MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
NOVEMBER 5TH, 1963
The City Council of the City of Downey held a regular adjourned
meeting in the Council Chamber of the Downey City Hall at 7:30 P.M.,
November 5, 1963, Mayor Stephen G. Skinner, Jr. presiding.

Councilman Thomas H. Morton delivered the invocation.
Mayor Skinner called on Director of Public Works, Ervin Spindel,
to make the presentation to one of his associate civil engineers.
Mr. Spindel state -d the very rigid training required for issuance of an
in- training certificate is the first step toward becoming a registered
engineer. It was stated this training is one of the most difficult
and culminates in a very rigid examination. The Mayor presented the
certificate to Bill Ralph and stated it was a pleasure to have him
with the City.
Mayor Skinner announced, that now is the time and place set for the
canvass of hospital election votes.
This being the time and place fixed for the canvass of the
returns of the special municipal election held on October 29, 1963,
the returns of said election and the absentee votes cast at said
election that have been received were duly and regularly canvassed
as provided by law.
It was moved by Councilman Corbin, seconded by Councilman Morton
and unanimously carried, that the following resolution declaring the
result of said canvass be adopted, and that said resolution, together
with the City Clerk's statement, be set forth in full on the minutes.
The City Clerk read the title of the resolution only.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
DOWNEY, CALIFORNIA, DECLARING THE RESULT OF THE
CANVASS OF ELECTION RETURNS OF SPECIAL MUNICIPAL
ELECTION HELD IN SAID CITY ON OCTOBER 29, 1963
THE CITY COUNCIL OF THE CITY OF DOWNEY, CALIFORNIA, DOES
HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. That a special municipal election was duly called
and regularly held in said city on the 29th day of October, 1963,
at which election there was submitted to the qualified voters of
said city the following proposition, to wit:
MUNICIPAL HOSPITAL PROPOSITION: ,Shall
a municipal hospital be established in the City
of Downey?
SECTION 2. That the returns of said election have been duly and
regularly canvassed by this City Council as provided by law, and
all absentee ballots received have been counted and canvassed as
provided by law.
SECTION 3. That the votes cast in the precincts established
for said election upon said proposition and for and against said
proposition, the absentee votes cast upon said proposition and for
and against said proposition, and the total votes cast at said
election for and against said proposition and upon said proposition

The City Council of the City of Downey, California, DOES
HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. That a special bond election was duly called
and regularly held insaid city on the 29th day of October,
1963, at which election there was submitted to the qualified
voters of said city the following proposition, to wit:
HOSPITAL BONDS: Shall the City of Downey
incur a bonded indebtedness in-the principal
amount of $4,000,000 for the purpose of the
acquisition and construction by said city of a
certain municipal improvement, to wit: a general
hospital, including the acquisition of all equip-
ment and other property necessary therefor?
SECTION 2. That the returns of said election have been duly
and regularly canvassed by this City Council as provided by law,
and all absentee ballots received have been counted and canvassed
as provided by law.

the voters voting at said election were cast in favor of the adoption
of said bond proposition, and szid bond proposition is hereby declared
to have failed to carry at said election.

STATEMENT OF CITY CLERK
I, DELLA DOYLE, City Clerk of the City of Downey, California,
DO HEREBY CERTIFY that the above and foregoing resolution is a

