MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
OCTOBER 8TH, 1962
The City Council of the City of Downey held a regular meeting
in the council chamber of the Downey City Hall at 7:30 P.M., October 8,
1962, Mayor Scott E. Temple presiding.

Reverend Floyd Peterson of the Moravian Church delivered the invo-
cation.
Mayor Temple introduced Dr. Ralph Christensen, emissary of goodwill
who delivered a plaque commending the City of Racine, Wisconsin on their
work toward a cancer education program in the filming of "The Other City ".
Dr. Christensen expressed his personal thanks for the opportunity to help
with the project. He stated this was the first time that anyone had
bothered to say "thank you" for a community effort well done, and that the
^ plaque was very well received.
Mayor Temple announced that this is the time and place set for the
hearing on the intention to vacate the future and private street lying
northerly from Adwen Street within Tract #15475.
The Mayor inquired of the City Clerk if she had the Affidavit of
Publication. The City Clerk replied she had the affidavit and that notices
of the hearing had been duly posted.
There being no written correspondence and no oral communications
relative to this hearing, it was moved by Councilman Skinner, seconded by
Councilman Peavey and so ordered that the hearing be closed.
RESOLUTION NO. 1042
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ORDERING THE VACATION OF THE FUTURE AND PRIVATE STREET
LYING NORTHERLY FROM ADWEN STREET WITHIN TRACT NO. 15475

Mayor Temple announced that this is the time and place set for
the hearing on the resolution of intention to improve Duesler Lane, a
private street in A.D. #22.
The Mayor inquired of the City Clerk if she had the affidavits of
posting, mailing and publication. The City Clerk reported she had the
affidavits.
It was moved by Councilman Corbin, seconded by Councilman Peavey
and so ordered that the affidavits be received and filed.
There being no written communications and no oral comments relative
to the hearing, it was moved by Councilman Skinner, seconded by Councilman
Morton and so ordered that the hearing be closed.
RESOLUTION NO. 1043
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ORDERING WORK TO BE DONE ON DUESLER LANE, A PRIVATE STREET

It was moved by Councilman Peavey, seconded by Councilman Skinner

The City Clerk reported on the following written communications:
(1) A letter from Standard Oil Company requesting permission to
perform a geophysical survey on the City of Downey property commonly
known as the ,Public Works Yard.
It was moved by Councilman Skinner, seconded by Councilman Corbin
and passed by the following vote to grant approval for the Standard Oil
Company to perform a geophysical survey at the Public Works Yard.

(2) A notification of annual adjustment in rates covering care of
City prisoners in the Los Angeles County Jail from the Los Angeles
County Sheriff's Department.
Councilman Skinner requested that a report be required from the
Los Angeles County Sheriff's Department showing the number of prisoners
housed by cities. So ordered.
(3) A letter from Mrs. Phyllis Gardea which advised a booklet was
being forwarded to each Councilman under separate cover.
(4) A letter from Dick Sandberg appealing Zone Exception #316.

(5) A letter from the Downey Board of Realtors informing Council
of the resignation of Mary E. Hollis as a member of the Citizens Tax
Committee and recommending the appointment of Larry Chaney.
It was moved by Councilman Peavey, seconded by Councilman Corbin
and so ordered to approve the appointment of Larry Chaney to the Citizens
Tax Committee as recommended by the Downey Board of Realtors.
Councilman Skinner recommended sending a letter of thanks for her
services to Mary Hollis on behalf of the City Council.
(6) A letter from the Downey Chamber of Commerce recommending the

It was moved by Councilman Peavey, seconded by Councilman Morton and
so ordered that the citizens committee appointments be approved as recom-
mended by Councilman Skinner.
Councilman Corbin recommended appointing Fred Jacobson to the Youth
Committee.
It was moved by Councilman Peavey, seconded by Councilman Skinner and
so ordered to approve the recommendation of Council Corbin.
(7) A letter from the Downey Employees Association in appreciation
of the recognition dinner of September 12 and the five -year awards.

