1629 MINUTES OF THE CITY COUNCIL OF THE CITY OF DOWNEY MARCH 11TH, 1963 The City Council of the City of Downey held a regular meeting in the Council Chamber of the Downey City Hall at 7:30 P.M., March 11, 1963, Mayor Ben Corbin presiding. PRESENT: Councilmen: Skinner, Peavey, Morton, Temple, Corbin ALSO PRESENT: Oren L. King, City Manager Royal M. Sorensen, City Attorney Sherman Griselle, Director of Planning A. C. Gabriel, Director of Finance Ervin Spindel, Director of Public Works Robert Gain, Fire Chief Ray Lake, Director of Building and Safety Ivan A. Robinson, Chief of Police Don Robison, Senior Administrative Assistant Della Doyle, City Clerk Alberta Pfeiffer, Deputy City Clerk It was moved by Councilman Temple, seconded by Councilman Skinner and so ordered that the minutes of the meeting held on February 26, 1963, be approved as corrected. The City Clerk reported on the following correspondence: 1. A letter from Rev. Rodney Cogswell, Downey Community Hospital Board of Directors, recommending that a special election be called for a vote on hospital bonds. It was moved by Councilman Morton, seconded by Councilman Skinner and so ordered that a letter be transmitted to Rev. Cogswell, accompanied by a copy of that portion of the minutes of the last Council Meeting wherein the discussion was held relative to calling a special election on hospital bonds. The letter was ordered received and filed. 2. A letter from Burke, Williams and Sorensen relative to an assign- ment agreement from the Rio Hondo Disposal for consideration and approval by Council. The City Attorney reported that the disposal company, formerly a partnership of 3 people, changed to a partnership of 2. The second partnership now has become a corporation and another assignment from the partnership to the corporation is now being presented for approval. The contract would be on the same contingent with the new corporation rather than the old partnership. It was moved by Councilman Temple, seconded by Councilman Morton and passed by the following vote to authorize the Mayor to sign the consent to the assignment of the Rio Hondo Disposal Company. A letter from the Director of Building and Safety to the Square and Compass Building Association relative to certain requirements being met on the old building when a new construction is completed. It was moved by Councilman Peavey, seconded by Councilman Skinner and so ordered that the letter be received and filed. Council Minutes 3/11/63 -1- 1630 4. A letter from the Chairman of the Sister City Committee request- ing support from the City. The City Manager reported the need seems apparent and an amount from $500 to $1,000 should carry the committee through the balance of the current year. Councilman Temple stated he did not feel any of the members of the committee should be out any pocket money. Councilman Morton stated that he is agreeable to setting forth $500 for Sister City activities. Councilman Skinner suggested holding this item until the next Council Meeting. The City Attorney was asked for his opinion on whether or not this would be a valid expenditure on the part of the City. He advised that an expenditure of City funds to support the Sister City program has been deemed a proper expenditure. If funds actually are going to be disbursed by other than City officers, there should be some type of contractual agreement similar to what is held with the Chamber of Commerce, etc., set- ting forth the accounting procedure. It was moved by Councilman Temple, seconded by Councilman Peavey and passed by the following vote to direct the City Attorney to prepare a • contractual agreement governing the purpose and use of funds allocated for Sister City functions not to exceed $500. AYES: 5 Councilmen: Peavey, Skinner, Morton, Temple, Corbin NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None The City Attorney advised that correspondence had been sent from his office regarding a litigation between the City and Safeway Tree Trimming Company. This company was employed by the City under a purchase order to do certain tree trimming work. After part of the work had been, a dispute arose as to whether the work was being done properly. There was further question then as to what amount was owed by the City to the Tree Company. There was then a demand presented to the City in the sum of $1,533.00. The City offered $880.45. The attorney stated that the matter now can be settled for an additional amount of $120.63 and recommended that the offer be accepted in light of the fact that further litigation would give rise to additional court costs plus the time of Public Works personnel, for possibly 2 days. The City would pay Safeway Tree Service $800.00 and assume the obligation on the stop order of $201.08. It was moved by Councilman Peavey, seconded by Councilman Skinner and passed by the following vote to approve the City Attorney's recommenda- tion to settle the dispute between the City of Downey and Safety Tree Service for the sum of $1,001.08. Ervin Spindel, Director of Public Works replied that the map was not yet ready. It was moved by Councilman Skinner, seconded by Councilman Temple and so ordered that the ordinance covering Planning Resolution No. 77, Zone Change No. 94 as well as the resolution ordering the vacation of a portion of Farm Street and Myrtle Street, be held for subdivision map. RESOLUTION NO. 1100 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ADOPTING THE PROFILE AND IMPROVEMENT PLAN AND