MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
SEPTEMBER 11TH, 1962
The City Council, preceding its regular meeting, held a special
program in recognition of the fifth anniversary of the Downey Fire
Department with Assemblyman Carley V. Porter participating in the
activities and offering congratulations on the reduction to the new
No. 3 fire rating recently awarded the City of Downey through the
untiring efforts and efficiency of its Fire Department.
The City Council of the City of Downey held a regular meeting ad-
journed in the Council Chamber of the Downey City Hall at 7:30 P.M.,
September 11, 1962, Mayor Scott E. Temple presiding.

Reverend John Krieder of the Faith Mennonite Church delivered the
invocation.
Mayor Temple announced that this is the time and place set for the
hearing on the appeal to Zone Case #305, Mr. Glenn Stevens, 7857 Cole Street.
The Mayor ascertained that the City Clerk had the affidavit of publication on
the hearing. Mr. Sherman Griselle gave a resume of the Planning Commission
findings.
Mr. Leslie V. Olson, 10022 Tristan Drive, spoke for the appellant in
the case and stated that appellants do not feel the neighborhood would be
affected adversely in any way through the allowance of this zoning request.
Also speaking for the appellants was Darryl Shumway, 7911 Cole Street,
who stated that the neighbors on Cole Street are favorable to the Stevens'
request.
The Mayor inquired if there were any written protests. The City Clerk
read a letter which was signed by 10 property owners, 9 on Smallwood and 1
on Morning Avenue; a letter from Mr. & Mrs. Thomas Steward, 7811 E. Cole
Street; and one from Charles B. Linderman on Smallwood.
Speaking in protest were: Mrs. Lloyd Lynd, 7845 Cole Street,
Mr. A. W. Stringer on Smallwood (12006) and Mr. R. E. Nowell, 12020 Smallwood
Avenue.
Mr. Leslie Olson and Darryl Shumway spoke in rebuttal with Mr. Shumway
stating that the Stevens are willing to sign a covenant that no other person
will use the dwelling but themselves or the parents.
It was moved by Councilman Skinner, seconded by Councilman Corbin and
so ordered that the hearing on the appeal to Zone Case #305 be closed.

After discussion and questioning the Director of Building and
Safety regarding the structure in question, it was moved by Councilman
Peavey, seconded by Councilman Skinner and passed by the following vote
that Zone Case #305 appeal be taken under submission.

Mayor Temple announced that this is the time and place set for the
hearing on the vacation of the road easement on Planett Avenue extending
northerly from Iowa Street located between Dolan Avenue and Brookshire
Avenue.
The Mayor ascertained that the resolution of intention and necessary
postings to vacate Planett Avenue had been published and posted and that
the City Clerk had the affidavits.
After the Director of Public Works' report, there being no written
and no oral comments, it was moved by Councilman Skinner, seconded by
Councilman Morton and so ordered that the hearing on the vacation of
Planett Avenue be closed.
RESOLUTION NO. 1029
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ORDERING THE VACATION OF A CERTAIN EASEMENT KNOWN AS
PLANETT AVENUE EXTENDING NORTHERLY FROM IOWA STREET
LOCATED BETWEEN DOLAN AVENUE AND BROOKSHIRE AVENUE
The resolution was read by title only. It was moved by Councilman
Skinner, seconded by Councilman Corbin and so ordered that further read-
ing be waived.
It was moved by Councilman Skinner, seconded by Councilman Peavey and
passed by the following vote that Resolution No. 1029 be adopted.

The Mayor announced that now is the time that the hearing is set for
the vacation of Florence Avenue Service Road for Public Road purposes.
The City Clerk advised that the Resolution of Intention had been duly
adopted, posted and published and that she had the affidavits.
After a report by Mr. Ervin Spindel, there being no written and no
oral comments, it was moved by Councilman Morton, seconded by Councilman
Corbin and so ordered that the hearing be closed.
RESOLUTION NO. 1030
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ORDERING THE VACATION OF FLORENCE AVENUE SERVICE ROAD
FOR PUBLIC ROAD PURPOSES
The resolution was read by title only. It was moved by Councilman
Corbin, seconded by Councilman Morton and so ordered that further reading
be waived.

