MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
AUGUST 12TH, 1963
The City Council of the City of Downey held a regular meeting in
the Council Chamber of the Downey City Hall at 7:30 P.M., August 12,.
1963, Mayor Ben Corbin presiding.

Reverend John T. Kreider of the Faith Mennonite Church of the City
of Downey delivered the invocation.
Mayor Corbin called on Mr. George Morrison, Manager of the Northwest
Downey Senior Little League Baseball Team to introduce the team and coaches,
Leonard Dolan and Hadley, so that they may be honored for winning the
regional championship of 11 Western states. When the boys were introduced,
Mr. Morrison stated they had been selected as all -stars and that they had
played seven games without defeat.
Chief of Police Ivan A. Robinson requested Mayor Corbin to assist him
in presenting certificates of completion from Peace Officers Standards
Training Course to police officers William E. Olmstead, Ben F. Wordon and
Leonard K. Wolcott, who had completed a most rigid course. Chief Robinson
stated that this course is financed through a 10% levy through recent legis-
lation on fines other than traffiq which is used for intensive peace officer
training.
Ervin Spindel, Director of Public Works, requested Mayor Corbin to
assist him in presenting certificates for completion of a training course
for Public Works Construction Inspectors at Los Angeles State College.
Recipients of the certificates were Don W. Marlowe and Phil Adsit.
Mayor Corbin announced that this is the time and place set for the
hearing on Regentview AD #67 Debt Limit Report. The Mayor asked if the
City Clerk had the Affidavit of Mailing relative to the hearing. The City
Clerk replie d'she had the affidavit.
It was moved by Councilman Temple, seconded by Councilman Skinner and
so ordered that the affidavit be received and filed.
The factual date of the report was presented by Mr. Ervin Spindel,
Director of Public Works.
Mayor Corbin inquired if there were any written protests which had
been submitted. The City Clerk replied she had received one protest from
Mr. Leo DuLac protesting the cost of the improvements. It was reported that
the cost is an estimate and is usually over and above the actual cost.
It was moved by Councilman Temple, seconded by Councilman Skinner and
so ordered that the protest be received and filed.

and passed by the following vote that the objection to the cost of the
improvements in A.D. #67, Regentview Avenue, be overruled.

RESOLUTION NO. 1217
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
FINDING AND DETERMINING THAT ASSESSMENT DISTRICT NO. 67
(REGENTVIEW AND OTHER STREETS) IS FEASIBLE AND THAT THE
LANDS WITHIN THE PROPOSED DISTRICT WILL BE ABLE TO BEAR
THE BURDEN OF SUCH PROPOSED ASSESSMENT
The resolution was read by title only. It was moved by Councilman
Temple, seconded by Councilman Skinner and so ordered that further reading
be waived.
It was moved by Councilman Skinner, seconded by Councilman Temple
and passed by the following vote that Resolution No. 1217 be adopted.

Mayor Corbin announced that this is the time and place for the hearing
of Intention on AD #67, Regentview Avenue, and asked the City Clerk if she

so ordered that the affidavits be received and filed.
Mayor Corbin inquired if there were any written protests. The City
Clerk replied there were none other than the one presented from Mr. Leo DuLac
in the previous hearing.

RESOLUTION NO. 1218
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
DOWNEY ORDERING WORK TO BE DONE ON REGENTVIEW
AVENUE AND OTHER STREETS IN ACCORDANCE WITH
RESOLUTION OF INTENTION NO. 1210 (AD #67)
The resolution was read by title only. It was moved by Councilman
Skinner, seconded by Councilman Temple and so ordered that further read-
ing be waived.
It was moved by Councilman Skinner, seconded by Councilman Temple
and passed by the following vote that Resolution No. 1218 be adopted.