SPECIFICA- TION FOR THE IMPROVEMENT OF DONOVAN STREET AND BIRCHDALE AVENUE IN THE CITY OF DOWNEY (AD 71) The resolution was read by title only. Ervin Spindel presented the investigation report and advised that incidental costs were formerly authorized by Council in the amount of $2700. Total cost for incidental expenditures will now be $4,000 due to lowering of gas lines where there were prior rights. The resolution also authorizes the incidental costs in the total amount of $4,000.00. It was moved by Councilman Temple, seconded by Councilman Skinner and so ordered to receive and file the investigation report as presented by Mr. Spindel. It was moved by Councilman Morton, seconded by Councilman Skinner and passed by the following vote to adopt the resolution setting the hearing on the investigation report for 7:30 P.M., May 13, 1963, in the Council Chamber of the Downey City Hall. Mr. Spindel reported that the access rights to Brookshire Avenue from the lots easterly thereof were dedicated. Owners of several of these properties have requested that pedestrian access be permitted from these properties to Brookshire Avenue in order to maintain trees which are to be planted in the parkways. This will probably entail construction of gate openings through the block wall on Brookshire. Cost of such construction will be borne by the property owners. Mayor Corbin asked for the vote on the motion to adopt the reso- lution. It was moved by Councilman Peavey, seconded by Councilman Skinner and passed by the following vote to award Cash Contract #86 in the amount of $22,056.27 to Electric and Machinery Service, Inc. and that all other bids be rejected. Councilman Peavey stated he felt it should be in the total amount as bid. The City Attorney's opinion was asked and he stated that the bid would be correct if awarded on the basis of the bid submitted, which actually was submitted on a unit price. Councilman Peavey withdrew his motion with Councilman Skinner withdraw- ing his second. Then it was moved by Councilman Peavey, seconded by Councilman Skinner and passed by the following vote to award the bid for Cash Contract #86 to the lowest and best bidder, Electric and Machinery Service, Inc., in accordance with the bid submitted, and that all other bids be rejected. AYES: 5 Councilmen: Skinner, Peavey, Morton, Temple, Corbin NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None After a bid summation for Cash Contract No. 97, Miscellaneous Cement Concrete Repair Work, it was moved by Councilman Morton, seconded by Council- man Temple and passed by the following vote to award the bid to the lowest Council Minutes 3/11/63 -9- 1,63 81 t and best bidder, Sully- Miller Contracting Company in the amount of the unit prices of the bid proposal submitted, and all other bids be rejected. AYES: 5 Councilmen: Skinner, Peavey, Morton, Temple, Corbin NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Mr. Ervin Spindel submitted a bid summary for construction of side- walks on Izetta Avenue between Dunrobin Avenue and Washburn Road. There was only one bid submitted, and the cost was above the engineer's estimate. Since considerable concern had been expressed by the property owners in the area as to the sidewalk cost exceeding the engineer's estimate, it is recommended that the single bid be rejected, and that authority be granted to readvertise in the hope that additional bidders may be solicited for this construction. It was moved by Councilman Skinner, seconded by Councilman Peavey and passed by the following vote that all bids be rejected for A.D. #81, Izetta Avenue sidewalks, and authority granted to readvertise. It was moved by Councilman Temple, seconded by Councilman Skinner and passed by the following vote to approve the distribution and release of surplus funds under A.D. #33, Phlox Street. Councilman Skinner moved, it was seconded by Councilman Temple and so ordered that a field trip be made to the area before any action is made on the matter. The City Manager was instructed to set up a field trip. A report was made on the results of investigation regarding paveout on Iowa Street westerly of Brookshire Avenue, adjacent to the School Ad- ministration building. Councilman Skinner stated that he had requested this investigation, however he believes the sidewalks on Brookshire Avenue are more important at this time than the paveout on Iowa Street. It was moved by Councilman Skinner, seconded by Councilman Temple and so ordered to hold the matter of paveouts on Iowa Street for further study. • Council Minutes 3/11/63 -10- 1639 Mr. Spindel reported on miscellaneous improvements under Chapter 27, 1911 Act, in various sections of the City where the majority of the property owners on the streets have completed their improvements, while others have not yet put in curb, gutter, sidewalks and /or paving. Because of poor drainage conditions existing which create a nuisance as a result of water standing and stagnating, thus also creat- ing a maintenance problem for the City, it is recommended that curb, gutter and paving be constructed at the locations as outlined on the maps submitted by Mr. Spindel. Mr. King suggested a field trip be made to the locations. Mr. Spindel outlined the proposed procedure for carrying out the miscellaneous improvements under Chapter 27, 1911 Act. First, an informal letter will be sent to the residents informing them of the pro- visions of the Act and giving them the opportatty to put in the improve- ments; if