MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
DECEMBER 10TH, 1962
The City Council of the City of Downey held a regular meeting in
P—ki the Council Chamber of the Downey City Hall at 7:30 P.M., December 10,
1962, Mayor Ben Corbin presiding.

Dr. Russell E. Clay of the Downey Methodist Church delivered the
invocation.
Mayor Corbin announced that this is the time and place set for the
hearing on Planning Resolution #74, Zone Change Case #86 - Woodworth/
7810 -7922 Stewart and Gray Road.
.� Mr. Griselle presented a resume of the case to change R -3 to construct
apartments with a 66' P zone with the required parking areas to serve as an
open area between R -1 properties and the proposed R3 to act as a buffer.
The Mayor inquired if the City Clerk had the Affidavit of Publication.
The City Clerk replied she had the affidavit.
It was moved by Councilman Temple, seconded by Councilman Skinner and
so ordered to receive and file the Affidavit of Publication.
Speaking in favor of Zone Change #86 was Charles Woodworth, 7947 East
Cole Street, Downey. No one spoke in opposition of the case.
It was moved by Councilman Temple, seconded by Councilman Morton and
so ordered that the hearing be closed on Zone Change Case #86, Planning
Resolution No. 74.
ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AMENDING THE ZONING MAP ADOPTED BY SECTION 9107 OF THE
DOWNEY MUNICIPAL CODE (PLANNING RESOLUTION N). 74, ZONE
CHANGE #86)
The ordinance was read by title only. It was moved by Councilman
Temple, seconded by Councilman Morton and so ordered that further reading
be waived.

Mayor Corbin announced that this is the time and place for the
hearing on Zone Change Case #76, being considered as a zone exception -
Grabe /Florence Avenue.
Mr. Griselle presented a resume of the case reminding Council that
this is the case which originally requested a zone change to Cl; the
Commission indicated it preferred that it would be a zone exception. The
case went back to the Commission and certain conditions have been
recommended being placed on it if it is changed to a zone exception. A
plot plan and elevation have been presented to Council which is 3' from
the property line, with a sign on the front of the building. The follow-
ing conditions were read by Mr. Griselle:
1. That this approval is based upon an approved plot plan and
elevation. Deviations or exceptions from said approved plot plan
and elevation shall not be permitted without the approval of the
City Planning Commission and that the existing building, if used
for commercial purposes, shall be remodeled to resemble a com-
mercial budding and that the remodeling of same shall be approved
by the Director of Planning.
2. That all businesses normally permitted in a C -1 zone shall be
permitted with the following exceptions listed under Sub - section
9120.1: 5, 6, 7, 10, 22, 24, 29, 31, 39, 43, 53, 54, 61, 78, 83,
0--k 84, 90, 92, 96, 100, 108, 112, 119 and 122.
3. That so long as any portion of the structure or the premises is
utilized for commercial purposes no portion thereof shall be used
for residential use.
4. That the parking area shall be constructed and permanently main-
tained in conformance with an approved plot plan and Section 9127 of
the Comprehensive Zoning Ordinance.
5. That all signs shall conform to the plot plan and elevation
approved and that such sign shall be interior lighted or back light-
ed and shall conform to Section 9126.38 of the Comprehensive Zoning
Ordinance and shall not encroach into the public right -of -way.
6. All lights used to illuminate any display portion of building,
signs, open spaces or parking areas shall be so arranged so as to not
reflect the light directly upon adjacent properties or public right-
of-way.
7. That the northerly twenty feet (20') of the property shall be
dedicated and improved to city standards as a public alley, with the
exception that the westerly one foot (1') of same shall not be dedi-
cated.
Speaking in favor of the zone change was Jack Robinson, 8555 Gainford
Avenue, Downey.
Mrs. Dorothy Hatfield, owner of the property directly behind 8041
Florence Avenue.

