MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
OCTOBER 14TH, 1963
The City Council of the City of Downey held a regular meeting
in the Council Chamber of the Downey City Hall at 7:30 P.M., October 14, 1963

Reverend Milton Gould of the First Baptist Church in Downey de-
livered the invocation.
Mayor Corbin announced that this is the time and place set for the
hearing on the Resolution of Intention for vacation of a portion of
Firestone Boulevard and Pangborn Avenue. Mr. Spindel gave a resume of
the proposed vacation of the southwest corner of the property to have it
placed back on the tax roll. It had been ascertained that there were no
easements existing within the portion for vacation.
There being no written and no oral protests to the vacation of the
portion of Firestone Boulevard and Pangborn Avenue, it was moved by
Councilman Skinner, seconded by Councilman Morton and so ordered that the
hearing on the Resolution of Intention be closed.
RESOLUTION NO. 1246
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
DOWNEY ORDERING THE VACATION OF A PORTION OF
FIRESTONE BOULEVARD AND PANGBORN AVENUE
The resolution was read by title only. It was moved by Councilman
Temple, seconded by Councilman Dickerson and so ordered that further
reading be waived.
It was moved by Councilman Temple, seconded by Councilman Dickerson
and passed by the following vote that Resolution No. 1246 be adopted.

Mayor Corbin announced that this is the time and place set for the
hearing of protests or objections against the assessment for improvement
of Donavan Street and Birchdale Avenue, AD #71.
The Mayor inquired if the City Clerk had the Affidavits of Publica-
tion, Posting and Mailing. The City Clerk replied she had the Affidavits.

It was moved by Councilman Morton, seconded by Councilman
Temple and so ordered the affidavits be received and filed.
The Mayor asked the City Clerk if she had received any written
protests. The City Clerk replied she had none.
The Mayor then inquired if there was anyone wishing to speak
against the assessment for these improvements. There were none.
The Director of Public Works reported that the cost to be
assessed against the property owners was to be $7,506.10.

OF INTENTION NO. 1120 (AD 71 - DONOVAN STREET AND BIRCH -
DALE AVENUE)

Mayor Corbin reported that this is the time and place set for the
hearing on Downey Improvement Project #506. Mr. Spindel reported that
50% of property owners on the west side of Rives- south of Luxor have

The City Clerk reported on the following correspondence:
1. A letter was read in full from South Coast Construction Company,
General Contractors commending b�ft &etty for its cooperation in meeting
the deadline for construction of the /States National Bank. Ordered re-
ceived and filed.
2. A letter from the Downey Unified School District again declining
participation in the pedestrian overpass project at the Santa Ana Freeway.
Ordered received and filed.
3. A claim for damages from Arlene H. Wilson in the amount of $479.04
for automobile repair, plus an unknown amount for injuries.

the insurance carrier.

J. Arch Morris, 10005 Sideview Drive, owner of property at 8267 Phlox
Street, objected to restricting parking at all times as proposed, but
would consider 2 -hour parking.
It was moved by Councilman Skinner, seconded by Councilman Temple
and passed by the following vote to hold the resolution for further study

Street.

ilman Skinner requested that the City Manager direct a letter to
authorities to inquire if there might be other funds returnable
cases.
The City Attorney reviewed a letter in answer to the question which
had been raised as to whether it is proper for the City of Downey to sell
property originally purchased by the City and contemplated to be used as
a site for a superior court within the City of Downey. Since there is no

provision in the general laws of the State of California or in a city
ordinance requiring any specific procedure by the City Council relative
to the sale of real property which has not been used or devoted to a
public use, then the property in question, being determined to be sur-
plus and not needed for the purpose for xv ch it was purchased, nor for
any other public purpose, can be sold for its fair market price.
City Attorney Sorensen reviewed the escrow instructions reporting
$5,000 to be deposited by buyer in escrow, the purchase price to be
$108,000; that title will pass to the purchaser upon final payment;
that an agreement of sale shall be entered into; and that the buyer and
seller will bear their proper portions of escrow charges.

reviewed by the City Attorney.

The City Attorney then reviewed the Installment Agreement for Sale
and summarized as follows: sale by the City to Downey Towers, a co-
partnership, of the subject property for $108,000, price to be paid as
follows: $5,000 down with interest at 7% on the unpaid balance, the
balance to be paid as follows: $1,000 with interest accrued to date on
November 1, 1963, and $1,000 to be paid on the first, each and every
month thereafter with interest accrued to date until September 1, 1964,
the total purchase price to be paid no later than October 1, 1964; that
at the event the purchase price was not paid buyer would have no right to
the property and all payments made to the City be forfeited.

to execute the Installment Agreement.

and passed by the following vote that there be deleted from prior in-
structions to the City Attorney, City Manager and Mayor the requirement
that Downey Towers sign an Ancillary Agreement requiring them to complete
a structure of 16 stories and roughly 80,000 net rentable square feet
within a period of two years from vesting of title.