Mayor Skinner stated that the question has arisen as to whether
or not the matter could come up again on the April election and inquired
of the City Attorney.
The City Attorney advised that the statutes provide that no
election shall be held within six months on the same issue, and that the
hospital bond election had missed the necessary time by a couple of
weeks. Unless a petition signed by 15% of the voters should be submitted
requesting the matter to be placed on the ballot in the April election,
it would not be possible.
The Mayor inquired what time table would be required if such a
petition were to be filed, and the City Attorney advised it would have
to be within the time element but that he was not in a position at this
time to give the exact time schedule. He added that the matter could
possibly be set for the primary election in June.
Councilman Morton stated the City Council has reviewed Tuesday's
vote for the hospital and find that the people have very clearly
indicated that they are interested in a municipal hospital in the City
of Downey.
Councilman Corbin stated that earlier he had thought it was advis-
able that the people be given the opportunity to express themselves
on the hospital issue and that the City Council and the people decided
they would like to have that expression. It is now very clear to him
that the people have overwhelmingly endorsed a hospital for the City.
It was stated by Councilman Morton that a quick analysis of other
avenues warrants study and consideration as thereis still a possibility
that revenue bonds might be possible, particularly as they are tax
exempt revenue bonds that incur no obligation on the tax structure of
the City. Also private capital might be available.
Consequently, it was moved by Councilman Morton, seconded by
Councilman Temple and passed by the following vote that the City
Council exert the leadership in this problem and take this matter
under study to determine what positive course of action can be taken

in regard to the hospital issue, to meet promptly, this week, with
the Downey Community Hospital Foundation to see what avenues of
approach can be taken by the City Council at this time, to invite
the press to such meeting.

Mayor Skinner advised that a letter had been written to
Reverend Cogswell, President of the Hospital Foundation, to request
a joint meeting at 6:45 A.M., Friday, November 8, 1963, at the
Stonewood Restaurant.
It was moved by Councilman Temple, seconded by Councilman Dickerson
and so ordered to authorize forwarding the letter to the Downey Com-
munity Hospital Foundation as outlined.
It was moved by Councilman Morton, seconded by Councilman Temple
and so ordered that the minutes of the Council Meeting held on
October 14, 1963, be approved as distributed.
The City Clerk reported on the following written correspondence:
1. A letter from Los Angeles County relative to increase in
rates for jail prisoners. The City Attorney advised that no action is
necessary other than to receive and file this communication.
2. A memorandum from the Planning Director, Sherman Griselle,
advising that it will be necessary to establish an Airport Zoning
Commission to recommend zone boundaries and ordinance text for
establishing well defined procedures for zoning protection against
hazards in the municipal heliport approach patterns. It was requested
that if it is the desire of the Council to have the zoning ordinance
amended in the near future to provide for heliport zoning protection,
the City Council should appoint the City Planning Commission as the
Airport Zoning Commission.
It was moved by Councilman Corbin, seconded by Councilman Temple
and passed by the following vote to appoint the City Planning Commission
as the Airport Zoning Commission.

3. A request from the Downey Coordinating Council requesting
authority to circulate a petition proposing voluntary exclusion of
obscene literature from Downey.
It was moved by Councilman Dickerson and seconded by Councilman
Temple that circulation of the petition be authorized. After discus-
sion and recommendations by the City Attorney and Chief of Police, the
Mayor asked for the vote on the motion.

4. The City Clerk read in full a memorandum from the Mayor informing
of the installation of sanitary sewers on Woodruff Avenue and Benedict
which will be completed at no cost to the City but will be paid out of
County Sanitation District funds. Ordered received and filed.

5; Letters submitted by the Mayor to Assemblyman Porter and
the State Division of Highways thanking them for securing some land-
scaping for freeway interchanges. Ordered received and filed.
6. A letter submitted by the Mayor to the Park and Recreation
Board requesting a joint meeting, the date of which meeting is being
held open for verification of a mutually satisfactory meeting time.
7. Letter of resignation from Mr. Don R. Morrison from the
Citizens Sanitation Committee.
It was moved by Councilman Corbin, seconded by Councilman Temple
and so ordered to accept Mr. Morrison's resignation from the Citizens
Sanitation Committee with regrets.
Councilman Dickerson advised he will make an appointment for
replacement of Mr. Morrison in the near future.
It was moved by Councilman Morton, seconded by Councilman Temple
and so ordered to approve the appointment of Mr. Francis N. Hart,
9643 Cedartree Road, to the Citizens Sanitation Committee, as proposed
by Councilman Morton.
8. Claim for damages in the amount of $1,000 from Mary C. Halsey.
It was moved by Councilman Corbin, seconded by Councilman Temple
and passed by the following vote to deny the claim of Mary Halsey and
refer it to the City's insurance carrier.