Sal Lorenzetti, 7634 Cecilia, speaking for his parents who own
8049 Florence Avenue. He submitted pictures of the area.
It was moved by Councilman Skinner, seconded by Councilman Temple
and so ordered to accept the pictures submitted by Mr. Lorenzetti as
exhibits in Zone Change Case #76.
Others who spoke in opposition were:
Martin Stearn and Bess Stearn, 8425 Dinsdale,
Jack Robinson presented his rebuttal after which it was moved by
Councilman Temple, seconded by Councilman Skinner and so ordered that
the hearing on Zone Change #76 be closed.
The Chief of Police was asked his opinion of the traffic problem
that could be created by the opening of an alley. He stated that he
questioned whether the alley would be used as a by -pass route. This
would increase the traffic flow into Don's Market and the new building
area and would be an asset to the businesses; however, this might change
the traffic flow on Orizaba.
Thg City Attorney stated that by imposing a condition whereby the
City would retain a 1' or 2' strip at the end of the alley, they could
require that a gate be erected and maintained with Council retaining
jurisdiction over the hours that said gate be closed.
It was moved by Councilman Temple, seconded by Councilman Morton to
change the Zone Change Case #76 to Zone Exception Case #347 in conformance
with the conditions recommended by the Planning Commission with the Condi-
tion #7 modified to state that the northerly 20' of the property shall be
dedicated and improved to City standards as a public alley, except for
the most westerly 2' of said northerly 20' and that the 2' strip excepted
from the dedication for alley purposes be conveyed to the City; that such
exception as granted meets the requirements of Section 9130.2 of the
Downey Municipal Code.
After discussion of the purpose served by the dedication and dis-
closure that there is no wall existing between the present construction
and the alleyway, Council Morton withdrew his secondand Councilman Temple
withdrew his motion. The Mayor stated the motion had been withdrawn.
Councilman Skinner moved that the case be taken under submission. The
motion died for lack of a second.
It was moved by Councilman Corbin, seconded by Councilman Temple and
passed by the following vote to change Zone Change #76 to Zone Exception
Case #347 and that the zone exception be approved in conformance with the
conditions recommended by the Planning Commission with Condition #7 to
read "that the northerly twenty feet (20') of the property shall be dedi-
cated and improved to city standards as a public alley" and that such
exception as granted meets the requirements of Section 9130.2 of the
Downey Municipal Code.

Mayor Corbin called Miss LeAnne Patton to the platform and presented
a scroll to her as recognition of the gracious manner in which she served
as Miss Downey during the past year. Miss Patton thanked Council and the
City of Downey for being such a gracious and friendly City.

Sal Lorenzetti, 7634 Cecilia, speaking for his parents who own
8049 Florence Avenue. He submitted pictures of the area.
It was moved by Councilman Skinner, seconded by Councilman Temple
and so ordered to accept the pictures submitted by Mr. Lorenzetti as
exhibits in Zone Change Case #76.
Others who spoke in opposition were:

Mayor Corbin announced that now is the time and place set for the
hearing on Zone Exception Case #328 which had been appealed for denial
by the Planning Commission.
Mayor Corbin inquired if the City Clerk had the Affidavit of Pub-
lication. The City Clerk replied she had the Affidavit.
It was moved by Councilman Temple, seconded by Councilman Morton
and so ordered that the affidavit be received and filed.
The Mayor asked the City Clerk if she had any written communica-
tions relative to this zone case. The City Clerk reported she had re-
ceived a petition with 96 signatures and a letter from Paul and Ellen
Gephart,7560..Boyson St., in favor of granting the zone exception for
operation of the rest home.

After Mr. Stephens' rebuttal, it was moved by Councilman Morton,
seconded by Councilman Skinner and so ordered the hearing be closed on
Zone Exception Case #328.
It was moved by Councilman Skinner, seconded by Councilman Morton
and passed by the following vote to uphold the decision of the Planning
Commission in Zone Exception Case #328 and that the appeal be denied.

