attendant parking, and that a report and recommendation

The City Manager stated that a report from the Building Department
indicates that it is necessary to request authorization for the expenditure
of an additional *mount for pleat checking expenses, not to exceed $16,000
for the remainder of the fiscal year 1963 -64.« The increase is throe to an
excess of building applications over those estimated during the last budget
session.. The fees to offset this expenditure will be an additional revenue
to support the anticipated expenditures as outlined ,above, and no
expenditures will be made unless comparable fees are received*

Mr:. King reported that the Personnel Board recommends the appointment
of Mr. Robert L# Shand as Purchasing Agent and confirmed this appointment
made by Mrs Gabriel, Director of Finance. The appointment is to be on
Salary Schedule 24, Step B, $754* effective February 24, 1964,
The Personnel Board also concurred with the recommendation of the City
Manager that the contract with the Water Ma rutger-Consultant be amended 'to
reflect his responsibility relative to the acquisition of a City -wide water
system, and that his monthly retainer be increased from $850 to $9003,
effective February 13, 1964.

Board to amend the contract with the Water Manager-Consultant to the incr sed

It was reported that the old Post Office alto and binding may be
obtained at the purchase price of $1101000 if- tt#e City of Downey is int.erestad,.

The City Attorney advised it will be necessary to set up An authority
similar to the parking Authority of 1949 if the property is to be paid for

The City Manager reported that the Civic Development Committee unani-
mously recommended the City's, purchase of the old post office building,

approved at the last council meeting-'for the parking lot,of the Masonic ,

Councilman Morton remarked that he would like to see the Water Board
which was recently established,organized and in operation as soon as possible.
Mr. King advised that their first meeting has been set for February 18.
Mayor Skinner recommended that the "City of Downey" be painted atop
the large reservoir.
Councilman Dickerson temarked he has observed there are fifteen dif-
ferent types of doors and Aardware'throughout the City Hall and he would
like to see them made uniform, if possible.
Councilman Corbin inquired of .the proposed change of street name des-
ignation from Cecilia Street to Fifth Street, crosstown.
Mr. Griselle stated a hearing on-this street name change has been set
before the Planning Commission for February 19, 1964.
Councilman Corbin gave a report on the Rees Bill for organization of
a Metropolitan Transit District and advised that it had been recommended to
include four members from the League of California Cities, three from the
County, and,two from the City of Los Angeles. Senator Rees stated he would
go along with this recommendation. The bill will require a 60% vote to
carry instead of a 2/3 majority.