9.. The City Clerk read in full a letter from the Southern California
Water Company advising of a proposed increase in water rates to their
users as the result of the need to pump more expensive purchased water to
prevent destruction of the underground water reservoirs in the Central
Basin. Mr. Sam McGuffin, Division Manager, of the water company was
present to answer Council's questions. Letter received and filed.
10. Letters from the City of Santa Fe Springs and Vincent Drugs
commending Chief Gain and the Downey Fire Department staff on the
excellent job done in helping to contain a fire at the Grant's Department
Store recently, and advising it was a fine example of how effective
the mutual aid pact between the cities acts "under fire ".
11. Copy of a letter to be submitted to the Downey Park and
Recreation Board relative to a joint meeting with them to discuss the
disposition of the old post office building.
It was moved by Councilman Temple, seconded by Councilman Morton
and so ordered to approve transmittal to the Park District Board and
that Councilmen Morton, Skinner and Corbin present the letter at the
joint meeting so they can discuss any questions which may arise at that
time.
12. A letter of appreciation from Los Angeles County Rancho Los
Amigos Hospital Administrator Eugene R. Erickson thanking the Mayor
for his distinct contribution and plaque presented them in their program
celebrating the 75th Diamond Jubilee of the hospital on October 30.
Ordered received and filed.
Bea Axton, President of the Realty Board, and Robert Sasine,
President of the Downey Chamber of Commerce, were recognized and
introduced by Mayor Skinner at this time.

ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF DOWNEY AMENDING SECTION 7100.1 OF THE DOWNEY
MUNICIPAL CODE AND ADDING THERETO SECTION 7101.4,
WHICH SAID SECTIONS RELATE TO STREETS AND PUBLIC
WORKS
The ordinance was read by title only. Mr. King reviewed
the ordinance and explained the amendment is to clarify the
definition of City Engineer in the City Code, and to enforce the
removal of pre- existing obstructions from the public right of way.
Councilman Morton reminded Council that this action resulted
from Mr. Duggan's comments and Councilman Dickerson's recommendation
and request to take the matter under immediate study relative to
obstructions'in the right of way at Paramount Boulevard and Third
Street. He should be pleased to note some action is being taken.

Dickerson and so ordered that further reading be waived.

RESOLUTION NO. 1254
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
DOWNEY RESCINDING CERTAIN RESOLUTIONS AND TERMI-
NATING PROCEEDINGS FOR THE IMPROVEMENT OF BROOK -
SHIRE AVENUE AND OTHER STREETS IN THE CITY OF
DOWNEY (AD 69)
The resolution was read by title only. The City Attorney advised
that resolutions initiating proceedings were adopted approximately
two weeks ago but after reviewing the proceedings, it was the opinion
of the Engineering Department and his office to rescind and re- initiate
the proceedings. This does not change the work or scope of the work
to be done to improve these streets.

It was reported by Mr. Ervin Spindel, Director of Public Works,
that the work required of the contractor, Aggregate Construction
Company, on Paramount Boulevard between Third Street and Irwingrove
Drive, has been satisfactorily completed. The contractor exceeded
the time limit for the completion of this contract by five working days.
It was recommended that liquidated damages in the amount of $100 per
day be deducted from the amount due the contractor. Mr. Spindel
reported there was no real reason for the delay, the contractor just
did not finish and just "dragged his feet ". He has been notified by
letter the action being taken which is under the terms of the contract.

Mr. King advised that the Parking Place Commissioners, as indicated
in the minutes of their meeting, recommend that no action be taken on
construction of Parking Lot No. 4 in Vehicle Parking District No. 1, as
they wish to have further study. Mr. Spindel advised that the recom-
mendations will be brought to the next Council Meeting.

