OF THE CITY OF DOWNEY
MAY 7TH, 1962
The City Council of the City of Downey held a regular adjourned
meeting in the Council Chamber of the Downey City Hall at 7:30 P.M.,
May 7, 1962, Mayor Scott E. Temple presiding.

Reverend John Kreider of the Faith Mennonite Church delivered the
invocation.
Mayor Temple announced at this time a presentation shall be made com-
mending Robert Ryan, former member of the Downey Planning Commission.
Sherman Griselle, Planning Director, spoke a few words of appreciation
from the staff of the Planning Department stating that he feels Mr. Ryan is
one of the finest planning commissioners with whom he has ever worked.
Each of the councilmen and the City Manager expressed appreciation for
Mr. Ryan's outstanding work on the Planning Commission from its inception
and their regrets at his having to resign. Each felt it a real loss to the
City.
Mayor Temple then presented a plaque to Mr. Ryan.
Mr. Ryan stated he considered it very rare and a rewarding experience
to serve on the Planning Commission and that not once has any member of the
Council or City Administration tried to put any kind of pressure or voice
an opinion to him, but each case was decided on its merits, and it is very
rewarding to know there are men of this type to guide the City in this manner.
Mayor Temple announced that now is the time and place set for the hear-
ing on Planning Resolution #79, Zone Change #85 (Max Eisman, Paramount
Boulevard and Birchcrest Road).
The Mayor asked if the City Clerk had the affidavit of publication of
the hearing on Zone Change #85. The City Clerk replied she had the affidavit.
The Mayor asked if there were any written protests. The City Clerk replied
there were no communications received.
Leslie Olson, 10002 Tristan Drive, represented applicant and stated he
feels the property is now more suitable for apartment development due to its
size and shape, which is not conducive for R -1, single family development.
It was moved by Councilman Corbin, seconded by Councilman Skinner and
so ordered that the hearing on Planning Resolution #70, Zone Change #85
(Max Eisman, Paramount Boulevard and Birchcrest Road) be closed.

ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AMENDING THE ZONING MAP ADOPTED BY SECTION 9107 OF THE
DOWNEY MUNICIPAL CODE (PLANNING RESOLUTION NO. 70,
ZONE CHANGE #85 (MAX EISMAN, PARAMOUNT BOULEVARD AND
BIRCHCREST ROAD)

Peavey, seconded by Councilman Corbin and so ordered that further reading
be waived.

Councilman Peavey requested the minutes of April 24, 1962, be corrected
to show that the motion read "Sister City Committee" rather than the Rose
Float Association members shall be by appointment only and all associate
members eliminated.
It was moved by Councilman Peavey, seconded by Councilman Skinner and
so ordered that the minutes of April 24, 1962, be approved as corrected.
The City Clerk reported on the following written correspondence:
(1) An appeal from William P. Wilson, attorney for Marian Wilson Jones
from Zone Change #84. It was moved by Councilman Skinner, seconded by
Councilman Peavey and so ordered that a hearing be set for 7:30 P.M., June 11,
1962, in the Council Chamber of the Downey City Hall.
(2) A reply from State Department of Public Works to Mr. King's letter
to them regarding a request of the residents in the northeast area of
Downey regarding installing a pedestrian overpass over the Santa Ana Freeway.
It was reported the matter will be studied by the Assistant State Highway
Engineer and that as soon as the investigation is complete, the City will be
advised regarding the feasibility of financing and construction of the over-
pass for pedestrians as requested. Mr. King advised that a copy of the letter
was sent to residents and the School Board.
(3) A letter from the Downey Junior Woman's Club in appreciation of
Council support in the T B Eradication program, and a request to pass h hand-
bill ordinance. It was recommended t1-at the City's present handbill ordinance
be checked by the City Attorney and that a letter be directed to the Downey
Junior Woman's Club informing them that the matter is being investigated.
(4) A letter from Edwin T. Powell, Deputy Director of Civil Defense
regarding possible adaptation of existing storm drains for use as emergency
fallout shelters. Council was advised the matter is under study through the
engineering department. Council requested a report on the cost factor.
(5) A letter from the League of California Cities inviting the City of
Downey to join in a page of advertising in the "Western Cities" publication
to commemorate their 39th year. The cost would be $384. The letter was
ordered accepted and filed.
(6) A letter from Paul B. Powell, Jr. regarding drainage on Woodruff.
A drafted reply to Mr. Powell from the City Manager was read and accepted.

