MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
DECEMBER 26TH, 1962
The City Council of the City of Downey held a regular meeting in
the Council Chamber of the Downey City Hall at 8:00 A.M., December 26,
1962, Mayor Ben Corbin presiding.

Mayor Corbin announced he wished to make a presentation to the Downey
Ministerial Association for furnishing invocations to the City Council
Meetings through the years and also for the Nativity scene placed on the
lawn of the City Hall during the Christmas Season. A plaque was presented
to Reverend Rodney Cogswell of the Presbyterian Church who, in turn,
presented the commendation to Reverend Epp who is President of the Association.
The firm of Utter - McKinley was thanked for their loan of the display which was
valued at $50,000 when first purchased by them. Mr. Lloyd, Manager of
Utter - McKinley, was introduced and Mayor Corbin and Reverend Cogswell extended
their thanks to him.

so ordered that the minutes of the Council Meeting of December 10, 1962,
be approved as written.
The City Clerk reported on the following written correspondence:
(1) A letter from the Downtown Business Association in appreciation
for the Council's efforts through establishment of the future Downtown ,Ex-
change Center and other progress made in the downtown business area. The
letter was ordered received and filed.
(2) A report from the Junior Chamber of Commerce which is their
regular quarterly report presented to Council. Ordered received and filed.
(3) A memorandum from Ervin Spindel, Director of Public Works, in
reply to the request of Council to check into the acquisition of right of way
on the south side of Foster Road east of Clark Avenue and the south side
of Gardendale Street east of Lakewood Boulevard. It was reported the
location on Foster Road easterly of Clark Avenue is fully improved with
curb, gutters and paving with a width of 48 feet, all in the City of Downey.
In reference to the other location on Gardendale Street, it was found that
the owners of the property were unwilling to dedicate the land. If the
land were to be acquired, it was expected that the City of Downey pay for
the right of way as well as all improvements to be constructed. Upon check-
ing with the City of Bellflower, who advised this City has no plans for
acquisition and improvement of this area, they did indicate if the City of

The City Manager reported that the ordinance was to clarify
present provisions for persons to properly identify themselves oand

register correctly. Chief Robinson reported thatthis type
has been in effect in other cities for some time and that this is the
way all better motels handle registrations.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AMENDING SECTION 3185 OF THE DOWNEY MUNICIPAL CODE BY
ADDING THERETO A NEW SUB - SECTION RELATING TO PARKING OF
UNLOCKED MOTOR VEHICLES

Councilman Skinner requested a further explanation of the pro-
visions of this ordinance. Chief Robinson reported that many cities,
primarily in the east, do have legislation requiring locking of
ignition switches and taking the keys with the exception of parking in
attended lots.

Chief Robinson reported that this proposed ordinance is being sub-
mitted to the League of California Cities for introducing as possible
state legislation.

AMENDING SECTIONS 7166.2, 7169, 7170, 7171 AND 7172 OF
THE DOWNEY MUNICIPAL CODE, WHICH SAID SECTIONS RELATE TO
OVERHEAD STRUCTURES
The ordinance was read by title only. Mr. Spindel explained that
the encroaching into public right of way of primarily signs has deemed
it necessary to bring the section of the code of the Public Works section
in line with the Building Code and also standardinzing regulations with
other municipalities.

After a summation of bids for improvement of Eucalyptus Strebt from
Birchdale Avenue to its westerly terminus it was recommended that the
bid be awarded to the lowest and best bidder, Sheets Construction Company,
at the unit prices bid and that all other bids be rejected.
It was moved by Councilman Skinner, seconded by Councilman Temple
and passed by the following vote to award the bid for improvements in
A.D-. #79, Eucalyptus Street, tothe lowest and best bidder, Sheets
Construction Company, and that all other bids be rejected, and that the
City Clerk insert the name of the construction company in the resolution.

