MINUTES OF THE CITY COUNCIL
CITY OF DOWNEY
MARCH 26, 1963
The City Council of the City of Downey held a regular meeting
in the Council Chamber of the Downey City Hall at 8:00 A.M., Mayor
Ben Corbin presiding.

Reverend Walter R. Armantage of the Congregational Church of Downey
delivered the invocation.
It was moved by Councilman Temple, seconded by Councilman Skinner and
so ordered that the minutes of the meeting of March 11, 1963, be approved
as written.
The City Clerk reported on the following written correspondence:
(1) A letter from Winston R. Updegraff in appreciation of the
plaque of commendation presented him from the City Council. Ordered
accepted and filed.
(1) Letter from Harry Boand, Jr. relative to City Development.
Ordered received and filed.
(3) Letter from Violet B. Dayhoff, et al., relative to cleaning of
trash from a vacant lot across from 9051 - 512 - 53 - 532 and 55 Iowa
Street.
The Director of Public Works reported that under the current weed
abatement program, this lot should be taken care of and other similar
problem lots. Ordered received and filed.
It was recommended that the Y.M.C.A. be contacted to see if they will
clear this lot at an earlier date.
(4) Letter of resignation from the Rose Float Committee from Ruth
Kelley.
It was moved by Councilman Skinner, seconded by Councilman Temple and
so ordered to accept Mrs. Kelley's resignation with regrets and recommended
to send a letter to Mrs. Kelley in appreciation of the very fine services
rendered to the community through her service on the Rose Float Committee.
(5) Communication from the Charter Study Committee with results of
their study. Mr. Melvin QuAley, Chairman of the Charter City Committee,
submitted a complete oral report and read in full a resolution adopted by
the committee recommending the preparation of a charter for submission to
the voters of the City of Downey and suggesting approval of their recommenda-
tion by City Council. Mayor Corbin commended Mr. Quigley and the Charter
Study Committee for their fine work.

Councilman Morton remarked that the Charter Study Committee has
worked very hard and given of their time; the City Attorney also spent
considerable time on the matter and the work of this committee shows
what a citizens' group can do to better the community.
It was moved by Councilman Morton, seconded by Councilman Temple
-� and passed by the following vote to approve the recommendations contained
in the resolution adopted by the Charter Study Committee.

The City Manager stated it was a pleasure to work with this committee
throughout its study and recommended authorization for appropriation of
$5,000 to be placed in the coming year's budget in the General Government
fund for completion of this program and that an additional appropriation
of $500 in the City Clerk's budget for advertising purposes, etc. regarding
a City Charter.
It was moved by Councilman Peavey, seconded by Councilman Temple and
passed by the following vote to authorize an appropriation of $5,000 in the
1963 -64 Budget in the General Government Fund for completion of the City
Charter program, and an appropriation of $500 in the City Clerk's Budget
for advertising purposes.

The City Attorney suggested „that City Council forward a letter to the
legal firm of Burke, Williams & Sorensen advising that Council has approved
the recommendation of the City Charter Study Committee and setting forth
thebasis on which the legal firm is to be employed.
It was moved by Councilman Temple, seconded by Councilman Morton and
so ordered to authorize sending a letter from the City Council to the legal
firm of Burke, Williams & Sorensen stating in effect that it has approved
the Charter Study Committee's recommendation and authorized preparation of
a charter for submittal to the voters by election in April 1964.
(6) A letter from the Downey Coordinating Council relative to the
circulation of petitions calling for a vote on annexation to the Compton
Junior College District.
It was moved by Councilman Skinner, seconded by Councilman Peavey to
support the stand taken by the Coordinating Council.
After discussion and suggestion by Councilman Morton to include the
support of the School Board in the motion, it was so ordered by the Mayor
that the City Council support the Coordinating Council and the School Board
in their stand relative to annexing to a junior college district.
RESOLUTION NO. 1118

It was reported by Ervin Spindel, Director of Public Works, that
all conditions required for public improvement by the Planning Commission
in their approval of tentative Tract No. 27769 are shown on the plans
which have been submitted to and approved by his department.
It was moved by Councilman Skinner, seconded by Councilman Temple and
so ordered that further reading of Resolution No. 1118 be waived.

RESOLUTION NO. 1120
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
DECLARING ITS INTENTION TO IMPROVE DONOVAN STREET AND
BIRCHDALE AVENUE IN THE CITY OF DOWNEY, DETERMINING
THAT BONDS SHALL BE ISSUED TO REPRESENT THE COST THERE-
FOR, DECLARING THE WORK TO BE OF MORE THAN LOCAL OR
ORDINARY PUBLIC BENEFIT, AND THAT THE EXPENSE THEREOF
SHALL BE ASSESSED UPON A DISTRICT (AD 71)
The resolution was read by title only. The City Attorney reported
that the resolution was the same as one previously adopted which has
had a mistake in calling the hearing date.

