Robinson, Chief of Police Della Doyle, City Clerk Alberta M. Pfeiffer, Deputy City Clerk Reverend Claude Young of the First Methodist Church delivered the invocation. Mayor Corbin called upon the Director of Public Works for presenta- tion of in- service training certificates from the State Board of Regis- tration. Mr. Spindel reported the recipients of the certificates had undergone a very comprehensive examination which lasted approximately 8 hours. Passing the examination necessary for becoming a registered pro- fessional engineer is a great achievement. The two members awarded the engineering certificates were Witold Hryniewicki and Donald E. Donovan. Certificates were presented by Mayor Corbin. It was moved by Councilman Skinner, seconded by Councilman Temple and so ordered that the minutes of September 10, 1963, be approved as written. The City Clerk reported on the following correspondence: 1. A letter from the General Services Administration relative to declaration of the Old Post Office Building as surplus property, indicat- ing the best estimate of the date the property is expected to become surplus is about November 15. 2. Letter signed by George Binder, representative for various property owners on Firestone Boulevard requesting rearranging and improving parking lots at the rear of J. J. Newberry and other businesses. The matter was referred to the City Manager and Director of Public Works for investigation and report. 3. A copy of letter to the Superintendent of Downey Unified School District from W. M. Fitch relative to school bus schedules. Ordered received and filed. 4. Copy of letter submitted by Mr. King to Assemblyman John Moreno relative to State participation in a pedestrian overpass over the Santa Ana Freeway. 1 E..2 5. A letter from F. A. Howell, Park Superintendent, requesting the City to install sidewalks around the perimeter of Imperial Park. It was moved by Councilman Skinner, seconded by Councilman Dickerson and so ordered that the letter be received and filed as the parks belong to the County and the Park District should install their own sidewalks from its own taxing district. 6. A letter from Mr. Gil Huffman complimenting the City on the beautification on Firestone Boulevard. Ordered received and filed. 7. A copy of resolution from the Downey Chamber of Commerce re- questing the City Council to prepare a presentation similar to the one made for the Superior Court site to present to the Board of Trustees of the California College of Medicine. It was moved by Councilman Skinner, seconded by Councilman Temple and passed by the following vote to instruct the City Manager to prepare a resolution for the next Council Meeting, similar to the one adopted by the Chamber of Commerce, and that the Chamber of Commerce share in the cost of a brochure. AYES: 4 Councilmen: Skinner, Temple, Dickerson, Corbin NOES: 0 Councilmen: None ABSENT: 1 Councilman: Morton A notice of Americanism Rally to be held October 24 1963, from the President of the Downey Chamber of Commerce and President of the Downey Junior Woman's Club was presented, requesting observance of Patriotic Education Week, October 19 through October 25. Mayor Corbin requested the Chamber of Commerce to prepare a proclamation for him to sign. Buddy Bushman, representative of the Downtown Businessmen's Associa- tion, requested the City's appropriation of $2500 toward Christmas lighting for the downtown business area and gateway lighting. Cost of the gateway lighting was set at $1000. Bob Sasine, President of the Downey Chamber of Commerce, outlined the plan for the Christmas lighting, stating it would include lights at Florence and Paramount and in front of the Stonewood Shopping Center. After discussion, it was moved by Councilman Skinner, seconded by Councilman Temple and passed by the following vote that the City Council appropriate $1000 for gateway Christmas lighting to be disbursedfor the City by the Downey Chamber of Commerce, such sum for this purpose to be transferred from operating reserves. ORDINANCE NO. 235 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING SECTION 9132.4 OF THE DOWNEY MUNICIPAL CODE, WHICH SAID SECTION RELATES TO FILING FEES The ordinance was read by title only. 1 It was moved by Councilman Temple, seconded by Councilman Skinner and so ordered that further reading be waived. Hahn, in the amount of $7,648.00, and that all other bids be rejected. It was moved by Councilman Skinner, seconded by Councilman Temple and passed by the following vote to approve plans and specifications on Cash Contract No. 89, Woodruff Avenue, and grant authority to advertise for bids. Company, Inc., the lowest and best bidder, at the unit price as bid, and that all other