Temple presiding. PRESENT: Councilmen: Corbin, Peavey, Skinner, Temple ABSENT: Councilman: Morton ALSO PRESENT: Royal M. Sorensen, City Attorney Ervin Spindel, Director of Public Works A. C. Gabriel,Director of Finance Lee Leavitt, City Engineer Sherman Griselle, Planning Director Robert Gain, Fire Chief Ray Lake, Director of Building and Safety Loren Morgan, Deputy Chief of Police Don Robison, Administrative Assistant Lester Bergslien, City Librarian Edwin Powell, Purchasing Agent Della Doyle, City Clerk Alberta Pfeiffer, Deputy City Clerk Reverend Walter R. Armantage of the Congregational Church of Downey delivered the invocation. Mayor Temple introduced John K. Morris, Planning Commissioner com- pleting the unexpired term of Robert Ryan who had resigned from the Planning Commission. Mayor Temple announced that now is the time and place set for the hearing on proposed work changes on Dunrobin Avenue, A.D. #55. The Mayor inquired of the City Clerk if she had received the affidavits of mailing, posting and publication. The City Clerk replied she had the affidavits. Ervin Spindel, Director of Public Works, reported that the proposed work changes were for driveways which had been requested by property owners who were paying for the driveways themselves. The Mayor inquired if there was anyone wishing to comment on the pro- posed work changes. There were none. It was moved by Councilman Corbin, seconded by Councilman Peavey and so ordered that the hearing on work changes in Dunrobin Avenue A.D. #55 be closed. RESOLUTION NO. 974 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ORDERING CERTAIN MODIFICATIONS OF THE WORK TO BE DONE IN ASSESSMENT DISTRICT NO. 55 (DUNROBIN AVENUE AND OTHRR STREETS) The resolution was read by title only. It was moved by Councilman Corbin, seconded by Councilman Skinner and so ordered that further reading be waived. 1409 It was moved by Councilman Skinner, seconded by Councilman Peavey and passed by the following vote that Resolution No. 974 be adopted. AYES: 4 Councilmen: Peavey, Corbin, Skinner, Temple NOES: 0 Councilmen: None ABSENT: 1 Councilman: Morton The Mayor announced that this is the time and place set for the public hearing on confirmation of assessments in A.D. #55, Dunrobin Avenue and other streets. The City Engineer reported that this is the distribu- tion of cost to all who are already in the district. Councilman Skinner recommended that the hearing be continued to the next evening Council Meeting to be held on June 11, 1962, as requested by various property owners in the area. It was moved by Councilman Skinner, seconded by Councilman Peavey and passed by the following vote to continue the hearing on the confirmation of assessments in A.D. #55, Dunrobin Avenue and other streets, to 7:30 P.M., June 11, 1962, in the Council Chamber of the Downy City Hall. AYES: 4 Councilmen: Peavey, Corbin, Skinner, Temple NOES: 0 Councilmen: None ABSENT: 1 Councilman: Morton Councilman Skinner requested that the persons involved in this hearing on A.D. #55 be notified of the continuation of the hearing. It was moved by Councilman Peavey, seconded by Councilman Corbin and so ordered that the minutes of the Council Meeting of May 7, 1962, be approved as corrected. The City Clerk reported that the following written correspondence had been received: (1) A letter from the City Attorney in the matter of the City of Downey vs. Lucci' et al., indicating that the pre -trial in the matter had been continued until November 5, 1962. It was also indicated that it would appear advisable that by the middle of October some determination be made as to whether it is desirable to pursue the matter to a conclusion or whether it should be taken off calendar so that more time will be available to determine whether the subject property can be developed as a single unit. Councilman Peavey inquired as to whether the property owner should be conferred with as to what his desires are, since the property has changed hands. The City Attorney stated that if he proceeds with the lawsuit and recovers the $16,000, then the City is obligated to compldte the improvements. If it is determined that a street is not desired, it would be considered unwise by him to continue with the lawsuit. Mayor Temple advised a decision would be made about the disposition of this matter by the middle of October, and the City Attorney would be so advised. (2) A letter from Lee Felts of May 9, 1962, resigning as planning commissioner, effective immediately. Mr. Felts' term on the commission expires December 31, 1 9 6 4. It was moved by Councilman Skinner, seconded by Councilman Corbin and so ordered that the resignation of Lee Felts from the Planning Commission, effective as of May 9, 1962, be accepted with regret. 1410 (3) A letter from the County Board of Supervisors recognizing the support of the City of Downey of the reapportionment plan. (4) A letter from Mrs. V. J. Shrader, 10357 Mattock Avenue, Downey, relative to the Freedom and Free Enterprise Shelf. Councilman Peavey requested the City Clerk to read the letter in full. ORDINANCE NO. 203 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE ZONING MAP ADOPTED BY SECTION 9107 OF THE DOWNEY MUNICIPAL CODE (PLANNING RESOLUTION NO. 70, ZONE CHANGE #85 (MAX EISMAN, PARAMOUNT BOULEVARD AND BIRCHCREST ROAD) The ordinance was read by title only. Mr. Spindel, Director of Public Works, reported on the improvements proposed on Telegraph Road, Paramount Boulevard and Imperial Highway. The improvements requested are to complete paveouts where curbs and gutters have been recently constructed along Paramount Boulevard and Imperial Highway, and to alleviate a dangerous