It was reported by the Director of Public Works that all work re-
quired of Sheets Construction Company to improve Fifth Street - between
Downey Avenue and Paramount Boulevard has been satisfactorily completed.
The contract price bid for this improvement was $33,011.43 with a final
cost amounting to $32,933.

under Cash Contract No. 58, Fifth Street, be accepted and authority
granted to file Notice of Completion.

Howard Vleerick thanked Council for having faith in his organization
and stated they are proceeding with building plans satisfactorily.

It was reported that the City of Downey has budgeted sufficient
funds for a traffic signal at Serapis Avenue and Telegraph Road to be a
joint venture with the City of Pico Rivera, and that the Agreement to be
entered into has been reviewed by the City Attorney.
It was moved by Councilman Morton, seconded by Councilman Skinner
and passed by the following vote to approve the agreement for participation
with the City of Pico Rivera for construction of a traffic signal at
Serapis Avenue and Telegraph Road, and authorize the Mayor to sign the
Agreement.

It was reported by Mr. King that a check in the amount of $700
has been received from Mr. Frahm for his share in the cost of re-
striping of Firestone Boulevard between Paramount Boulevard and Rives
Avenue.
Councilman Corbin stated he felt an adjustment should be made
.-. to Mr. Frahm in view of the fact that other property owners at this
location had not been required to share in the cost of striping
adjacent to their properties. It was suggested that the City might
be able to share or lessen the amount of the cost.

Dickerson and passed by the following vote to approve the restriping
of Firestone Boulevrd between Paramount Boulevard and Rives Avenue in
accordance with Plan ST -42 and State Encroachment Permit No. 763 -E -1205.

It was reported by Mr. Spindel that the property owner, Mr. Murata,
owning the property on the north and south of Florence Avenue between the
San Gabriel River Freeway and Fairford Avenue has deposited $13,500 with
the City for the purpose of widening and improving Florence Avenue, to-
gether with installation of a traffic signal at the intersection of
Studebaker Road and Florence Avenue, as part of the contract of the San
Gabriel River Freeway. The agreement has been reviewed and approved by
the City Attorney.
It was moved by Councilman Temple, seconded by Councilman Dickerson
and passed by the following vote to accept the Agreement between the State
and the City of Downey to improve a portion of Florence Avenue as part of
the San Gabriel River Freeway construction project, and authorize the Mayor
to sign the agreement on behalf of the City.

passed by the following vote to refer the following recommendations of the
City Council for changes in various areas of the General Plan, arrived at
through two general plan study meetings, to the Planning Commission:

1. The north side of Eleventh Street between Birchdale and Brookshire
Avenue to a parking and buffer category to be developed in conjunction
with the proposed professional- office - medical area to the north, pro-
vided access to the proposed parking area is from Florence Avenue and
individual development plans include a solid wall along the north side
of Eleventh Street.
,.� 2. Both sides of Dinwiddie west of Old River School Road in a medium
density residential category, provided an adequate standard alley
system is first developed as a means of secondary access in this
area to reduce future traffic congestion on these long blocks.
3. The area bounded by Stewart and Gray Road on the north; the rear
property lines of the properties west of Susan Street on the east;
the proposed County golf course on the south; and the City limits