no action is taken, official notifications can be given and a time set for hearing, and that work shall be commenced in 60 days. The residents then actually have a 90 -day notice. If the improvements still are not put in, the City will do the work, assess the property owner, and after the work is completed and the cost determined, a hearing would be scheduled on the cost of the improvements and any unpaid assessments would then become a lien against the property. It was recommended that Council authorize the Department of Public Works to proceed with the informal notices to property owners to perform improvements at various locations throughout the City. Councilman Temple requested that the decision on Zone Change #89 be held for the agenda for the meeting of March 26, 1963. Councilman Skinner inquired if procedures or a policy will be adopted by Council relative to the improvements to be made out of the revolving fund under Chapter 27, 1911 Act. Councilman Morton stated he would like to have each case come before Council and he so moved, it was seconded by Councilman Skinner and passed by the following vote to approve the policy for improvements to be made from the revolving fund under Chapter 27, 1911 Act, subject to the cases'being brought to the Council case by case. It was moved by Councilman Temple, seconded by Councilman Morton and passed by the following vote to authorize the City Attorney to prepare a contract for the purpose of the City's sweeping Lakewood and Firestone Boulevards with refund of approximately $3,000.00 a year to be paid the City to cover cost of operation and rental equipment. Mr. King stated the most important steps to be taken are construction of storage places at the various schools for emergency supply stations. It was reported that the call for bids for rental of real property at the Public Works Yard had had no response. The lease agreement with Cee Bee Chemical Company was reviewed by Mr. Spindel as presented at the last Council Meeting. It was moved by Councilman Skinner, seconded by Councilman Peavey and passed by the following vote to authorize a contract being prepared and submitted for approval at the next Council Meeting, or as soon there- after as is feasible. Council must approve this action in order to join with the County of Los Angeles on the annual bid for gasoline. It was moved by Councilman Temple, seconded by Councilman Peavey and passed by the following vote that the City of Downey join with the County of Los Angeles on the annual bid for gasoline. It was recommended by the City Manager that the same procedure be fol- lowed as the program had netted the City $1,000.00 in collections this past year. It was so ordered. A resolution from the Downey Citizens Industrial Development Committee regarding taxes had just been received; therefore, it was held for further study. Mr. H. L. Duggan, 7901 Stewart and Gray Road, stated he was pleased to see Council set over to the next meeting, items which came up for dis- cussion which did not appear on the agenda for the current meeting. Mr. Duggan again requested a report on the costs involved in taking over the Downey County Water District by the City. The Mayor stated it was impossible at this time to submit such a report. The City Attorney stated that at the time of annexation and completion of incorporation Council Minutes 3/11/63 -12- 1641 proceedings of the City of Downey, the Downey County Water District was contained and entirely within the City, and as a matter of law, it was automatically dissolved and came into the City when it incorporated, and it would not be up to the vote of the people to decide the matter. Mr. Duggan stated that the controversy over the entire matter is —1, relative to the rate that is to be charged. Mr. Bruce inquired about the possibility of the City's having its own dog catcher. He stated he did not feel the City was getting proper control and enforcement through the animal shelters operated by the County of Los Angeles. The City Manager recommended a review of the contract and stated he believes a little better control can be made pos- sible. The City Attorney gave Council an interim report on the actions taken on the Downey County Water District litigation, and he stated that he hopes the - matter will be heard by the District Court of Appeals shortly. Councilman Skinner commended the program of school students' painting addresses on curbs throughout the residential areas of the City. Councilman Peavey reported that he is attending a convention as the President of the Southeast District Mosquito Abatement. It was suggested by Councilman Morton that inasmuch as Mr. Peavey will be that near Washington, D.C., he be directed to check on the status of the Downey Heliport. It war moved by Councilman Morton, seconded by Councilman Skinner and passed by the following vote to authorize the expenditures reasonable and necessary for Councilman Peavey, if able to do so, to check in Washington, D.C. on the status of the heliport to be located in the City of Downey. He suggested that the Council look over very carefully those nominated last year who did not serve. Also, next month, it might be worthwhile to have a report of what the various committees have accomplished. Councilman Skinner suggested that a report be requested from the chairman of each committee on the appointees who have not been active; however, Mayor Corbin stated these should be carefully checked with both chairmen and members.