The Mayor announced that this is the time and place set for the
hearing on Zone Exception Case X6388 appealed by Al Hoffman.
Mr. Sherman Griselle, Director of Planning, presented a 'resume of
the zone exception case.
Mayor Corbin asked if there was anyone wishing to speak in favor of
the zone exception.
Estelle Hoffman, 9023 Lubec, stated she and Mr. Hoffman were will-
ing to agree to comply with all of the requirements of the Planning Com-
mission in relation to the installation of their sign in the parkway on
Firestone Boulevard except the sidewalks on Pangborn Avenue to the east.
She stated this area was now covered with asphaltic cement which would
accommodate a small amount of pedestrian traffic at this time and that
the installation of sidewalks would be more detrimental to them than it
would be beneficial to the public.
No one spoke against the appeal.
The completion of this zone exception case will result in the dedi-
cation back to the owner of a small portion of the radius at the inter-
section of Firestone and Pangborn. This will effect a more uniform radius
in accordance with Firestone Boulevard improvements.
After discussion, it was moved by Councilman Skinner, seconded by
Councilman Dickerson and passed by the following vote to table action until
the August 27 Council Meeting for the Director of Public Works to bring
back a report on the dedication of this right of way.

Maurice L. McAlister, Chairman of the Chamber of Commerce Hospital
Committee, made a presentation of petitions signed by more than 8,300
citizens, requesting the City Council to set up a special election on
October 29, 1963, so that the people might vote as to whether a municipal
hospital shall be established in the City of Downey and as to whether the
financing shall be by a general obligation bond issue. Mr. McAlister
introduced nurse Kenton who had obtained 1,000 signatures. Mrs. Kenton
expressed her appreciation of the wonderful reception she was given while
obtaining these signatures.
Mr. McAlister expressed the hope that the City Council would establish
the date of the special election for the municipal hospital on October 29, 1963
(as per his letter dated August 12, 1963, filed with the City Clerk).

James Bannister, Editor of the Herald American newspaper, expressed
in his opinion he has never seen any popular move which gained greater
response or enthusiasm.
Councilman Temple inquired if the City Clerk had checked the petitions.
The City Clerk certified that the petitions had been checked and more than
15% of the registered voters had signed.

passed by the following vote to call a special election for October 29,
1963, on the hospital petitions.

The ballot for such special election shall read approximately as fol-
lows:
A. MUNICIPAL HOSPITAL PROPOSITION:
Shall a municipal hospital be established
in the City of Downey?
B. HOSPITAL BONDS:
Shall the City of Downey incur a bonded indebt-
edness in the principal amount of $4,000,000
for the purpose of the acquisition and construction
by said city of a certain municipal improvement, to
wit: a general hospital, including the acquisition
of all equipment and other property necessary there-
for?
It was moved by Councilman Skinner, seconded by Councilman Temple and
passed by the following vote to authorize the employment of Martin & Chapman
for miscellaneous election services and supplies.

based upon their proposal.

It was moved by Councilman Skinner, seconded by Councilman Temple and
passed by the following vote to authorize the transfer of necessary election
expenses in the estimated amount not to exceed $10,000 from the unappropriated
reserves to Account No. 9 -2006.

Mayor Corbin congratulated Mr. McAlister and the committee on the
job they had done in circulation of the hospital petitions. He stated
he had never been opposed to the hospital but felt the citizens should
express their desires.
The Mayor announced that this is the time and place set for the
-"� public hearing on Planning Resolution No. 82, the General Plan.
Mr. Griselle presented a resume of the General Plan as outlined on a
map displayed in the Council Chamber.
The City Clerk was asked if she had received any written correspond-
ence for or against the General Plan.
The City Clerk replied she had received a petition from Mrs. Bertha
Carpenter signed by 14 citizens regarding proposed changes on the north
side of Fifth Street, and a letter from Downey Home Owners Association
signed by Robert S. Brazleton in favor of the General Plan.
It was moved by Councilman Dickerson, seconded by Councilman Temple
and so ordered that the correspondence be received and filed.
Mr. James M. Fox, 9122 Charloma Drive, speaking for the combined
group from Downey Chamber of Commerce, Downey Board of Realtors and Southeast
Building Contractors Association, requested that Gil Sais, Chairman of the
Committee on Zoning introduce the speakers from these various groups. The
following spoke on various changes which they recommended in the General Plan
before its adoption:
Ernie McCallum, Realtor, 9711 Save Avenue, Downey.
Copies of Mr. McCallum's requested changes from the Downey Chamber of
'~ Commerce were presented to Council.
It was moved by Councilman Skinner, seconded by Councilman Temple and
so ordered that the proposed changes submitted by Ernie McCallum be received
and filed.
Lee Felts, 12107 Woodruff Avenue, spoke in concurrence with Mr. McCallum's
comments.
S. T. Ziler, representative from the Southeast Building Contractors
Association, 7648 Cecilia, Downey. A copy of his statements was submitted
to Council.
It was moved by Councilman Skinner, seconded by Councilman Temple and
so ordered that the copy of Mr. S. T. Ziler's statements be received and filed.
Bea Axton, 9948 Smallwood, requested due consideration be given to the
proposals of the Southeast Building Contractors Association and was, she stated,
opposed to any downgrading of zoning.
Royal Brown, 11709 Downey Avenue, urged caution in the location of a
hospital within the City of Downey and streesed a need for additional
restaurants in Downey. He questioned dwelling so intensely on major depart -
mant stores as added sources of sales tax dollars.
Demos Shakarian, 8413 Lexington Road, complimented the Planning Department
on the General Plan but stated that he does not feel Downey was being upgraded
enough.
Also speaking in opposition to the General Plan ( specifically concerning
the Dinwiddie area) was Wayne Hunt.

