MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
SEPTEMBER 25TH, 1962
The City Council of the City of Downey held a regular meeting in
the Council Chamber of the Downey City Hall at 8:00 A.M., September 25,
1962, Mayor Scott E. Temple presiding.
PRESENT: Councilmen: Peavey, Corbin, Skinner, Morton, Temple

Reverend Austin Coe of the Downey Memorial Christian Church delivered
the invocation.
Mayor Temple announced that Mayor Pro Tem William J. McCann and Com-
missioner of Peace Officer Standards and Training would like to make a
presentation. Mr. McCann stated he wished to present a check in the amount
of $1,353.60 as the 1962 reimbursement to the City of Downey from the
California Peace Officers' Training Fund for the City's participation in
this program and by adhering to or exceeding the minimum standards for the
selection and training of police officers, the City of Downey has voluntarily
joined over 250 California cities and counties in maintaining the highest
standards of law enforcement in the nation. Mr. McCann commended the City
of Downey on its progress, stating that the foremost and most outstanding is
the achievement of the Police Department. The check was presented to the
Chief of Police, Ivan A. Robinson, and Mayor Temple. The check was accepted
by Chief Robinson with much humility.
Mayor Temple stated that now is the time and place set for the hearing
on the appeal to Zone Change #89, E. Mason by Vernon Blythe, 7952 Cole Street.
, Sherman Griselle, Director of Planning, gave a resume of the previous
proceedings in Zone Change #89.
The Mayor asked the Deputy City Clerk if she had the affidavit of
publication of the hearing. The deputy reported she had the affidavit.
Speaking in favor of the Zone Change #89 were Vernon Blythe, 10911 Old
River School Rd., who stated he is developing the property due to the ill
health of Mr. Mason. He stated he feels it is reasonable to change this
zoning as the area had lost the A -1 and C -2 usage. He stated that the, zoning
had been previously C -1 on this property and this had been removed and
changed to R -1. A plan was submitted for the proposed use of the property,
should it be changed to an R -3 zoning. The City Attorney advised Council
that such plan is not binding but is merely an intention on the part of

Letters from Henrietta M. Durston, 7969 Brunache Street, Downey
And Arthur Frakes, 7.955 Brunache Street, were submitted by Vernon Blythe in
evidence that they are in favor of the R -3 zoning.
It was moved by Councilman Corbin, seconded by Councilman Skinner and
so ordered that the letters be accepted and filed.

Mr. Griselle was asked to clarify the statement by Mr. Blythe that
the zoning previously had been C -1. Mr. Griselle pointed out on the map
that zoning follows the property lines and would not cross a property
line or be a criss -cross line. He stated that the property line is a
zoning line. Mr. Griselle was asked to check past records to determine
if the zoning formerly was C -1.
Speaking further for the zone change were Kenneth Craun, 10703 Haledon
Street who stated he owns property at 11943 Paramount Boulevard and that his
father owns property at 7955 Cole Street.
Speaking against the zone change #89 were:
Derryl Shumway, 7911 Cole Street
W. J. Downing, 12012 Samoline Lane
Mr. Downing read a petition signed by 38 property owners who object to
the zone change. The petition was presented to Council for the record.
It was moved by Councilman Skinner, seconded by Councilman Corbin and
so ordered that the petition be received and filed.
Speaking further against the zone change were:

The Mayor asked if there were any letters protesting to Zone Change #89.
The Deputy City Clerk reported one letter received in protest from Mrs. Lloyd
Lynd.
It was moved by Councilman Skinner, seconded by Councilman Morton and
so ordered that the letter be received and filed.
Mr. Blythe presented his rebuttal, after which Mr. Griselle reported
that on the easterly edge of the property the records indicate there were
between 12' or 15' of C -1 zoning. This had been placed on the property by
the County of Los Angeles and it had since been adjusted to conform to the
property line.
Council was advised by the City Attorney that it may request the Plan-
ning Commission to submit a report giving the history of the zoning on the
property and such adjacent property as designated by them, but any findings
would not change the present zoning or zone boundary, which is only 10 -15'
that would have been C -1.
It was moved by Councilman Peavey, seconded by Councilman Skinner and
so ordered that the hearing on the appeal to Zone Change #89 be closed.
It was moved by Councilman Peavey, seconded by Councilman Morton and
passed by the following vote that the appeal to Zone Change #89 be taken
under submission.