RESOLUTION NO. 1121

ENDORSING ASSEMBLY BILL NO. 1152 RELATING TO SPECIAL
ASSESSMENT PROCEEDINGS

It was moved by Councilman Skinner and seconded by Councilman
Peavey that Resolution No. 1121 be adopted.
Councilman Skinner inquired if AB #1152 provides that work may be
done on private property, privately contracted or by City employees,
_ both or either? Mr. Spindel stated that the work generally is done by
the contractor and is included under a contract in the plans for off -
site work and cannot exceed $200 in each parcel. The extra cost therefor
is spread on each parcel and not assessed to the entire district.
The City Attorney reported that this has been one of the problems
in various improvements and previously steps could not be taken to
alleviate this type of problem.
Mayor Corbin called for the vote on the motion to adopt the resolution.

RESOLUTION NO. 1122

SUPPORTING LEGISLATION REGULATING THE DEGREE OF DEGRAD-
ABILITY OF SYNTHETIC DETERGENTS
The resolution was read by title only. It was moved by Councilman

Councilman Peavey stated this resolution originated through the rec-
ommendation of the Sanitation District.

RESOLUTION NO. 1123
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AUTHORIZING THE EXECUTION OF A CONTRACT WITH THE
DEPARTMENT OF FINANCE OF THE STATE OF CALIFORNIA FOR A
POPULATION ESTIMATE
The resolution was read by title only. Mr. King explained that it is
felt with numerous additional housing developments being built within the
City, the population might possibly be increased by from 1700 to 1800
which would mean greater distribution for the City of gas tax monies which
payment is based upon population figures.

RESOLUTION NO. 1124
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AUTHORIZING INSPECTION OF SALES AND USE TAX RECORDS
The resolution was read by title only. Mr. King advised that the
resolution authorizes the Director of Finance to check with the State
Finance Department relative to the 1�- gas tax.

The City Manager reported the Citizens Tax Committee had submitted
a resolution which they adopted opposing legislation for State withhold-
ing tax.
It was moved by Councilman Temple, seconded by Councilman Morton
and passed by the following vote to direct the City Attorney to prepare a
resolution supporting the recommendation of the Citizens Tax Committee
regarding State withholding tax.

Mr. Spindel reported that plans and specifications for improvement of
Dolan Avenue between Firestone Boulevard and the Southern Pacific Railroad
right of way have been completed. In order to meet the schedule of the on-
site improvements of Simpson Buick Agency and the Greschner Development,
it is necessary to proceed with the street at this time. It was also
reported that there is an alternate condition for construction of sidewalks
if Council so desires to be included in this project.

Contract #91, Dolan Avenue, and authorize advertising for bids.

It was moved by Councilman Skinner, seconded by Councilman Temple and
so ordered to authorize a letter to be sent to the Southern California
Edison Company and General Telephone Company commending them on their
cooperation in going underground with their utilities at this improvement
site.
It was reported by Mr. Spindel that as part of the improvement of
Woodruff Avenue between Firestone Boulevard and Stewart and Gray Road it
is necessary to provide certain drainage from the private properties,
since this new improvement will obstruct the natural drainage as has
existed in the past. It is necessary that this drainage be constructed at
this time by the contractor performing the work being done on Woodruff
Avenue under Cash Contract #52. To do this, an additional expenditure of
$3200 will be required, with the State Highways Division authorizing $3,000
to be taken from the City's Ctate Contingency Fund.

struction of the storm drain in Cash Contract #52, Woodruff Avenue.

Mr. Al Springer, President of the Downey Chamber of Commerce, extended
his appreciation to the Council and to the City as a whole for their
cooperation with them and presented each councilman with honorary member-
ship in the Chamber of Commerce.
Mayor Corbin thanked Mr.Springer for bestowing the honorary memberships
to Council and commended the Chamber of Commerce for the fine job they are
doing.
Mr. Spindel reported that after consideration by the Traffic Committee,
it has been recommended that no stop signs be installed at the intersection
of Ryerson Avenue and Leeds Street. The intersection is partially in the
City of South Gate and partially in the City of Downey, and the Traffic
Committee of the City of South Gate also recommended against installation of
a stop sign at this intersection.
Mr. Spindel reported that an agreement for maintenance of State High-
ways in the City of Downey which is presented for approval by Council, is
a modification of the existing agreement.
RESOLUTION NO. 1125
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
APPROVING AGREEMENT FOR MAINTENANCE OF STATE HIGHWAYS
IN THE CITY OF DOWNEY