Mayor Temple announced that now is the time and place set for the
hearing on the Resolution of Intention to vacate a certain easement south
of Imperial Highway, easterly of Bellflower Boulevard for sanitary sewer
purposes.
The City Clerk advised the resolution had been duly adopted, posted
and published and she had the affidavits.
After the Director of Public Works' report, there being no written
and no oral comments, it was moved by Councilman Skinner, seconded by
Councilman Peavey and so ordered that the hearing be closed.
RESOLUTION NO. 1031
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ORDERING THE VACATION OF A CERTAIN EASEMENT SOUTH OF
IMPERIAL HIGHWAY, EASTERLY OF BELLFLOWER BOULEVARD FOR
SANITARY SEWER PURPOSES
The resolution was read by title only. It was moved by Councilman
Corbin, seconded by Councilman Skinner and so ordered that further read-
ing be waived.
It was moved by Councilman Skinner, seconded by Councilman Peavey
and passed by the following vote that Resolution No. 1031 be adopted.

It was moved by Councilman Skinner, seconded by Councilman Morton and
so ordered that the minutes of the Council Meeting held on August 24, 1962,
be approved as written.
The City Clerk reported on the following correspondence:
(1) A letter from the Downey County Water District of the court
decision upon which it was moved by Councilman Peavey, seconded by Council-
man Skinner and so ordered that it be referred to the City Attorney.
(2) A letter from the firm of Burke, Williams & Sorensen regarding
the Downey County Water District's issue regarding disposition of certain
proposals made by the District in lieu of the terms and provisions of the
judgment as entered. The letter was accepted and filed.
(3) A letter from John W. Thompson regarding development of a
medical center by private capital.
(4) And on the same subject of a municipal hospital in Downey, a
letter from Maurice L. McAlister together with a report from the Chamber
of Commerce on its recommendations for a hospital. It is the feeling of
the Chamber of Commerce that the matter, in order to be resolved, should be
placed before the vote of the people for them to decide if they definitely
feel there is a need for a municipal hospital. Mr. McAlister requested
that the report be accepted and taken under submission.
Councilman Morton and Councilman Skinner complimented Mr. McAlister
on the thorough job he had done and on the final report resulting from it.

Reverend Rodney V. Cogswell read a resolution which had been
adopted by the Board of the Hospital at their last meeting and gave
some statistics relative to the cost of a hospital to the taxpayers
on a general revenue bond basis. He does not believe the taxpayers
would have to put anything into it, although this could be changed by
certain phases which might enter into it which may now be unforeseen.
The City Clerk informed Council that a special election would cost
in the neighborhood of $10,000 and that the only savings to be gained
would be through cutting down on the precincting. It was doubted that
the cost could be shaved very much lower than that figure, in her
estimation.
It was moved by Councilman Corbin, seconded by Councilman Skinner
and so ordered that the report on the hospital from the Chamber of
Commerce be taken under submission.
Al Springer, President of the Chamber of Commerce and a member of
the Downey Hospital Board was recognized by the Mayor and stressed that
they have the interests of the citizens of Downey at heart in carrying
out their program for the coming year.
(5) A letter from Rev. Frank Peters, President of the Ministerial
Association, requesting use of the, City Hall lawn areas and /or parking
areas for the purpose of Christmas displays to be participated in by the
churches, schools and community. Reverend Peters outlined the plan for
this Christmas program.
It was moved by Councilman Peavey, seconded by Councilman Morton and
so ordered to approve the program and direct the City Manager to work with
the Ministerial Association in planning the Christmas display program to
be set up for the City Hall lawn area.
(6) A letter from Olson Surveying Service, Inc. appealing to the City
Council to eliminate the sidewalk on a portion of Tract #27524 as a condi-
tion of the Planning Commission, as this property is not a part of the sub-
division. Mr. Griselle outlined the action taken by the Planning Commission,
stating the property is to be split in order to allow the rest of the property
to come under the subdivision.
There is no ruling in the Downey Code relative to the appeal of conditions
placed on a tract by the Planning Commission. Therefore, it was moved by
Councilman Peavey, seconded by Councilman Morton and so ordered that the matter
be referred to the City Attorney for review.
Lee Felts, 12107 Woodruff Avenue, representing the property owner and
also the developr of the property brought up the subject of grading require-
ments in the City of Downey (and also on this property).
Mr. Spindel gave a resume of the requirement for 1% grading which is
almost unified throughout this area and that the 1% grade is also a
requirement of F.H.A. It was recommended also that this matter be referred
to the City Attorney for review.
(7) A request from the United Nations requesting that a representa-
tive be appointed to the United Nations Committee (a Downey chairman). The
letter was referred to the City Manager.
(8) A request from the League of California Cities for appointment of
a member to the Committee on International Municipal Cooperation.
It was moved by Councilman Peavey, seconded by Councilman Skinner and
so ordered that Councilman Ben Corbin be appointed to serve on the Committee
on International Municipal Cooperation and that the League of California
Cities be notified.