It was moved by Councilman Peavey, seconded by Councilman Corbin and
so ordered that the minutes of September 11, 1962 be approved as written.
The Deputy City Clerk reported on the following written correspondence:
(1) A letter from Ray L. Mayfield, Attorney for Harvey's Broiler,
assuring the City of Downey and its officers of the desire of Harvey's to be
law abiding citizens and of their intent to cooperate with every
reasonable request that the City may make.
(2) A letter from Reverend J. T. Chase requesting some positive
control over the disturbance and litter nuisance surrounding Harvey's
Broiler.
(3) A letter from Josephine Miller, 10708 Old River School Road,
protesting the noise, littering, drag racing and speed in and around
Harvey's Broiler, and suggesting tighter curfews.
Chief of Police Robinson was asked to report on the situation at
Harvey's Broiler and his figures over a month and a half survey showed
that there were 10 complaint calls reported for Harvey's Broiler in com-
parison to 33 calls against MacDonald's. This is not just a Downey
problem, but one in other vicinities, such as Glendale. At the present
time Chief Robinson stated he would recommend surveying the suggestions
that there might possibly be some type of legislation for curtailing
the closing hours of such drive -ins.. It is his feeling that the owners
of the drive -ins are the victims rather than the trouble makers ... the
victims of irresponsible teenagers not being properly trained by the
parents in the first place, and those that do not have sense enough to
follow the laws their parents set down. Curfewing, policing and strict
enforcing are never satisfactory to an R -1 residential area.
The City Attorney advised that he will research and report to
Council on any possible ordinance or legislation.
Chief Robinson stated the Law and Legislative Committee has already
been contacted, as well as the League of California Cities Law Enforcement
and City Problems Committees.
It was moved by Councilman Morton, seconded by Councilman Peavey and
so ordered that Council support the stand taken by the Police Chief in
relation to the problem of drive -ins in the City of Downey.
(4) A letter from the chairman of the Christmas Lane Parade of
Huntington Park was referred to the Downey Chamber of Commerce relative to
the possibility of the City of Downey's participation in the parade.
(5) Two damage claims arising from an automobile accident between
claimants and a City police car: Mrs. ,Karen H. Lee in the amount of
$5,000, plus other expenses unknown at this time, and James Alfred Lee, Jr.
in the amount of $2500, plus $100 property damage, $173 auto damage, $40
medical bills, plus other expenses unknown at this time.
It was moved by Councilman Corbin, seconded by Councilman Morton and
so ordered that the claims be denied and referred to the insurance carrier
and the City Attorney.
RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
DECLARING ITS INTENTION TO VACATE A PORTION OF VIA
AMORITA LYING NORTHWESTERLY OF SHERRY AVENUE, AS SHOWN
ON TRACT NO. 14227
The resolution was read by title only. Mr. Spindel stated the matter
was considered by Council previously in November, 1961, at which time it
was held in abeyance for the purpose of future consideration as to compen-
sation which might be received for this vacation. The City Attorney's office
has advised that no compensation can be requested in consideration of the
vacation of a street.

After discussion it was moved by Councilman Peavey, seconded by

RESOLUTION NO. 1041
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
DECLARING ITS INTENTION TO VACATE THE FUTURE AND PRIVATE
STREET LYING NORTHERLY FROM ADWEN STREET WITHIN TRACT
NO. 15475
The resolution was read by title only. Mr. Spindel reported that it
had been requested by the property owners of the area extending northerly
of Adwen Street and parallel and westerly of Old River School Road, which
is a future and private street, be vacated. The matter had been consid-
ered by the Planning Commission with the recommendation that the street be
so vacated.
It was moved by Councilman Corbin, seconded by Councilman Peavey and
so ordered that further reading of the resolution be waived.
It was moved by Councilman Corbin, seconded by Councilman Peavey and
passed by the following vote that Resolution No. 1041 be adopted.

The City Attorney reported that the low bidder for Cash Contract #76
for miscellaneous paveouts within the City of Downey had submitted a 10%
surety bond, which was executed by the bonding company but was not signed
by the principal or bidder although it is noted that his signature is
witnessed. The bid is from $3,000 to $4,000 lower than the engineers'
estimate. In the opinion of the City Attorney, inasmuch as the statutes only
require that the bond be executed by the surety and inasmuch as there is
nothing in the bond that says that it is not valid, if notsigned by the
principal, so long as the principal has actually submitted this bond with
a bid duly executed, if the Council wishes, it may award the contract
to Mr. E. H. Phillip Smith, who appears to be the low bidder.
Mr. SnfLth was asked to come in to sign the bond, it was reported by
Mr. Spindel, and at that time he stated he was not interested in pursuing
the bid.
Mr. James Bedner, attorney representing Mr. Smith, also present at the
Council Meeting, 5901 W. Third Street, Los Angeles 36, stated that Mr. Smith
was guilty of clerical errors in his bid and that as it is the viewpoint
of the surety in this case that the bond very clearly shows that Mr. Smith
had anticipated signing it, the bond to be delivered only if and when he
intended to sign it. He states he feels Council should either readvertise
or award to the next low bidder.
Councilman Morton asked for clarification as to whether the bids
received are estimates. Mr. Spindel stated that there is no way of knowing
what the final amount will be; however, the quantities would be very close
to the final amount and would not vary much appreciably.
After much discussion, it was moved by Councilman Skinner, seconded by
Councilman Peavey and passed by the following vote that all bids on Cash
Contract #76, Miscellaneous Paveouts in the City of Downey, be rejected and
authorize readvertising for bids.