traffic condition on Telegraph Road. AYES: 4 Councilmen: Corbin, Peavey, Skinner, Temple NOES: 0 Councilmen: None ABSENT: 1 Councilman: Morton 1411 RESOLUTION NO. 976 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY, CALIFORNIA, ADOPTING AN OFFICIAL MAP FOR A PORTION OF THE RANCHO SANTA GERTRUDES AS PER MAP RECORDED IN BOOK 1, PAGES 502 AND 503 OF MAPS, IN THE OFFICE OF THE COUNTY RECORDER OF LOS ANGELES COUNTY The resolution was read by title only. The City Engineer stated that the purpose of the official map is to clarify legal descriptions on properties in A.D. #57, Hall Road, and for the purpose of recording the assessment roll to clarify numerous discrepancies and overlapping descriptions. Councilman Peavey inquired if the metes and bounds descriptions could be limited in order that properties may be referred to as lot numbers. The City Engineer stated that the department of Public Works is in the process of drafting an official map for the Municipal Parking District in the immediate downtown area in which instance lot numbers can be used to designate properties rather than using lengthy legal descriptions. It was established that a public hearing would be set for 7:30 P.M.,-June 11, 1962, in the Council Chamber of the Downey City Hall for work changes in A.D. #57, Hall Road and other streets. The City Attorney reported that the resolution simply changes the work proposed to conform with the work actually done. The changes were minor and the contractor has signed a written agreement consenting to the change. RESOLUTION NO. 982 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY DECLARING ITS INTENTION TO IMPROVE BLODGETT AVENUE AND OTHER STREETS IN THE CITY OF DOWNEY, DETERMINING THAT BONDS SHALL BE ISSUED TO REPRESENT THE COST THEREFOR, DECLARING THE WORK TO BE OF MORE THAN LOCAL OR ORDINARY PUBLIC BENEFIT, AND THAT THE EXPENSE THEREOF SHALL BE ASSESSED UPON A DISTRICT (A.D. #59) The resolution was read by title only. AYES: 4 Councilmen: Peavey, Corbin, Skinner, Temple NOES: 0 Councilmen: None ABSENT: 1 Councilman: Morton Mr. Ervin Spindel, Director of Public Works, reported on various projects as the result of inquiries from City Council. He stated that the obstruction from trees at the intersection of Stewart and Gray Road 1415 and Brookshire Avenue has been corrected as much as is possible to do so under the Municipal Code; that the northwest corner of the intersection of Third Street and Paramount Boulevard has been checked and that the trees and shrubs obstructing the view have been cut back to provide better visibility. It was stated that there is also visual obstruction resulting from vehicular traffic parking along the west side of Paramount Boulevard immediately north of Third Street. The prohibition of parking along this section would certainly improve the sight distances at this intersection. The report on the damaged sidewalk on Fourth Street west of Paramount Boulevard was that it has been scheduled for reconstruction and that work should have commenced on or about May 21. The matter relative to parking on the east side of Paramount Boulevard between Florence Avenue and Seventh Street was referred to in Item 8 of the Traffic Committee Report of April 26, 1962. Mr. Spindel advised that it is proposed that limited parking shall be initiated and that the Department of Public Works is in the process of drafting an ordinance for this purpose which shall be sub- mitted to the City Attorney for his approval. Mr. Lester Bergslien, City Librarian, reported on the library pro- cedures related to the type of books and the manner in which they are chosen by the City Library. So that all may have a better understanding of the procedures of the library, it was suggested that the City Council and Library Board have a joint meeting in the near future for a complete review and discussion of the City Library operations. It was moved by Councilman Corbin, seconded by Councilman Skinner and passed by the following vote that approval be granted for Mr. Bergslien to attend the American Library Association meeting in Miami Beach, Florida, June 17 -23, with necessary expenses allowed. AYES: 4 Councilmen: Peavey, Corbin, Skinner, Temple NOES: 0 Councilmen: None ABSENT: 1 Councilman: Morton It was reported that through the recommendation of Supervisor Bonelli the Los Angeles County has approved the City Council's request for $60,000 for 50% of the improvement of Downey Avenue from Florence to Gallatin Road. Also, it was reported that favorable progress is being made on the right -of way acquisition and the preparation of plans and specifications. The City Attorney reported that condemnation has been filed on the property of Dr. Miller at Cherokee Drive and Downey Avenue and that Dr. Miller is having an appraisal made and will meet again to discuss the possibility of some settlement without proceeding with the litigation. Councilman Corbin recommended trimming the shrubbery at the intersection at Third Street and Paramount Boulevard to improve the viability at that point. Mr. Spindell advised thkt the Department of Public Works is now progressing along that line. Councilman Peavey recommended amending of the ordinance to lower the height requirements from 42" to 36" for shrubbery at intersections. Councilman Skinner also suggested checking the code on wall construction at side yards. The City Attorney advised that the City Concil may set the height re- -- quirements for trees and shrubs in the traffic hazard ordinarc e; however, heights of side walls would have to be taken before the Planning Commission or the Building Department. It was Councilman Skinner's contention that these