(8) A letter submitting the quarterly report from the Junior
Chamber of Commerce. The City Manager stated that the most important
phase of the letter was the fact that the Lions Club, the Junior
Chamber of Commerce and the Citywide Retail Coordination Committee
are planning a Christmas Parade as usual.
-� (9) A letter from Mrs. Robert P. Whitney objecting to the notice
from the Planning Department to destroy or remove one of four animals
(collie dogs) from their premises as, according to the Code, only
three animals are permissable in an R -1 zone. It was reported that
Mrs. Whitney had been advised to file for a zone exception in which
instance a hearing would be held before the Planning Commission and
their decision rendered as to granting of such zone exception.
(10) A letter from Mr. Wiser, Chairman of the Civil Defense Com-
mittee, extending thanks for the recent action to provide warning
signals for the City of Downey.
The City Attorney reported that he had checked on the appeal pro-
cedures in the matter of Tract No. 27524 which had been referred to him
and his findings were that there is no provision in the Municipal Code
for an appeal but there is provision for appeal in the State Code.
According to the information furnished him, the City has requested that
the subdivider construct sidewalks on 10th Street in front of property
that is not a part of the subdivision. It was stated under applicable
statutes that a subdivider could not be required to pay the cost of
improving offsite streets. As the Planning Commission had approved the
subdivision attaching as one of the conditions that sidewalks be
installed along 10th street adjoining the property which was not a part
of the subdivision, this condition should not be placed on this particu-
lar property.
It was moved by Councilman Peavey, seconded by Councilman Corbin
and passed by the following vote to allow the appeal and delete the
requirement of sidewalks on 10th Street adjoining the parcel that is not
a part of the subdivision tract #27524.

(11) A memorandum from the City Manager reporting that the minutes of
the.Civic Development Committee meeting of September 24, 1962 were
incorrect and had been spread in the minutes of the last Council Meeting
as incorrectly submitted. Therefore, it is necessary for Council to
accept the correction of the minutes of the Civic Development Committee.
It was moved by Councilman Skinner, seconded by Councilman Morton and
passed by the following vote to accept the correction of the Civic
Development Committee to show the location of a fourth parking lot to be
the 85' Firestone frontage between "Downey and Dolan" instead of Firestone
and Dolan.

RESOLUTION NO. 1044
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
PROPOSING CERTAIN CHANGES IN THE ACQUISITION AND IM-
PROVEMENT OF VEHICLE PARKING DISTRICT NO. 1 OF THE CITY
OF DOWNEY AND DIRECTING NOTICE OF HEARING ON SAID PRO-
POSED CHANGES (A.D. #66)
The resolution was read by title only. The City Attorney stated
that the resolution adopts by reference a form of notice for changes
in the now existing Parking District and that these changes can be
made upon a hearing being held and a subsequent 4/5 vote of the Council
so long as the assessment has not been confirmed, which it has not.
The hearing shall be set for November 13, 1962, at 7:30 P.M., for hear-
ing any objections to the proposed improvement and acquisition of
property on Firestone and Dolan. The improvements are also set forth
and are substantially the same improvements which were set out in the
previous resolution. In the event said proposed changes are approved
it is estimated that the costs and expenses for said Vehicle Parking
District No. 1 will be increased by the sum of $376,000.00.

The City Manager reported on the options of properties on Firestone
and requested acceptance and approval of these options and that Council
ratify the action of the City Manager in executing them on behalf of the
City.

Firestone Boulevard and ratify the action of the City Manager in executing
them on behalf of the City.

The City Manager expressed the appreciation to the persons involved
for their fine cooperation in forming this Parking District. The expenditures
for the acquisition of the property and improvements will be pro -rated and
assessed against the property and improvements within the Parking District
according to the direct benefits derived from the Parking District.

RESOLUTION NO. WS -314

ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING THE
FUNDS OUT OF WHICH THE SAME ARE TO BE PAID ( #8314 -
#8471 $149,439.96)
The resolution was read by title only. It was moved by
Councilman Peavey, seconded by Councilman Corbin and so ordered that
further reading be waived.
Mr. Gabriel was requested to report on the ambulance collections.
He stated there were 94 billings totaling $2,169.00, of which $444.00
has been collected. The accounts were then turned over to a collection
agency totaling $4,803.00, of which $754.00 has been collected through
this agency.

After a summation of bids for slurry seal, Cash Contract #82, it was
moved by Councilman Skinner, seconded by Councilman Morton and passed by
the following vote that the bid be awarded to the lowest and best bidder,
Slurry Seal, at the unit price submitted, and that all other bids be
rejected.