The City Attorney requested that matters needing his attention be con-
sidered next on the agenda as it was necessary that he leave very shortly.
The City Manager read a rough draft of a letter directed to Mr. T. Yale
Hurt, who is in charge of the County study relating to the location of the
Superior Court site.
The letter advised that Council had approved acquisition of an
adequate site for the proposed Superior Courts Building in the City of
Downey in the block between Second and Third Streets on LaReina Avenue,
immediately west of the three municipal courts. This site consists of two
acres for the court house and parking for court officials and attaches.
Sufficient parking will be provided on three adjacent sites to accomodate
Superior Court needs at this location.
The City Council also agreed (stated the drafted letter) that it would
furnish this site for the Superior Courts at no cost to the County of Los
Angeles. This action was taken with the sincere feeling that this site is

the best suited for the location of the proposed Superior Courts
building due to its proximity to the population center, geographical
center, and criminal case load center of the Southeast Superior Courts
center.
Councilman Peavey inquired about the feasibility of having a lease
arrangement. The City Attorney advised it could be conveyed and there
is some merit in a lease. The wording in the first sentence of the
second paragraph was advised changed to read "Council also agreed to
make this site available" instead of "furnish this site ".
It was moved by Councilman Peavey, seconded by Councilman Morton
and passed by the following vote to authorize the Mayor to sign the
letter with the recommended change of the City Attorney.

The City Manager gave an outline of the meeting of the Civic Develop-
ment Committee held at 9:00 A.M. on Monday, September 24 and read the fol-
lowing resolution which was passed by them:
"The Civic Development Committee commended the Board of Parking
Commissioners and the City Council on their program of action
in establishing the downtown parking district and setting up
the legal procedures to acquire the first three parking lots
under the 1943 Act. It is now recommended that the Board of
Parking Commissioners and the City Council establish the fourth
Parking lot, consisting of the 85' Firestone frontage between
Firestone and Dolan, as the fourth parking lot in the establish-
ment and development of the downtown center core area, as defined
and recommended in the program of action set forth by Welton
Becket and Associates."
The Committee also suggested that a letter be sent to the merchants in
Stonewood Shopping Center commending them on their improvements of their
shopping area.
The City Manager advised that the additional acquisition would not
increase the assessment beyond the limits specified by the Act.
Mr. King reported that the legal documents are being prepared, the
estimates of cost being prepared and he recommended authorizing the same
procedures be applied to Parcels 3D and 3C in their acquisition program for
off - street parking facilities in this area.
It was moved by Councilman Skinner, seconded by Councilman Peavey and
passed by the following vote that the following actions be taken in accord-
ance with the recommendations of the Board of Parking Place Commissioners
at their meeting held on September 24, 1962.
A. Order a legal description of the area to be acquired and a
description of the improvements proposed.
B. Direct the City Attorney to prepare an Ordinance and proper
Notice of Hearing thereon be given.
C. Authorize hiring Jack Mann to make preliminary appraisals on
the property in question.
D. Report to the Board of Parking Commissioners for any further
action necessary.

off - street parking facilities in this area.

passed by the following vote that the following actions be taken in accord-
ance with the recommendations of the Board of Parking Place Commissioners
at their meeting held on September 24, 1962.
A. Order a legal description of the area to be acquired and a
description of the improvements proposed.

Notice of Hearing thereon be given.

The Director of Public Works stated his department has worked
over the past several months in the acquisition of right of way on
Downey Avenue between Florence Avenue and Gallatin Road. There are
still a number of parcels from which right of way has not been ac-
quired. A tentative time limit of October 1, 1962 for the acquisition
of the necessary right of way has been set and it is recommended that
any right of way not acquired by that date be processed for condemnation
action. It was also recommended that Council grant authority at that
time to proceed with condemnation; grant authority to retain an appraiser;
and grant authority to retain the firm of Burke, Williams & Sorensen for
the condemnation proceedings.
It was moved by Councilman Peavey, seconded by Councilman Corbin
and passed by the following vote to set a tentative time limit of
October 1, 1962, for the acquisition of the necessary right of way and
that any right of way not acquired by that date be processed for condemna-
tion action; that authority be granted to proceed with condemnation; grant
authority to retain an appraiser; and grant authority to retain the firm
of Burke, Williams & Sorensen for the condemnation proceedings.