bids be rejected. AYES: 4 Councilmen: Skinner, Temple, Dickerson, Corbin NOES: 0 Councilmen: None ABSENT: 1 Councilman: Morton It was reported by the Director of Public Works that in Resolution of Intention under improvement on Donovan Street, AD #71, between Brookshire Avenue and Birchdale Avenue authorization was given by the City Council for the City to contribute $4,000 which was to cover all inci- dental expenses in connection with the improvements on Donovan Street. The project has now been completed and the finial costs have been determined to be $4,887.50. It is recommended that the City Council consider transferring this amount from unappropriated reserves to account #14410. The final cost in the amount of $3,510.83 has been determined and it is now requested that a transfer of funds be made in order to cover this expense. Mayor Corbin.then declared a 3- minute recess with the meeting recon- vening at 9:18 A.M. with roll call. PRESENT: Councilmen: Skinner, Temple, Dickerson, Corbin It was recommended that Council grant the request of property owner at 9342 Telegraph Road for matching funds from the City for con- struction of sidewalks adjacent to his property, in accordance with the Sidewalk Matching Funds policy of Council. It was moved by Councilman Temple, seconded by Councilman Dickerson and passed by the following vote to grant matching funds for constructirn of sidewalks adjacent to the property located at 9342 Telegraph Road at the estimated cost of $125.00 to the City. Mr. King reported that the handbook for employees is ready to go to press and suggested 600 to 700 books be printed. Total employees number- ing 303, it was r @commended by Council that only 450 books be printed. It was moved by Councilman Skinner, seconded by Councilman Temple and passed by the following vote to authorize printing of 450 employee handbooks and authorize appropriation of $350 from the Operating Reserves to Account No. 2000 -331 for this purpose. AYES: 3 4 Councilmen: Skinner, Temple, Dickerson, Corbin NOES: 0 Councilmen: None ABSENT: 1 Councilman: Morton It was moved by Councilman Skinner, seconded by Councilman Temple and so ordered to approve the appointment by Councilman Corbin of George Olson to the Fire Committee. 1810 The City Attorney briefed Council on the suit, Downey County Water District vs. City of Downey and read portions of the Judgment rendered by the Supreme Court which declared the Downey County Water District merged with the City by reason of the inclusion of the entire District within the boundaries of the City of Downey. The effective date of the Judgment will be delayed if the Supreme Court grants a hearing to the Water District, should they appeal. There will be no action taken by the City to physically take over the Downey County Water District until a final judgment is received. Councilman Temple commended Sue Simmons, Miss Downey, for the fine job she did while attending and participating in the Independence Day celebration in Downey's sister city, Guadalajara, Mexico. It was suggested by Councilman Temple that a resolution be prepared to be submitted to the League of California Cities, suggesting they adopt a resolution to submit to the American Municipal Association to see if they would care to set up an International Sister - Cities Conference to be held in Guadalajara, Mexico in a year or two, with other cities having sister cities in Mexico participating. It was also suggested that copies of the resolution prepared for the City of Downey be forwarded to cities in the State of California to determine their interests in such a conference. It was moved by Councilman Temple, seconded by Councilman Skinner and so ordered that a resolution be prepared as suggested for an International Sister Cities Conference. Councilman Dickerson reported a traffic hazard existing in his district at the intersection of Third Street and Paramount Boulevard where shrubbery encroaches on the right of way and that he had received several complaints regarding remedying this situation. It was suggested that this .