Mr. Spindel reported that in the preliminary engineer's estimate for
work to be done in A.D. #79, improvement of Eucalyptus Street, it was
determined that the cost of the improvements, excluding incidental costs,
would not exceed $8.00 per foot, at which time the property owners were
so advised. After the completion of the final Plans and Specifications,
the final engineer's estimate for construction has increased the cost per
assessable foot in excess of $8.00. Since this is an estimate, it is
still possible that the work may be done for less than $8.00 per assessable
foot; however, in preparing the report the engineer's estimate has been
shown and the costs distributed to the various owners. As a result, there
has developed considerable protest from the area, and it has been requested
by property owners in the district that the City absorb all costs in excess
of $8.00 per foot.
The City Attorney advised that a resolution could be drawn approving
a contribution of whatever amount the Council deems advisable. As the
bids are on a unit basis, a total bid is not necessarily a final analysis.
It was moved by Councilman Morton, seconded by Councilman Corbin and
so ordered that this matter be tabled until bids are received for improve-
ments in A.D. #79, Eucalyptus Street.

Mr. King reported that Ray Lake, Director of Building and Safety,
is being considered for an appointment from Governor Brown's office to
the State of California Building Standards Commission.
It was moved by Councilman Corbin, seconded by Councilman Skinner
and passed by the following vote to approve a recommendation's being
sent in Mr. Lake's behalf for membership with the State of California
Building Standards Commission.

The City Manager reported that at the request of the Public Works
Department, the Finance Department solicited quotations for the repair
and modification of ten Downey Welcome signs. As in the past, there was
only one quotation submitted, by Cascade Plastics Inc. of Lynwood, for
work to be performed on nine of the signs. No quotation has been
received for exterior electrical work needed for the tenth sign. The
quotation would provide for the complete repair and modification of two
signs at a cost of $872.32 and the modification of seven signs at a cost
of $90.00 each, for a total cost of $1502.32. Only one sign would then
be inoperative requiring the services of a licensed electrician. If
this modification work is performed, future servicing and replacement of
tubes and ballasts may be performed by City forces at a saving to the
City.
It was recommended that $2,000 be transferred from the Operating
Reserves,to Account No. 6300 -4 to cover the costs of repair and modifica-
tion of the nine Downey Welcome signs at a price quoted, and to provide
funds for the tenth sign when a quotation is received.
Councilman Skinner recommended moving the Downey Welcome sign at
the southern end of Lakewood at Rosecrans. City Manager Oren King con-
curred with Councilman Skinner and recommended a further study.
After further discussion it was moved by Councilman Corbin, seconded
by Councilman Morton and passed by the following vote to transfer the
following funds for repair and modification of the Downey Welcome signs:

It was recommended that a member of the Citizens Industrial Committee
and a member of the City Council attend the California Industrial Develop-
ment Conference and Society of Industrial Realtors Industry Seminar, at the
Statler- Hilton Hotel, October 25 -26, 1962. Reservations include registra-
tion and luncheon for $20.00 covering each guest.
It was moved by Councilman Peavey, seconded by Councilman Skinner and
passed by the following vote to authorize a member of the Citizens Industrial
Committee and a member of the City Council to attend the California
Industrial Development Conference and the Society of Industrial Realtors

It was recommended that a member of the Citizens Industrial Committee
and a member of the City Council attend the California Industrial Develop-
ment Conference and Society of Industrial Realtors Industry Seminar, at the
Statler- Hilton Hotel, October 25 -26, 1962. Reservations include registra-

It was moved by Councilman Peavey, seconded by Councilman Skinner
and passed by the following vote to declare a record player in the
library surplus in order that it may be sold at auction.

Mr. King reported on the following Personnel Board Recommendations:
Police Clerk. Six positions of Typist Clerk II, Schedule 8,
($323 -$393) be reclassified to Police Clerk, Schedule 9 ($338 -$412) due
to their unpleasant duty of assisting police officers in searching,
transporting, and maintaining custody over female prisoners. Many cities
utilize policewomen or matrons for this work, necessitating a much higher
salary. Approval of this recommendation by the Council will incur an
expense of $896 which can be absorbed within the current Police budget.
Communications Operators. Recommended that the Schedule 8 ($323 -$393
be raised to Schedule 11 ($373 -$454) and that present employees be raised
one step, with future recruiting upon the new schedule. Funds in the
amount of $1008 can be absorbed in the current Police budget. The request
is in the nature of an emergency due to the high rate of turnover in this
particular position.
It was moved by Councilman Skinner and seconded by Councilman Peavey
that the personnel reclassifications be denied, in line with Council's
decision not to grant pay increases after approval of the final budget.
After discussion and report by Deputy Chief of Police Loren Morgan who
indicated that these requests had been submitted prior to budget time and
had not been given consideration, Councilman Skinner withdrew his motion
and Councilman Peavey, his second to the motion.
It was then moved by Councilman Skinner, seconded by Councilman Temple
and so ordered to request this matter to be held over for supporting data
accompanying a statement of what these positions involve in other cities of
same or like population, and the cost for police officers doing the work.
It was recommended by the Personnel Board and concurred in by City
Manager Oren King that the education and experience requirement for Junior
Civil Engineer be changed from graduation from an accredited school of
civil engineering to graduation from an accredited college or university
with a degree in Civil Engineering or registration with the California Board
of Registration for Civil and Professional Engineers, as an Engineer -in-
training. Engineering experience at the level of this class, involving
appreciable amount of computation and design, may be substituted for the
required education on a year for year basis.
It was moved by Councilman Skinner, seconded by Councilman Morton and
passed by the following vote to approve the recommendation of the Personnel
Board that experience at the professional level be substituted for educa-
tion for Junior Civil Engineer.

