HomeMy WebLinkAboutMinutes-04-23-63-Regular Meeting1666 MINUTES OF THE CITY COUNCIL OF THE CITY OF DOWNEY APRIL 23RD, 1963 The City Council of the City of Downey held a regular meeting in the Council Chamber of the Downey City Hall at 8 :00 A.M., Mayor Ben Corbin presiding. PRESENT: Councilmen: Skinner, Peavey, Morton, Temple, Corbin ALSO PRESENT: Oren L. King, City Manager Royal M. Sorensen, City Attorney Sherman Griselle, Director of Planning A. C. Gabriel, Director of Finance Ervin Spindel, Director of Public Works Lee Leavitt, City Engineer Robert DeSio, City Forester Don Robison, Sr. Adm. Asst. Robert Gain, Fire Chief Ray Lake, Director of Building & Safety Loren Morgan, Deputy Chief of Police Della Doyle, City Clerk Alberta Pfeiffer, Deputy City Clerk The invocation was delivered by Rabbi Martin Rybach, Jewish Temple. Mayor Corbin presented a five -year service pin to Lee Gauildin, member of the Personnel Advisory Board for over five years, commending him on his fine service on this Board. Mr. Gauldin stated it has been an extreme pleasure to serve in an advisory capacity and hopes he can contin- ue. He thanked Mayor Corbin and Council for the pin. Mr. William Burke, President of the Downey City Employees Association presented a resume of the recommendations of the Industrial Relations Committee of the Association for various fringe benefits for City employ- ees. Members of this committee representing the various departments were introduced. Mayor Corbin stated he is pleased with the City employees and very proud of the work they are doing. Councilman Peavey stated he is proud of the accomplishments which have been made by the City and by the respective departments and congratu- lated all the departments. He advised that Council tries to do the best it can and still be able to pay salaries and expenses that come along. He commended them for the very fine progress made since incorporation of the City of Downey. The City Manager stated that it has been a pleasure to work with the City employees group throughout the years and commended them on the fine work and the manner in which they have conducted their York throughout the departments day after day and month after month. It was moved by Councilman Skinner, seconded by Councilman Peavey and so ordered that the minutes of the Council Meeting of April 8, 1963, be approved as written. The City Clerk reported on the following written correspondence: (1) A letter from Edward DiLoretto, Yale Engineering Company, regard- ing Compton Junior College District's annexing Downey Unified School District. Councilman Skinner proposed presentation of a resolution relative to this junior college matter at this time. The City Clerk read the resolu- tion in full as follows: 166'7 RESOLUTION NO. 1139 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY COMMENDING THE DOWNEY UNIFIED SCHOOL DISTRICT, DOWNEY PARENT- TEACHER ASSOCIATIONS, PARENT- TEACHER COUNCIL, PARENTS' GROUPS, AND THE DOWNEY COORDINATING COUNCIL FOR CIRCULATING PETITIONS SO THAT DOWNEY MAY HAVE FREE CHOICE IN SELECTING A JUNIOR COLLEGE; ALSO URGING ALL CITIZENS IN THE SIGNING THEREOF It was moved by Councilman Skinner, seconded by Councilman Peavey and passed by the following vote that Resolution No. 1139 be adopted. (2) A letter of resignation from the Sister City Committee from Mrs. Edwin Giddings. It was moved by Councilman Temple, seconded by Councilman Skinner and so ordered to accept the resignation with regrets. (3) Councilman Peavey appointed Mrs. Stanley Throgmorton and Mr. Fred Walsh to the Sister City Committee replacing appointments of Mrs. Rose Zambrano and Mrs. Gypsie Johnson, and reappointed all other appointments in District No. 3. It was moved by Councilman Temple, seconded by Councilman Skinner and so ordered that Councilman Peavey's appointments be approved as xedommended. (4) An appeal from Samuel & Lucas to Building Department Board of Appeals. Councilman Skinner suggested that since the provisions of the Building Code have now been met by appellant, the appeal be denied. It was moved by Councilman Skinner, seconded by Councilman Temple and passed by the following vote to support the Building Director and deny the appeal of Whitcomb Roofing Company of Artesia. AYES: 5 Councilmen: Skinner, Peavey, Morton, Temple, Corbin NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None (5) A letter fr om Toraei & Midori Nagami protesting a change of zoning of their property from C -4 in the new recommended General Plan. It was moved by Councilman Skinner, seconded