and passed by the following vote that the hearing on the General Plan be

The City Manager stated that this General Plan had been under way for
some time and that it should be considered in three main categories: 1. Pro-
tection of the beautiful residential areas; 2. Encourage development of retail
business areas and industrial areas; and 3. Adequate high -rise apartment
zoning. The only way for the City to grow is up but the City and Planning
Department are thinking definitely of protecting the residential areas of the
City of Downey. The City Manager commended Sherman Griselle, his staff, the
Planning Department and Planning Commission for doing an excellent job.

passed by the following vote to take the matter of Planning Resolution No. 82,
General Plan, under submission for further study.

Mayor Corbin called for a 10- minute recess. The meeting reconvened at
10:30 P.M. with roll call with all Councilman present.
It was moved by Councilman Skinner, seconded by Councilman Temple and
passed by the following vote that the proposed court site which the City had
purchased be put up for sale based upon a current appraisal and a recapitula-
tion of all related costs of the acquisition of this property, including
building removal and superior court brochure expense; that the Board of
Parking Place Commissioners be directed to study the 50' strip in the center
of the block between Second and Third Streets and make a recommendation
relative to the possible use of this property in the future for off - street
parking to support the downtown area.

court site properties which had been acquired by the City.

Mayor Corbin announced that this is the time and place set for the
public hearing on Downey Improvement Project #502 (Gainford and Brookshire:
and Second and Dolan Streets).
Mr. Spindel reported that notices had been mailed and posting done
requesting that sidewalks be constructed on properties located on the

northwest corner of Gainford Street and Brookshire Avenue, and on the
northwest corner of Dolan Avenue and Second Street, in accordance with
the provisions of Chapter 27, Part 3, Division 7 (The Improvement Act of
1911), Streets and Highways Code.
The Mayor asked if there were any protests.
Howard Blondford, 8449 Gainford, objected to installation of side-
walks at his property and requested an extension of time for this
installation with the thought in mind that he may either participate in
other sidewalk installations due to begin early in September along Brook-
shire Avenue, from Charloma Drive to Gallatin Road, or proceed under
private contract.

passed by the following vote to grant an extension of time to Mr. Howard
Blondford until such time as sidewalks are installed on Brookshire Avenue
from Charloma Drive to Gallatin Road under Chapter 27 and inform Mr. Blond -
ford (City Engineer) when bids are due.

The Mayor announced that this is the time and place for the hearing on
Downey Improvement Project #503, Patton Road. Mr. Spindel reported that
notices had been mailed and posting done requesting that curb, gutter,
driveways and paving be constructed on Patton Road in the 12100 block, in
accordance with the provisions of Chapter 27, Part 32 Division 7 (The
Improvement Act of 1911), Streets and Highways Code.
Mr. DuLa.c requested information only and asked about the method of
payment. The Director of Public Works stated that it is preferred that it
be on a cash basis. Councilman Temple inquired if it could not be handled
on a current year status.
After discussion, it was moved by Councilman Temple, seconded by
Councilman Dickerson and passed by the following vote to close the hearing.

It was suggested that a study be made of financing of Downey Improvement
Projects and that a recommendation be submitted to Council by the Director
of Public Works.

It was moved by Councilman Temple, seconded by Councilman Skinner
and passed by the following vote to authorize the Public Works Department
to proceed with improvements under Downey Improvement Project #503,
Patton Road.

