Skinner, Jr. presiding. PRESENT: Councilmen: Temple, Morton, Dickerson, Corbin, Skinner ALSO PRESENT: Oren L. King, City Manager Royal M. Sorensen, City Attorney A. C. Robinson, Chief of Police Della Doyle, City Clerk Alberta Pfeiffer, Deputy City Clerk Reverend Milton Gould of the First Baptist Church in Downey delivered the invocation. It was moved by Councilman Temple, seconded by Councilman Morton and so ordered that the minutes of the meeting of November 12, 1963, be approved as corrected. The City Clerk reported on the following written correspondence: 1. A letter from the Division of Highways relative to the limited funds which are available for planting purposes for freeway landscaping along the Santa Ana Freeway in the City of Downey. It was moved by Councilman Temple, seconded by Councilman Morton and so ordered to hold for further study and refer to the City Manager and the Mayor for further conferences with those persons who may be able to con- summate the project for freeway landscaping in the City of Downey. 2. A letter of appreciation from United California Bank for the fine manner in which the groundbreaking for their bank was handled. Ordered received and filed. 3. A letter from Assemblyman George A. Willson relative to initiation of location studies for the State Legislative Route 174(42) 176(42) Freeway between California Avenue in South Gate and the Los Angeles/ Orange County boundary line. Ordered referred to the Department of Public Works and the Planning Department and a report made when the results of their study have been assembled. 4. The City Clerk read in full a letter from the City of Santa Fe Springs submitting copy of a letter from the Rotary Club in appreciation of the invaluable service performed by the City of Downey as a member of the Area E Mutual Fire Aid group during a recent fire in Santa Fe Springs. There was no question but that the prompt response and coordinated fire methods of the various departments prevented much more serious loss. Copies of these letters were ordered submitted to the Fire Chief. Council Minutes 11 /26/63 -1- 5. Letter from Olson Surveying Service, Inc. requesting Council to hold a hearing on a drainage problem at 9330 Telegraph Road. Mr. Olson stated he was representing the property owner, Dr. Morris Griffin, 10634 Pico Vista Road, Downey, who has offices at 8619 South Chaney, Pico Rivera. It was stated by Mr. Olson that in order to develop the property at 9330 Telegraph Road it is necessary to construct a concrete drainage channel along the west line of the property and box culverts and a catch basin on Telegraph Road, and a 3 barrel box culvert bridge on Cedartree Road, besides dedicating 20 -foot widening on Telegraph Road and 30 -foot dedication on Cedartree Road, and construction of curbs, gutters, side- walks and paveout on these two streets. This makes the cost of improvements on the property very high and imposes an unfair penalty on this property owner out of proportion to the test of the properties in this area. It was requested therefore that the City construct drainage channel along the west side of this property and the culverts, catch basin and paving on Telegraph Road. The property owner will construct curb, gutters, sidewalks on both streets and the paving on Cedartree Road. After discussion, it was moved by Councilman Corbin, seconded by Councilman Dickerson and so ordered that the matter be referred to the Department of Public Works for a field trip and study on costs of drainage and paving. 6. A letter of appeal from Mr. H. A. Oatman, et al., 11618 Adenmoor Avenue in Zone Change Case #92. It was moved by Councilman Morton, seconded by Councilman Corbin and so ordered to set a public hearing on Zone Change Case #92 for 7:30 P.M., January 13, 1964, in the Council Chamber of the Downey City Hall. 7. A memorandum from Thomas H. Morton to appoint Mr. Gene Woods, ^" 9434 Buell, to serve as a member of the Civil Defense Advisory Committee. It was moved by Councilman Corbin, seconded by Councilman Temple and so ordered that the appointment of Mr. Woods to the Civil Defense Advisory Committee be approved as recommended by Councilman Morton. Councilman Morton announced the resignation of Mr. Joe R. Sarabia from the Civic Development Committee. It was moved by Councilman Corbin, seconded by Councilman Temple and so ordered to accept the resignation of Mr. Sarabia with regret and it was directed that a letter be sent thanking him for his services while a member of this committee. 9. A letter from the Chamber of Commerce advising that at their Board meeting held on November 18 they voted to send a letter to the State Highway Department, requesting that they take proper steps to obtain signs designating the City of Downey on the Long Beach and Santa Ana Freeways and that adequate signs be planned for Downey on the new San Gabriel Freeway. It was further requested in their letter that more con- sideration be given to freeway landscaping in Downey and that a sprinkler system be installed. The assistance of the City was asked in submitting a similar request to the State Highway Department. .