Temple presiding. PRESENT: Councilmen: Corbin, Giddings, Peavey, Skinner, Temple ALSO PRESENT: Oren L. King, City Manager Robert Flandrick, Acting City Attorney Sherman Griselle, Director of Planning Lee Leavitt, Acting Director of Public Works A. C. Gabriel, Director of Finance Ivan A. Robinson, Chief of Police Tom Brown, Fire Prevention Bureau Chief Ray Lake, Director of Building & Safety Don Robison, Administrative Assistant Loren Morgan, Deputy Chief of Police Della Doyle, City Clerk Alberta M. Pfeiffer, Deputy City Clerk Mr. James A. Lacey of the Y.M.C.A. presented the invocation. Mayor Temple announced thatat this time there would be a presentation of certificates from the Police Academy to police officers completing this training. Deputy Chief of Police Loren Morgan requested that Mayor Temple assist in presenting certificates to the following officers: William Lund Lloyd Straughn Albert McFarland Mayor Temple announced that this is the time and place set for the public hearing on Planning Resolution #68, Zone Change #82, Sachs Ford Agency on Lakewood Boulevard. Sherman Griselle presented a resume of the matter. The Mayor asked the City Clerk if she had the Affidavit of Publication on Zone Change Case #82 setting for hearing, Planning Resolution No. 68. The City Clerk had the Affidavit. Speaking for the applicant in the case was Leslie Olson, 10022 Tristan Drive. Objecting to the possible planting of trees was Mr. Keith L. Jansen, 9511 Birchdale. Mr. Olson explained that some of the residents in the area requested some screen planting in order to screen off the lights from the existing automobile agency to the south of the proposed agency, and that this would not be done if unfavorable to Mr. Jansen. It was moved by Councilman Peavey, seconded by Councilman Skinner and so ordered that the hearing be closed on Planning Resolution No. 68, Zone Change #82 (Sachs, Lakewood Boulevard.) ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE ZONING MAP ADOPTED BY SECTION 9107 OF THE DOWNEY MUNICIPAL CODE (PLANNING RESOLUTION NO. 68 - ZONE CHANGE #82) (Sachs, Lakewood Boulevard) The ordinance was read by title only. The City Engineer presented a resume of this assessment district for sewer construction along Fontana Street. Mayor Temple asked the City Clerk if she had the Affidavits of Publica- tion, Posting and Mailing. The City Clerk replied she had the affidavits on file. It was moved by Councilman Peavey, seconded by Councilman Skinner and so ordered to receive and file the Affidavits of Publication, Posting and Mailing. The Mayor inquired if any written protests had been received. There were none. There were no oral comments. It was moved by Councilman Peavey, seconded by Councilman Skinner and so ordered that the hearing on A.D. #54, Fontana Street, be closed. RESOLUTION NO. 950 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY CONFIRMING THE ASSESSMENT FOR THE IMPROVEMENT OF FONTANA STREET, A PRIVATE ROADWAY (AD #54) The resolution was read by title only. It was moved by Councilman Peavey, seconded by Councilman Corbin and so ordered that further reading be waived. The City Clerk reported on the following written correspondence: (1) A letter from Mr. Woodrow W. Christensen, 9951 Brookshire Avenue, regarding setback which will be required of them on their property involved in A.D. #76, improvement of Dacosta Street. Pictures and plot plans were submitted by Mr. Christensen. Mr. Griselle presented a resume of the facts. The Christensens were advised they should file an application for a zone exception. The City Engineer reported that improvement was requested by 75% of the property owners within the area involved in A.D. #76, Dacosta Street. Mr. Christensen advised he is still endeavoring to get the improvements done on a cash contract basis. Council Minutes - 3 -27 -62 -2- 1363 Mrs. Christensen spoke in protest to the assessment district. The City Manager stated that possibly by going through a zone ex- ception procedure, some variance might be granted. It was moved by Councilman Peavey, seconded by Councilman Skinner and so ordered that preparation of plans and specifications for A.D. #76, Dacosta Street improvements, be authorized. It was moved by Councilman Corbin, seconded by Councilman Peavey and passed by the following vote to employ the legal firm of Burke, Williams & Sorensen. AYES: 5. Geis regarding Planning provisions in Tract #26225. Councilman Skinner suggested a field trip as the subdivision in question might possibly be involved in some later work on Downey Avenue regarding drainage. The City Manager stated that the work coming up on improvement Qf Downey Avenue would involve some lowering of the street for drainage pur- poses. Mr. Olson, representing Mr. Geis, stated that he feels there is just cause for requesting the City's aid in the project to obtain proper drainage. He requested that a thorough study be made. The Mayor