Skinner presiding. PRESENT: Councilmen: Morton, Temple, Skinner ABSENT: Councilman: Corbin ALSO PRESENT: Oren L. King, City Manager A. C. Gabriel, Director of Finance William A. Goggin, Assistant Director of Planning Ervin Spindel, Director of Public Works Lee Leavitt, City Engineer Ray Lake, Director of Building & Safety Robert Gain, Fire Chief Ivan A. Robinson, Chief of Police Don Robison, Senior Administrative Assistant Della Doyle, City Clerk Alberta Pfeiffer, Deputy City Clerk Royal M. Sorensen, City Attorney Reverend Austin Coe of the Memorial Christian Church in Downey de- livered the invocation. Mayor Pro Tempore Stephen Skinner introduced Ed Nay of the Pasadena Executive Committee for the Tournament of Roses and John O'Grady, Float Chairman. Mr. Nay remarked that it was with a great deal of pride that he wished to acknowledge participation by sister cities in the San Gabriel Valley and that the City of Downey had a very impressive record, winning •� five first place awards, one second, three thirds and one fourth, with their first float having been entered in 1920. Mr. Nay stated that Downey always has had outstanding floats and it is his privilege to present to the Mayor Pro Tem, the 1963 Tournament of Roses award. Emmett Williams, Chairman of the Sister City Committee, assisted by Mayor Pro Tem Skinner, presented certificates of honorary citizenship to Jorge Eduardo Schultz, Carlos Gil Elizondo and Esteban Torres Lample from Guadalajara. Carlos Elizondo thanked the Sister City Committee, the City Council and citizens for the opportunity to learn and practice the language, live new experiences, learn more of American customs and philosophies and hoped to some day have the privilege to repay some of the favors which have been extended to them. The Mayor Pro Tem announced that now is the time and place set for the hearing on the appeal to Zone Exception #389 (10400 Downey Avenue, D. Dudlext). Bill Goggin, Assistant Director of Planning presented a resume of Zone Exception #389. A map showing certain changes in the original plan was displayed. The Mayor Pro Tem called a 10- minute recess to allow persons opposing the zone exception to view the map. The meeting reconvened at 8:00 P.M. The Mayor Pro Tem asked the City Clerk if she had the affidavit of publication on the zone exception case appeal hearing. The City Clerk replied she had the affidavit. It was moved by Councilman Temple, seconded by Councilman Morton and so ordered that the affidavit of publication on Zone Exception Case #389 be received and filed. The City Clerk stated she had received one formal written protest from Mrs. E. M. Rudd. Speaking against the zone exception were the following persons: Donovan Dudlext, 10421 Stamps Road (appellant) Harvey Peterson, 10416 Stamps Road David W. Lyons, 10415 Stamps Road Dorothy Dudlext, 10421 Stamps Road E. M. Rudd, owner of property at 10424 - 104302 Downey Avenue Virginia Peterson, 10406 Stamps Road Mrs. Ann Thomas, 10446 Stamps Road Ivar Thomas, 10446 Stamps Road Speaking in favor of the zone exception case were Leslie Olson, 10022 Tristan Drive and S. T. Ziler, 7648 Cecelia Street. Mr. Ziler presented a letter from Mr. Harry Bowen who is not opposed to the zone exception. The letter was ordered received and filed. Mr. Ziler presented Mr. Wick, 1164 North Howard, Glendale, who has built this type construction elsewhere. Speaking in rebuttal were the following persons: Mr. and Mrs. Dudlext and Mr. Thomas It was moved by Councilman Morton, seconded by Councilman Temple and so ordered that the hearing on Zone Exception Case #389 appeal be closed. After some discussion, it was moved by Councilman Temple, seconded by Councilman Morton and passed by the following vote to take Zone Exception Case #389 under submission. AYES: 3 Councilmen: Morton, Temple, Skinner NOES: 0 Councilmen: None ABSENT: 1 Councilman: Corbin Mr. Ray Goates announced the achievement of Dr. Travis, who recently won the State of California Amateur Golf Championship. Mayor Pro Tem Skinner presented a plaque of recognition by the City for his achievement in winning this championship. Mayor Pro Tem ,Skinner announced that this is the time and plase set for the hearing on Planning Resolution #81, Zone Change #97 (Lakewood and Cecilia, Loewy). Mr. Goggin presented his factual report, followed by a resume by Leslie Olson representing applicant. Speaking against the zone change was Mr. E. G. Farquharson, 10729 Shellyfield Road. The Mayor Pro Tem inquired if the City Clerk had the affidavit of publication on the hearing. The City Clerk stated she had the affidavit. It was moved by Councilman Morton, seconded by Councilman Temple and so ordered that the affidavit be received and filed. It was moved by Councilman Temple, seconded by Councilman Morton and so ordered that the hearing on Planning Resolution #81, Zone Change #97 be 01-4 closed. ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWEY AMENDING ZONING MAP ADOPTED BY SECTION 9107 OF THE DOWNEY MUNICIPAL CODE (PLANNING RESOLUTION NO. 81, ZONE CHANGE NO. 97) The ordinance was read by title only. 1742 It was moved by Councilman Temple, seconded by Councilman Morton and so ordered that further reading be waived. It was moved by Councilman Morton, seconded by Councilman Temple and passed by the following vote that the ordinance be introduced. It was moved by Councilman Temple, seconded by Councilman Morton and so ordered that the affidavits be received and filed. The City Clerk reported she had received a letter of protest against the assessment from Mr. John E. Boland, 9626 Spry Street Speaking against the assessment was Mr. Norman Martin, 12102 South Izetta Street. Mr. Spindel, Director of Public Works, answered questions raised con- cerning the incidental costs to the district. There were no further oral or written protests or comments. It was moved by Councilman Temple, seconded by Councilman Morton and so ordered that the hearing on Izetta Avenue, A.D. #81, be closed. It was moved by Councilman Temple, seconded by Councilman Morton and so ordered that the written protest be overruled. RESOLUTION NO. 1203 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY CONFIRMING THE ASSESSMENT FOR THE IMPROVEMENT OF IZETTA AVENUE AND OTHER STREETS (AD 81) The resolution was read by title only. It was moved by Councilman Temple, seconded by Councilman Morton and so ordered that further reading be waived. It was moved by Councilman Temple, seconded by Councilman Morton and passed by the following vote that Resolution No. 1203 be adopted. It was moved by Councilman Morton, seconded by Councilman Temple and passed by the following vote to authorize the Department of Public Works to proceed with construction on Downey Improvement Project #502 in accord- ance with the provisions of Chapter 27 of the Improvement Act of 1911 of the Division of Streets and Highway. Mr. Spindel presented his report, stating a. petition had been received requesting these sidewalks. Mr. Walter Lexin protested the installation of sidewalks in his area., stating he did not feel there was a. need for them. It was moved by Councilman Temple, seconded by Councilman Morton and so ordered that the hearing on DIP #501 be closed. It was moved by Councilman Morton, seconded by Councilman Temple and passed by the following vote that further action be tabled at this time on Downey Project No. 501, sidewalks on Parrot Street. The City Clerk reported on the following correspondence: (1) A letter from Hollis M. Peavey in appreciation for the farewell ceremonies and wishes from the City. (2) A letter from the Downey Junior Woman's Club in appreciation for the participation of the City in the "Let Freedom Ring" program on July 4th. Councilman Morton suggested that a. letter be directed to the Downey Junior Woman's Club for their participation and help in making the Fourth of July program a success. Four letters requesting consideration for the Council vacancy in District #3 from the following persons: Jim Brown, 9339 Samoline Avenue Thomas J. McDonald, 9127 Brock Avenue Mr. Harry Garo, 7738 Allengrove Street Mrs. Neville Kilpatrick, 8117 Fifth Street The City Clerk reported she had set up appointments for the above applicants for personal interviews with Council. It was moved by Councilman Temple, seconded by Councilman Morton and so ordered that the deadline for receiving applications for the Council vacancy in District #3 be set for the close of business, July 19. (3) A letter from Mr. William Hart protesting the decision on the Zoning Ordinance and asking that the City Council now revoke its decision. The City Attorney stated the hearing having been closed and action having been taken by granting the exception, there is no provision in the ordinance providing for a further appeal and the Council has lost juris- diction. The letter was ordered received and filed. The Mayor Pro Tem declared a. 10- minute recess. The meeting reconvened at 10:00 o'clock P.M. with roll call, with all councilmen present. ORDINANCE NO. 227 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE DOWNEY MUNICIPAL CODE BY ADDING SECTION 6254.1 THERETO WHICH SAID SECTION RELATES TO A LICENSE TAX UPON PERSONS ENGAGED IN THE BUSINESS OF PRODUCING OIL IN THE CITY OF DOWNEY The ordinance was read by title only. It was moved by Councilman Temple, seconded by Councilman Morton and passed by the following vote to authorize the circulation of peti- tions for Assessment District #90 street improvements. AYES: 3 Councilmen: Morton, Temple, Skinner NOES: 0 Councilmen: None ABSENT: 1 Councilman: Corbin Authorization was requested from Council for property owners to be