Skinner, Jr. presiding. PRESENT: Councilmen: Temple, Morton, Dickerson, Corbin, Skinner ABSENT: Councilmen: ALSO PRESENT: Oren L. King, City Manager Royal M. Sorensen, City Attorney A. C. Gabriel, Director of Finance William Goggin, Assistant Director of Planning Ervin Spindel, Director of Public Works Lee Leavitt, City Engineer Don Robinson, St. Administrative Asst. - Deputy Director of Civil Defense Ivan A. Robinson, Chief of Police Ray Lake, Director of Building and Safety Ed. Williamson, Consultant, Water Department Robert Gain, Fire Chief Della Doyle, City Clerk Alberta Pfeiffer, Deputy City Clerk Reverend Claude W. Young, Methodist Church delivered the invocation. Mayor Skinner hnnounced that this is the time and place set for the public hearing on the appeal on Zone Change #92.(11603 to 11623 and 11618 to 11626 Adenoor Avenue- Harold A. Oatman) Mr. Bill Goggin, Assistant Director of Planning presented a resume of Zone Change #92. He brought out that conditions considered were in connection with traffic, necessitating the dedication of right of ways. The Mayor asked if the City Clerk had an affidavit of publication on this hearing. The Clerk replied that she had the affidavit. Speaking for the Zone Change were: Harold A. Oatman, 11618 Adenmoor Ave. Leslie Olson, 10022 Tristan There was no to speak in opposition. It was moved by Councilman Temple, seconded by Councilman Morton and so ordered that the hearing be closed. Inasmuch as Mr. Oatman indicated that the necessary dedications were forthcoming it was moved by Councilman Corbin, seconded by Councilman Morton and passed by the following vote that the matter be taken under submission until the necessary deeds are properly filed. AYES: 5 Councilmen: Temple, Morton, Dickerson, Corbin, Skinner NOES: 0 ABSENT:O The Mayor announced that this is the time and place set for the public hearing on the appeal to Zone Change Case #98( Leslie and Norma Bleamaster, 11957 Patton Road) The Mayor asked the City Clerk if she had the affidavit of publication. She replied that she had. Mr. Bill Goggin gave a resume of Zone Change #98 with a map showing the subject property. Council Minutes 1/13/64 -1- 1909 The Mayor called for those wishing to speak in pf the change. Those speaking in favor of the change were: Norma V. Bleamaster, 11957 Patton Rd. (appellant) Mrs. Bleamaster presented a petition with 19 signatures of owners of the adjacent property that had certified that they are in favor of the change. It was moved by Councilman Corbin, seconded by Councilman Temple and so ordered that the petition be received and filed. Also speaking for the change were: Leslie F. Bleamaster, 11957 Patton Rd. Leona Ruff, 8561 E. Fontana Ronald Bjorlin, 12021 Patton Rd. Ray McCullough, 7545 Cole St. Mrs. M.M. Wagner, 8514 Cole St. Those speaking in opposition to the change were: O.J.Barris, 8615 Nada St. Martin Mulder, 8609 Nada St. Charles A. Tabor, 8600 Stewart & Gray Rd. Andrew Bian, 8531 Byer St. Mr. Biaf presented a petition with 9 signatures of owners opposing the change. It was moved by Councilman Temple, seconded by Councilman Corbin, and so ordered, that the petition be received and filed. Letters were presented by the City Clerk. Those in favor of the change fiere from Mr. & Mrs. John P. Jesse, 12012 Patton Rd. Ben E. Badger, 8618 E. Nada St. Those opposing the change were from Mrs. Anna Dreher, 8609 Stewart & Gray Rd. Mr. & Mrs. F. W. Nelson, 7518 Fontana Mr. & Mrs. J.L.Lillie, 8621 Nada St. It was. moved by Councilman Temple, seconded by Councilman Corbin and so ordered that these letters be received and filed. Those speaking in rebuttal for the appelants. Mrs. Norma Bleamaster Leslie Bleamaster It was moved by Councilman Corbin, seconded by Councilman Morton and passed by the following vote that the hearing be closed. AYES: 5 Councilmen: Temple, Morton, Dickerson, Corbin, Skinner NOES: 0 ABSENT: 0 It was moved by Councilman Corbin, seconded by Councilman Morotn, and passed by the