It was announced by the Mayor that this is the time for the public
hearing on Downey Improvement Project #102, Imperial Highway. Mr. Spindel
reported that notices had been mailed and posting done requesting that
sidewalks be constructed on Imperial Highway in the 9600 block, in accord-
ance with the provisions of Chapter 27, Part 3, Division 7 (The Improvement
Act of 1911), Streets and Highways Code.
The Mayor asked if there were any protests or comments.
Mr. C. J. Trollop, 9641 East Imperial Highway, stated that he had
initiated the project for sidewalks on his block on Imperial Highway and re-
quested permission to go to private contract if they so desire.
It was moved by Councilman Temple, seconded by Councilman Skinner and
so ordered that the hearing be closed.
It was moved by Councilman Temple, seconded by Councilman Skinner and
passed by the following vote to authorize the Public Works Department to
proceed with 'D.!.P; contract #102 with the stipulation of meeting with the
property owners to give them the opportunity to go to private contract if
they so desire.

It was moved by Councilman Skinner, seconded by Councilman Temple and
so ordered that the minutes of the meeting of July 23, 1963, be approved as
corrected.
The City Clerk reported on the following correspondence:
1. A letter of resignation from the Police Committee, from Arthur F.
Barnaby.
2. A letter of resignation from the fire Committee from Andy Anderson.
It was moved by Councilman Temple, seconded by Councilman Skinner and
so ordered to accept the resignations with regrets and that letters be sent
to Messrs. Barnaby and Anderson to that effect.
3. A copy of the Sister City Committee's proposed budget for 1963.
It was moved by Councilman Temple that the budget be accepted as proposed.
The motion died for lack of a second.
After discussion relative to Sister City expenditures for the previous
year and a desire to have a report on City appropriations before accepting
e-11 this budget, it was moved by Councilman Skinner, seconded by Councilman Temple
and so ordered to take the matter under submission pending a report from the
Director of Finance.
4. A financial Statement from the Rose Float Association. Ordered re-
ceived and filed.

5. A letter from Burke, Williams & Sorensen regarding Downey vs.
Barham, et al.
It was moved by Councilman Skinner, seconded by Councilman Temple
and passed by the following vote to take the matter under submission.

6. A request from Joseph T. Hall, Vice President of Delta Invest-
ment, reques0_ng that the City install curbs and gutters and paving on
Brookshire Avenue in return for the dedication of 2D' along the West side
of Brookshire Avenue in Tract #28399. Mr. Hall, 8444 Albia Street, spoke
in support of his communication.
After discussion, it was moved by Councilman Skinner, seconded by
Councilman Dickerson and passed by the following vote to uphold the Plan-
ning Commission's decision and the certain requirements imposed by them.

7. A petition for sidewalks on Tweedy Lane which was taken under
submission after noting Resolution No. 1224 requesting that Tweedy Lane
be designated a, street of major importance in the City of Downey.
8. A request for a parade permit for Labor Day for a parade saluting
youth. Chief of Police Ivan Robinson reported the request and parade had
been cancelled when the State Highway Commission had refused to allow the
parade to cross Lakewood Boulevard on a legal holiday. Chief Robinson reported
that youth organizations were working together with the thought of establishing
a Youth Day and parade in the spring.
(9) A request from Nelle Morrison, Vice - Regent for Daughters of the
American Revolution, for the Mayor to proclaim the week of September 17 -23
as Constitution Week.
It was moved by Councilman Temple, seconded by Councilman Corbin that
the proclamation be approved as requeeted. So ordered.
(10) A letter from the League of Women Voters requesting permission to
hold a "Go See" tour on Wednesday, September 18, of the various departments
of the City of Downey.
It was moved by Councilman Temple, seconded by Councilman Skinner and
so ordered that the request of the League of Women Voters be approved.
(11) A letter from Jorge Agnesi, Guadalajara, inviting participation
again by the City of Downey in the Float parade on their Independence Day.
. It was moved by Councilman Temple, seconded by Councilman Dickerson
and passed by the following vote to continue with the program of entering
a float in the Guadalajara Independence Day Parade, keeping the cost of
Downey's float to a maximum of $350.00.