notified on Paramount Boulevard to complete improvements in accordance with the State Streets and Highways Code at 10912 Paramount Boulevard et al. Mr. Spindel reported that the majority of improvements along a section of the block have been completed and additional improvement of these areas will help the flow of traffic as well as eliminate a maintenance problem and hazardous conditions. The work was proposed to be done under Chapter 27 of the Improvement Act of 1911 of the Streets and Highways Code. Inquiries were made as to whether or not this might be done under gas tax funds. After discussion, it was moved by Councilman Temple, seconded by Councilman Morton and so ordered to table action on Downey Improvement Project #504, Paramount Boulevard et al. It was reported that over 50% of the sidewalks have been con- structed along the west side of Brookshire Avenue between Firestone Boule- vard and Iowa Street, with only one property in the area not having 1749 completed sidewalk construction. It was requested that the Department of Public Works be authorized to notify the owner to complete sidewalk construction adjacent to his property. It was moved by Councilman Morton, seconded by Councilman Temple and passed by the following vote to authorize the Department of Public Works to issue notice to the owner on the west side of Brookshire Avenue north of Iowa Street to complete sidewalk construction according to Chapter 27 of the 1911 Act of the Streets and Highway Code, under Project No. 505. It was moved by Councilman Temple, seconded by Councilman Morton and passed by the following vote to approve.acceptance of improvements com- pleted as required in the agreement to improve Tract No. 27524, Birchdale Avenue and Tenth Street. Bloome Company at the unit price of$12.95. An allowance will be made of $1.50 per recappable tire and no allowance on nonrecappable tires. It was moved by Councilman Temple, seconded by Councilman .Skinner and passed by the following vote to award the bid for 150 tires to Mark C. Bloome at the unit price of $12.95 for U. S. Royal Tires and that all other bids be re3ected. AYES: 3 Councilmen: Morton, Temple, Skinner NOES: 0 Councilmen: None ABSENT: 1 Councilman: Corbin The City Attorney reported that it would appear that all property owners with exception of two have agreed to accept the City's appraisal on Downey street widening. Parcel #4 has asked for an additional $300.00; Parcel #5, $800.00 additional. Mr. Sorensen reported that he had reviewed the appraisals with the appraiser and Director of Public Works and that he cannot recommend that an increase be granted. It appears to him that the appraisals are in line and that it is a matter to be determined by the Council at this time.. It was moved by Councilman Temple, seconded by Councilman Morton to concur with the appraiser and not deviate from the appraiser's recommendations or those of the City Attorney. Council was informed that Parcel #4 was located at 9608 Downey Avenue and was owned by Mazur; Parcel #5, 9730 Downey Avenue, owned by Levchuk. Mrs. Jean Levchuck came forward and stated that they had not been allowed as much per square foot as neighbors, and that the two trees removed from their property had been valued too low. She also stated that one of the reasons given for the lowered value on their property was due to a drainage problem, which she stated does not exist. In view of the statements of Mrs. Levchuk, Councilman Morton withdrew his second and Councilman Temple, his motion in order to re -check the drainage problem and the evaluation placed on the property by the appraiser. It was moved by Councilman Morton, seconded by Councilman Temple and passed by the following vote to authorize the City Attorney to proceed with condemnation actions on Downey widening, with the exception of Parcel #5. AYES: 3 Councilmen: Morton, Temple, Skinner NOES: 0 Councilmen: None ABSENT: 1 Councilman: Corbin 1751 The Director of Public Works was directed to report to the City Attorney if, after further checking, the Levchuk property has been properly evaluated. A report from the Director of Finance revealed that the taxi cab rates for surrounding cities are comparable to those in Downey. Rates for taxi cab stands and fees for driver's permits do vary considerably and it was felt, therefore, that the license fee for taxi cabs is sufficient for this area. The Department of Public Works and Police Department are checking further on rates for taxi cabs stands and driver's permits. No action was taken at this time. Councilman Morton suggested that some of the official City flowers, the "Everlasting ", be planted in the downtown divider areas, on Firestone Boulevard. Councilman Temple suggested that a study be made of the possibility of having city -owned gasoline pumps at some future date.
