HomeMy WebLinkAboutMinutes-04-08-63-Regular Meeting1654 MINUTES OF THE CITY COUNCIL OF THE CITY OF DOWNEY APRIL 8TH, 1963 The City Council of the City of Downey held a regular meeting in the Council Chamber of the Downey City Hall at 7:30 P.M., Mayor Ben Corbin presiding. PRESENT: Councilmen: Skinner, Peavey, Morton, Temple, Corbin ALSO PRESENT: Oren L. King, City Manager Royal M. Sorensen, City Attorney Sherman Griselle, Director of Planning G. C. Gabriel, Director of Finance Ervin Spindel, Director of Public Works Loren Morgan, Deputy Chief of Police Robert Gain, Fire Chief Ray Lake, Director of Building & Safety Robert DeSio, City Forester Don Robison, Sr. Administrative Assistant Della Doyle, City Clerk Deputy City Clerk, Alberta Pfeiffer Reverend John Kreider, Faith Mennonite Church of Downey, delivered the invocation. Dr. Roberts, representing National and local SPEBSQSA, Inc., was introduced by James D. Brown and it was requested by him that the week of April 25 -31 be proclaimed by Council as Barbershop Harmony Week in the City of Downey honoring the 25th anniversary of the organization. It was moved by Councilman Temple, seconded by Councilman Morton and so ordered to authorize issuing a proclamation as requested by Dr. Roberts. Mayor Corbin presented a copy of the proclamation to Dr. Roberts. The Mayor announced that this is the time and place set for the hear- ing of protests or objections against the assessments for improvement of Duesler Lane. The City Clerk was asked by the Mayor if she had the Affidavits of Publication, Posting and Mailing. The City Clerk replied that she had the three affidavits. It was moved by Councilman Temple, seconded by Councilman Peavey and so ordered that the affidavits be received and filed. The Mayor asked if there were any written protests. The City Clerk read a protest received from Mr. Floyd J. Tooley, 8128 Duesler Lane. Mr. Spindel was called upon to give a report on the manner in which the assessment had proceeded to date. The City Attorney inquired of Mr. Spindel if the work was done in accordance with the plans submitted and approved by Council. Mr. Spindel replied that this was correct. The City Attorney inquired if there had been any objections at that point. The answer was no. The City Attorney then advised that the letter of protest was not against the proceedings, or the work, but was against the manner in which the assessment has been spread. It was moved by Councilman Peavey, seconded by Councilman Skinner and passed by the following vote that the protest from Mr. Tooley be overruled. RESOLUTION NO. 1126 R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY CONFIRMING THE ASSESSMENT FOR THE IMPROVEMENT OF DUESLER LANE, A PRIVATE STREET (AD 22) The resolution was read by title only. The City Clerk reported on the following correspondence: (1) A letter from Mr. & Mrs. Ronald Liles in appreciation of attention given by the City to fallen trees. Ordered received and filed. (2) A letter from Mrs. Cecile Lecoq, 8061 Seventh St., requesting relief from a drainage problem. A report was given by Mr. Spindel and estimated costs to supply drainage pipe from 5th Street to Florence Avenue amounted to $250,000. It was requested th& an estimate be prepared for drains from 5th to 7th Streets. It was moved by Councilman Temple, seconded by Councilman Peavey and so ordered that a letter be sent to Mrs. Lecoq advising the action taken, and that her letter be received and filed. (3) A letter from Councilman Peavey relative to installation of a traffic signal on Tweedy Lane and Florence Avenue. A petition accompanies the letter. It was moved by Councilman Peavey, seconded by Councilman Skinner and passed by the following vote to again refer the matter to the Traffic Committee for consideration of installation of a traffic signal at Tweedy Lane and FWrence Avenue to conform to signals at Paramount Boulevard and Florence Avenue, with a recommendation for lefthand turn signals being included at the last mentioned intersection. It was moved by Councilman Skinner, seconded by Councilman Temple and so ordered to set hearing for 7:30.P.M., May 13, 1963, in the Council Chamber of the Downey City Hall on Zone Exception Case No. 366. (5) A letter from the Downey Junior Woman's Club relative to resolu- tions passed by them pertaining to narcotic traffic and pornographic literature. 