by Councilman Temple and so ordered that the letter be referred to the Planning Commission. The City Attorney advised that the General Plan is now before tke Planning Commission for hearings and protest letters ofPthis nature should first be heard before it; it then will come before Council in due course. Mr. Griselle recommended the record for the Commission property owner's wishes; and hearing. that all letters of protest be read into so that they will be made aware of the again read in the record of the City Council (6) Memorandum from the Director of Public Works relative to hearing protests to the weed abatement program. There were no protests, therefore no action was taken. • • r • � � (7) A letter of gratification and thanks to the City Fire and Police Departments from Cee -Bee Chemical Company for the quick response in a time of need and stating it certainly gives one a sense of security and confidence in the service available and con- firms the correctness of their decision to have located their factory in the City of Downey some years ago. The City Manager reported that in Cash Contract #91, Dolan Avenue, bid includes the complete improvement of Dolan from Firestone to the railroad tracks. An alternate to this bid was the completion of the east side of Dolan, including painting curbs, gutters, driveways, sidewalks and drainage, from Firestone northerly to the alley, at a bid price of $2308.55. Mr. Gertler who has this property under lease has been contacted relative to paying for this work under this contract so that Dolan Avenue would have a uniform improvement from Third Street to the railroad tracks. Mr. Gertler advised that the owners or lessors are not in a position to pay on this, but that he is willing to pay $800.00. It was recommended that Council also award this alternate in the amount of $2308.55 and accept the proposal and check from Mr. Gertler in the amount of $800.00. It was moved by Councilman Peavey, seconded by Councilman Morton and passed by the following vote to approve the recommendation of the City Manager and accept the check in the amount of $800.00 from Mr. Gertler to be used as specified. Mr. Griselle stated it is an amendment to the Planning Code and he feels it is up to a local body to decide whether they want to control or permit non - conforming business operations and recommends opposing this bill. Mayor Corbin asked for the vote on the motion to adopt Resolution No. 1156. Deputy Chief of Police Loren Morgan explained this particular proposed legislation and the question having arisen as to whether or not the restriction included holidays, the motion to adopt was withdrawn and it was moved by Councilman Temple, seconded by Councilman Morton and passed by the following vote that the resolution be tabled for further study and report. It was moved by Councilman Skinner, seconded by Councilman Temple and passed by the following vote to award the bid for Cash Contract #91, Dolan Avenue, to the lost and best bidder, Sully- Miller Contracting Company, for Site 1 and Site 2 in the amount of the unit prices submitted in the proposal, and that all other bids be rejected. I. Haddon at the nnit prices submitted in the bid proposal. It was moved by Councilman Temple, seconded by Councilman Skinner and passed by the following vote to award the bid for Cash Contract #98, Weed Abatement, to the lowest and best bidder, P. I. Haddon, at the unit prices submitted, and that all other bids be rejected. The total amount of the contract awarded was $5,035.00; however extra work required of the contractor, including lowering windows, bond beam, painting ceiling, increased the cost to a total of $5,189.00. Additional work being done in the Mayor's office under this contract is not yet completeq, and it was recommended that the work be excluded from this final acceptance. Mr. King reported that information has been received from the State Highway Division that a pedestrian overcrossing at Tweedy Lane and Para- mount Boulevard has been approved with the City of Downey, Downey Unified School District and the State of California participating in the costs of this project in the total amount of $75,000, or $25,000 for each participant. r--� Councilman Peavey inquired if the City may use gas tax monies for this pedestrian overcrossing and was informed this would be done. Removal of these buildings would also be beneficial to the City for use as ,_. temporary parking areas during the interim period until the new lots are established under the Downtown Parking