(7) Minutes of the May meeting of the Finance Advisory Committee.
Ordered received and filed.
(8) A petition signed by approximately 58z% of the property owners
in proposed Assessment District #69, Everest Street, Brookshire Avenue and
district embraced by such assessment district. Mr. King reported that this
area had been endeavoring to cut through Brookshire to Imperial Highway and
the proposal is now ready for acceptance and referral to the Engineering
Department. A diagram was drawn by the City Manager to present to Council
just what is involved in this Assessment District.
Mr. Ralph H. Woodmansee, 12507 Dolan, who was active in circulating
petitions for this proposed assessment district, spoke in favor of the im-
provements. Councilman Skinner complimented him and the residents who had
worked toward accomplishing these improvements.
It was moved by Councilman Skinner, seconded by Councilman Morton and
passed by the following vote to refer the petition on A.D. #69, Everest
Street, to the Engineering Department to check percentages and bring a report
to Council.

SAID SECTION RELATES TO BUILDING PERMIT FEES
The ordinance was read by title only. Ray Lake, Director of Building
and Safety, reported on the proposed changes. The City Manager stated that
these increases are merely to conform to other cities within the area.

8:00 A.M., May 22, 1962)
The resolution was read by title only. The City Attorney reported
this is simply proposing changes in the work contemplated and improvement
work accomplished. Additional work had been requasted by property owners
in installing driveways. The description of work must abide with additional
improvements done as requested by property owners.

RESOLUTION NO. 971
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ADOPTING AND SUBMITTING A BUDGET FOR EXPENDITURE OF FUNDS
ALLOCATED FROM THE STATE HIGHWAY FUND TO CITIES
The resolution was read by title only. The City Manager reported that
bids were received by the California Division of Highways on Thursday, May 3,
for the Firestone Improvement Project. There were five bidders with Oswald
Brothers Company low at $426,000. Although this is $8,000 above the state
engineering estimate, it is believed this bid will be awarded within the
near future after which the contractor will have 230 working days. Because
the cost of reconstruction and modification of the traffic signals was con-
siderably more than the state estimate, it is necessary for the City to ask
for an additional $20,000.00.

It was recommended by Council that ambulance service collections
be turned over to a local collection agency before being paid for by
the City.
It was reported that improvements on Dalen Street under Cash
Contract #65 have been completed and it was recommended these be ac-
cepted and authority granted to file a Notice of Completion. It was also
requested that liquidation damages in the am ount of $100 be charged for
delay in completion of this work.
It was moved by Councilman Peavey, seconded by Councilman Corbin
and passed by the following vote to approve final acceptance, authorize
filing a Notice of Completion and charge $100 liquidation damages for work
done under Cash Contract #65, Dalen Street.

It was reported that improvements on Paramount Boulevard under Cash
Contract #66 have been completed and it was recommended Council accept
these improvements, and authorize filing a Notice of Completion.

After a summation of bids received for Cash Contract #80, Slurry Seal,
it was recommended that the bid be awarded to the best and lowest bidder,
Chamber Mix Concrete, Inc., in the amount of $15,147.00.
It was moved by Councilman Corbin, seconded by Councilman Morton and
passed by the following vote that the bid for Cash Contract #80, Slurry
Seal, be awarded to the lowest and best bidder, Chamber Mix Concrete, Inc.,
in the amount of $15,147.00 and that all other bids be rejected.