on the west to a medium density residential category, provided
a parking and buffer area was placed along the east side to
protect the residences on the west side of Susan Street.
4. An area bounded by Downey Avenue on the west; Iowa Street on the
north; Dolan Avenue on the east; and the alley and rear lot lines
.-. of properties on the south side of Texas Street to a high density
residential category with a parking and buffer area to be placed
on the south side, provided building code and zoning regulations
were amended before development actually took place to assure that
any high -rise apartment developments would be high -type construction
and not three -story walk -up type.
5. An area bounded by Stewart and Gray Road on the south; an existing
apartment building on the west; the rear lot lines of properties on
the north side of Stewart and Gray Road, and generally the east
property line of the first property east of La Reina Avenue to a
medium density category, provided LaReina Street became a standard
city street.
6. An area on both sides of Imperial Highway; bounded on the east by
the San Gabriel Flood Control Channel; on the south by the rear lot
lines of properties on the north side of Adoree Street on the west
by Woodruff Avenue excluding the commercially zoned corner; on the
northwest by Woodruff Junior High School; and on the north about
700' north of Imperial Highway to a high density residential category
with a parking and buffer category along the south portion of the
area to protect the residential properties to the south.
7. An area bounded by Imperial Boulevard on the south; the rear of the
properties facing Bellder on the west; the rear of the properties
facing Meadow Road on the north; and approximately 500' west of
Lakewood Boulevard on the east, to a General Commercial category for
the Blue Star Nursery property and the properties to the east, with
the remainder of the area to stay in a medium density category.
8. A parking and buffer category on the east side of the industrial area
south of Telegraph Road and west of the residential properties on the
west side of Rives Avenue, to protect these residential properties.
9. Broad standard 2 on page 115 changed to say: "No height limits shall
be required."
10. Beginning of last paragraph on page 2 changed to say: "To remain
reliable, the General Plan must be reviewed every five years or less
to determine modifications that may be needed..."
11. Beginning of last paragraph on page 57 changed to say: "To create
and retain residential areas...."
12. Dennis the Mer*ace Park added to the list of parks in the second full
paragraph on page 85.
13. The Planning Department is given the authority to make needed
statistical changes in the General Plan Report to reflect dwelling
unit and population changes due to the additional areas recommended
for apartment use, provided no policy changes are made.

Councilman Morton pointed out the importance of commitments for
high -rise apartment areas being based upon building and zoning regula-
tions' being revised to provide for first -class high density residential
buildings and that no high -rise apartment areas be recommended if they
are permitted to develop into low quality walk -ups.
After a summation of the bid received for a truck - mounted brush
chipper for the Public Works Department, it was moved by Councilman
Temple, seconded by Councilman Morton and passed by the following vote
to award the bid to the Agricultural Machinery Company, Inc. in the
amount of $3,710.72.

The City Manager reviewed the minutes of the Civic Development Com-
mittee of October 14, 1963, pointing out specifically their action
endorsing the City's negotiating to acquire the old Post Office building
for the best use possible and also their recommendation that the City
sell the city -owned property at the northwest corner of Second and LaReina
as previously outlined.
It was moved by Councilman Morton, seconded by Councilman Temple and
passed by the following vote that the City negotiate with the GSA direct
with a letter informing them that the City of Downey would like to acquire
the old Post Office building in accordance with the Federal Property Re-
negotiation Act.

Mr. Irvin V. Phelan, 7714 East Yankee, Vice Chairman of the Civic
Development Committee, made a report on the progress of the forthcoming
hospital election and the need for further informing the citizens of
Downey regarding a need for a new hospital, and he outlined reasons for
recommending a community hospital, the bond issue, and site selection.
He stated that Mr. King had informed the committee that the Council will
make the site determination and operation of the hospital after the
election.
Rodney Cogswell, 10019 Birchdale, stated he wanted to assure that the
hospital would not cost the citizens of Downey one penny and that the
hospital board would ba4 it with 3/4 million dollars of assets.
Mr. King reported that due to the continued injured status of
Sergeant J. B. Florence, who has been under State Compensation since
February 1, 1963, it is necessary to request permission to employ a
sergeant on a temporary basis. This position would be discontinued upon
Sergeant Florence's contemplated disability retirement, effective February 1,
1964. There is no effect upon the current budget as Sergeant Florence
is being paid by State Compensation insurance. The Police Department
may be kept as near full strength as possible.

and passed by the following vote to authorize employment of a sergeant on
a temporary basis, effective to February 1, 1964.

Mr. King read a letter from Warren Baker, C.P.A., agreeing to perform
an audit and accounting of the Downey County Water District for the period
December 6, 1957 through December 31, 1963, or such prior completion date
as may later be determined, and stating the auditing procedures which will
be followed in this audit.
It was moved by Councilman Skinner, seconded by Councilman Temple
and passed by the following vote to authorize employment of Warren H. Baker,
C.P.A. to audit the Downey County Water District records for the City.

Mrs. Hutchison of the Downey Jr. Women's Club, serving as ticket
chairman for a drive to obtain funds to defray building costs of Civil
Defense Supply Stations proposed for local school grounds, requested
assistance from the City Council.
Mr. King reported that the Library Advisory Board unanimously approved
borrowing privileges being extended to non - residents by payment of a $5
annual fee which is pursuant to Section 2424.1 of the Downey Municipal Code
which section such a policy may be established with approval of the City
.-� Council.
It was moved by Councilman Morton, seconded by Councilman Temple and
passed by the following vote to authorize borrowing privileges being extend-
ed to non - residents by payment of an annual fee of $5, with a provision
that such privilege may be revoked by the librarian.