Before declaring a 5- minute recess, Mayor Skinner recognized and
introduced Mrs. Mike Kraskowski, President of the Jr. Woman's Club.
The meeting reconvened at 9:20 P.M. with roll call:
PRESENT: Councilmen: Temple, Morton, Dickerson, Corbin, Skinner
Mayor Skinner requested Mr. Sherman Griselle, Director of Planning,
to give the report from the Planning Commission relative to the General
Plan. Mr. Griselle reported there were certain items, 13 in all, of
proposed changes which the City Council transmitted to the Commission,
and that the Commission concurred with 11 of the Council's recommendations,
but sustained the Commission's original recommendations on 2 areas.
Councilman Morton inquired about a modification on Eleventh Street.
Mr. Griselle stated this concerned an area on the North side of
Eleventh Street between Birchdale and Brookshire Avenues. He said the
Council recommended this area be placed in a parking and buffer category
to be developed in conjunction with the proposed professional-office-
medical area to the north, provided access to the proposed parking area
is from Florence Avenue and individual development plans include a solid
wall along the north side of Eleventh Street. He said the Commission
concurred, provided access to the proposed parking area is from Florence
Avenue and beginning about fifty feet (50') north of Eleventh Street to
Birchdale and Brookshire Avenue and that individual development plans
include a solid wall along the north side of Eleventh Street and extend-
ing around the corners and along Birchdale and Brookshire Avenue for a
distance of about fifty feet.
Mr. Griselle then reviewed the Planning Commission's original
recommendation concerning an area on both sides of Dinwiddie Street
west of Old River School Road wherein the Commission believed only the
southerly properties along Dinwiddie Street should be placed in a
medium density category provided an adequate standard alley system is
first developed as a means of secondary access in the area to reduce
future traffic congestion on the long street. He said the Commission
felt Dinwiddie's exit onto Old River School Road is too close to the
intersection of Firestone Boulevard and Old River School Road and this
causes Dinwiddie Street to back up at peak hours and that if both sides
of Dinwiddie were to develop solidly with medium density apartments
there could be approximately 544 units along the street which would
generate approximately 1,500 automobile trips per day, and it is
difficult for just a few cars to get out of Dinwiddie onto Old River
School Road at the present time.
.-. After discussion concerning the traffic problems and alternate
means of access to the area, it was moved by Councilman Morton,
seconded by Councilman Temple and passed by the following vote to
accept the recommendation of the Planning Commission on Dinwiddie Street
that only the southerly properties along Dinwiddie Street be placed in
a medium density category and incorporate the recommendation of the
Council concerning an adequate standard alley system for the south side
properties.

The last item reviewed was an area containing the Blue Star
Nursery and apartment properties to the east on the north side of
Imperial Highway. Mr. Griselle stated the Council recommended
that the Blue Star Nursery property and the property adjoining
to the east be placed in a general commercial category but the
Planning Commission recommended that good planning for this area
indicated a medium density residential category with a parking lot
and buffer area along the north for the best future development.
After discussion it was moved by Councilman Temple, seconded
by Councilman Dickerson that the Blue Star Nursery property and
apartments adjoining to the east be shown on the General Plan in a
general commercial category.

RESOLUTION NO. 1262
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
DOWNEY ADOPTING A GENERAL PLAN AND GENERAL PLAN
MAP
The resolution was read by title only.
Councilman Morton stated that the Planning Commission had gone
on record endorsing, as well as spreading on their minutes, the need
for building code and zoning code regulations' being amended before
high density, high -rise apartment development takes place to assure
that any high -rise apartment development would be high -type con-
struction and not three - story, walk -up type, and he believed these
amendments should be initiated.

Mr. Griselle reported the problem of high -rise structures is being given
thought as to what type amendments should be suggested to the Commission,
and as soon as something workable is prepared, it will be submitted to
the Commission and Council.