(9) A letter from the Downey Board of Realtors submitting a
copy of a notice to them stating they were chosen first place winner
in a contest to determine the best Realtor Week observances earlier
in the year. The letter was accepted and filed with congratulations
to the Downey Board of Realtors.
-- (10) A letter from Burke, Williams & Sorensen, advising that in
the case of Stevenson vs. City of Downey (Stonewood Center) the supreme
court has refused to hear arguments, thus affirming the District Court
of Appeals' opinion.
(11) A letter from Mr. William D. Greschner outlining the status
of his land acquisition program and four -phase construction plans for
the development of the Downey Exchange Center was reviewed by the City
Council and the following action taken in accordance with recommendations
of the Board of Parking Commissioners at a meeting held on March 2, 1962.
It was moved by Councilman Peavey, seconded by Councilman Skinner and
passed by the following vote that the following actions be taken in accord-
ance with the recommendations of the Board of Park Commissioners at their
meeting held on March 2, 1962:
A. Order a legal description of the area to be acquired and a
description of the improvements proposed.
B. Direct the City Attorney to prepare an Ordinance and proper
Notice of Hearing thereon be given.
C. Authorize hiring Jack Mann to make preliminary appraisals on
the property in question.
D. Report to the Board of Parking Commissioners for action asking
for further study and recommendation.

(12) A letter from Councilman Stephen G. Skinner, Jr. recommending
Mr. Ira L. Watson and Mrs. Nelda Ott to serve on the Youth Advisory Commit-
tee for the coming year.
Councilman Corbin recommended the following appointments be made to
the named committees:
Chester R. Baldwin, Sister City Committee
Edwin G. Giddings, City Charter Committee
Councilman Morton recommended the following appointment:
Dr. Ben Pacheco, City Charter Committee
Mayor Temple recommended the following appointments:
Darryl Shumway, City Charter Committee
Russell Solomon, Sanitation Committee
It was moved by Councilman Skinner, seconded by Councilman Morton and
so ordered that the appointments to the various citizens committees be
approved as recommended by Council.
(13) A letter from Russell Solomon, a candidate for the Park and
Recreation District Board was read in full by the City Clerk which set

forth his platform on county ownership of Downey parks and tax support
of parks outside the City of Downey. The letter was ordered accepted
and filed.
(14) A claim for damages from Katherine L. Becker in the amount of
$15,000 arising from an accident on July 27, 1962.
It was moved by Councilman Corbin, seconded by Councilman Morton
and so ordered that the claim of Katherine L. Becker for damages be denied
and the matter referred to the insurance carrier and the City Attorney.

COMMENDING THE CITY OF DOWNEY FIRE CHIEF, OFFICERS AND
MEMBERS, AND CITIZENS' FIRE ADVISORY COMMITTEE

RESOLUTION NO. 1032
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
COOPERATING IN AN ENDEAVOR BY THE COUNTY OF LOS ANGELES TO
DO ALL THINGS NECESSARY AND PROPER TO PROPOSE AND SUPPORT
ANY NECESSARY AMENDMENTS AND MODIFICATIONS OF EXISTING
LEGISLATION, ADMINISTRATIVE ORDERS OR POLICIES OF THE STATE
TO PROVIDE THAT ALL CITIES OF LOS ANGELES COUNTY CAN QUALIFY
FOR SUCH FINANCIAL ASSISTANCE IN THE SAME MANNER AS THOSE
CITIES CONTIGUOUS TO THE RURAL AREAS

more Federal funds to be applied to streets and highways in cities.

so ordered that the letter from the Los Angeles County Health Department be
spread in the minutes of the City Council relative to sanitary sewers for
Assessment District No. 22, Duesler Lane, in the City of Downey.

"SUBJECT; Sanitary Sewer Assessment District No. 22, Duesler Lane,
City of Downey.
"RECOMMENDATION: It is respectfully recommended that sanitary sewers be
installed in this district.
"ANALYSIS: This department has made an investigation of Sanitary
Sewer Assessment District No. 22, Duesler Lane, City of
Downey, as shown on the attached map. During the course of this investiga-
tion, 11 house -to -house calls were made. Of this number, 2 occupants were
not at home or did not answer the door. Of the 9 property owners or
tenants actually contacted 4 or 44.4% reported having experienced trouble
with their individual subsurface sewage disposal systems. They complained
that the seepage pits filled up causing raw sewage to back up into the
house plumbing fixtures or to overflow onto the surface of the ground.
Also that frequent pumping and cleaning out of the seepage pits or the
construction of new pits was necessary.
"The soil within the area of this proposed sanitary -sewer district consists
mostly of a fine silty sand. This type of soil is not conducive to the
proper functioning of any type of individual subsurface sewage system as it
has poor leaching qualities.
"In view of our survey, I, the undersigned Health Officer of the County of
Los Angeles, having been officially designated by the City Council of the
City of Downey to perform public health services for the City of Downey,
do hereby recommend that proceedings be instituted at once for the con-
struction of sanitary sewers in the Duesler Lane, Sewer Assessment District
No. 22, City of Downey, as an improvement necessary to the protection of
public health. This recommendation is made pursuant to the provisions of
Section 2808 of the Streets and Highways Code."