It was moved by Councilman Temple, seconded by Councilman Morton
and so ordered that the minutes of the Council Meeting of November 27,
1962, be approved as corrected.
The Mayor declared a 5- minute recess at 9:15 P.M.
The meeting reconvened at 9:20 P.M.
The City Clerk reported on the following written correspondence:
A telegram from Arch N. Booth, Executive Vice President of the
National Chamber of Commerce, congratulating the City on the leadership
and responsibility accepted by Downey Government and business leaders for
renewal of the downtown area.
(1) A letter from Burke, Williams & Sorensen relative to the
breakage of the water main in A.D. #59, Blodgett Street, which advised,
in view of the fact that the cost to the City of compromising the amount
of repair work would be considerably less than the cost of litigation

to determine the question of liability, that the City and the Park Water
Company each pay half of $525.64, the cost for repairs.
It was moved by Councilman Skinner, seconded by Councilman Corbin
and passed by the following vote to approve payment of half the cost of
repairs to the water main in A.D. #59, Blodgett Avenue.

(2) A report and request for regular payment from the Downey Chamber
of Commerce. Letter approved and ordered accepted and filed.

proposed resolution for a holiday safety program.
RESOLUTION NO. 1063
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
SUPPORTING THE PROGRAM OF THE GREATER LOS ANGELES
CHAPTER OF THE NATIONAL SAFETY COUNCIL
The resolution was read by title only. It was moved by Councilman
Morton, seconded by Councilman Temple and so ordered that further reading
be waived.

passed by the following vote that Resolution No. 1063 be adopted.

(4) A letter from Councilman Peavey extending holiday greetings to
the Mayor, Council, Department Heads and members of the City Employees'
Association. Ordered accepted and filed.
(5) A letter from Jim Nakatani requesting the City to pay for paving
in front of his property on Bellflower as it is a major highway. Mr. Griselle
informed Council that the paving was a requirement under one of the conditions
placed on Plot Plan #202 on this property.
Councilman Skinner moved to give Mr. Nakatani relief on the paving only
from gas tax funds and that a more complete report be submitted at the next
Council Meeting relative to properties adjacent.
Councilman Temple stated he thought the matter warranted further study.
Councilman Skinner withdrew his motion. The matter was tabled for further
study.
(6) A letter from the Citizens Tax Committee with their recommenda-
tions relative to the proposed Downey Unified School District tax increase.
Mr. Garstang was asked to clarify the report.
Upon a request made by Councilman Morton, the City Clerk read the
report in full. Ordered accepted and filed.
An assignment from Rio Hondo Disposal Service assigning the contract
for refuse collection for the City of Downey to a new co- partngrship com-
posed of Stanliegh Megargee, Jr. and Eugene Puckett.

It was moved by Councilman Skinner, seconded by Councilman Temple
and so ordered to approve the assignment to the new co- partnership of
Stanliegh Megargee, Jr. and Eugene Puckett, d /b /a/ Rio Hondo Disposal
Company.
The City Manager stated that the Downey City Youth Band has been
invited to play in the Pasadena Tournament of Roses Parade, and that the
City has been asked to furnish transportation in the form of two buses
at an approximate cost of $125.
It was moved by Councilman Morton, seconded by Councilman Skinner and
passed by the following vote that the City furnish the transportation for
the Downey Youth Band to the Rose Parade.

A letter addressed to Assemblyman Porter relative to landscaping the
Santa Ana Freeway through the City of Downey was read and approved.

so ordered to set a hearing on Planning Resolution No. 76, for 7:30 P.M.,
January 14, 1963, in the Council Chamber of the Downey City Hall.

ORDINANCE NO. 213
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AMENDING SECTIONS 5106 AND 5106.2 OF THE DOWNEY
MUNICIPAL CODE, WHICH SAID SECTIONS RELATE TO REFUSE
COLLECTION
The ordinance was read by title only. Mr. Larry Chaney, Chairman of
the Citizens Sanitation Committee, stated the primary reason for the rec-
ommendation of the committee is the weight problem of the heavy duty drums.
It was moved by Councilman Skinner, seconded by Councilman Temple and
so ordered that further reading be waived.

ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AMENDING THE DOWNEY MUNICIPAL CODE BY ADDING TO ARTICLE
VI THEREOF A NEW CHAPTER TO BE DESIGNATED AS CHAPTER 8
RELATING TO DRIVE -IN RESTAURANTS
The ordinance was read by title only. It was moved by Councilman
Morton, seconded by Councilman Skinner and so ordered that further
reading be waived.
Mr. Victor Eppurt, 3600 Wilshire Blvd., Los Angeles, stated the
reasons he felt this type ordinance should not be passed and stated
that he feels it would be advisable to see what happens with the en-
forcement of two ordinances which have been recently passed before
considering the one governing the drive -in restaurants. He requested
that the second reading of subject ordinance be held at the next regular
night meeting of the City Council.

RESOLUTION NO. 1064
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
APPROVING AGREEMENT NO. 1389 WITH THE STATE OF CALIF-
ORNIA DIVISION OF HIGHWAYS (FOR TRAFFIC SIGNAL)
MODIFICATION AT FIRESTONE BOULEVARD AND WOODRUFF AVENUE
The title was read only. The City Attorney stated that he had
reviewed the agreement and could see no objections to it.
Mr. Spindel reported on the modifications to this traffic signal,
stating the cost to the City will amount to approximately $790.
It was moved by Councilman Skinner, seconded by Councilman Temple
and passed by the following votes to approve the following transfer of

The City Manager reported plans have been drawn for the proposed
parking lot located in the vicinity of the Chamber of Commerce building
at Second Street and Brookshire Avenue, at an estimated cost of $7500,
which funds are in the budget.

passed by the following vote to approve plans and specifications for Cash
Contract No. 85, City Hall Parking Lot No. 3 and authorized calling for
bids.

After a summation of bids on plant material for Firestone Boulevard
Center Island planting and report by Mr. Spindel, it was moved by Coun-

vote to award to Select Nursery's Inc., La Brea, California, a pur-
chase order in the amount of $2634.40 plus tax to cover the cost of
plant material, and to reject all other bids.

A report was presented on rubbish pickup at City Hall and it was
recommended that there be no change for the remainder of the fiscal year,
but that the litter basket program be started at,this time and contracted
for the balance of this fiscal year. The total cost for this program is
$1200, and it was recommended that transfer of these funds be authorized.

A report was given by Ervin Spindel on the plans for extending water
service to the islands on Firestone Boulevard for the purpose of supplying
the proposed sprinkler system within the island perimeter. This will also
include electrical conduits.

grant authority to advertise for bids for the water system for Firestone
Boulevard island planters.

It was reported by Mr. King that the Civil Defense Advisory Committee
has requested the City's participation in the acquisition of two communica-
tions sets for the Emergency Communications Station, operated by the
Downey Races and located in the east end of the Council Chamber building.
Their estimate of cost is approximately $1400 for the two units to be
shared 50% by Federal matching funds and 50% by the City. Ed Powell, Deputy
Director of Civil Defense and Ray Grimes, member of the Civil Defense
^ Advisory Committee, explained the proposed operation of the equipment and
the setup.

and so ordered to approve the recommendation of the Civil Defense Advisory
Committee as stated above.

