HomeMy WebLinkAboutMinutes-04-24-62-Regular Meeting1381 MINUTES OF THE CITY COUNCIL OF THE CITY OF DOWNEY APRIL 24TH, 1962 The City Council of the City of Downey held a regular meeting in the Council Chamber of the Downey City Hall at 8:00 A.M., April 24, 1962, Mayor Scott E. Temple presiding. PRESENT: Councilmen: Corbin, Peavey, Skinner, Morton, Temple ALSO PRESENT: Oren L. King, City Manager Royal M. Sorensen, City Attorney A. C. Gabriel, Director of Finance Ervin Spindel, Director of Public Works Lee Leavitt, City Engineer Don Robison, Administrative Assistant Royal M. Sorensen, City Attorney Robert Gain, Fire Chief Ivan A. Robinson, Chief of Police Tom Nudson, Assistant Director of Building & Safety Bill Fritsche, Sr. Building Inspector Ed Powell, Deputy Director of Civil Defense Della Doyle, City Clerk Alberta Pfeiffer, Deputy City Clerk Reverend Al M. Johnson of the First Baptist Church delivered the invocation. Mayor Temple announced that this is the time and place set for the public hearing on Zone Exception #274 which was appealed by applicant, Philip J. Albaum. Planning Director Sherman Griselle presented a resume of the case and advised Council that applicant is appealing certain con- ditions attached by the Planning Commission and is asking that they not be applied until the temporary period is over. The conditions set forth by the Planning Commission are as follows: 1. This approval is based upon an approved plot plan and elevation. Deviations or exceptions from said approved plot plan and eleva- tion shall not be permitted without the approval of the City Planning Commission. 2. That the approved uses shall be automobile parking and the 3 signs requested. 3. That 20 feet of right -of -way shall be dedicated for the widening of Telegraph Road to the standards of the Department of Public Works. 4. That curbs, gutters, and paveout shall be installed along the entire frontage of Telegraph Road and to the standards of the Department of Public Works. 5. That standard five (5) foot sidewalks shall be installed six inches (611) from the property line along the street frontage of Telegraph Road and to the standards of the Department of Public .-•. Works. 6. That the parking area shall be constructed and permanently main- tained in conformance with Section 9127 of the Comprehensive Zoning Ordinance. Council Minutes 4/24/62 -1- 1382 7. That all signs shall conform to the plot plan and elevation approved and that such signs shall be interior lighted or back lighted and shall conform to Section 9126.38 of the Comprehensive Zoning Ordinance and shall not encroach into the public right -of -way and that such signs shall not be permitted for a period exceeding eighteen months from the date of approval. 8. That the property shall be connected to the main sewer. 9. That water shall be provided in the volume and pressure recommended by the Department of Public Works and Fire Department. Mr. Griselle stated that Mr. Albaum has requested that Conditions #1, #2 and #7 only apply and that the rest of the conditions be deleted for an 18 -month period. Leslie Olson, 10002 Tristan Drive, and applicant Philip J. Albaum, 9548 Farm Street, spoke in favor of the Zone Exception. The Mayor inquired if the City Clerk had the affidavit of publication. In reply, the City Clerk stated she had the affidavit. The City Clerk was asked by Mayor if there was any written correspondence regarding Zone Exception #274. The City Clerk replied there was none. It was moved by Councilman Peavey, seconded by Councilman Skinner and so ordered that the hearing on the appeal to Zone Exception #274, Philip J. Albaum, applicant, be closed. It was moved by Councilman Corbin, seconded by Councilman Peavey and passed by the following vote that the appeal from Mr.AIbhum from the decision of the Planning Commission in Zone Exception Case No. 274 be granted deleting from the conditions made a part of the Planning Commission approval condi- tions #4, #5, #6, #8 and #9 on the condition that said Zone Exception shall expire on October 1,; 1963, and shall be of no force or effect after said date. The Mayor asked if there was anyone opposing this zone change. No one spoke in opposition. The Mayor inquired if the City Clerk had the affidavit of publication. The City Clerk replied she did have the affidavit. Mayor Temple inquired if there were any written protests. The City Clerk replied there were none. Leslie Olson and Ralph Cook,applicant in Zone Change #83, spoke in favor of the Zone Change. It was moved by Councilman Corbin, seconded by Councilman Skinner and so ordered that the hearing on Planning Resolution #69, Zone Change #83, Ralph Cook, et al., Elm Vista Drive be closed. Council Minutes 4/24/62 -2- 1383 ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE ZONING MAP ADOPTED BY SECTION 9107 OF THE DOWNEY MUNICIPAL CODE ( PLANNING RESOLUTION NO. 69, ZONE CHANGE #83) (COOK, ELM VISTA DRIVE) The ordinance was read by title only. It was moved by Councilman Skinner, seconded by Councilman Corbin and so ordered that the further reading of the ordinance be waived. It was moved by Councilman Skinner, seconded by Councilman Peavey and passed by the following vote that the ordinance be introduced. The City Clerk reported on the following written correspondence: (1) A letter from Lucille T. Hoskins relative to the Firestone Boulevard Landscaping. (2) An activity report from Downey