It was reported by Mr. King that in acquiring the right of way for
the widening of Brookshire Avenue, it was determined that because of
severence damage to Lot No. 27, which is the subject lot located south-
easterly of Brookshire and Avon, it would be more economical to purchase
the entire 50' x 140' lot. The cost of the remaining unused portion of
the lot, based on the total amount paid for the land, is $3,373.25. In
order to recover the above amount of money spent, it is recommended that
this portion of the lot be sold at a cost of not less than $3,373.25.

The City Manager reported that the Rose Float Committee has made
arrangements for Miss Downey, Queen Lee Ann Patten, to fly to Guadalajara
on Thursday, September 13, so that she may take part in their events and
ride on the Downey Float in the Guadalajara Independence Day parade. It
is recommended the City Council send a delegate from the City of Downey
to accompany Miss Patten.

any other councilmen who can go, be authorized reasonable and necessary

The City Manager read in full the contract between the City of Downey
and the Downey Parks, and Recreation District.

District Board with a transmittal letter requesting a change in the can-
cellation period from 90 to 60 days and that the word "warehouse" in the

that Council accept the improvements completed on Tract No. 24197 and
release the cash deposit in the amount of $33,200.00, retaining $3,000
for grading (Ratliffe Street and Clark Avenue). Passed by the following

The City Manager reported that it has been recommended by the
Traffic Committee and agreed by the Council that in lieu of installing
traffic signals at the intersections of Ratliffe and Woodruff, and
Dunrobin Avenue and Imperial Highway, in order to accomodate the school
children's walking to school, an attempt would be made to acquire the
right of way on the east side of Woodruff Avenue southerly of Imperial
Highway and construct street improvements, including sidewalk, in order
that the school children could walk to the signalized intersection at
Imperial and Woodruff. The property owners have agreed to dedicate the
necessary right of way in return for the City's construction of the
improvements.
The estimated cost of the improvements is $10,000. In order to
finance these, it is recommended that $5,000 be transferred to this
project from the General Government Capital Improvement Projects,
specifically, the City's share of the proposed traffic signal at Telegraph
Road and Serapis Avenue, since it dQea not appear that this signal will
be constructed this year. It is believed that the remainder of the
project can be financed from County Aid or State Gas Tax Funds.

The City Manager reported that a sixty -day option was granted the
City on July 16, 1962, by Mr. and Mrs. Loyd Wallar to purchase two lots
located at 8137 -1/4 and 8137 -1/2 Second Street at the price of $7,950
each. The owners have indicated they prefer the execution of this option
rather than extending it for another 60 -day period. Therefore, it is
recommended that Council authorize the City Manager to enter into escrow
proceedings in accordance with the option dated July 16, 1962, and that
funds in the amount of approximately $16,000 be authorized for the pur-
chase of these properties from the Unappropriated Reserve Fund.

A rough draft of a proposed letter to the Administrator of the
General Services Administration, stipulating the City of Downey's
continued interest in the acquisition of the old Post Office site at
Second and La Reina, was submitted to Council for its approval.

and passed by the following vote that the City Manager be authorized to
proceed to acquire the old Post Office Site and change the wording in
the letter to "our former mayor ".

The City Manager requested a clarification of the mileage rates
for employees who drive private cars on City business, at the following

Councilman Peavey reported that he has been receiving numerous tele-
phone complaints relative to drive -ins that remain open all night, their
nuisance, and he recommended that Council arrange to accompany police
department personnel to inspect some of these drive -ins as he feels there
should be some further regulation if there is a nuisance factor.
Mayor Temple reported Dr. Joseph M. Oyster has requested permission
to conduct a heart fund drive in the City of Downey. The matter was re-
ferred to the City Manager and the Chief of Police.
Mayor Temple reviewed a letter from the Mayor of Racine, Wisconsin,
expressing appreciation for a plaque presented him by Dr. Ralph Christensen
of the City of Downey relative to his cancer crusade.
Mayor Temple reported that he had received a letter of resignation
from Pat Erhart from the Sanitation Committee.
It was moved by Councilman Skinner, seconded by Councilman Peavey and
so ordered that the resignation of Pat Erhart from the Sanitation Committee
be accepted with regret.
