Administrative Assistant Della Doyle, ';City Clerk Alberta Pfeiffer, Deputy City Clerk Mayor Pro Tempore Hollis Peavey announced that this is the time and place set for the hearing on the Resolution of Intention, Izetta Street, A.D. #81. The Mayor Pro Tem inquired if the City Clerk had the affidavits of publication, posting and mailing. The City Clerk reported she had the affidavits. It was moved and passed by the filed. AYES: 4 NOES: 0 ABSENT: 1 by Councilman Temple, seconded by Councilman Morton following vote that the affidavits be received and Councilmen: Skinner, Morton, Temple, Peavey Councilmen: None Councilman: Corbin The Mayor Pro Tem inquired if there were any written protests or communications. The City Clerk replied there were none. Speaking in opposition to the assessment district was John Boland, 9626 Spry Street, who objected to the cost. A petition was presented to the City Clerk by him. The City Attorney reported that to be a legal protest it would have had to be in the Clerk's possession before the hearing was opened, but it could be received and filed. It was so ordered. Mr. Spindel stated that he felt there was a misunderstanding of the cost of the assessment and that the property owners are not assessed the amount of the estimated cost but the actual contractor's bid price. It was moved by Councilman Temple, seconded by Councilman Skinner and passed by the following vote to close the hearing on the Resolution of Intention on Izetta Street, A.D. #81. AYES: 4 Councilmen: Skinner, Morton, Temple, Peavey NOES: 0 Councilmen: None ABSENT: 1 Councilman: Corbin Councilman Morton inquired if Mr. Boland was against the sidewalks or against the estimated cost. Mr. Boland stated he was against the cost. Mr. Spindel explained the reason for the higher cost of construction in an assessment district in comparison to construction under a private contract. No other person indicated a desire to be heard. 1608 RESOLUTION NO. 1093 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY OVERRULING ALL PROTESTS RELATIVE TO A.D. 081 The resolution was read in full. It was moved by Councilman Morton, seconded by Councilmsn Temple and passed by the following vote that Resolution No. 1093 be adopted. AYES: 4 Councilmen: Skinner, Morton, Temple, Peavey NOES: 0 Councilmen: None ABSENT: 1 Councilman: Corbin RESOLUTION NO. 1094 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING WORK TO BE DONE ON IZETTA AVENUE AND OTHER STREETS (A.D. #81) The resolution was read by title only. It was moved by Councilman Skinner, seconded by Councilman Temple and so ordered that further reading be waived. It was moved by Councilman Skinner, seconded by Councilman Morton and passed by the following vote that Resolution No. 1094 be adopted. The Mayor asked if the City Clerk had the Affidavit of Publication. The City Clerk replied she had the affidavit. It was moved by Councilman Skinner, seconded by Councilman Temple and so ordered that the affidavit be received and filed. Mayor Pro Tem Peavey then asked if anyone wished to speak on Zone Case #94. Larry Hoag, 10612 Paramount Blvd., spoke in favor of Zone Change #95 which proposes a change from an R -3 to an R -4 zone for the con- struction of a garden type development in high -rise apartments. John Barr, 10408 Samoline, spoke in opposition. It was moved by Councilman Skinner, seconded by Councilman Temple and passed by the following vote that the hearing be closed on Planning Resolution #77, Zone Change #94 -- Peacock, Farm & Paramount. AYES: 4 Councilmen: Skinner, Morton, Temple, Peavey NOES: 0 Councilmen: None ABSENT: 1 Councilman: Corbin ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE ZONING MAP ADOPTED BY SECTION 9107 OF THE DOWNEY MUNICIPAL CODE (PLANNING RESOLUTION NO. 77, ZONE CHANGE NO. 94) The ordinance was read by title only. It was moved by Councilman Temple, seconded by Councilman Skinner and so ordered that further read- ing be waived. 1609 It was moved by Councilman Skinner, seconded by Councilman Morton and passed by the following vote that the ordinance be introduced. AYES: 4 Councilmen: Peavey, Skinner, Morton, Temple NOES: 0 Councilmen: None ABSENT: 1 Councilman: Corbin The Mayor Pro -Tem announced that this is the time and place set for the hearing of Intention of Vacation of a Portion of Farm and Myrtle Street, Tract #21227. Mr. Spindel gave a report on this intended vacation. The City Clerk reported a letter had been submitted by the Gas Company requesting an easement of 10 feet lying on each side of their gas main prior to the vacation. The Mayor asked the City Clerk if she had the Affidavit of Publica- tion. The City Clerk replied she had the affidavit. It was moved by Councilman Skinner, seconded by Councilman Temple and so ordered that the affidavit be received