--. It was moved by Councilman and so ordered to cooperate with possible toward obtaining signs freeways. Temple, seconded by Councilman Dickerson the Chamber of Commerce and do all as proposed by their Board of Directors on Councilman Temple advised that he had received a letter from Mr. and Mrs. Harry Goldstein who had had an exchange student from Guadalajara, Mexico in the sister city program in 1960 -61, who sent their sympathies to the City and its residents on the death of the President of the United States, Council Minutes 11 /26/63 -2- 1859 Mr. Corbin advised that Dr. Menchaca had sent a wire sympathizing with the City of Downey and Mr. King advised that a letter from Mr. Agnesi was being translated. ORDINANCE NO. 237 ^, AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING SECTIONS 2801, 2802, 2803, AND 2804 OF THE DOWNEY MUNICIPAL CODE, WHICH SAID SECTIONS RELATE TO THE DISP©SITION OF UNCLAIMED PROPERTY AND MONEY The ordinance was read by title only. It was moved by Councilman Temple, seconded by Councilman Corbin and so ordered that further reading be waived. Mr. Spindel explained the existence of a slope easement on the easterly side of Suva Street westerly of Bluff Road and that it has been recommended by the Depart- ment of Public Works and the Planning Commission that this slope easement be vacated since it is of no further use to the City. Mr. King reviewed that recommendations from the Parking Place Commissioners of several plans for parking area #4 had been submitted to Council at their last meet- ing and had been held for further study. The present plan gives more parking spaces and better egress and ingress. It was moved by Councilman Corbin, seconded by Councilman Temple and so ordered that further reading be waived. AYES: 5 Councilmen: Temple, Morton, Dickerson, Corbin, Skinner ]NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None RESOLUTION NO. 1271 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY OF INTENTION TO APPROVE AN AMENDMENT TO CONTRACT BETWEEN THE BOARD OF ADMINISTRATION OF THE STATE EMPLOYEES' RETIREMENT SYSTEM AND THE CITY COUNCIL OF THE CITY OF DOWNEY The resolution was read by title only. Mr. King advised that the resolution reaffirms the action taken at budget time, authorizing members of Police and Fire Departments to retire at age 50 instead of 55, if they so desire. Melvin Quigley, 7722 Hondo, thanked all who worked on the committee with him, giving special credit to Mr. Elwayne Smith who substituted for him as chairman when he was unable to attend meetings. Other members of Council Minutes 11/26/63 -5- 1862 the committee were acknowledged by Mr. Quigley. Appreciation was also expressed to Mr. King and his secretary, Irene McGary, and the City Attorney and Mr. Harry Williams. The recommended charter was presented for study. The City Attorney stated that he has had occasion to sit with other charter committees in other cities and he feels Downey's committee was the most able, hardworking and serious charter committee he has observed. They were commended by him for doing a fine job and in such a short time. Mr. King commended the committee and the City Attorney for the progressive and thorough study presented in plenty of time for study and consideration to meet certain deadlines. Councilmen all expressed their praise and appreciation of the work of the Charter City Committee, with Councilman Morton exclaiming that it is the hardest working committee of the City of Downey. Mayor Skinner directed that a letter from Council, the City Manager and Mayor be forwarded to the Charter City Committee in appreciation of their fine work on this project. RESOLUTION NO. WS -366 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING THE FUNDS OUT OF WHICH THE SAME ARE TO BE PAID ( #29568 - #29912 $99,418.24) (Payroll) The resolution was read by title only. NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Council Minutes 11/26/63 -6- 1863 Mr. Spindel reported plans and specifications are ready for approval by Council for improvement of the drainage conditions on Cabell Avenue. Mayor Skinner questioned the fact that if it is to be called a street, it should be of the normal street width. Councilman Morton �..4 stated he is of the same opinion as Mr. Skinner. It was moved. by Councilman Temple, seconded by Councilman Morton and so ordered that a field trip be made to the area. It was moved by Councilman Temple, seconded by Councilman Dickerson and passed by the following vote to approve plans and specifications for Cash Contract #100, Gas Tax Project #43, and authorize advertising for bids. The City Attorney has advised that these outstanding bonds should be paid for by the City as part of the cost of acquisition of the land. Therefore, it was requested that $2,953.57 be transferred from Unappropriated Reserves to Account No. 14310, to be refunded at such time that the bonds on the Parking District should be sold. AYES: 5 Councilmen: Temple, Morton, Dickerson, Corbin, Skinner NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Mr. King advised that negotiations are continuing with the State through assemblymen requesting further participation from State funds for a pedestrian overpass at Tweedy Lane and Santa Ana Freeway. It was sug- gested that the City pay 50% of the estimated cost of $75,000 and these funds could come out of the new 1,,, gas tax and which is $12,500 over and above a previous amount approved of $25,000. It was moved by Councilman Morton, seconded by Councilman Dickerson and passed by the following vote to authorize participation of 50% of the r--. expenses to be $75,000 for construction of a pedestrian overpass at Tweedy Lane and Santa Ana Freeway. AYES: 5 Councilmen: Temple, Morton, Dickerson, Corbin, Skinner NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Council Minutes 11/26/63 -7- The City Manager reported that 1200 homes in the northwest area