RESOLUTION NO. 1066
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AWARDING CONTRACT TO IMPROVE EUCALYPTUS STREET AND
BIRCHDALE AVENUE IN THE CITY, IN ACCORDANCE WITH RESOLU-
TION OF INTENTION NO. 1049 (AD 79)

Mr. Spindel outlined the various lighting zones in the Downey City
Lighting District and the abandonment of this old district to establish
a new Downey City Lighting District as provided for by Sections 18191
and 18192 of the Street Lighting Act of 1919. It was reported that in
1965 the Downey County Lighting District will have the lighting
standards paid in full and then can be annexed to this new Downey City
Lighting District.

Mr. Ervin Spindel, Director of Public Works, presented a preliminary
report on the abandonment of the Downey City Lighting District as is now
constituted and the establishment of a new Downey City Lighting District
as provided for by Sections 18191 and 18192 of the Street Lighting Act of
1919.

so ordered that the report be received and filed.

It was reported by Mr. Spindel that the work has been completed on
the Police Department Booking and Storage Room, Cash Contract No. 90,
but that due to a delay in delivery of the wire cage from Chicago, the
job was not completed within the deadline set. It was recommended that

a 5 -day extension be granted and that authority be granted to
file a Notice of Completion of the job.

and so ordered that an extension of time of five (5) working days be
granted the contractor for Cash Contract No. 90.

Mr. Spindel stated that inpsmuch as in the past the City Council
has authorized General Fund Monies to absorb the cost of incidental
expenses on assessment districts for sidewalk construction, it is rec-
ommended that Council consider paying the incidental costs for the
improvement of Izetta Avenue by sidewalk construction between
Washburn Road and Spry Street, in Assessment District #81. The estimated
cost is $3600.
Mr. King reported that this procedure is consistent with a policy
established throughout the City; however, Councilman Morton stated he
did not feel this particular precedent should be set.
It was moved by Councilman Skinner, seconded by Councilman Temple
and was a tie vote that the City contribute incidental expenses toward
construction of sidewalks in Assessment District #81, Izetta Avenue.

Councilman Skinner requested that a further study be made and a
report brought to Council at its meeting on January 22, 1963, with
regard to the sidewalk construction and City participation in A.D. #81,
Izetta Avenue. So ordered.
At 9:00 o'clock A.M. the Mayor announced that this is the time and
place set for the hearing of protests or objections to the proposed
changes in Vehicle Parking District No. 1
Mayor Corbin asked the City Clerk if she had the Affidavit of
Publication relative to this hearing.
The City Clerk reported she had the Affidavit of Publication.
It was moved by Councilman Morton, seconded by Councilman Skinner_
and so ordered that the affidavit be received and filed.
The Mayor inquired of the City Clerk if she had received any
written protests or objections against the proposed changes as such
changes are set forth and described in Resolution No. 1057. The City
Clerk replied she had received one letter from Mr. Frank Nathan, and
as it was questionable as to whether or not it actually constituted a
protest, it had been referred to the City Attorney who had advised it
is to be considered as a written protest. The letter was read in full
by the City Clerk.

Council is that there is no majority protest to the proposed changes
in Vehicle Parking District No. 1, A.D. No. 66.

It was reported by the Director of Public Works, Mr. Ervin .Spindel,
that a petition signed by 66% of the property owners on Bixler Avenue,
between Downey Avenue and Century Boulevard, has been filed with the
City, requesting that assessment district proceedings be initiated to
improve Bixler Avenue by the construction of curb, gutter, paving,
sewers, and the acquisition of right of way.
It was moved by Councilman Temple, seconded by Councilman Morton and
so ordered to authorize the Departma-t of Public Works to prepare plans
and specifications for improvements in A.D. #73 -P, Bixler Avenue.

Burke, Williams & Sorensen to perform the necessary legal work

and passed by the following vote that the City acquire tax delinquent
lands which fall within the proposed right of way of Barlin Avenue between
Imperial Highway and Devenir Street in Assessment District No. 85.