requested the City Manager to arrange for the suggested field trip to view this project. The City Manager added that it would appear the City might be able to assist in this drainage problem through gas tax funds. This will govern how much participation the City can give. (3) The City Clerk reported that an appeal of Zone Exception #274 had been received from Philip J. Albaum, and that appellant requested the hearing be set for the next morning Council Meeting. It was moved by Councilman Peavey, seconded by Councilman Skinner and so ordered that a public hearing on the appeal to Zone Exception #274 be set for 8:00 A.M., April 24, 1962, in the Council Chamber of the Downey City Hall. (4) A letter from the Downtown Business Association, commending the Downey Exchange Center. (5) A letter from the Downtown Business Association recommending sign posting and enforcement pertaining to all -night parking on downtown streets to enable the street sweepers to sweep all streets near the curb where rubbish collects. 1364 The City Manager reported that with the improvement of the downtown business area, all -night parking should be prevented. Tte Mayor recommended submission of a plan from the traffic engineer. (6) A letter of appreciation to the Forestry Department from Mrs. Ronald Glick. (7) A petition submitted by Mildred Campbell requesting construction of an overpass in the vicinity north of the Santa Ana Freeway, between Paramount Boulevard and the Rio Hondo River. Mrs. Campbell commented on the need of school children and residents in the area for such an overpass. Councilman Peavey stated he would like the City to support this request and for the City Manager to work with the citizens and the State Division of Highways for an overpass to permit school children and residents to cross the freeway to schools. It was moved by Councilman Peavey, seconded by Councilman Skinner and so ordered that the City Conncil give all support possible to get the State Highway Division to construct an overpass over the Santa Ana Freeway between Paramount Boulevard and the Rio Hondo River. Councilman Peavey requested the City Manager be instructed to give all support from his office and to contact the Division of State Highways. (8) The City Clerk reported receipt of a letter from John A. Nordbak regarding the setting up of a Board of Appeal in matters pertaining to the Uniform Building Code. Councilman Peavey inquired of Mr. Lake if there is a provision for a committee of appeal. Mr. Lake advised the matter is being taken up with the City Attorney to be presented to Council at a later date. (9) A letter of appreciation for her commendation at the last Council Meeting for her services as Acting Purchasing Agent was read in full by the City Clerk as written by Le Keyser. (10) A letter of appreciation from the Downey City Employees Association to Councilman Edwin W. Giddings and an expression of regret of his decision to end his Councilmanic career was read in full to Council by the City Clerk. Councilman Giddings stated he appreciated it very much. ORDINANCE NO. 195 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE ZONING MAP ADOPTED BY SECTION 9107 OF THE DOWNEY MUNICIPAL CODE (PLANNING RESOLUTION NO. 63 - ZONE CHANGE #78) (PHILLIPS - COLDBROOK) The ordinance was read by title only. Mr. Leavitt gave a summation of the proposed budget of gas tax funds which included an additional alloca- tion for Stewart and Gray Road extension. Mr. Leavitt gave a resume of the proposed vacation of a 1.66 -foot strip along the easterly side of Adenmoor Avenue between Borson Street and Imperial Highway. The land to the east had been conveyed to the original grantor of the subject vacatirn land which will again revert to this grantor and will avoid the present offset in the right of way line in the easterly line of Ardis Avenue. The City will be unable to commence with the construction of the major portion of the work until such time that the .Southern Pacific Railroad Company has completed their portion of the improvement. The plans and specifications for approval are being submitted at this time in order that the successful contractor for the City can be in a position to commence construction immediately after completion of the work to be done by the Southern Pacific Railroad Company. AYES: 5 Councilmen: None NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None 1368 It was reported that the work required of Bay Area Concrete in construction of sidewalks on Dunrobin Avenue, et al. has been satis- factorily completed. It was moved by Councilman Skinner, seconded by Councilman Corbin and passed by the following vote to accept the work and file a Notice of Completion in A.D. #55, Dunrobin Avenue, et al. AYES: 5 Councilmen: Corbin, Giddings, Peavey, Skinner, Temple NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None The City Manager reported on three parcels of ground which are