It was reported that property owners on Donovan Street between
Birchdale Avenue and Brookshire Avenue have requested that the City prepare
the necessary legal petitions to be circulated on Donovan Street, for the
purpose of improving this street as an assessment district. It was rec-
ommended by the City Manager that inasmuch as the property owners have put
in part of the improvements and have vested interest therein, Council set
up a City participation in the amount of approximately $2700 for engineer-
ing and contingencies and authorize circulation of petitions to form
A.D. #71.
It was moved by Councilman Skinner, seconded by Councilman Corbin and
passed by the following vote to authorize circulation of petitions on
Donovan Street, A.D. #71, and authorize funds of approximately $2700 for
incidental and engineering costs.

The City Engineer reported on three claims relative to weed
abatement charges to property owners which have been collected by the
Los Angeles County Assessor's Office: 1. Work was done on adjacent
property; 2. There was an overcharge due to a typographical error;
3. Work was performed by the City of Downey subsequent to property
owners' having initiated the lot cleaning themselves.
It was moved by Councilman Morton, seconded by Councilman Skinner
and passed by the following vote to authorize reimbursement of weed
abatement charges to the following property owners:
1. Mr. Harley Friddy, 12113 Alice Avenue, Compton - $52.55
2. Mr. Russel Morris, 7953 E. Sixth Street, Downey - $7.00,
3. Sam and Edna Stephanian, 12217 Gneiss St., Downey - $25.13

It was recommended by the City Manager that transfer funds totaling
$4,961.01 be authorized to cover the cost of relocation and modification
of traffic signals by the Los Angeles County Road Department in conjunction
with the improvement on Bellflower Boulevard.' Billing was received this
fiscal year, and an additional cost of $2,104.67 resulting from traffic
signal relocation and construction at the intersection of Woodruff Avenue
and Foster Road was included. This work was performed by the Los Angeles
County Road Department in conjunction with the Foster Road project.

The City Engineer reported on three claims relative to weed
abatement charges to property owners which have been collected by the
Los Angeles County Assessor's Office: 1. Work was done on adjacent

Councilman Temple appointed John K. Morris to the Planning Commission
to replace Robert Ryan. Mr. Temple stated he resides at 12228 S. Rives
Avenue and is chief engineer for Western Gear Corporation. Mr. Ryan's term
of office, which Mr. Morris will be completing, expires December 31, 1962.
RESOLUTION NO. 973
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
APPROVING THE APPOINTMENT BY THE MAYOR OF A MEMBER TO
THE PLANNING COMMISSION
The resolution was read by title only. It was moved by Councilman
Peavey, seconded by Councilman Corbin and so ordered that further reading
be waived.

Council approval was requested for the following department heads
to attend the conventions listed below, with reasonable and justifiable
expenses allowed. Funds are included in the current budgets for this
purpose.
1. Finance Director - Municipal Finance Officers' Meeting in
Boston, Mass. - May 27 - 31.
2. Librarian - American Library Association Meeting in Miami, Beach,
Florida - June 17 - 23
(This is the annual meeting wherein the City Librarian has pro-
cured approximately 3,000 books each year at a savings of 50 %)
Councilman Corbin stated he has received some complaints as certain
books needed for reference work are not available in the Downey City Library.
It was recommended that a check be made of just what books are desired for
research purposes of students and latrons of the library, and that action be
deferred on Item 2 until a recommendation from the Library Board is submitted
to Council.
It was moved by Councilman Skinner, seconded by Councilman Peavey and
passed by the following vote that attendance at the Municipal Finance
Officers' Meeting in Boston, Mass., May 27 - 31 be approved for Director of
Finance, A. C. Gabriel.

The City Manager requested Council's approval to call for bids for air
conditioning and heating for the Council Chamber which will amount to
approximately $7,000 and is budgeted in the 1962 -63 budget. Bids should be
presented at the next Council Meeting so that the work can be done before
hot weather.
It was moved by Councilman Peavey, seconded by Councilman Skinner and
passed by the following vote to authorize calling for bids for air condition-
ing and heating for the Council Chamber.