It was reported by A. C. Gabriel, Director of Finance, that the
Federal Electronics, Inc. had requested cancellation of the Radio Main-
tenance Contract as of December 21, 1962, which necessitated securing
bids for this service for the balance of the fiscal year.
After a summation of bids, it was moved by Councilman Temple,
seconded by Councilman Skinner and passed by the following vote to award
the contract fDr Radio Maintenance to the lowest and best bidder, Mobile
Radio, Inc. of Santa Fe Springs, at the rate of $552 per month for all
units, and that all other bids be rejected.

After a summation of bids for six motorcycles for the Police Depart-
ment, it was moved by Councilman Temple, seconded by Councilman Skinner
and passed by the following vote that the bid be awarded to the lowest
and best bidder, S & J Harley- Davidson, for the total bid price for 6
units of $6,801.00, and that other bids be rejected.

Mayor Corbin inquired about the warning sirens which are to be
installed in the City of Downey. It was reported by the Director of
Finance that these had been sent to the Area Defense Office in Pasadena
for their inspection and approval and that a report on the progress of
this project will be made at the next Council Meeting.
Councilman Morton commended the Civil Defense Committee in the
progress it has made and for their regular submission of progress reports.

Francis Hart, 9643 E. Cedartree Road, Downey, expressed his dis-
satisfaction with the manner in which the Planning Commission meetings
and hearings are conducted and referred specifically to Zone Exception
Case #335 and Zone Change #95.
. Mayor Corbin advised that this case has not been brought before
the City Council and that when the Planning Resolution pertaining to the
zone change is brought to the City Council, that will be the time for
voicing any protests or for speaking for this particular zone change.
Mr. Hart stated he was not speaking in protest of the zone change but
of what he feels are irregularities in the way the Planning Commission
conducts hearings. He stated that he feels the Planning Commission should
be investigated to assure that all residents interested in commenting at
the Planning hearings will be heard.
Mayor Corbin advised Mr. Hart that anyone wanting information can
obtain it just for the asking and that he feels everyone who wishes to be
heard at the public hearings is recognized.
Councilman Morton stated he has been informed that sometimes it appears
there are new matters brought forth in rebuttal on which the opposition is
not permitted to comment.
The City Attorney stated that the Commission is not a trained body
and the people presenting the matter are not trained in that respect and
it is sometimes a little difficult to tell from time to time whether a new
matter is matter is presented and may not particularly be relative to the

sidered and on a matter being opened again, an opportunity is given for
comments, and this is mainly at the discretion of the chairman of the
..., Planning Commission.
Councilman Skinner requested that the City of Bellflower be contacted
with regard to right of way acquisition on Foster Road and Gardendale
Street in a further attempt to persuade the City of Bellflower to participate
in acquisition of the right of way and improvements, and that a letter be
directed to Supervisor Bonelli to see if assistance might be obtained from
gas tax monies. A report to Council of these results of the inquiries was
requested.
Councilman Skinner requested an investigation and report by the
Director of Public Works of Iowa Street near the Downey Unified School
District Administration Office. So ordered.
Councilman Temple reported he would like to reappoint John K. Morris
to the Planning Commission for the term expiring December 31, 1966, as his
presentterm is expiring December 31, 1962.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
APPROVING THE APPOINTMENT BY THE MAYOR OF A MEMBER TO
THE PLANNING COMMISSION
The resolution was read by title only. It was moved by Councilman
Temple, seconded by Councilman Morton and so ordered that further reading
be waived.
It was moved by Councilman Morton, seconded by Councilman Temple and
passed by the following vote that Resolution No. 1072 be adopted.

The Mayor and each of the Councilmen expressed their gratitude
and appreciation for the cooperation and accomplishments in 1962 and
their sincere best wishes for 1963.
Mr. King, City Manager, expressed his appreciation of the adminis-
trative staff and City employees stating that there is no City in the
State of California that can parallel the accomplishments of the City of
Downey. He extended to the Department Heads, Chiefs his sincere wishes
as they enter a new year and that it should be the most progressive
year in the history of the City of Downey.
Mayor Corbin expressed his special tribute to the newspapers for
their fine cooperation and news coverage for the City of Downey.
There being no further business to come before Council, the meeting
adjourned at 10:00 A.M.
