MINUTES OF THE CITY COUNCIL OF THE CITY OF DOWNEY AUGUST 27TH, 1963 The City Council of the City of Downey held a regular meeting in the Council Chamber of the Downey City Hall at 8:00 A.M., August 27, 1963, Mayor Ben Corbin presiding. PRESENT: Councilmen: Morton, Skinner, Temple, Dickerson, Corbin ALSO PRESENT: Oren L. King, City Manager Royal M. Sorensen, City Attorney Sherman Griselle, Director of Planning A. C. Gabriel, Director of Finance Ervin Spindel, Director of Public Works Lee Leavitt, City Engineer Robert Gain, Fire Chief Ivan A. Robinson, Chief of Police Tom Nudson, Asst. Director of Building & safety Ray Lake, Director of Building & Safety Don Robison, Sr. Administrative Assistat'it Della Doyle, City Clerk Alberta M. Pfeiffer, Deputy City Clerk Reverend Claude Young of the Methodist Church delivered the invocation. It was moved by Councilman Skinner, seconded by Councilman Morton and so ordered that the minutes of the Council Meeting of August 12, 1963, be approved as corrected. The City Clerk reported on the following correspondence: 1. A letter from Mrs. Violette Ledebuhr objecting to the garbage and rubbish rates. Ordered received and filed. 2. A letter from William E. Burke, President, Downey City Employees Association in appreciation to the City Council for Admission Day. 3. A letter from D. A. Pehrson, Real Estate Manager of North American Aviation, Inc., requesting an extension of time to use City property on Bellflower Boulevard for parking purposes. The City Manager summarized this request to Council after which it was moved by Councilman Skinner, seconded by Councilman Temple and so ordered that the extension of time for use of City property for parking be granted to North American Aviation, Inc. as re- quested. 4. Appraisals on City property at 2nd and 3rd Streets and LaReina Avenue submitted by Mr. J. A. Mann. The City Manager outlined the recommenda- tion of the Parking Place Commissioners after their review of the entire appraisals of the property. They recommended that the corner lot at 2nd Street and La Reina Avenue be put up for sale by the City and that the other areas, lots 2, 3 and 4, be held for the future possibility of parking lots. It was moved by Councilman Temple, seconded by Councilman Skinner and so ordered that the report from J. A. Mann, appraiser, be received and filed. 5. Letter from Mr. Howard Vleerick and certified check in the amount of $5,000 as an offer and down payment to purchase the lot on which to construct a 16- story structure by Downey Towers at 2nd Street and LaReina Avenues total purchase price to be $108,000.00. Architect Vincent R. Bonfanti displayed a drawing of the proposed building. The City Attorney was asked if there was any legal reason why this property could not be sold in this manner, and the City Attorney advised that there was none as no notice was required, and if would be considered a just and fair price. AYES: 5 Councilmen: Morton, Skinner, Temple, Dickerson, Corbin NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None RESOLUTION NO. 1227 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY, CALIFORNIA, DETERMINING THAT THE PUBLIC INTEREST AND NECESSITY DEMAND THE ACQUISITION AND CONSTRUCTION OF A CERTAIN MUNICIPAL IMPROVEMENT, AND MAKING FINDINGS RELATING THERETO The resolution was read by title only. It was moved by Councilman Temple, seconded by Councilman Skinner and so ordered that further reading be waived. Mr. Harry Garo, 7738 Allengrove Street, expressed a desire that the vote as to whether or not the citizens of Downey want a hospital,including the issue as to whether or notthe City should float a bond to build the hospital, should also include the issue as to whether or not the City should maintain and operate the hospital, instead of turning it over to the group which is presently operating the Downey Community Hospital. The City Attorney stated that the question as to how the hospital will be operated will be a matter of policy to be determined by the City Council and could vary from year to year on a 5 -year period or more or less, but that there is no provision for submitting such a question to the vote of the people. It would constitute an expenditure of public funds and would be a query as to whether it would be a proper expenditure of public funds. A vote of the people might bind the City forever and ever without leaving that matter to the discretion of the City Council. AYES: 5 Councilmen: Morton, Skinner, Temple, Dickerson, Corbin NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Mr. Spindel reported that the contractor for Cash Contract #99, for resurfacing of Paramount Boulevard, was delayed in commencement in that his equipment did not meet the specifications and required modifications to comply with City of Downey regulations. An extension of time for completion of the contract was requested of 14 working days. It was moved by Councilman Temple,�seconded by Councilman Skinner and so ordered to grant the extension of time of 14 working days for completion of Cash Contract #99, Paramount Boulevard resurfacing. The Director of Public