—. be included as a project under gas tax funds since it is a major inter- section. It was moved by Councilman Temple, seconded by Councilman Dickerson and so ordered that the intersection of Third Street and Paramount Boulevard be included in select system projects list currently being formulated. Mr. H. L. Duggan, 7901 East Stewart and Gray Road requested, if possible, that assessment district costs be decreased inasmuch as improve- ments done on private contract run about 1/3 less than costs under assessment district proceedings. Mr. Duggan also inquired about the location of the proposed municipal hospital and was informed it is impossible at this time to state the exact location as this cannot be decided until after the municipal election. Council advised Mr. Duggan it would check all available land before determining the site on which the hospital will be built. Mr. Duggan also urged that Council not use profits from Downey County Water District for purposes other than actual operation of a municipal water department and that the rate not be raised to users. The City Attorney advised that the Judgment stated that the City "shall have only the same power that the Water District has had and should be able to adjust the matter of details." Mr. Duggan compared the figures as to the legal costs incurred by both the City and the Downey County Water Dist5ict in the sub Downey vs. Downey County Water District which were $11,810.92 by the City and $20,808.60 by Downey County Water District. Charles Bates, Director of Civil Defense for Area E reported that at the California Civil Defense and Disaster Conference in Santa Maria recently, he had presented a report on the action in the City of Downey relative to installation of medical supply centers in the City, and also that he had been requested to furnish copes of the report of the activities taking place in Downey to all members of the association. Mr. Bates commended Council, 181-1 School District and community organizations on behalf of their work in Downey on Civil Defense projects and also praised the fine job Director Ed Powell is doing. The City Attorney advised that relative to the sale of property at Second and LaReina Streets, a conditional sale contract should be .-� entered into whereby the City would retain title until all the funds were paid. This type contract is satisfactory with Mr. Howard Vleerick, and when prepared, will be submitted for approval of Council. The City Attorney also reminded Council that they had requested that an ancillary agreement be drawn up by him to assure the particular development as presented by the group represented by Mr. Vleerick known a# Downey Towers. This agreement has already been signed by Howard Vleerick for the group and a certified copy of the partnership agreement has been requested by the City Attorney to determine who has the power of signing. Councilman Skinner requested that Council be furnished copies of the ancillary agreement for study before submission for its final approval or disapproval. It was also suggested that the plans be submitted to the planning department for checking. The Director of Planning advised Council that he had checked the plans and they met the provisions of zoning for C -3 within the City and that such type building can be built unless something is later added in final plans or was not apparent in the preliminary plans which he had checked. It was moved by Councilman Temple, seconded by Councilman Dickerson to approve plans as submitted and authorize the Mayor to execute an agree- ment in substantially the form as outlined by the City Attorney. After discussion of certain phases of the proposed agreement which were not entirely clear to Council, Councilman Temple withdrew his motion and Councilman Dickerson, his second to the motion, in order to enable Council to give the matter further study. Mr. Howard Vleerick reported that they are willing to pay $1,000 per month on the purchase price, the full amount to be paid at the time they receive title, and also that the group intends to build in a year or two. It was also mentioned that a land sale contract would be satisfactory. It was agreed by the City Council and Mr. Vleerick that the sale con- tract in the amount of $108,000 should not exceed a period of one year; that Mr. Vleerick and Associates should pay $1,000 per month from the date of the opening of the escrow and that if the escrow should not be completed and the title transferred, at the end of one year Howard Vleerick and Associates would forfeit monies paid on this conditional sale contract. Mr. Vleerick stated that their intentions were to break ground by June or July of 1964 and that the entire amount would be paid on or before this date and in no event later than one year. The interest on the unpaid balance during this one -year period would be 7 percent. It was noted that in the above condition set forth in the ancillary �-. agreement Downey Towers (Howard Vleerick, et al.) would have a period of 2 years to complete the building after the delivery of title and closing of escrow. The City Manager and City Attorney were requested to bring back the suggested escrow proceedings containing the conditional sale contract and the ancillary agreement in complete detail so that the Council might have more time to thoroughly review them before final agreement.