1656 It was moved by Councilman Skinner, seconded by Councilman Temple and so ordered that Mr. King be directed to report to Council on its previous actions pertaining to legislation referred to by the Downey Junior Woman's Club. (6)- A survey report from C. L. Murphy, 7931 Borson Street, Downey, relative to the hospital matter. It was moved by Councilman Temple that this report be referred to the hospital committee. The motion died for lack of a second. The report was ordered received and filed. (7) A letter from Burke, Williams & Sorensen relative to their proposal for the terms upon which it would undertake to act as legal adviser, consultant, and draftsman for a committee appointed by the City Council to prepare a draft of a city charter for the City of Downey. It was moved by Councilman Skinner, seconded by Councilman Peavey and passed by the following vote to approve and authorize the agreement and submit a letter of reply to the City Attorney that the firm of Burke, Williams & Sorensen will be the legal firm employed to draft a city charter. Their professor thanked the City of Downey for its hospitality and one of the students interpretted the pro- fessor's Spanish. Citizens who have opened their homes to the students were introduced by Mr. Williams. The Mayor expressed appreciation to the members of the Sister City Committee for their participation. ORDINANCE NO. 222 r AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE ZONING MAP ADOPTED BY SECTION 9107 OF THE DOWNEY MUNICIPAL CODE (ZONE CHANGE #89) The ordinance was read by title only. RESOLUTION NO. 1138 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY AWARDING CONTRACT TO IMPROVE IZETTA AVENUE AND OTHER STREETS IN THE CITY, IN ACCORDANCE WITH RESOLUTION OF INTENTION NO. 1077 (AD 81) The resolution was read by title only. The total costs have been computed and it has been determined that the total incidental ex- pense is $6618.82. The incidental cost as originally estimated for this project was $5190.73, and this was approved by the City Council in the Resolution of Intention. The resolution further stipulated that all incidental costs be borne by the City. It was recommended that Council authorize the expenditure of $6618.82 for incidental expenses on Eucalyptus Street. AYES: 5 Councilmen: Skinner, Peavey, Morton, Temple, Corbin NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None It was reported by Mr. Spindel that the Sewer Connection Fund from which money is drawn to extend laterals to the property line within streets which are subject to being improved, has been depleted. There are several projects pending, among which are Downey Avenue between Florence Avenue and Gallatin Road, Regentview Avenue between Washburn Road and Firestone Boulevard; and Barlin Avenue south of Gardendale Street, as well as others where it is necessary to extend the sewer laterals to the property lines. It was therefore requested that Council appropriate $5,000 to be deposited in Account No. 17 -74 to cover the costs of extending sewer laterals as outlined by Mr. Spindel. The money will be refunded to the account at such time as the property owners connect to the sewer. More than 50% of sidewalks have been constructed, and it was requested in the petition that the remaining owners complete their sidewalks in accordance with the provisions of Chapter 27, Part 3, Division 7 of the Improvement Act of 1911 of the Streets and Highways Code. It was further requested that the City remove the trees along this street which are now damaging existing curb, gutter and sidewalks. It was moved by Councilman Peavey, seconded by Councilman Skinner and passed by the following vote to authorize the Department of Public Works to proceed with the improvements under Chapter 27 of the Streets and High- ways Code as requested'on Parrot Avenue; and authorize the removal of existing trees damaging public improvements. Glaze, a study was made of peak hour parking restrictions along the south side of Firestone Boulevard, approxi- mately 150 yards west of Lakewood Boulevard. At the present time the curb between Lakewood Boulevard and Nash Street is painted red and, there- fore, there is no parking at any time at that particular location. Nash Street is approximately 100 yards westerly of Lakewood Boulevard. The possibility of additional peak hour restrictions further to the west will be studied. It was moved by Councilman Skinner, seconded by Councilman Peavey and so ordered to refer the possible restriction on Lakewood Boulevard as re- quested to the Traffic Committee. Inasmuch as the City's current liability insurance policy expires on May 16, 1963, authority was requested from Council to authorize calling for bids for this service. The City Attorney advised that there is no change in the current coverage involved in call for bids, and they will be called for on the same basis as the current coveraW-. It was moved by Councilman Morton, seconded by Councilman Temple and passed by the following vote to authorize calling for bids for liability insurance for the City of Downey. It was moved by Councilman Peavey, seconded