District. Manning for the purchase of property (135 feet on Firestone by 85 feet deep) identified as Parcel No. 7 in Parking Lot No. 4 of the Parking District proceedings. Mrs. Manning has agreed to enter into escrow proceedings for the sale of the property to the City and /or Parking District at the appraised price of $69,000.00. Money for the acquisition of this lot will be paid from Parking District Bonds. If the City's escrow proceedings are completed prior to the sale of the bonds, the City will be reimbursed for all of the expenses and purchase price incurred in the acquisition of this parcel. Manning for the purchase of Parcel No. 7 in Parking Lot No. 4 of the Parking District proceedings, for the sum of $69,000.00. AYES: 5 Councilmen: Skinner, Peavey, Mortonf Temple, Corbin NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Upon incorporation, the City of Downey inherited a system of vertical controls from the Los Angeles County Road Department. The last check for adjustment to this bench mark circuit was made during the year 1955 by the Los Angeles County Road Department. There has been considerable subsidence through the County of Los Angeles during the years, and because of this it becomes necessary to check and adjust these vertical controls periodically. This really should be done every 3 to 5 years; however, since incorporation this has not been done within the City of Downey and it is now 8 years since the last check was made. Changes in some of the elevations of the bench marks from 1952 to 1955 amounted to almost 1 foot in some places. This is not a constant change, and in some places there may be very little subsidence; in other places, the maximum. Therefore, it is now necessary that, in order to maintain proper vertical control and provide adequate design for the discharge of drainage water and sanitary sewage and other public improvements within the City, the periodic adjustment is required. It would be quite impractical for the Engineering Division of the City of Downey, with its limited personnel and survey instruments which are not of the proper precision, for this type of work, to attempt this task. Since such an adjustment is normally warranted approximately every 5 years, it would not be advisable to increase the force for this specific task. The Los Angeles County Road Department has made the surveys and adjustment for these bench marks in the past, and has the records, personnel and equipment required for this type of work. At the present time, the Los Angeles County Road Department is in a position to do this work for the _x.6'78 City at an estimated cost of $4,000.00. This can be paid for from funds presently budgeted in the Engineering budget without requiring any transfers. It is, therefore, recommended that authority be given for the approval of this project, which is of the utmost necessity. Councilman Skinner asked for a report on cost by surrounding cities. P"mft Mr. Spindel reported that the County is doing the work at the same price as it does the work for contract cities. Duggan, 7901 East Stewart and Gray Road, requested that Council identify the legislative bills which it opposes or supports. Mayor Corbin advised Mr. Duggan that the League of California Cities, as a rule, recommends adoption or opposition of legislation and also that the information is given to the press prior to Council Meetings. Mr. Duggan requested that, in the future, the City Clerk read the subject of each bill. Mrs. Betty Rupp thanked Council for approving her appointment on the Rose Float Committee. Councilman Skinner requested the City Manager to arrange a field trip to Cabell Avenue. Inquiry was made by Councilman Skinner of the status of the matter of 3 -story buildings in M zones which had been taken under submission by Council, and requested the City Attorney to prepare an ordinance eliminating 3 -story height buildings. The City Attorney advised there would first have to be a hearing set on this matter. It was moved by Councilman Skinner, seconded by Councilman Peavey and so ordered to set a hearing for 7:30 P.M., August 12, 1963, in the Council Chamber of the Downey City Hall on height restrictions in M zones. Councilman Peavey requested that a field trip be arranged to Tweedy Lane where a sidewalk problem exists, which trip might be included with the field trip to Cabell Avenue. Councilman Temple reappointed his citizens advisory committee members �. and added the appointment of Mrs. Barbara Adams, 12047 Samoline to the Youth Advisory Committee.