two items should conform, nevertheless. Councilman Skinner stated he would like the Industrial Survey Report to be checked before it is submitted to the State Chamber of Commerce as he feels the report submitted from Downey should not advertise other cities in competi- tion with the City of Downey. Edwin Powell, Purchasing Agent, advised that the State Chamber recommends the form to be followed in the Industrial Survey Report and that all cities should submit their report in like form. After discussion, it was Council's recommendation that a check be made with the State Chamber of Commerce to determine whether items pertaining to cities other than the City of Downey might be omitted in Downey's Industrial Survey Report. Councilman Corbin retired from the Council Chamber at 9:10 A.M. Mayor Temple read a letter from a resident on the "Island" in District 3 relative to boat and house trailers parked in front yards, side yards, streets and parkways, requesting some enforcement for violators in this matter. Councilman Peavey suggested an inspection be made in order to check violations and work toward legal parking of all kinds of trailers throughout the City. He also stated that trailers and boats parked in front yards affects the entire community and should not be allowed on a permanent basis. Mr. Griselle, Director of Planning, advised the zoning ordinance does not permit trailers to park in a front yard or side yard setback, but it cannot control parking of trailers in the street or parkways. It was reported by him that there are some trailers which have been parked in existing non- conforming use areas for long periods. This was substantiated by the Director of Building and Safety. The City Attorney stated that insofar as parking in the City right -of -way the police can enforce this particular issue. So far as parking in the street, parking of over a particular width or length, there would be the same right to park as automobiles are concerned. Councilman Peavey suggested that the respective departments check to eliminate the problem. Mayor Temple requested an investigation and report to Council on the matter of parking trailers in residential areas. Mayor Temple reported on a letter from the Plumbing Officials Associa- tion requesting that Ray Lake, Director of BuiUng and Safety be designated as a representative of the City of Downey to attend meetings in connection with their association. It was moved by Councilman Skinner, seconded by Councilman Peavey and so ordered that Ray Lake be designated to represent the City at various meetings of the Plumbing Officials Association. The Mayor read.a letter from Jorge Agnesi of Guadalajara regarding the celebration and festival held in their city which expressed their thanks for the cooperation of the City of Downey in helping to make this affair a success. The Mayor mentioned that various citizens of the City of Guadalajara have requested an exchange of their youth and local youth during the summer months advising that this information will be turned over to the Sister City Committee for their information and handling. Mr. Charles Brandt, 9711 Wiley -Burke Avenue, Downey, representing the Veterans on Proposition #2 on the June primary ballot, requested support by the City Council of the California Veterans Loan proposition coming up. This has been in effect since 1921 and up to the present time loans in the amount of $1,835,000,000.00 have been made and has not cost the taxpayers one cent as it has paid for itself. An additional $250,000,000.00 is being requested and the City Council of the City of Downey-vas asked to endorse a resolution in support of it. 1417 RESOLUTION NO. 983 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ENDORSING PROPOSITION 2 ON THE JUNE, 1962 BALLOT The resolution was read by title only. It was moved by Councilman Peavey, seconded by Councilman Skinner and so ordered that the further reading of Resolution No. 983 be waived. The City Attorney reported that the District Court of Appeals had denied the re- hearing in the Downey County Water case, the next step, if there be one, is to petition to the Supreme Court for hearing. Condemnation proceedings for the Parking District have been filed, all owners have been served, there has been response from one or two of the owners. Nothing definite has been worked out - -some will be settled and it appears some will be litigated; however, he will make a further report as it progresses. The City Attorney reported that in the case of Bleimaster vs. the City of Downey, he had received the final Brief in Trial Court filed by �. the Bleamasters and should have a decision on that within the next 30 days. The City Attorney gave Councilman Skinner a brief review of the Bleimaster matter. The City Attorney also reported that the Stevenson case in the matter of the opening of Stonewood had been heard by the court of appeals but he has not heard a decision as yet. Mr. Ervin Spindel announced the Southern California Regional Public Works Association is having a bi- annual conference and equipment show on Long Beach May 31 and June 1. Mr. Spindel will be one of the moderators on a panel on May 31. On Friday, June 1, all manufacturers will be exhibiting new equipment in the Public Works fields and giving exhits of them, and on behalf of the Southwestern California Chapter, he invited Council members to view this equipment. It was moved by Councilman Skinner, seconded by Councilman Peavey and passed by the following vote to authorize Mr. Spindel and Mr. Leavitt to attend the bi- annual conference of Southern California Regional Public Works Association with reasonable expenses allowed.