Choralaires for the period January 1, 1962 through March 31, 1962. (3) A petition regarding the drainage on Stamps Avenue. Mr. King advised that the petition is presented by Mrs. Rohkwell, requesting the City's participation in Tract #26225 and that the field trip and study made of the area last week indicated that the City could expend additional funds on Downey Avenue to lower the grade to take the water off Charloma Street, then on to Downey Avenue, but it could not be justified to spend city funds for improvement of a private area. The City Manager read a letter directed to Mr. Geis relative to the proposed development of Tract #26225. Leslie Olson and Mrs. Rockwell, 8233 Suva, spoke relative to correction of the drainage problem caused by subdivisions in the area which did not provide proper drainage and that it would appear that Gainford would have to be lowered to take care of run -off waters from Stamps Avenue. Mr. Spindel, Director of Public Works, advised that an exhorbitantly high expenditure would be required to alleviate the drainage problem in this tract through city funds; however, it could be worked out if done on a par- ticipation basis. The City Attorney advised that if the developers wished, it could be done under the 1911 Act rather than tatting a private contract. The costs, however, if done by contract would be less than in an assessment district. Upon the request of Councilman Morton, the City Manager re -read the letter directed to Mr. Geis. Mayor Temple directed that the letter be referred to the City Attorney before mailing it to Mr. Geis. Councilman Morton recommended directing an additional letter to the people on Stamps Avenue, advising of Council's action relative to the drainage problem in that area. Council Minutes 4/24/62 -3- 1384 (4) The City Clerk read a letter from D. K. Grandey thanking the City Manager and members of the City Council for hospitality shown the Management group on March 27. (5) A letter from Harry E. Beddoe, President of the Downey Board of Realtors, advising of a resolution adopted by their board clarifying the realty board's position as related to individual members of the board with respect to planning and zoning in Downey. (6) A claim received from Ronald A. Kolar, 11724 Gurley, Downey, for injuries sustained in a fall while playing basketball at the Earl Warren High School gymnasium on January 22, 1962. It was moved by Councilman Corbin, seconded by Councilman Peavey and passed by the following vote to deny the claim of Ronald A. Kolar and refer it to the City Attorney. The City Attorney advised that this ordinance is merely to bring the code into line with statutory provisions. It was moved by Councilman Peavey, seconded by Councilman Skinner and so ordered that further reading be waived. Mr. Spindel advised that this is an annual request made by the City for $7500 engineering allot- ment granted by Gas Tax Funds for preliminary engineering on various street projects. Mr. Spindel reported that the final tract map has been approved, the agreement signed by the subdivider and the subdivider has provided an instrument of credit to insure proper performance of the improvements, and the agreement also has been signed by the Escrow Company. RESOLUTION NO. 961 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY REQUESTING "HIGHWAYS THROUGH CITIES" COUNTY AID FUNDS ON DOWNEY AVENUE The resolution was read by title only. Mr. King stated this action was through summarizing of the field trip made last week and is the first project for improvement of Downey Avenue from Florence Avenue to Gallatin Road. It was moved by Councilman Peavey, seconded by Councilman Corbin and so ordered that further reading be waived. WS -292 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY ALLOWING CERTAIN CLAIMS AND DEMANDS AND SPECIFYING THE FUNDS OUT OF WHICH THE SAME ARE TO BE PAID 05679 #5951 $27,797.56) The resolution was read by title only. A question was raised regarding the item pertaining to the duplicating work done on the machine used in the Police Department. It was suggested that a research be made for a less expensive manner of duplicting, with a report to Council in the near future. Councilman Skinner commended the manner in which the election was handled by the City Clerk and suggested heavier consolidation of the precincts in order to cut election expenses still farther in the future. The City Clerkstated she felt the election had gone very smoothly but she was disappointed in the small turnout of voters in the General Municipal Election and that consolidation of precincts more heavily in the future shall be considered in order to realize further economies. It was moved by Councilman Peavey, seconded by Councilman Skinner and so ordered that further reading of Resolution No. WS -292 be waived. Mr. King reported that it is proposed to continue the slurry seal preventative maintenance program with 117 miles of City streets, or 3/4 of the streets eligible for slurry seal being completed with the addition of 12 miles under Cash Contract #80. It was requested Council approve plans and specifications and authorize advertising for bids on this project. Councilman Corbin inquired what is to be done in the downtown area, particularly on 2nd, 3rd Streets, etc. Mr. Spindel, Director of Public Works, replied that these streets cannot be repaired through the application of slurry seal and as soon as