of the City were without water for almost four hours due to a loss of electrical energy resulting from a storm on November 20. If the City had jurisdiction of the water system in this area, connections could be made between the present Downey water system and the Lakewood water system which would prevent any future emergencies. It is suggested that the City Council authorize negotiations to begin with the City of Lakewood to acquire that portion of the Lakewood Water Department which lies within the City of Downey. It was moved by Councilman Temple, seconded by Councilman Morton and passed by the following vote to authorize negotiations with the City of Lakewood to acquire that portion of the Lakewood Water Depart- ment which lies within the City of Downey. AYES: 5 Councilmen: Temple, Morton, Dickerson, Corbin, Skinner NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None The City Clerk read a letter from the Downey Community Hospital Committee handed her, requesting the City of Downey to contract for and obtain a survey of needs and feasibility report by the Garrett Organiza- tion, Inc. relative to construction of a new hospital facility in the City of Downey. It was moved by Councilman Corbin, seconded by Councilman authorize employing the firm of Garrett Organization, Inc. to survey and feasibility report not to exceed $2500, such amount ferred from operating reserves to Account No. 9- 2000 -312, and be authorized to sign the agreement and that the City "ll not any other agreement. The agreement to be signed was read by Mr. King. The Purchasing Division was informed subsequent to receiving this bid that other potential bidders would have submitted bids if they had sufficient time to do so. It was recommended that the bid be rejected and readvertise for bids. It was moved by Councilman Corbin, seconded by Councilman Temple and passed by the following vote to reject the bid received from Sherwin Electric Company of Los Angeles and authorize readvertising for bids on warning sirens. AYES: 5 Councilmen: Temple, Morton,Dickerson, Corbin, Skinner NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Council Minutes 11/26/63 -8- M : • Mr. King reported that the Administrative Assistant, Deputy Director of Civil Defense and Purchasing Agent Edwin Powell, has accepted a position as City Manager of Irwindale, and that everyone wishes him well. Mr. Powell was commended for his excellent work with the City of Downey. It was moved by Councilman Temple, seconded by Councilman Corbin and so ordered to authorize preparation of a special plaque for presentation to Edwin Powell. Ed Powell stated that the expression is used many times, that "we do things with mixed emotions" and added that never has it been more appropriate than at this moment. He did not know he would become as attached to a community as he has with the City of Downey. He thanked City Council, City Manager, Department Heads in attendance, and the press for taking him in, helping him and making him a part of this family. He said that when he first came with the City of Downey, Mr. King told him there never will be a city as tightly knit or well organized as the City of Downey. It is not ne Mr. Powell's assistance was requested in continuing the civil defense project of the women's auxiliary committee as he had been such a great help with this project. The committee would appreciate his fol- lowing up on completion of the project. Council congratulated Mr. Powell on his appointment advising he will be missed and it will be difficult to replace him as he has been filling three hats. Councilman Temple stated he will be an excellent city manager. Mr. King reported that recruitment will be on the same basis as when Mr. Powell was recruited. Councilman Morton inquired about the time allotted to each category of Mr. Powell's position. It was reported to be about 50 -50 except during a lull. Councilman Morton requested exploring the possibility of the position of Administrative Assistant being comgined with that of Deputy Director of Civil Defense. It was moved by Councilman Temple, seconded by Councilman Morton and passed by the following vote to authorize Mrs. LeKaiser to act as Purchasing Agent with additional compensation of $100 per month during the interim of Mr. Powell's departure and employment of a replacement for him. Thurston has submitted a pro- cedure whereby the City of Downey could use his flying service and his official capacity as a sergeant of the Downey Police Department in Council. Minutes 11/26/63 -9- ra • . r. returning prisoners arrested by other jurisdictions throughout the State of California, by air. He will furnish a policy of insurance for $100,000 and $200,000 with the City of Downey listed as additional insured. The aircraft will be commercially licensed under Part 42 of the Civil Air Regulations. Mr. A. C. Gabriel, Finance Director, has investigated and approved this offer made by Sgt. Thurston. The cost of the service will be billed at 15(� per air mile. The Police Depart- ment intends to use this service as an economic move in both personnel time and financial cost to the City. It has been noted there is quite a saving in this type of operation in such areas as Blythe, Indio, etc. for transportation of prisoners or police activities. After discussion it was moved by Councilman Morton and seconded by Councilman Corbin to have more study before the City Council becomes involved in aircraft business. So ordered. The City Manager was requested to submit a report