and filed. Leslie Olson, 10022 Tristan Dr., representing applicant, spoke in favor of the intended vacation. He also stated the easement requested by the Gas Company would be worked out with them. No one spoke in opposition. It was moved by Councilman Temple, seconded by Councilman Morton and passed by the following vote that the hearing on the Intention to Vacate a portion of Farm Street and Myrtle Street be closed, AYES: 4 Councilmen: Skinner, Morton, Temple, Peavey NOES: 0 Councilmen: None ABSENT: 1 Councilman: Corbin The resolution ordering vacation was held for the next Council Meet - ing so that formal arrangements could be made with the Gas Company regarding the utility easement. The Mayor Pro Tempore announced that this is the time and place set for the hearing on Planning Resolution #78, Zone Change #95 - Nutt /Hasty and Songfest. Mr. Griselle presented a resume of this zone change. The Mayor Pro Tem inquired if the City Clerk had the Affidavit of Publication. The City Clerk replied she had the affidavit. It was moved by Councilman Skinner; seconded by Councilman Temple and so ordered that the affidavit of publication be received and filed. Speaking in favor of the Zone Change was Leslie Olson, 10022 Tristan Dr. Pictures were presented by Mr. Olson in support of this proposed zone change. Ordered received and filed. A petition was then submitted by Mr. Olson which had been signed by 18 adjacent property owners favoring the zone change. Ordered received and filed. Speaking also in favor of the zone change was Mr. W. N. Page, 9519 Cedartree Road. 1610 Speaking in opposition to Zone Change #95 were the following persons: Winfield Walker, 9722 Alwin Street Mrs. David C. Gloeckler, 9269 So. Klinedale W. H. Johnson, 9219 Songfest Dr. Francis Hart, 9643 E. Cedartree Rd. David C. Gloeckler, 9629 So. Klinedale Herbert Hamilton, 9249 Dalewood William Willise, 9536 Metro Frank Stephens, 9108 S. Cord Harry Williams 9112 Cord Elmer Easley, 9650 Telegraph Rd. Mr. Leslie Olson gave his rebuttal, after which it was moved by Councilman Temple, seconded by Councilman Morton and passed by the fol- lowing vote that the hearing on Planning Resolution #78, Zone Change #95 be closed. AYES: 4 Councilmen: Skinner, Morton, Temple, Peavey NOES: 0 Councilmen: None ABSENT: 1 Councilman: Corbin It was moved by Councilman Temple, seconded by Councilman Skinner and passed by the following vote that the matter of Planning Resolution #78, Zone Change #95 be taken under submission. The meeting reconvened at 10:00 P.M. with roll call. Mayor Pro Tempore Peavey announced that this is the time and place for the hearing set for the appeal to Zone Exception #348. He asked the City Clerk if she had the Affidavit of Publication. The City Clerk replied she had the affidavit. Ordered received and filed. Mr. Griselle gave a resume of the zone exception. Appellant Larry Young, 7928 Cole Drive, spoke against the zone exception. Also speaking against the zone exception were the following persons: Gilbert Powers, 12542 Smallwood Eldon F. Seybold, 12534 S. Smallwood Speaking in favor of Zone Exception #348 were: Bill Davis, 1432 N. Gordon, Pomona, builder designer Gordon Manis, 5777 Main, Hollydale Rev. Marshall Hoffman, pastor of Grace Baptist Church Bill Minnick, 7409 Cloverlawn, South Gate After Mr. Young's rebuttal, in which he requested that he would like to see certain conditions spelled out with regard to a buffer strip and def l ected lighting, it was moved by Councilman Skinner, seconded by Council- man Temple and passed by the following vote that the hearing be closed on Zone Exception #348. AYES: 4 Councilmen: Skinner, Temple, Morton, Peavey NOES: 0 Councilmen: None ABSENT: 1 Councilman: Corbin 1611. It was moved by Councilman Skinner that Zone Exception #348 be taken under submission. Motion died for lack of a second. It was moved by Councilman Morton that the zone exception be approved subject to the westerly side of the property's planted area's being extended to three feet. The motion died for lack of a second. It was moved by Councilman Skinner, seconded by Councilman Temple and passed by the following vote that the matter be taken under submission. AYES: 3 Councilmen: Skinner, Temple, Peavey NOES: 1 Councilman: Morton ABSENT: 1 Councilman: Corbin It was moved by Councilman Skinner, seoonded by Councilman Temple and so ordered that the minutes of the meeting of January 22, 1963 be approved as corrected. The City Clerk reported on the following written correspondence: (1) A letter from the Downey Unified School District in appreciation of the opening of Cedartree Road. Ordered received and filed. (2) & (3) Letters from Wendell W. Wiser resigning from the Civil Defense and Industrial Development Committee. It was moved by Councilman Temple, seconded