by Councilman Temple and so ordered that the appointments of Councilman Peavey and Mayor Corbin as recommended. Councilman Temple recommended appointment of Howard Hanson, 12243 South Rives, to the Citizens Tax Committee, and Mrs. Thelma Hanson to the City Beautification Committee. It was moved by Councilman Peavey, seconded by Councilman Temple and so ordered that Councilman Temple's appointments be approved. Councilman Skinner reappointed Mrs. Betty Kilpatrick to the Rose Float Committee and appointed in addition, Mrs. Vera Michaels and Mrs. Ellan Cannon. It was moved by Councilman Temple, seconded by Councilman Skinner and so ordered that Councilman Skinner's appointments to the Rose Float Com- mittee be approved. Councilman Skinner reappointed Mrs. A. D. Boone and Joe R. Sarabia to the Civic Development Committee; R. H. Woodmansee and Carl G. Bragg to the Citizens' Tax Committee; Mrs. Camille Molyneux and Bob Collins to the City Beautification Committee; Gano F. Culwell and Doug Morrow to the City Charter Committee; Ed Christensen and Earl Berry to the Civil Defense Advisory Committee; Lou A. Mr. George Craven, 8267 Santa Gertrudes, inquired about a 72' easement which he had been informed must be granted by him before he can put certain improvements on his lot. The City Manager advised that he would meet with him Wednesday in an attempt to clarify the Planning Department's policy in the matter of improvement of Mr. Craven's property, and to direct him in meeting certain minimum specified standards for Zone R -1. Councilman Peavey recommended teappointment of George Harrison, Dick Raabe, and in addition, appointment of Frank Brown, John Blackburn and Mrs. Jean Dutton to the Rose Float Committee; Mayor Corbin reappointed Paul Edwards and Frank Gammell to the Rose Float Committee; Councilman Morton, Mrs. Walter Dufresne, Mrs. Jerri Lippert and added Robert DeSpain and Mrs. Skippy Blair. It was moved by Councilman Temple, seconded by Councilman Skinner and so ordered that the above appointments recommended to the Rose Float Com- mittee, be approved. Mr. King summarized resolutions passed by the Downey Chamber of Com- merce relative to certain proposed legislation, copies of which were sub- mitted for consideration by the Council. It was moved by Councilman Peavey, seconded by Councilman Skinner and so ordered to refer the Chamber of Commerce resolutions to the Citiz--ns Tax Committee. The City Manager reported that the miscellaneous sidewalk construction program under contract with Sully - Miller (Cash Contract #97) for which the original estimated bid cost was $3,986.26, has been extended to the price of $5286. The reason for this was the need for extending the removal and replacement of sidewalks, curbs and gutters in order that they might match the adjoining improvements, and the replacement of sidewalks, curbs and gutters in four additional locations on thessme street where the trees have been removed, subsequent to the award of this bid. The work has been com- pleted, and it was recommended that Council authorize the transfer of $1300 to Account No. 3400.3 in the Public Works Department, of which $745 will be transferred from Account No. 13000 -1 and $555 from Account No. 5010 -1. A. Mann has made the appraisals on the other parking lots within the District, it was recommended that Council authorize these appraisals by Mr. Mann. Mr. Spindel reported that 2 of the 4 petitions being circulated had been returned; that a resolution of intention should be ready at the next council meeting, with public hearing possibly ready for the next night meeting. Councilman Morton stated he is pleased that this is one step in the direction of better police protection, especially in the area where there have been many expensive tree thefts recently. Councilman Temple suggested a study of the possible supplementing on the police force of trained animals. Deputy Chief of Police Morgan reported a study had been made and it was found that it would not be feasible to use police dogs for the City of Downey. Mayor Corbin reported that he had attended the con -ference of the Hospital Board and their decision was to circulate petitions and attempt to obtain the necessary 15% of signatures to have a measure pertaining to a new Downey Hospital placed on a ballot. If 15% is not obtained, they will see that the people are not interested in a hospital and will drop the matter. • X665 The City Attorney advised that if there is a petition filed by 15% of the registered voters, then the Act provides that Council place the matter on the ballot. Councilman Skinner requested that any committee members not re- appointed be forwarded a letter of thanks for their past service on the various citizens committees.