Mr. Spindel requested that Council authorize the City Manager to enter
into an agreement with the Los Angeles County Flood Control District to
delete the trench resurfacing over the storm drain in Myrtle Street from
4th Street to 5th Street and reimburse the City's Capital Improvements Fund
for this deletion in the estimated amount of $315.00. This is necessitated
due to the fact that with construction of the storm drain in Myrtle Street
by the County Flood Control District, the curb on the east side of Myrtle
Street between the above limits, has been completely removed. In this
street, even though there is a 60 -foot right of way, the curb to curb width
has been only 24 feet; i.e., 12 feet on each side of the center line, leav-
ing 18 feet of parkways. The District and the contractor have agreed to
reconstruct the curb on the east side of the street to the standard location
20 feet from the center line, with the provision that the City pay for the
additional 8 feet of paving involved. The condition of the existing paving
in Myrtle Street is very poor; therefore, it would leave a situation whereby
over one -half the width of the street would be newly paved, with the remainder
being in a deteriorated condition. It would require just a little additional
to re- surface the entire street.
It was moved by Councilman Peavey, seconded by Councilman Morton and
passed by the following vote that the City Manager be authorized to enter
into an agreement with the Los Angeles County Flood Control District to
delete the trench resurfacing over the storm drain in Myrtle Street from 4th
Street to 5th Street and reimburse the City's Capital Improvements Fund for
this deletion in the estimated amount of $315.00.

Councilman Skinner excused himself from the meeting at 10:10 A.M.
It was moved by Councilman Peavey, seconded by Councilman Corbin and
passed by the following vote to accept the offer of dedication and the
improvements of sanitary sewers under Downey Private Contract #3, Lakewood
Boulevard, south of Lubec Street, and the maintenance thereof.

Edwin T. Powell, Deputy Director of Civil Defense, was requested to
submit his report on a siren warning system to be possibly installed in
the City of Downey.
Councilman Morton inquired about the locating of the sirens at each of
the fire stations which would total 5, and as to whether or not they would
be sufficient to cover the City.
Mr. Powell stated that these would have to be supplemented by others
to be adequate, and that 10 locations throughout the City have been desig-
nated in the survey.
Councilman Skinner returned to the Council Meeting at 10:20 A.M.
Councilman Morton stated that the Civil Defense Advisory Committee has
recommended setting up some home instruction program for citizens to find
some barrier or shelter in his own home. The three effects of a nuclear
attack were outlined by Councilman Morton whoconcluded by stating that
some shelter, even getting behind a blanket, rug or underneath some furni-
ture would afford some protection where shelters were not available.
Edwin Powell stated there will be Federal funds set aside for probably
one -half of the cost of the siren warning system installation and operation.

tions throughout the City, subject to the availability of Federal matching
funds; authorize calling for bids, and approval of funds from unappropriated
reserves in an amount not to exceed $25,000.

The City Manager stated that the City Employees Association has
recommended that Fire Chief Robert Gain be nominated as the Public
Agency member of the Board of Administration of the California State
Retirement System. In this capacity, he will be representing municipal
groups on the State Employees' Retirement Board. It is found that in
checking on the duties and time requirements, it will not be too de-
manding upon his time.
It was moved by Councilman Peavey, seconded by Councilman Skinner
and so ordered to authorize the Mayor and City Manager to write letters
on behalf of Council in support of Fire Chief Robert Gain as the Public
Agency member of the Board of Administration of the California State
Retirement System.
The City Manager reported that copies of suggestions for proposed
"ground rules" in establishing a more definite procedure for the Sister
City activities and relationships with Guadalajara. If City Council
desires, a Downey - Guadalajara headquarters office may be established
without any additional personnel in the present office of Civil Defuse,
and the Civil Defense sign will be changed so they are not placed
together. These proposed rules and regulations have been reviewed by
the Chamber of Commerce, Sister City and Rose Float Committee Chairmen
and they concur in the initial thinking as outlined. It was recommended
that a copy of these proposals be sent to Guadalajara for their sug-
gestions and, in turn, they are to send a copy of their by -laws.
In accordance with a further recommendation of the Board of Parking
Commissioners the City Manager stated that Council might possibly con-
sider leasing the available space from the wrecking of the buildings
adjacent to the Masonic Temple on Downey Avenue between Second and-Third
Streets, as a parking lot. The officials of the Masonic Temple have
advised that the concrete floor of the building will be left, which might
make parking available at very little cost.
It was moved by Councilman Skinner, seconded by Councilman Morton
and so ordered to authorize investigation of the possibility of leasing
space adjacent to the Masonic Temple on Downey Avenue between Sedond and
Third Streets as a parking lot.
The City Manager commended Mr. Spindel, Director of Public Works, on
his Capital Improvement Project schedule prepared and submitted.
There being no further business to come before Council, the meeting
adjourned at 11:20 A.M.