funds are available, they will be repaired. It was moved by Councilman Morton, seconded by Councilman Skinner and passed by the following vote to approve plans and specifications and ad- vertise for bids for Cash Contract #80, slurry seal. Council Minutes 4/24/62 -7- Mayor Temple requested Councilman Peavey to assist him in the presentation. Photographs were requested by the City Manager for special scrapbooks being prepared for the City of Guadalajara. After the presentation of the certificates, their spokesman, one of the students, gave an acceptance speech and thanked the City for having had them and extended an invitation for students and citizens from Downey to visit the City of Guadalajara. Mayor Temple commended the students, the Chamber of Commerce and citizens of Downey who hosted the students during their stay in the City of Downey. It was reported that a petition signed by approximately 68% of the property owners on Izetta Avenue between Washburn Crossing Road and Spry Street requesting initiation of assessment district proceedings for the construction of sidewalks had been presented. The total estimated cost of the project is approximately $15,000, $2600 of which is estimated for incidental costs. This would be collected from the Bond buyer on completion of the project, unless the City Council chose to contribute the incidental costs, as was done on the sidewalk construction on Dunrobin Avenue and Eastbrook Avenue, the streets just east of Izetta Avenue. It was moved by Councilman Corbin, seconded by Councilman Skinner and so ordered to prepare the necessary plans and specifications for sidewalks in A.D. #81, Izetta Avenue. It was moved by Councilman Corbin, seconded by Councilman Skinner and so ordered to retain the firm of Burke, Williams & Sorensen to perform the nec- essary legal work in A.D. #81, Izetta Avenue sidewalks. It was moved by Councilman Skinner, seconded by Councilman Peavey and passed by the following vote to advance $2600'engineering funds for A.D. #31, Izetta Avenue sidewalks. It was moved by Councilman Peavey, seconded by Councilman Skinner and passed by the following vote to set for public hearing, Planning Resolution No. 70, Zone Change #85 for 7:30 P.M., May 7, 1962, in the Council Chamber of the Downey City Hall. It was moved by Councilman Peavey, seconded by Councilman Skinner and .� passed by the following vote to authorise attendance by the City Clerk of the City of Downey to the Municipal City Clerks Conference in Santa Barbara, April 25, 26 and 27, 1962, with reasonable expenees allowed. AYES: 5 Councilmen: Corbin, Peavey, Morton, Skinner, Temple NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Council Minutes 4/24/62 -8- 1389 The City Clerk advised she would like to request Council to set a policy relative to the use of the recording tapes from the Council Meetings. Councilman .Skinner stated he would like to have a recommendation from the City Clerk as to how it should be used. ^ Councilman Peavey stated the tape recording should be used as an aid to the City Clerk, not to be copied; that the tape recorder should be used only as an aid in the City Clerk's office. The City Attorney stated that basically the tape is simply a substi- tute or assistant to the shorthand notes that the clerk otherwise would take. A policy varies from city to city and frequently it is provided that tapes are not available for a period of so many days after the meet- ing in order not to interfere with the clerk's transcription of the minutes. He added that the final minutes approved by the Council constitute the formal minutes and action of the Council, even though there may be something on the tape which would appear to be contrary. The formal minutes as approved take precedence. Any such rules and regulations as the clerk deems advisable should be set by Council, and the clerk can make any recommendations she so desires. The disadvantages of a re- recording of a tape is that Council would lose control over whether someone tampers with the tape. Councilman Skinner requested a written recommendation from the City Clerk. The City Clerk stated that as far as the office is concerned, the tapes are a convenient crutch; however, they are of no particular assistance and she sees no particular need for it. Therefore, she has no recommendations. She does feel, however, that it is important that the Council establish a policy as the tapes are not a legal record. ^ The City Attorney advised that the tapes are merely a transcript of a meeting, not an official action of the Council. There is much on a tape, he added,which is really of no consequence. Councilman Corbin suggested a time element be placed on their use. Councilman Peavey suggested that the City Attorney be instructed to draw up a resolution or something as to the use of a tape, specifying that the tape is for the use of the City Clerk when needed in writing the minutes only, and not to be made available to the public. Councilman Morton stated that to his way of thinking the tape is merely a secretarial aid to define the actions of the City Council, and that after 30 days, can be erazed and re -used. Mayor Temple stated that the next item on the agenda is the appointment of members to the citizens advisory committees. Councilman Peavey suggested that as there are some committees that have not met for some time, he feels such committee may be disbarred. Council made