It was moved by Councilman Temple, seconded by Councilman Morton and
defeated by the following vote that:
WHEREAS, pursuant to an application for zone change and a hearing
thereon, the Planning Commission of the City of Downey denied an applica-
tion for the zone change described in Zone Change Case 89 and refused to
recommend to the City Council the change of zone on said property from
R -1, 5,000 to R -3; and
^ WHEREAS, the applicant for said zone change appealed to the City
Council and tie City Council after the hearing thereon, upheld the appeal
and referred the matter to the Planning Commission for a report; and
WHEREAS, the Planning Commission reaffirmed its prior motion and
reported to the City Council that said zone change, in effect, would con-
stitute spot zoning;

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY FINDS
that the granting of Zone Change Case 89 is not necessary to carry
out the general purpose of Chapter 1 of Article IX of the Downey
Municipal Code for the following reasons:
1. The creation of an R -3 zone at the location of the subject
property will constitute a breakdown of the surrounding R -1 zone
property.
2. The property is subject to development for R -1 purposes and
uses.
3. The rezoning of the subject property from R -1, 5,000 to R -3
would constitute an intrusion of an incompatible use of property into
a residential neighborhood.
4. An R -3 zoning in this area would create traffic conditions
not compatible with the surrounding streets and uses.
5. The R -3 zoning would adversely affect the adjoining property
and would not be compatible with the general comprehensive plan.

It was then moved by Councilman Peavey, seconded by Councilman
Skinner and passed by the following vote that:
WHEREAS, pursuant to an application for zone change and a hearing
thereon, the Planning Commission of the City of Downey denied an applica-
tion for the zone change described in zone Change Case 89 and refused to
recommend to the City Council the change of zone on said property from
R -1, 5,000 to R -3; and
WHEREAS, the applicant for said zone change appealed to the City
Council and the City Council after the hearing thereon, upheld the
appeal and referred the matter to the Planning Commission for a report;
and
WHEREAS, the Planning Commission reaffirmed its prior action and
reported to the City Council that said zone change in effect, would con-
stitute spot zoning;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF DOWNEY FINDS:
That granting of Zone Change Case 89 and changing the zone on the
property described therein from Zone R -1, 5,000 to Zone R -3 is necessary
to carry out the general purpose of Chapter 1 of Article IX of the
Downey Municipal Code for the following reasons:
1. The property immediately east to the subject property is zoned
C -1 and is developed with apartments and commercial uses.
2. The R -3 zoning of the subject property will afford a good
buffer strip between the said C -1 zone property and the R -1 zone property
to the west of the subject property.
3. The subject property is of such a size as to trot lend itself to
reasonable R -1 development.
4. The property immediately to the west of the subject property is
developed with six residential units, giving the area some character of
multiple residential use.

5. A change of zone on the subject property to R 73 will not
adversely affect adjacent property and will be compatible with the
general over -all comprehensive plan of the City.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
DOWNEY AMENDING THE ZONING MAP ADOPTED BY SECTION
9107 OF THE DOWNEY MUNICIPAL CODE (ZONE CHANGE
#89)

It was moved by Councilman Temple, seconded by Councilman Skinner and
so ordered to accept the resignation of Mrs. Goldstein to the Sister City
Committee and appoint in her place, Mrs. Walter (Lettie) Bond, 12128
Orizaba.
The City Manager reported that it has been recommended that the City
Council approve the Southeast Cities Mutual Aid Pact to include the City
of LaHabra.

passed by the following vote to approve inclusion of the City of LaHabra
in the Southeast Cities Mutual Aid Pact.

Mr. King reported that it is recommended that the remodeling and
elimination of the present old restroom facility in the office of the
Secretary to the Mayor and Council now be carried through and authority
was requested for issuance of a purchase order in the amount of $575 for
the work of removing present plumbing fixtures, partitions and instal-
lation of plaster board to match the existing office.

The City Manager reported that the City Planning Commission has
completed its study sessions on the General Plan for the City of Downey
and that two public hearings have been set, one for April 10, the other
for April 24. Inasmuch as not everyone interested may have the oppor-
tunity to present testimony at these two hearings it is possible that the
second hearing may be continued to permit all testimony to be heard.
It was recommended by the City Manager that Council authorize the
Director of Finance to attend the Municipal Finance Officers Conference
in Detroit, Michigan, June 2 through June 6 and necessary expenses allowed.