Works, Mr. Ervin Spindel, reviewed the policy of the Council of constructing the paving on all major streets after the property owner has constructed curb and gutter. This is being considered ^ in the project under Cash Contract #94, Imperial Highway between Downey Avenue and Paramount Boulevard to include the construction of paving along the north side of Imperial Highway in front of properties which have been required to construct paving as conditions of zone exceptions by the Planning Commission. It was moved by Councilman Temple, seconded by Councilman Skinner and passed by the following votes to approve plans and specifications, subject to State Division of Highways' approval, and grant authority to advertise for bids, and construct paving along the north side of Imperial Highway as recommended by the Director of Public Works. It was moved by Councilman Morton, seconded by Councilman Temple and passed by the following vote to approve the plans and specifications and authorize advertising for bids for Cash Contract #88, Gas Tax Project #13, Brookshire Avenue and Imperial Highway traffic signal. It was moved by Councilman Temple, seconded by Councilman Skinner and passed by the following vote to authorize participation of City in engi- neering and incidental costs for AD #84, Puritan Avenue, in the amount of $8,300. It was recommended that the bid be awarded to the low bidder, International Harvester Company inasmuch as their bid was considerably lower than the Downey bid. It was moved by Councilman Temple, seconded by Councilman Dickerson and passed by the following vote that the bid for public works equipment be awarded to the lowest and best bidder, International Harvester Company in the amount of $10,061.68, including tax and trade -ins and that all other bids be rejected. AYES: 3 Councilmen: Temple, Dickerson, Corbin NOES: 2 Councilmen: Morton, Skinner ABSENP : 0 Councilmen: None It was suggested that the City Council authorize a Mutual Aid Agreement with the cities of Paramount and South Gate to facilitate proper traffic enforcement related to common boundaries running at various distances from the center line on Gardendale Avenue from Garfield to Paramount Boulevard in the City of South Gate, and along Gardendale Avenue from Paramount Boulevard to Grant Avenue; and also along Century Boulevard from Castana to Lakewood Boulevard in the City of Paramount, as was entered into on March 16, 1959, with the City of Pico Rivera because of the common boundary line in the center of Telegraph Road. It was moved by Councilman Temple, seconded by Councilman Skinner and passed by the following vote to authorize the Mayor to sign a Mutual Aid Agreement with the cities of South Gate and Paramount as outlined in Item #3 of the City Manager's Report. Downey Auto Center was the only bid received, as other automobile dealers within the City of Downey reported they are unable to compete with the low bid of the Downey Auto Center. It was moved by Councilman Temple, seconded by Councilman Skinner and passed by the following vote to award the bid for automotive replace- ment and maintenance to the Downey Auto Center. AYES: 4 Councilmen: Skinner, Temple, Dickerson, Corbin NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None ABSTAIN: 1 Councilman: Morton ' The City Manager reported that in response to the City Council's previous request, the Sister City Committee budget and expenses for the previous year had been submitted, prior to Council approval of the requested budget of $600 for the ensuing year of 1963 -64. It was moved by Councilman Temple, seconded by Councilman Morton and passed by the following vote to accept the budget of the Sister City Com- mittee for the 1963 -64 fiscal year as submitted. AYES: 5 Councilmen: Skinner, Temple, Dickerson, Corbin, Morton NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Pat Sanford, member of the Les Dauphines YMCA Junior Hi -Y Club, intro- duced a little orphan girl from the City of Downey's sister City, Guadalajara, Mexico, for whom the organization had held a car wash in order to raise money for the orphan's visit to Downey. Mayor Corbin presented Elvira Valtierra with honorary citizenship and the little visitor shook hands of all Councilmen, press, and department heads before retiring from the Council Chamber. City Manager Oren King advised that in order that money authorized for the Parking District Fund in the amount of $152,500 plus interest, it is requested that Council approve withdrawal of invested funds not to exceed $200,000 from one of the following banks, which will be dependent upon the time element: Bank of America, Security First National Bank, or Capital National Bank It was moved by Councilman Temple, seconded by Councilman Skinner and passed by the following vote to authorize withdrawal of invested funds not to exceed $200,000 as recommended by the City Manager. AYES: 5 Councilmen: Morton, Skinner, Temple, Dickerson, Corbin NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Council Minutes 8 /27/63 -8- Officials of North American Aviation have advised that they have acquired the