following vote that the appeal to Zone Change #98 be denied and the Planning Commissions upheld in their decision. AYES: 4 Councilmen: Temple, Morton, Dickerson, Corbin NOES: 1 Councilman: Skinner ABSENT: 0 The Mayor announced that this is the time and place for the hearing on the vacation of drainage e&stment on Phlox St. Mr. Erwin Spindel:_ gave a resume of the situation on the drainage ease- ment at 8208 Phlox. The Mayor asked if there was any one present that wished to speak on this matter. No one responded. It was moved by Councilman Temple, seconded by Councilman Corbin and } asked by the following vote that the hearing be closed. RESOLUTION NO. 1307 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING THE VACATION OF A DRAINAGE EASEMENT ALONG THE WESTERLY AND SOUTHERLY PERIMETER OF LOT 8208, PHLOX STREET. It was moved by Councilman Temple, seconded by Councilmen Morton, and so ordered that further reading be waived. It was moved by Councilman Temple, seconded by Councilman Morton and passed by the following vote that Resolution No. 1307 be adopted. AYES: 5 Councilmen: Temple, Morton, Dickerson, Corbin, Skinner. NOES: 0 ABSENT: 0 The Mayor announced that this is the time and place for the hearing on Annexation #5 to the Downey County Lighting District. The annexation was reviewed by Mr. Spindell. There was no one present that wished to speak on the subject. It was moved by Councilman Corbin, seconded by Councilman Temple and so ordered that the hearing be closed. RESOLUTION NO. 1308 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING CERTAIN LIGHTING FIXTURES, APPURTENANCES AND APPLIANCES ON CERTAIN STREETS AND PUBLIC PLACES OF SAID VITY TO BE MAINTAINED AND ELECTRIC CURRENT TO BE FURNISHED ALL IN ACCORDANCE WITH RESOLUTION NO. 1295 OF SAID CITY. (Downey County Lighting District - Annexation #5) It was moved by Councilman Temple, seconded by Councilman Dickerson and so ordered that further reading be waived. It was moved by Councilman Temple, seconded by Councilman Morton and passed by the following vote that Resolution No. 1308 be adopted. AYES: 5 Councilmen: Temple, Morton, Dickerson, Corbin, Skinner NOES: 0 ABSENT: 0 The Mayor announced that this is the time and place for the hearing on Annexation A, Zone #1 to the Downey City Lighting District. There was no one present that wished to speak on the subject. It was moved by Councilman Corbin, seconded by Councilman Temple and so ordered that the hearing be closed. RESOLUTION NO. 1309 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING CERTAIN LIGHTING FIXTURES, APPURTENANCE AND APPLIANCES ON CERTAIN STREETS AND PUBLIC PLACES OF SAID CITY TO BE MAINTAINED AND ELECTRIC CURRENT TO BE FURNISHED ALL IN ACCORDANCE WITH RESOLUTION NO. 1292 OF SAID CITY. (Downey City Lighting District, Annexation A, Zone #1) It Was moved by Councilman Temple, seconded by Councilman Corbin, and so ordered that-further reading be waived. Et was moved by Councilman Corbin, seconded by Councilman Temple, and passed by the following vote that Resolution No. 1309 be adopted. AYES: 5 Councilmen: Temple, Morton, Dickerson, Corbin, Skinner NOES: 0 ABSENT: 0 Council Minutes 1/13/64 -3- 1911 The Mayor announced that this is the time and place for the hearing on the Resolution of Intention of Stanbridge AD #98. The Mayor asked if the clerk had the affidavits of Publication, Posting and Mailing. She replied that she had these affidavits. It was moved by Councilman Temple, seconded by Councilman Corbin and so ordered that these affidavits be received and filed. The Mayor asked for correspondence regarding this hearing. The City Clerk presented a letter from Mr. Don Henry; 13011 Stanbridge, in opposition to this project. The hearing was opened to the public and the following were heard in opposition. Robert R. Reeves, 13252 Stanbridge Donald Fincher, 13039 Stanbridge There was a great deal of confusion in regard to the water mains being included in the Assessment District and to clear the