The City Manager reported that the Senate Fact Finding Committee had
submitted a recommendation for an addition of a 1(,l gasoline tax to provide
additional monies for the improvement of city and county streets of
secondary and primary importance, and some assistance for local streets.
It was moved by Councilman Skinner, seconded by Councilman Temple and
so ordered that the Senate Fact Findings report be referred to the Citizens
Tax Advisory Committee for further study and additional information.
In accordance with Council's request, the Director of Public Works and
City Manager met with the Superintendent of Schools, Bruce Moore, and
Bolton Jones, in charge of the School Business Office, to discuss further
the joint program of improving Brookshire Avenue south of Gallatin Road,
according to the City Manager. Mr. Moore and Mr. Jones stated they had
funds which would cover the construction of sidewalks on Gallatin Road in
front of the school, and that the school would dedicate the necessary right
of way. They suggested that in lieu of putting additional monies in curbs
and gutters on this street, where the City could use Gas Tax funds, they use
the little money they have left to curb and gutter and put in sidewalks
around the southeast corner of Tweedy Lane and Suva Street for the protection
of the school children in this area, where the City cannot use gasoline
funds.
It was recommended that the City participate with the School District
in the construction of curbs, gutters and pavement on the west side of
Brookshire Avenue from Gallatin Road, southerly, paralleling the Gallatin
School, from Gasoline Tax Funds in the 1963 -64 Street Improvement Budget;
that the schools install sidewalks paralleling this improvement, as well as
the suggested improvement at the corner of Tweedy Lane and Suva Street.

so ordered to approve the recommendation as stated above.
It was reported by the City Manager that Governor Brown, on December 5,
proclaimed "Monday, December 31, a State holiday, in accordance with
Section 6700 (N) of the Government Code, and called on all classes of
business and all classes of citizens to join in its observance" as "Part of
a four -day California First Celebration" commemorating our place as first
State in the Union.

The City Manager reported that the structure at 8130 Third Street
had been declared by the Building Department inspectors as being unsafe
to stand. Two informal bids for taking down the building were received
covering removal of the house, foundation and garage., One was for $1260
and the other for $2,095.
It was moved by Councilman Temple, seconded by Councilman Corbin and
so ordered to authorize calling for formal bids to see if a better bid
might be obtained for removal of this unsafe building at 8130 Third Street.
The City Manager requested action by Council to appropriate funds for
transporting the Downey City Youth Band to Pasadena for the Annual Roses
Tournament New Year's Day Parade.

passed by the following vote to authorize appropriation of funds in the sum
of $125.00 from the Community Promotion Account for transporting the Downey
City Youth Band to the Pasadena Rose Parade.

Mr. King requested two days' vsction, Thursday and Friday, December 27,
and 28.
It was moved by Councilman Temple, seconded by Councilman Morton and
so ordered that Mr. King's requested vacation be approved.
The City Attorney reported he had a Joint Use Agreement between the
Edison Company and the City of Downey, which agreement relates to easements
in District #10, Klondyke Assessment District, which District contains some
500 parcels. The Agreement provides a method of acquiring street easements
without buying out the Edison Company easements. Under the Agreement the
City agrees to pay for relocation of any facilities which may be moved by
reason of the street improvements. The Agreement gives no more rights than
were in existence at the time of the Joint Use Agreement. The City Attorney
recommended approval and authority for the Mayor to sign the Agreement.

passed by the following vote to approve the Joint Use Agreement between the
City of Downey and the Edison Company, and to authorize the Mayor to sign
such Agreement.

Councilman Morton inquired about the placement of a sign on the employees'
parking lot which was outlined in the Library Report. Director of Public Works
Ervin Spindel stated the sign could be erected in the very near future.
Councilman Morton suggested directing a letter to the Junior Auxiliary
of the Downey Junior Woman's Club, who had presented the library with books in
the sum of $75 to be used for students in preparation of their studies,
especially along literature lines.
It was moved by Councilman Skinner, seconded by Councilman Temple and so
ordered that the gift be accepted with thanks.
Councilman Temple introduced Morton Saltman, who he recommended for ap-
pointment to the Citizens Tax Committee. It was moved by Councilman Temple,
seconded by Councilman Skinner and so ordered to approve the appointment of
Mr. Saltman as recommended.

ordered to approve appointment of Mrs. Robert Cook to the Rose Float Associa-