by Councilman Skinner and so ordered to accept the resignations of Mr. Wiser. Councilman Temple stated he would send a letter of thanks and acknowledgment of the work and accomplishments of both committees. Letters were ordered received and filed. Councilman Morton stated that one of the letters from Mr. Wiser refers to a lack of cooperation from the City Council and he is not quite sure what Mr. Wiser means by that, but he goes along with the motion to accept the resignations. (4) A letter from the County Board of Supervisors in appreciation of the City of Downey's opposition to MTA legislation. Ordered received and filed. (5) A copy letter from Supervisor Frank G. Bonelli directed to N. H. Templin indicating County matching participation in Brookshire Avenue improvement projects. Ordered received and filed. (6) A letter from Burke, Williams & Sorensen, relative to condemnation action of the City of Downey vs. Forbes, et al. a.d. 66 requesting "authority to advise the owners of the property that in the event any claim is made against them by any of the tenants other than Mr. Garcia, who had been served, by reason of the City's acquiring the property through condemnation, they will be defended by the City and indemnified by the City without any cost to them." It was moved by Councilman Morton, seconded by Councilman Temple and passed by the following vote to authorize the City Attorney to proceed as requested in paragraph 3 of his letter as quoted above. He stated he would like to check the conditions of the areas to be relinquished. (8) A letter from John W. Thompson relative to a private hospital. Mr. King gave a background report on what had been done along this line. Ordered received and filed. 1612 (9) A letter from Mr. & Mrs. C. A. Glaze requesting parking restrictions at Lakewood Boulevard and Firestone Boulevard. Ordered referred to the Traffic Committee. (10) A letter from the Sub - Committee on Zoning of the Industrial Development Committee requesting the lifting of height limits imposed on industrial buildings. Ordered received and filed. (11) A letter from the County of Los Angeles relative to purchase of tax deed by the County. Ordered referred to the City Attorney. Councilman Skinner introduced Larry Sparks, student and newspaper carrier, who was interested in becoming acquainted with Council proceed- ings. RESOLUTION NJ. 1095 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY PROHIBITING PARKING AT ANY TIME,ALONG CERTAIN STREETS The resolution was read by title only. Mr. Spindel presented a resume. It was moved by Councilman Temple, seconded by Councilman Morton and so ordered that further reading be waived. It was moved by Councilman Temple, seconded by Councilman Skinner and passed by the following vote that Resolution No. 1095 be adopted. AYES: 4 Councilmen: Skinner, Morton, Temple, Peavey NOES: 0 Councilmen: None ABSENT: 1 Councilman: Corbin RESOLUTION NO. 1096 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY RESTRICTING PARKING TO CERTAIN HOURS ALONG BROOKSHIRE AVENUE AND LAKEWOOD BOULEVARD The resolution was read by title only. It was suggested that the hours prohibiting parking on Brookshire be changed to read between the hours of 7:00 A.M. and 8:00 A.M. and at all other times. It was moved by Councilman Morton, seconded by Councilman Temple and so ordered that further reading be waived. It was moved by Councilman Temple, seconded by Councilman Morton and passed by the following vote that Resolution No. 1096 be adopted with the recommended changes. OF THE STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA The resolution was read by title only. After an explanation of the purpose of this revolving fund by the City Attu rney, Councilman Morton requested time to study it further. No action was taken on the proposed resolution. AYES: 4 Councilmen: Skinner, Morton, Temple, Peavey NOES: 0 Councilmen: None ABSENT: 1 Councilman: Corbin Councilman Morton inquired about a recommendation in the Traffic Committee's Report relative to breaking through Pangborn to Florence, and advised using extreme caution before any decision to do this is made. Mr. Spindel advised that this item was just to be for study at this time. It was requested that the Traffic Committee study the possibility of installing a yield sign at Orizaba Street and Quoit. Councilman Temple requested that Mrs. Fanzler of 8219 Quoit Avenue, Downey, be contacted, and the matter was referred to the Traffic Committee for study. Councilman Morton commended the Southeast News for their articlB relative to the need for an integrated water system for the City of owney and on the article on Fire Chief Gain also appearing in the Southeast News, which was so very well done as to the reasons the City is involved in the water systems of Downey.