thinking of those speaking, a roll call was made by parcel number to determine whether they were opposed to the improvements including the water mains. This tally of those present was 10 for and 6 opposed. Inasmuch as the protests did not constitute the necessary majority it was moved by Councilman Corbin, seconded by Councilman Temple and passed by the following vote that the hearing be closed. AYES: 5 Councilmen: Temple, Morton, Dickerson, Corbin, Skinner NOES: 0 ABSENT: 0 The Attorney outlined the action that the Council could now take. 1- Adopted the Resolution ordering the improvements including the water mains. 2- Direct a change in the work to be done. 3- Hold up any action at this time. Councilman Corbin recommended that the Resolution be presented. RESOLUTION NO. 1310 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING WORK TO BE DONE ON STANBRIDGE AVENUE IN ACCORDANCE WITH RESOLUTION OF INTENTION NO. 1287 It was moved by Councilman Corbin, seconded by Councilman Dickerson, and so ordered that further reading be waived. It was moved by Councilmen Corbin, seconded by Councilman Dickerson and passed by the following vote thaht Resolution No. 1310 be adopted. AYES: 5 Councilmen: Temple, Morton, Dickerson, Corbin, Skinner NOES: 0 ARSENT : 0 Council Minutes 1/13/64 -4- 1912 It was moved by Councilman Corbin, seconded by Councilman Temple, and passed by the following vote that all protests be overruled. AYES: 5 Councilmen: Temple, Morton, Dickerson, Corbin, Skinner NOES: 0 ABSENT: 0 The Mayor declared a 5 minute recess. At 9:55 P.M. the Council reconvened with roll call. PRESENT: Councilmen: Temple, Morton, Dickerson, Corbin, Skinner The Mayor announced that this is the time and place for the public hearing on DIP #504- 10602 -8 Paramount Blvd. Mr. Spindell gave a resume of the project. He reported that since the notices have been sent out the property has been sold. Mr. Calvert Fincher, 10418 Brookshire, an associate of the owner, reported that they are proposing new construction on the property and at that time the old houses that are there will have to be moved. He requested that action, be held up for approximately 6 months so that the new building can be completed and at that time they will put the improvements in. It was moved by Councilman Morton, seconded by Councilman Temple, and so ordered that the hearing be closed. It was moved by Councilman Corbin, seconded by Councilman Temple and passed by the following vote that the Director of Public Works, the City Engineer and the Street Superintendent be directed to proceed to put in the improvements if they have not been completed at the end of the 6 month period. Mr. Spindell reviewed the project. Inasmuch as there was no one present that wished to speak on this matter it was moved by Councilmen Temple, seconded by Councilman Morton and so ordered that the hearing be closed. It was moved by Councilman Temple, seconded by Councilman Morton and passed by the following vote that the Director of Public Works be authorized to proceed on DIP #509, as outlined. AYES: 5 Councilmen: Temple, Morton, Dickerson, Corbin, Skinner NOES: 0 ABSENT: 0 The Mayor announced that thisis the time and place for the hearing on DIP #510, 10910 -12 Paramount. This project was reviewed by Mr. Spindell. Inasmuch as there was no one present that wished to speak on this project it was moved by Councilman Corbin, seconded by Councilman Temple and so ordered that the hearing be closed. It was moved by Councilman Corbin, seconded by Councilman Dickerson and passed by the following vote that the Director of Public Works be given auth- ority to proceed with DIP #510. AYES: 5 Councilmen, Temple, Morton, Dickerson, Corbin, Skinner NOES: 0 ABSENT: 0 Council Minutes 1/13/64 -5- 1913 It was moved by Councilman Temple, seconded by Councilman Corbin that the minutes of December 24th,1963, as coarected and the minutes of January 8th,1964 be approved. So ordered. The Clerk presented the following correspondence. A letter from Mr. & Mrs. James V. Travers regarding an access to their property from Bellflower Blvd. This matter was to be presented later in the meeting so action was held at this time. .