the following appointments: CITIZENS' TAX COMMITTEE Councilman Peavey, District #3 - Wendell Schooling Councilman Morton, District #4 - Eugene Lippert Councilman Corbin, District #5 - Mrs. F. D. Campbell and Carl E. Monahan Council Minutes 4/24/62 -9- 1390 Councilman Morton suggested setting a program of spelling out the scope for each committee and use them in every extent they can and in that capacity. Councilman Morton suggested that the word "Center" be deleted from the Civic Center Committee. After discussion of the possibility that such committee, changed as suggested, might overlap the scope of others, it was proposed to leave the name of this particular committee as it stand and if, in the future, it seems feasible to change it, such change will take place at that time. Alexander Councilman Morton, District #4 - Robert Storer and Robert Dufek It was recommended by Councilman Peavey that the committee appointments should be set up as soon as possible as they may need to be called upon at a moment's notice. Councilman Morton suggested the addition of three committees: (1) Cul- tural Advisory Committee with two members appointed from each councilmanic district; (2) Youth Advisory Committee with advisor or ex- officio member from the Police Department; and (3) Downey Beautification Advisory Committee. No action was taken by Council until a study can be made as to the scope of all committees and in order to avoid overlapping of committees or other citizens groups. It was recommended by Councilman Peavey that the Public Works Department study the possibility of taking water straight across to Downey Avenue rather than down to Stamps Avenue and Gainford relative to Tract #26225 development. The Public Works Department was directed to make this study and report to Council. Councilman Corbin suggested the possible establishment of a hospital committee, as he feels it merits a study. Council Minutes 4/24/62 -11- .x.392 The City Attorney, in connection with the hospital matter, inquired what action Council desired in the Lucci action which will come up in the near future for pre - trial. He wished to know if Council desired to push the action or hold off until such time as it is decided what will be done with the Lucci property. The latter action was proposed by Council. Councilman Corbin asked about the possibility of providing a hospital district and if there would be any reason why it could not include the entire City. The City Attorney advised there could be a hospital district and a provision made whereby the district could be extended even outside the City. Councilman Corbin asked the City Attorney to explain a bond issue as distinguished from a hospital district. After the explanation by the City Attorney, he stated there were advantages and disadvantages both ways. It was moved by Councilman Skinner that the .City Attorney check into the feasibility of a district and the manner in which it could be operated and set up. The City Manager stated he feels it should be started with establishment of a committee. Councilman Corbin recommended first to meet with the Hospital Board. Councilman Skinner withdrew his motion for lack of a second. It was then moved by Councilman .Skinner, seconded by Councilman Corbin and so ordered that the City Manager meet with the Hospital Board relative to Council's setting up a hospital committee. The City Manager advised of recommendations to be presented to the Personnel Board which would combine the positions of Administrative Assistant and City Forester, as well as the Deputy Director of Civil Defense with that of Purchasing Agent. No action was taken on these recommendations pending formal recommendations from the Personnel Board. It was moved by Councilman Skinner, seconded by Councilman Corbin and passed by the following vote to authorize Councilman Morton to attend the Mayors and Councilmen's Institute at Sacramento with reasonable expenses allowed, May 20 - 22. "Red" Barrett, Manager of the Downey Chamber of Commerce, stated as this has been a project of the Chamber for some time, they will take care of the matter for the City. Mayor Temple requested Council to pass a resolution proclaiming :thy month of May as Senior Citizens Month. Mr. H. L. Duggan, 7901 E. Stewart and Gray Road, congratulated Mayor Temple, Mayor Pro -Tem Ben Corbin and Councilman Morton for their appointments. He then gave a survey report of lack of sidewalks in the vicinity of most of Downey schools, fences and barriers which force children and others to walk in the streets and requested that some action be taken by the City to rectify the situation. The Director of Public Works stated that several feet of property from the curb area toward the residence is dedicated property and legally belongs to the City - -if fences, barriers or hedges have been built, they are in violation of the City Code. In their inspections, if they find a hazard is created by the fence or barrier, it can legally be requested that it be removed. Commander Charles Bates, Director of the Area E Civil Denfense office, acknowledged the anniversary of his first year in this position and stated the past year has been one of great pleasure due to the wonderful coopera- tion afforded him. A political science student from U.S.C. was introduced by Mayor Temple and a desire was expressed by him to interview each councilman and the City Manager at a later date.