old Excello plant on the east side of Bellflower Boulevard, immediately north of the City's heliport site. They are constructing a large building with adequate parking. The size of this additional facility will require a traffic control at the intersection of the heli- port and North Americals entrance with Bellflower Boulevard. With the installation of the heliport site at this location, the North American officials have asked if the City would share in the cost of a signal on a 50 -50 basis. It is believed that the installation of the signal will be advantageous to the City, as well as North American Aviation. Estimates from the Department of Public Works are approxi- mately $12,000, which would entail an expenditure of approximately $6,000 from the City and from North American Aviation. It was recommended that the City share in this project and request participation from either the State or County in the use of Gas Tax Funds and /or County Aid funds. It was moved by Councilman Morton, seconded by Councilman Temple and passed by the following vote to approve the City's participation in installation of a traffic control at the intersection of the heliport and North American's entrance with Bellflower Boulevard as outlined in Item 4 of the City Manager's Report. AYES: 5 Councilmen: Morton, Skinner, Temple, Dickerson, Corbin NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None It was recommended that bids for motorcycle maintenance be awarded to the only bidder, S & J Harley Davidson Company, who has been satisfactorily servicing the police motorcycles in the past and apparently are the only ones in the immediate area who are equipped to submit a bid. It was moved by Councilman Morton, seconded by Councilman Temple and passed by the following vote to award the bid for motorcycle maintenance to S & J Harley Davidson Company at the following rates; First 15,000 miles - .016 per mile Next 15,000 " - .02 per mile Next 15,000 miles - .025 per mile AYES: 5 Councilmen: Morton, Skinner, Temple, Dickerson, Corbin NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None The City Manager advised that a resolution from the United Way Chairman, Mr. Switzer had been received requesting that the months of October and November be designated "United Way Drive months ". It was moved by Councilman Temple, seconded by Councilman Morton and so ordered to approve the months of October and November as "United Way" time. The City Manager reviewed for Council the various tax delinquent parcels in the City of Downey which the City might wish to purchase. A. Mann, upon additional information and facts, had revised his appraisal on the Levchuk property. The Levchuks had originally requested $500 more than the appraisal. The present appraisal allows them an additional $532. They now have submitted a compromise and release to be formalized in a regular stipulated judgment that they will settle for a total sum of $641 over the original appraisal. Mr. Fulghum is moving to Idaho (Boise). Mr. Fulghum stated he will look back on his associations in the City of Downey with much pride and thanked Council for the plaque. Mr. Sherman Griselle, Director of Planning, submitted a report, as requested by Council previously, on the Uniform Zoning Ordinance Committee of the League of California Cities. He informed Council that he had been attending these meetings upon the request of former delegate to the committee, Hollis M. Peavey. It was moved by Councilman Skinner that Councilman Scott Temple be designated the representative on this Uniform Zoning Ordinance Committee from the City of Downey. The motion died for lack of a second. It was then moved by Councilman Morton, seconded by Councilman Temple and so ordered to designate Mr. Sherman Griselle, Director of Planning, to serve on the Uniform Zoning Ordinance Committee of the League of California Cities from the City of Downey, and that he report from time to time on the progress made by the committee. Councilman Morton suggested that condolences be sent from the City to the members of the family who survived the recent fire and also, he stated, he wished to commend the Fire Department for their action and specifically to the fireman who entered the home at the risk of his own life to bring out the occupant. Chiefe Robert Gain reported the heroic fireman was Gilbert Lake, and a summary report was given by him of the fire. Council Minutes 8 /27/63 -1C- A7F_m Councilman Morton gave a very comprehensive report on the AMA Conference in Houston, Texas, which he attended recently and stated it is a real pleasure to be able to be in a City that will help support itself and reach out and do things on the individualistic basis. He is proud of the fact that the City of Downey is way ahead of other cities even larger than itself. Councilmen commended Councilman Morton on his report. Mayor Corbin commended the Police Department on the quick thinking of one of the rookie firemen in applying pressure point bandages in order to save the life of a victim of an automobile accident on Florence Avenue near the Downey Savings & Loan Association.