Councilman Morton reported that in the crosswalk by the Bank of
America on Firestone, there is a blind spot which needs adjusting. It
was reported that this blind spot due to plantings, as well as installation
of a "No U Turn" sign at this location will be taken care of in the near
future.
The City Manager submitted a recommendation for renewal of the agree-
ment between the City of Downey and the firm of Diehl, Evans and Co. at
a $400 increase from $1600 to $2000, effective July 1, 1963, and authorize
the Mayor to sign in behalf of the City. The contract provides that
either the City or the auditing firm may cancel upon sixty days' written
notice, prior to July 1 of any year.
Councilman Temple requested a report on the possibility of local
auditors' taking over this municipal audit for the City.
Councilman Peavey recommended that bids be advertised for this audit-
ing service.
It was moved by Councilman Skinner, seconded by Councilman Temple and
so ordered to authorize advertising for bids and investigation of local
auditors to handle the municipal audit for the City.
The City Attorney reported on the widening of Brookshire proceedings,
indicating that in the litigation of Downey vs. Murphy, et al., for con-
demnation, three settlements have been made through stipulation and
approval for settlement for $7,650 in another was requested by the City
Attorney.
It was moved by Councilman Peavey, seconded by Councilman Temple and
passed by the following vote to approve settlement for $7,650 as per the
City Attorney's recommendation.

The City Attorney also reported that in one litigation which involved
a 42 day jury trial, the jury awarded $189 more than the offer. Mr. Sorensen
reported that the appraisers and Public Works personnel are doing a good job
in determining values.

Mr. King presented a diagram for study proposing adjustment of
the 50% ratio for downtown parking which would mean 18 or 20' parking zones
in alleyways with dedication being given by the property owners.
Councilman Peavey recommended proceeding with the study for adjustment
of the 50% ratio of parking in the downtown area.
Mayor Corbin disqualified himself from taking part in any Council action
on Zone Case #95 as he had been absent from the public hearing; turned the
chair over to Mayor Pro Tempore Peavey, and left the Council Chamber.
Mr. Griselle submitted the report from the Planning Commission in which
they recommended 15 conditions to be placed upon the property, should it be
considered as a zone exception case.
The City Attorney stated that it is within the province of the Council
to grant all or part of the property as a zone exception. Relative to
the one parcel on which plans and elevation have been submitted, the re-
zoning could be denied, then if desired, the exception could be granted.
There is nothing to keep Council from consideration of the area as three
individual properties. Council may take the matter under submission and act
on it as a single unit if it so desires.
Councilman Skinner stated he is in favor of denying the zone change
only if it is the portion of the parcel on which plans and elevation have
been submitted.
A request was made by an opponent of Zone Change Case #95 that no
action be taken on the matter until those who oppose it have had a chance
to study the new plans.
A wire from Catherine R. Gloeckler, 9269 S. Klinedale, was read by
City Clerk Della Doyle requesting continuance of Zone Exception Case
involving the property on Telegraph and Hasty until those of the opposition
have time to give the proposal further study. .
Councilman Morton inquired if consideration of the zone change case
as a zone exception case would require further hearings. The City Attorney
advised that no further hearings are required, and that the plans are open
for inspection.
After discussion it was moved by Councilman Temple, seconded by
Councilman Skinner and passed by the following vote that Zone Change #95 be
taken under submission for 30 days in order to allow time for the owners on
the two other parcels to present plans and elevations.

^ Mr. Griselle submitted a report on Zone Exception Case #348 and read
Condition #8 which was to be added to approval of the Commission as follows:
"That a three foot (3') planter strip be placed along the length
of the westerly property line and that suitable vertical shrubs
be planted and permanently maintained that would attain a height
of approximately twelve feet (12') and form an uninterrupted
screen in reasonable length of time and that the City
Forester shall recommend the type of shrubs to be planted
in order to create the desired screening effect."
It was moved by Councilman Morton, seconded by Councilman Temple
and passed by the following vote to uphold the decision of the Planning
Commission to grant zone Exception #348 with addition of Condition #8
stated above.

Leslie Olson of Olson Surveying Company, requested that the hearings
on the Master Plan give ample time for study and making of recommendations.
The City Attorney and Ervin Spindel, Director of Public Works, brought
Council up to date on the various condemnation proceedings throughout the
City.
Councilman Peavey requested that another check be made regarding the
possibility of installing traffic signals at Florence and Tweedy Lane.
It was moved by Councilman Temple, seconded by Councilman Skinner and
so ordered that the Director of Public Works investigate the possibility
of using cloverleafs to freeways for parking of vehicles for those who
share the ride.
It was moved by Councilman Temple, seconded by Councilman Skinner and
so ordered to refer to the Traffic Committee for study and recommendation
the possible installation of a hand signal at Firestone Boulevard near the
'—° General Telephone Company between Brookshire and Lakewood Boulevard.
Don Robison, President of the Downey Coordinating Council, invited
members of the City Council and Department Heads to attend a showing of
a film "Perversion for Profit" at 8:00 P.M. Tuesday, March 26, 1963, at
the Pacific S vings and Loan Building to mobilize the merchants in Downey
to take this type literature off shelves to keep it from coming into the
hands of minors.
There being no further business to come before Council, the meeting
adjourned at 10:35 A.M.