on comparison of costs of commercial airlines. The following proclamation was read by the City Manager with a request that the City Council ratify the Mayor's action: P R O C L A M A T I O N WHEREAS, John Fitzgerald Kennedy, 35th President of the United States, has been taken from us by an act which outrages mankind through- out the world; and WHEREAS, President Lyndon B. Johnson has appointed Monday, November 25 to be a national day of mourning throughout the United States; and WHEREAS, during this day of the funeral service of President Kennedy the people will be paying their homage of love and respect to the memory of a great and good man. NOW, THEREFORE, be it resolved, that the City of Downey observe the 25th day of November, 1963 in respectful memory of our late President and that the City Hall be closed in his honor. Councilman Morton inquired of the deposit of funds in the various banks, with some deposits at more than one branch of a name bank. The Director of Finance reported that each bank operates independently and it has been a policy of Council to keep the investment funds spread through- out the City. With additional banks coming into the City, it would seem advisable to have a cutting off point. It was moved by Councilman Corbin, seconded by Councilman Dickerson and passed by the following vote to limit deposit of funds to one per name bank. On page 25, beginning of first paragraph should be "except as herein- after expressly provided" and on page 26, third line after word "received" should be inserted: "or without advertising for bids if the total amount of the contract or project is less than $5,000." Councilman Temple recommended the appointments of M. Manny Coute, 7957 Conklin Street to the City Beautification Committee and 0. Ken Hunter, 12029 Horton Avenue to the City Traffic Committee to replace Mr. Murphy who resigned. It was moved by Councilman Temple, seconded by Councilman Corbin and so ordered that the appointments as recommended by Councilman Temple be approved. Councilman Morton remarked that as an aftermath of the disaster which hit the nation this week, one of the reports on television asked in what direction is America heading; what is wrong with society when an affair such as this can happen in America; are we losing ground as a nation? He feels strongly one of the things lacking in too many homes, and the home being the center of our way of American life, hus- bands and wives both are working and religion is not in the home, the family is not attending church together. The question as to where the nation is heading is brought home with regard to juvenile police prob- lems in the City of Downey indicating problems within the family relationship and no church life involved in the family at all. He hopes some good comes out of it. It is a blight on the country to have something like this occur and he urged Council to do what it can to encourage people to get back to the very rudiments of relationship. Councilman Dickerson inquired about the results of a survey which had been requested for possible installation of a traffic signal at Tweedy Lane and Florence Avenue. Mr. Spindel reported that this project is in the budget and scheduled for the spring. Also, it was suggested that something be done about the grade in the driveways to the City parking lot adjacent to the City Hall. Mr. Spindel reported it is planned that this entire parking lot will be reworked, including driveways. Councilman Dickerson stated that he had heard a discussion by Senator Reese on AB 1174 relative to rapid transit which he feels deserves a great deal of study on the part of any of the City Council and he reported the bill will come up in April 1964. Councilman Corbin inquired if the Council was ready to act on any of the resolutions recommended by the Personnel Advisory Board, it if it is their desire to meet with the chairman of the Personnel Advisory Board to go over them. It was recommended that the resolution relative to granting one additional holiday to police and fire department personnel be adopted at this time. It was suggested that further study be made of the location of "No Left Turn" signs at the intersection of Firestone Boulevard and Downey Avenue, and Council was advised by Mr. Spindel that it is planned to place a sign lower to be seen with more ease by motorists traveling south on Downey Avenue and that actually there will eventually be 3 signs facing this south traffic. Mrs. Bette Kilpatrick reported on the progress of the Rose Float contest and reported that Miss Downey will be sent to the Miss America Pageant in Santa Cruz. A report was also made that the next year's contest will include girls from surrounding areas in what is to be known as the San Gabriel Area. Mr. Spindel inquired of Council if they desire to take action on Downey Avenue paveout project which had been taken under submission. Councilman Morton stated that he is not in favor of the City paying for the paveouts. It was moved by Councilman Dickerson, seconded by Councilman Temple and passed by the following vote to overrule the protests and deny the request of the property owners to have the City to pay for the paving on Downey Avenue. Mayor Skinner requested that the City Manager submit an estimate of cost for air conditioners for the Council Chamber and to include bids on Day and Night gas units. It was requested by Mayor Skinner that property owners be notified of complaints registered with the police department against apartment residents.