� A letter from Jospeh R. Grill regarding the traffic turns onto Lake- wood from 1Cheroe2__Aye.This matter was referred to the Traffic Committee for some solution. A letter from the Downey Junior Woman's Club regard the 'Walking Man'. Mrs. Linda Raines, 9008 Rives and Mrs. June Benis, 8417 spoke on this matter and requested that the letter be read in full. After some discussion it was referred to the City Manager, the Chief of Police and the City Attorney for some recommendation that would give better control of these people. A letter from V.L.Cameron regarding a traffic ticket within the City of Downey. The letter was ordered received and filed. A letter from Burke, Williams & Sorensen regarding a Committee of Attorneys to present briefs supporting a City's position in important litigation. This was explained further by Mr. Sorensen. It was moved by Councilman Morton, seconded by Councilman Corbin and passed by the following vote that the City of Downey participate in this program up to the amount of $100.00 in such cases. It was moved by Councilman Corbin, seconded by Councilman Temple, and so ordered that the resignationbe accepted with regrets. A letter from Downey Post 270 American Legion, Inc. requesting that the City furnish flags for two competitive and parade units of girls being sponsored by the Post. It was moved by Councilman Morton, seconded by Councilman Corbin and passed by the following vote that the City present these two groups, the Shamrock Color Guard and the Blue and Gold Cadets with City flags. ORDINANCE NO. 240 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AUTHORIZING AN AMENDMENT TO THE CONTRACT BETWEEN THE CITY OF DOWNEY AND THE BOARD OF ADMINISTRATION OF THE CALIFORNIA STATE EMPLOYEES" RETIREMENT SYSTEM. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE DOWNEY MUNICIPAL CODE BY ADDING PART 7 TO CHAPTER 4 OF ARTICLE II CONSISTING OF SECTION 2470 THROUGH 2475, WHICH SAID SECTIONS RELATE TO THE WATER ADVISORY BOARD. They be instructed to contact our representatives in Sacramento and the League of California Cities and take steps to see if this legislation can be changed. Mr. Ellis Grieb, Principal of the school outlined the sidewalks in the area and requested Council to use matching funds in the places where there are now more than 50% of the sidewalks. After some discussion it was moved by Councilman Temple, seconded by Council- man Morton, and passed by the following vote that authority be granted to proceed with matching funds at the present time on Old River School Road, Adwen and Rives, as major streets and the other locations be discussed at a leter time. Mr. King reported that Mr. Peters, General Services Administration from San Francisco had left a verbal, but official appraisal of the old post office building site including land and buildings at $110,000.00. Since then we have had appraisals and estimates on the cost of demolishing the old building estimated at $15,000.00. Recently the City purchased the northwesterly corner of 2nd and LaReina at a price of $98,500.00 including building and land. Removal of these small wooden buildings from this 150' x 150' site was at a cost of approximately $35QO�00 leaving a total value of the ground at $95,000.00. It is estimated that these two sites are comparable and that the appraisals therefore should be approximately the same. It is suggested that the City Council authorize an offer of $80,000.00 for the acquisition of the old Post Office site based upon total value of $95,000.00, less $15,000.00 for the building demolishing costs. Chief Robinson reported that he had been elected to the Board of Directors of the Police Division of the League of California Cities and would be in attendance at the first meeting Danuary 15th thru 17th,1964.