It was moved by Councilman Peavey, seconded by Councilman Morton and
so ordered that the City Attorney be instructed to carry on in the City's
interest in the Downey County Water District vs. City of Downey matter which
appears to be heading for appeal by the Water Board to a higher court.
Councilman Peavey requested that a check be made with the license
collector in the City of Huntington Park to compare license fees being
collected by them from telephone companies.
Council delegated Mayor Temple and, as alternate, Councilman Morton to
attend the meeting of the Independent Cities May 16 at the Rodger Young
Auditorium. So ordered.

Councilman Skinner recommended a traffic check on Dalen Street
and Ardis Street to see what the traffic flow is with this new street.
Mr. King stated a complete check in that area is warranted at this time.
A check of the traffic flow also was recommended for the southwest corner
of Stewart and Gray and Brookshire Avenue.
Councilman Corbin asked for a check on the poor visibility at the
intersection of Third and Paramount Boulevard.
Councilman Morton reported a condition existing at Fourth Street,
just west of Paramount Boulevard, where some tress have been removed by the
City and sidewalks were left broken. It was agreed that if removal of
trees was by the City, repair of the sidewalk shaid be made by the City.
Mr. King submitted a cost breakdown incurred by the City in fulfilling
its contract arrangements with the Park and Recreation Board on a ratio of
functions and the number of purchasing orders, as follows:

Personnel 2197.00
$10,647.00 Total
Administrative Costs amount to $638, totaling $11,285.00. Authority was
requested to advise the Park and Recreation Board that the current amount
for the year would be $10,647.00,if administration is not included.

passed by the following vote to recommend a new contract be written and
presented to the Park and Recreation Board for the amount of $10,647.00, for
approval or rejection.

The City Attorney stated that for some time the matter of the City if
Downey vs. Lucci had been held, pending a decision of the hospital
acquisition of the property. It is his understanding that the determination
by the court has an effect upon the acquisition by the hospital. The City
Attorney advised that at a pre -trial coming up soon, the matter can be
moved up still later, if Council so desires.
It was moved by Councilman Skinner, seconded by Councilman Peavey and
so ordered that there be no definitive action taken at the Lucci pre -trial
until after November, 1962.
Councilman Peavey complimented the City Attorney on his representation
of the City of Downey against the Downey County Water Company.
Leslie Olson, representing Reverend John Kreider of Faith Mennonite
Church, petitioned for relief from conditions placed on Lot Split #196,
approved by the Planning Commission and upheld by the City Council in an
appeal hearing held July 19, 1961. An undue hardship is being suffered
as the church people cannot proceed with their building until after these
improvements have been completed. Mr. Olson stated that a deed has been pre-
pared for the land to be dedicated when the conditions have been conformed
to in this zoning case.
The City Attorney stated that a check of the records indicates the
decision of the Planning Commission had been appealed to the City Council at
the proper time. Council, after having discussed the matter at two meeting ,5,
confirmed the decision of the Planning Commission. Since the matter had been
acted upon by the City Council, there is nothing that can be done by the

Planning Commission. Council has now lost jurisdiction and the City
Council's decision is final and conclusive. The conditions imposed
are valid. The only recourse would seem to be for the property owner
to apply for a new lot split application.
Nellie Horner, 9717 Wiley Burke, representing Downey Coordinating
Council, read a letter which will be sent to the various organizations
in Downey asking for support of a Downey Youth Coordinating Council and
requesting representatives, either Mr. King or Chief of Police, to serve
on the committee, or appointment of someone to serve in their place if
they find they are unable to do so.
H. 0. Dougan, 7901 E. Stewart and Gray Road, inquired what is to
happen to smaller water companies in the event the City incorporates
the Downey County Water Company. Mr. Dougan was advised by the Mayor
that he feels this cannot be answered properly at this time. Mr. King
stated that the primary purpose in setting up a municipal water company
or district would be mainly to provide better service to the citizens,
and not to "make money."
There being no further business to come before Council, the meeting
adjourned at 10:00 P.M.
