HomeMy WebLinkAboutMinutes-04-13-62-Regular Meeting14,4 MINUTES OF THE CITY COUNCIL OF THE CITY OF DOWNEY AUGUST 13TH, 1962 The City Council of the City of Downey held a regular meeting in the Council Chamber of the Downey City Hall at 7:30 P.M., August 13, 1962, Mayor Scott Temple presiding. PRESENT: Councilmen: Peavey, Corbin, Skinner, Morton, Temple ALSO PRESENT: Oren L. King, City Manager A. C. Gabriel, Director of Finance Ervin Spindel, Director of Public Works Lee Leavitt, City Engineer Sherman Griselle, Director of Planning Ivan A. Robinson, Chief of Police Robert G. Gain, Fire Chief Ray Lake, Director of Building & Safety Don Robison, Administrative Assistant Della Doyle, City Clerk Alberta Pfeiffer, Deputy City Clerk Mayor Temple recognized Lee Felts for his long and valuable service as a Planning Commissioner and presented him with a plaque, thanking him for a job well done. Councilman Peavey stated Lee Felts had done an outstanding job on the Planning Commission. Councilman Corbin stated he appreciated the help awarded him during his term on the Planning Commission. Councilman Skinner stated Lee Felts was one of the staunch members during the early days of the Planning Commission. Councilman Morton stated he is very, very much impressed with the calibre of people serving the City of Downey and that he believes Downey is head and shoulders above other cities around. He commended Mr. Felts for the work which he has done. Sherman Griselle, Director of Planning, stated Commissioner Felts was a great assist to him and that he appreciated all the fine work Lee has done for the Commission. He was always there when he needed him for some support and he certainly appreciated the work he did for him. Mr. Felts stated he felt it a real honor to have the City Council of the City of Downey give him their vote of thanks and hopes he has done some good for the City, one all can be proud of. Councilman Skinner advised he wished to appoint Mrs. Mary Lou Woods to the Library Advisory Board. RESOLUTION NO. 1013 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY APPROVING THE APPOINTMENT BY THE MAYOR OF A MEMBER TO THE LIBRARY ADVISORY BOARD The resolution was read in full appointing Mrs. Lou Woods whose term expires June 30, 1965. Sherman Griselle, Director of Planning, presented a resume of this zone case. Mayor Temple inquired of the City Clerk if she had the affidavit of publication of the public hearing. The City Clerk replied she had the affidavit. Mayor Temple ascertained that there were no written and no oral pro- tests. Leslie Olson, 10002 Tristan Drive, representing the seven applicants in Zone Change #88 spoke for the z,ne change and stated he feels, as do the applicants, that the change would be a good advance in the City of Downey. It was moved by Councilman Skinner, seconded by Councilman Corbin and so ordered that the hearing on Planning Resolution #72, Zone Change #88 (Marie Johnson, et al. - 8040 - 8142 Stewart and Gray Road) be closed. ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE ZONING MAP ADOPTED BY SECTION 9107 OF THE DOWNEY MUNICIPAL CODE (PLANNING RESOLUTION NO. 72, ZONE CHANGE #88) The ordinance was read by title only. It was moved by Councilman Skinner, seconded by Councilman Morton and so ordered that further reading be waived. The City Clerk reported on the following written correspondence: (1) A letter from Glenn T. Stevens, 7857 Cole Street, Downey, appeal- ing the decision of the Planning Commission in Zone Exception Case No. 305. It was ordered that a hearing be set for 7:30 P.M., September 11, 1962, on Zone Exception Case No. 305, in the Council Chamber of the Downey City Hall. (2) A letter from Standard Oil Company of California requesting per- mission to conduct a long range geophysical reconnaissance program in the City of Downey. The City Manager stated that this has been done previously on the same type program with Council approval. 1446 It was moved by Councilman Corbin, seconded by Councilman Peavey and so ordered that permission be granted to Standard Oil Company as requested. ORDINANCE NO. AN ORDINANCE OF THE CITY OF DOWNEY AMENDING CHAPTER 2 OF ARTICLE IV OF THE DOWNEY MUNICIPAL CODE BY ADDING THERETO A NEW PART TO BE DESIGNATED PART 6 AND CON- SISTING OF SECTION 4290 THROUGH 4290.8, ALL RELATING TO THE RAISING AND KEEPING OF WILD OR VICIOUS ANIMALS OR REPTILES The ordinance was read by title only. Chief Robinson of the Police Department outlined the reasons for requesting passage of the ordinance. Mrs. Leona Aldrich, Chairman of the Sister City Committee and other members of the committee were introduced. Leonare Viscara was called upon to interpret for the students in the presentation to them by Mayor Temple of certificates as Honorary Citizens of the City of Downey. The president of the student body from Guadalajara acknowledged City of Downey's hospitality, with Leonare Viscara interpreting. ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING SECTION 6603 OF THE DOWNEY MUNICIPAL CODE WHICH SAID SECTION RELATES TO AUCTION SALES The ordinance was read by title only. After a summation of the bids for A.D. #59 improvements it was moved by Councilman Corbin, seconded by Councilman Skinner and so ordered that the bid be awarded to the lowest and best bidder, Oswald Bros. Company, in the amount of $31,392.51, and that all other bids be rejected. Council directed that they be notified if the bid price, based on estimated quantities, should go over the estimate. The error resulted in discrepancies in legal descriptions of the properties which were cleared. Councilman Peavey stated the City should be able to go back to the contractor. The contract should not be paid if the work has not actually been done. Councilman Peavey stated next year's contract should stipulate that this can be done so that the City could be reimbursed. Mayor Temple asked for the vote on the motion approving weed abatement reimbursements. AYES: 5 Councilmen: Peavey, Corbin, Skinner, Morton, Temple. Henderson, 8112 Brookgreen Road, Downey, be denied and referred to the insurance carrier for the City of Downey and the City Attorney. Councilman Skinner suggested that copies of the Traffic Committee's Report be forwarded to members of the Citizens Traffic Committee and that they be included in meetings of the technical committee. The City Manager reported on the following items: Use of the corner property at Second and LaReina Streets recently purchased by the City of Downey. The suggestion was made that this corner be utilized for temporary parking beginning November 1, until the permanent parking lots are completed and improved under the Parking District. Council- man Skinner suggested obtaining the recommendation of the Parking Place Commissioners. Due to the cost of asphalt topping this lot after removal of the buildings, Council recommended taking no action toward converting the property into a parking lot at this time until further study is made. AYES: 5 Councilmen: Peavey, Corbin, Skinner, Morton, Temple NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Studies revealed that Pay TV is still in the exploratory stage and has not achieved a very great measure of success to date. It was rec- ommended that City Council consider the following recommendations prior to approving any application for Pay TV franchises in the City of Downey. 1. That applicant present in detail the type of system to be used, its effect upon present television reception in this area, and the Federal regulations concerning it. 2. If a franchise is granted, it should not be "exclusive ", at least until the time in which the progress and general standards of Pay TV have been established in a more definite manner. Council took no action at this time in the matter of Pay TV franchises in the City of Downey. To add to the attractiveness, useability and convenience of the multi - purpose room of the City Library the Library Advisory Board has recommended purchase of a table and 75 chairs. The recommendation that Council author - ize obtaining quotations for the purchase of this furniture at an estimated figure not to exceed $1,750 from Operating Reserves was held for further study. It was moved by Councilman Peavey, seconded by Councilman Skinner and passed by the following vote to authorize preparation of plans and specifications and estimated cost for planting of medians easterly from Lakewood Boulevard to the easterly City Limits. It was moved by Councilman Peavey, seconded by Councilman Skinner and passed by the following vote to authorize attendance at the following con- ventions with tourist transportation and reasonable and necessary expenses allowed: Fire Chief to International Association of Fire Chiefs' Conference at Toronto, Canada, September 24 -27, 1962 City Manager to International City Managers' Association Conference at Philadelphia, October 14 -18, 1962 AYES: 5 Councilmen: Peavey, Corbin, Skinner, Morton, Temple NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None 1.4'43 It was moved by Councilman Corbin, seconded by Councilman Peavey and passed by the following vote to approve transfer of funds in the amount of approximately $6,000 to $7,000 from Operating Reserves for enlargement of Police Department facilities to accomodate booking, mugging, and printing facilities adjacent to the existing holding tank; enclosure of the space between the holding tanks and the squad room to provide facilities for interrogation room and arsenal; and the closing of the area immediately north of the squad room to house bicycles and recovered property. AYES: 5 Councilmen: Peavey, Corbin, Skinner, Morton, Temple NOES: O-- Councilmen: None ABSENT: 0 Councilmen: None A report from the Civil Defense Advisory Committee relative to a survey and recommendation that the City purchase 12 additional area sirens which had been taken under submission previously by Council was requested by the committee to be brought back to the attention of Council. The cost of these sirens is $24,000, with the government to pay half and the City to pay half. Councilman Peavey recommended further study relative to the possibil- ity of future height and density of the Downtown Business District relative to such sirens. After a summation of bids for compact cars for the Building Department, it was moved by Councilman.Skinner, seconded by Councilman Peavey and passed by the following vote to award the bid to the sole bidder, Downey Auto Center, in the total amount of $6968 and authorize the following transfer of funds: AMOUNT $1080 5888 6968 Total AYES: 5 Councilmen: NOES: 0 Councilmen: ABSENT: 0 Councilmen: FROM TO 9- 3810 -221 9- 3810 -621 Operating Reserve 9- 3810 -621 Peavey, Corbin, Skinner, Morton, Temple None None The City Manager read a letter which had been prepared to send to Downey Avenue property owners indicating the City will request dedication of only 18 feet of right of way from those properties which have not yet dedicated the full street right of way, making the total dedication 38 feet from the centerline on each side. It also agreed that the curbs on the west side of the street will be 30 feet from the centerline throughout this section of Downey Avenue. The statement that the City of Downey agrees that sidewalks will be constructed only if they are desired by a majority of the adjacent property owners was questioned by Council. Councilman Peavey stated there should be sidewalks. Councilman Corbin stated they should be uniform throughout. The possibility of having the sidewalks at the curbline was discussed. Councilman Morton stated he feels the citizens should be informed of just what the City intends regarding sidewalks and that rather than deleting entirely a statement relative to sidewalks, there should be clarification of this detail. 1414 It was moved by Councilman Peavey, seconded by Councilman Corbin and passed by the following vote to approve the letter as recommended by City Manager Oren King, directed to the property owners on Downey Avenue, with the deletion of the sentence regarding sidewalks. Mr. King reported that the Annual Report circulated throughout the City is ready to go to press for mailing. Councilman Skinner suggested deletion of the "plus 25(,% Park District" and listing of all special tax districts. Also, he suggested adding the City Hall address and telephone number to the brochure. Councilman Peavey suggested that a statement that the Park District tax is not under the control of the City but does have to be paid by the tax- payers in the City of Downey be included. Councilman Morton suggested adding "Not under the control of the City" or It levied by the City Administration ", after the Park District tax. The City Manager was directed to clarify this portion of the brochure. Councilman Morton wished to clarify his comment relative to the motion regarding the letter directed to the Downey Avenue property owners in that he feels the City should tell the people what is intended; that he is very much in favor of sidewalks and feels the City needs a sidewalk program throughout the City and he hopes next year something can be started toward this end. Councilman Skinner ascertained that improvements proposed for Rutgers Avenue are proceeding according to schedule with design and preparation of plans and specifications in progress. Councilman Skinner requested Council and the City Manager to make a field trip regarding the feasibility of a new fire station in District #2. The City Manager clarified the question of ownership of a bomber which was proposed to be placed in the new Dennis the Menace Park, stating that it is a Park District problem and not the City of Downey. Councilman Skinner recommended the reappointment of Michael Kearns to the Parking Place Commissioners.