Mr. King requested Thursday and Friday, October 17 and 18, as vacation
time.

Councilman Morton requested copies of tables mentioned in the Traffic
Committee report relative to a one -way traffic pattern on Fifth Street and
Sixth Street, and was informed they would be supplied at the next Council
Meeting.
Councilman Morton again commended the Police Department on their
handling of juvenile problems within their own department without the
necessity of going elsewhere for further action.

Councilman Skinner requested that a study session be set on
the report from the Planning Director relative to fees for non -use
zoning variances.
Councilman Temple announced the resignation of Mrs. Marjorie Phelan
from the Sister City Committee.
It was moved by Councilman Temple, seconded by Councilman Morton
and so ordered that Mrs. Phelan's resignation from the Sister City Com-
mittee be accepted with regrets.
It was moved by Councilman Temple, seconded by Councilman Skinner
and passed by the following vote that appointments of Mrs. Myrtle S. Gobel,
7803 Kingbee Street to the Sister City Committee; Mr. W. R. Ogden, 7443
East Rundell Street to the Youth Advisory Committee; and Mr. Asia E. Still,
7922 DePalma Street to the Civil Defense Committee be approved.

Councilman Temple stated that boys and girls are still having to walk
to West Jr. High in the street and he inquired about the progress of the
Old River School Road project, requesting that, if possible, it be expedited.
It was reported that the County will provide curbs, gutters and
sidewalks with the City putting in the paving with a schedule for next
spring.
It was moved by Councilman Temple, seconded by Councilman Skinner and
so ordered that an attempt be made to expedite the Old River School Road
improvements.
Councilman Temple suggested that the Civic Development Committee
again study the possibility of a Civic Auditorium being constructed in the
City of Downey.
Councilman inquired of the liability for injury from guide lines or
tie lines and was informed that both the City and the utility compan3 are
liable.
The City Clerk requested Council authority for the Deputy City Clerk
to adjourn the council meeting of October 22, 1963, to 7:30 P.M.,
November 5, 1963, in the Council Chamber of the Downey City Hall.

Mr. Spindel stated there are 10 properties @4/Florence and Gallatin,of
which some have not constructed curbs, gutters and paveouts, and additional
properties which need condemnation. He requested permission to proceed
under Chapter 27 of the 1911 Act on the 10 properties to require them to
put in curbs, gutters and sidewalks where applicable.

Mayor Corbin stated that the time had arrived when his one -year term
asmayor was drawing to a close and that he had lived in the City of Downey
for 28 or 29 years, witnessing its growth from a population of 7,000 to
its present population, and that many plans and programs had been insti-
gated. The Mayor gave a rundown of numerous accomplishments and projects
completed during his year's term in office as Mayor. The chair was then
turned over to Mayor Pro - Tempore Stephen Skinner.
It was moved by Councilman Temple, seconded by Councilman Morton and
so ordered to accept Mayor Ben Corbin's resignation as Mayor and he was
commended on a job well done.

Former Mayor Pro Tem Skinner presented Councilman Corbin a plaque commending
him on his services as Mayor of the city, and the fine job he had done the
past year.
Mr. King, City Manager, congratulated Councilman Corbin on a wonder-
ful job, Well done during the past year and on behalf of the employees
and all the people of Downey, stated he had never seen a more conscientious
group of men serving a City as the ones who have served the City of Downey.
Councilman Corbin extended similar congratulations, commending the
department heads working with him and all the Councilmen, and he stated
that if it had not been for the City Manager's great assistance all along
the road, he could not have carried on.
Mayor Skinner stated that all the past years the Council have continued
to work together, doing a good job and that it is a pleasure to follow
Mayor Corbin and the other Mayors; that he will attempt to help spread
the workload and create the best teamwork that he knows how; that there are
many things which he would like to bring up at a later meeting... some have
been worked on, others have not. He would like to keep everyone well
informed. Mayor Skinner stEted he was happy to have Councilman Morton
serving with him as Mayor Pro - Tempore.
City Manager Oren L. King welcomed Skinner as Mayor and assured him he
will have the same loyalty, cooperation as the other mayors have had.
Councilman Corbin thanked Councilman Skinner for working with him in
,the capacity of Mayor Pro - Tempore and being of great help to him.
There being no further business to come before Council, the meeting