Planning Director to proceed with workable amendments to the high -rise
sections of the Downey Municipal Code.

Mayor Skinner complimented Sherman Griselle and his department and
the Planning Commission on their fine job in preparing the General Plan.

Mr. Griselle stated he has never had such a fine experience
working on a general plan as he had with this one - -many other com-
munities cannot accomplish what the City of Downey has. He expressed
appreciation to the Council, Commission and fellow employees for the
fine cooperation they gave.
.-. The City Manager concurred with the Mayor's commendations
relative to the final draft of the General Plan.
The City Manager announced that groundbreaking for the United
California Bank Building in the Greshner development on Firestone
Boulevard will begin at 10:00 A.M. Friday morning, November 8.
A new aerial map of the City of Downey displayed on the Council
Chamber wall immediately behind the Mayor's chair was pointed out by
the City Manager. He pointed out that the map is on a larger scale
than had been the previous one.
The City Manager read the minutes of the Parking Place Commis-
sioner's meeting held on November 4, 1963, wherein it was recommended
signs be ordered as soon as possible for the parking lots in Vehicle
Parking District.
After an outline by the Director of Public Works relative to the
type of signs needed, it was moved by Councilman Morton, seconded by
Councilman Corbin and passed by the following vote to authorize pur-
chase of directional signs in the approximate coat of $250, funds to
be appropriated from general funds.

Mr. Spindel advised of construction to begin this week of a
Metropolitan Water District line on Woodruff Avenue which will be a
48" transmission line, consisting of 1 mile of street's being involved
in Downey. It is anticipated that this will be under construction in
the City for the next 3 to 32 months and the Department of Public Works
^ will be watching it very closely for traffic control and obstructions
to traffic.
Chief of Police Ivan A. Robinson announced receipt by his department
of an International Association of Police Chiefs and International
Safety Council award for safe driving in a fleet safety contest. Last
year small motorcycle units were driven 110,000 miles without any
reportable accident and hold the #1 position in the United States. The
other award was in the 3- wheeler small fleet special group which has
been driven 15,000 to 20,000 miles a year without having a reportable
incident. This, Chief Robinson feels, is due to the intensive training
program, with emphasis being put on hazards involved.

City Attorney Sorensen requested that authorization of Council
be given to execute the necessary stipulations or substitution of
parties in the action involving the Central Water Basin suit in
view of the Judgment now in existence merging the Downey County
Water District with the City of Downey. It is necessary for the
City to be substituted as a party defendant, and the City Attorney
to be substituted for the attorney for the water firm to represent
the City in this action.
It was moved by Councilman Morton, seconded by Councilman Temple
and passed by the following vote to authorize the City Attorney to
represent the City in the suit involving the Central Water Basin.

Councilman Dickerson congratulated the City Clerk on the job done
in the special municipal election and stated the City Clerk had fore-
stalled her vacation in order to carry through to the finish the
election proceedings.
The City Clerk extended her thanks to her staff and to everyone
in the City who had assisted her in organizing and handling the
special municipal election on the hospital issue.
Mr. Earl J. Berry, President of the Progressive Property Owners
Association, Inc., read a letter urging the citizens in Downey to
follow the example set by the people of the Whittier district, when
they sold subscriptions and built the Whittier Presbyterian Hospital.
Ordered received and filed.
Mr. King reported that one of the City's volunteer workers in
the RACES program had succumbed to a heart attack while on duty and
recommended that the Council Meeting be adjourned in his honor.

and passed by the following vote to appoint Mr. Irving Rosen, 10321
Casanes Avenue, Downey, to the Citizens Tax Committee, replacing
Mr. Schooling.

and so ordered to submit a letter of recommendation to the Downey
Unified School District Board on behalf of the citizens of Downey that
the front parking lot of the Downey High School be open and available
for parking of Christmas shoppers.

sidewalks are to be installed by the School District completely
around the Maude Price School, at which locality the need for
sidewalks has been apparent for some time.