Mr. King called Mrs. Ruth Miller to the rostrum and advised that upon
the recommendation of the Personnel Board and the Library Advisory Board,
and with the concurrence of the City Council, she was appointed City
Librarian, effective this date, at a salary of $750.00 per month.

Mr. King reported that an option to purchase property 50' x 150' at
8130 E. 3rd Street from Mr. & Mrs. Atkinson is to be executed through
escrow proceedings with Downey Escrow Company and requested a transfer
of $31,500 from unappropriated reserves for this transaction.

Mr. King suggested the City Charter Committee endeavor to begin the
study of a City charter with the assistance of the City Attorney, with a
meeting schedule for 3:30 or 4 :00 November 7, and the 1st and 3rd
Wednesdays thereafter. It was recommended that the City Manager and the
City Attorney serve as ex- officio members on the City Charter Committee.

The City Attorney reported he will continue to pursue further the
problem of consumption and possession of liquor on the parking lots of
various drive -ins.
Councilman Peavey requested the City Attorney to study all avenues of
regulation which would be constitutional and stand up in court.
The City Attorney requested recommendations from the Police Department
of specific controls and regulations desired.
.-% Deputy Chief Morgan stated that the residents could assist the Police
Department in carrying out their responsibilities if they would be willing
to file a complaint and appear in court as a witness to testify.
Francis Hart, 9643 E. Cedartree, requested planting of trees and
lawns on the meridian that exists on True Street and Songfest Drive.
E. A. Easley, 9656 E. Telegraph Rd., inquired of the manner of watering
this area after the plantings and requested further action on the parking
problem in this area. It was his feeling that restricted parking was
ineffective and that there should be no parking allowed. Councilman Morton
recommended the matter be referred back to the Traffic Committee and to
proceed as originally recommended- -that there be no parking.
Councilman Skinner reques{ed a written report from the Planning De-
partment on the progress of the,Master Plan and a time table.
Councilman Peavey repprted he had met with a group in District #5
who had asked for assistance in getting an overpass over the Santa Ana
Freeway at Tweedy Lane. The State's assistance was requested. Installa-
tion of a sidewalk over to Paramount Boulevard as suggested by the State
was opposed by the residents and they wish to go back to the State
requesting the overpass.
It was moved by Councilman Peavey, seconded by Councilman Skinner and
passed by the following vote to instruct the Public Works Department to
submit an estimate on the cost of putting a sidewalk under the overpass.
Councilman Corbin recommended including a guard rail along with the sidewalk.

Mrs. Betty Torro, 7930 Cole Street, requested Council to proclaim
October 19 -25 as Patriotic Education Week in accordance with State law.

so ordered to proclaim October 19 -25 Patriotic Education Week.
Mayor Temple reviewed the accomplishments in the City of Downey during
the past year and stated it had been a real pleasure to act as Mayor, and
tendered his resignation as Mayor for the past one -year term.

passed by the following vote to accept the resignation of Councilman Scott E.
Temple as Mayor.

Councilman Corbin presented a commendation to Councilman Temple for
serving as Mayor from July 14, 1958 to January 13, 1959, and from
October 14, 1961 to October 8, 1962.
The City Manager expressed his appreciation to Councilman Temple
for the past year's excellent service and stated it has been a pleasure
to serve with him and work with him, and also thanked him for his con-
sideration during the entire year.
Councilmen Peavey, Skinner and Morton added their congratulations,
thanks and appreciation to Councilman Temple.
There being no further business to come before Council, the meeting