APPROVING THE APPOINTMENT BY THE MAYOR OF A MEMBER OF
THE PARKING PLACE COMMISSION
The resolution was read by title only. It was moved by Councilman

RESOLUTION NO. 1220
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ADOPTING BUDGET FOR EXPENDITURE OF FUNDS ALLOCATED FROM
THE STATE HIGHWAY FUND TO CITIES
The resolution was read by title only. It was moved by Councilman
Skinner, seconded by Councilman Temple and so ordered that further reading
be waived.

The Director of Public Works advised Council that there are tax
delinquent parcels in the City of Downey which they may wish to consider
for acquisition. This matter was recommended for a field study.
A request for matching funds for construction of sidewalks along
Cherokee from the property owner at 8366 Cherokee Drive was received in
the Department of Public Works and it was recommended that Council con-
sider this request in accordance with the Sidewalk Matching Fund policy
adopted on June 25, 1963.

owner at 8366 Cherokee Drive (approximately $115.00) for construction of
sidewalks along the Cherokee frontage.

As reported by Mr. Spindel, more than 50% of the curb, gutter and
sidewalks have been constructed on the west side of Rives Avenue between
DePalma Street and Luxor Street. A property owner on this street has re-
quested that the remaining improvements be completed under Chapter 27,
Division 7 of the Streets and Highways Code.

Larry Chaney, Chairman of the Citizens Sanitation Committee, submitted
a report relative to a recommendation for increase in rates for rubbish
collection within the City.
Requests and recommendations were submitted as follows:
1. That an increase to a uniform rate be granted in all three zones
and that the rate for single family dwellings be established at
$1.30 per month.
2. That in return for granting the increase, the contractors agree
to waive their right of cancellation for a period of six months.
3. That the requirements for replacing all trucks after a period of
five years be eliminated; and instead that all trucks be inspected
by the Department of Public Works on a semi annual basis for com-
pliance with standards to be determined by the Department of
Public Works.
4. That the second day per week garbage pickup be eliminated.
5. That the rate for multiple family units be changed to a straight
75�- per unit per month instead of the current method of the first
unit paying the single residence rate and all other units paying
50�- per unit.
6. That the Contract be reviewed every two years for a determination
of the equity of the rates.

It was reported that since November 1961 the City has been endeavor-
ing to install a complete siren warning system in accordance with the
Federal Government specifications. Previous bids received proved not to
meet Federal specifications. An application is being re- submitted to the
Federal Government for approval of revised specifications for the service
and installation of five (5) - 125 decibel sirens. The amount of $25,000
is being carried forward in the current budget for installation of the
sirens, one -half of which would be replaced by the Federal Government under
the current agreement with them.
The proposed sirens would be activated by the Police Department on
lease wires from the Telephone Company. Permission was requested to again
call for bids for purchase and installation of 5 new sirens.

It was reported by the City Manager that stipulations have been
acquired for the remaining properties in Parking Lot #4 of the Down-
town Parking District program. Bids and /or quotations for demolishing
buildings and preparing plans and specifications for the paving of the
lot. In order to demolish the building, it is necessary to acquire the
property through court procedure in the same manner as the other properties
were acquired. It is therefore recommended that Council authorize transfer
of $152,500 plus interest as figured by the City Attorney for the acquisi-
tion of Parcels #7, #9 and #10. These monies will be returned to the
Reserve Fund as soon as the assessments are spread and the bonds are sold.

It was reported that the county is preparing to begin construction on
the extension of Old River School Road south of Imperial Highway to serve
the new Fire Station No. 5, in the Rancho Los Amigos property. Even
though this is a private street, it is felt that it would be very dangerous,
if there were no signal indications for northbound traffic on Old River
School Road. This is the way the fire engines will be entering Imperial
Highway. Inasmuch as the County is bearing the cost of the construction of
the road, which amounts to an estimated $30,000.00, it has been requested
that the City bear the cost of the signal modification at an estimated
$2,000. It is suggested that Council consider the contribution for this
signal modification and funds be appropriated from unappropriated balance of
City Capital Improvements Fund Account No. 13768 to Account No. 13769.

It was reported that while Mr. Peavey was on the City Council he was
on the Uniform Zoning Committee of the League of California Cities and that

suggested that Mr. Griselle continue to attend the meetings and that he
present a report to Council of the progress made by this committee to date.
Mr. King reported that the past two years the City Hall has observed
September 9, Admission Day as a holiday, and that it is recommended the City
Hall remain closed again this September 9.