avail- able to the City for payment of taxes and bonds existing. One is at the intersection of Dempster and Downey Aventes, the other two are 25' by approximately 100'- -one on Laureldale for the sum of $1800 and one on Earnshaw for the sum of $2400. Mr. King stated there is no particular reason he feels the City would be interested but just wanted to bring it to their attention. Sherman Griselle, Director of Planning, stated there is one lot which may be of value for beautification purposes as a first view coming into the City of Downey. It was moved by Councilman Skinner that the City purchase the lot at the corner of Downey and Dempster to be used as a start toward a Downey Park system. A discussion followed concerning purchase of the other two lots. Councilman Giddings stated he could see no reason for the City to purchase the two 25' lots and that the use should be omitted from the motion of Councilman Skinner for the purchase of Parcel 1. Councilman Skinner deleted the use of the land in his motion. It was then seconded by Councilman Giddings and passed by the following - vote to approve the purchase of the lot at the corner of Downey and Dempster and authorize the transfer of monies for expenditure of $1,050 from Land Acquisition Account #9- 2000 -612. It was ascertained that this service, to be operated from a private garage at an apartment house, is in a commercial zone. It was moved by Councilman Peavey, seconded by Councilman eStinner and passed by the following vote to grant the application of Mr. Armand Billadeaux to operate a limousine service in the City of Downey. AYES: 5 Councilmen: Corbin, Giddings, Peavey, Skinner, Temple NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None The City Manager reported that in conjunction with the safety to schools program it has been requested that authority be granted to relocate a fence on private property and extend sidewalk along Brookshire Avenue to prevent school children from having to walk in the street. It was moved by Councilman Skinner, seconded by Councilman Giddings and passed by the following vote to authorize relocating a fence on private property along a portion of Brookshire Avenue so that school children can walk along the parkway rather than in the street. ,kYES: 5 Councilmen: Corbin, Giddings, Peavey, Skinner, Temple NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None 1399 The City Manager reported the agreement between the City of Downey and the City of Santa Fe Springs for the use of library facilities had been revised by the City Attorney and is now ready for approval by the Council. Councilman Giddings urged pushing a similar agreement for Public Works mutual aid agreement for use of equipment. Acting City Attorney Bob Flandrick instructed that the agreement be changed to read "teachers" rather than employees in Section 1 of the Agreement for use of library facilities. It was moved by Councilman Giddings, seconded by Councilman Corbin and passed by the following vote to approve the agreement between the City of Santa Fe Springs and the City of Downey for use of library facilities and authorize the Mayor to sign. Edelberg, attorney for Charles Bass, had been received, resulting from an accident involving Mr. Bass and a City vehicle. It was moved by Councilman Peavey, seconded by Councilman Skinner and passed by the following vote to deny the claim of Mr. Charles Bass and refer the matter to the insurance carrier and the City Attorney. AYES: 5 Councilmen: Corbin, Giddings, Peavey, Skinner, Temple NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Mr. King reported that the dues have been increased for membership approximately 25% in the League of California Cities, this being the first increase since 1951, becoming effective January 1, 1963. The dues for the City of Downey would be to approximately $2,000, providing the population figure does not exceed $90,000 in April or May. It was moved by Councilman Peavey, seuanded by Councilman Corbin and passed by the following vote to continue membership in the League of California Cities and approve the new rate schedule. AYES: 5 Councilmen: Corbin, Giddings, Peavey, Skinner, Temple NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Bob Flandrick, acting City Attorney, read a report prepared by City Attorney Royal M. Sorensen, relative to imposing different license fees upon persons engaged in the same kind of business but who have been so engaged within the City for different periods of time. So long as a person has a fixed place of business within the City and which place of business is properly located in accordance with the Zoning Ordinance, Building Code and other municipal ordinances, the City cannot distinguish between such persons who are so located for a period of six months and those who are so located for a period longer than six months. The City Manager reported he and Councilman Skinner had called upon Mrs. Reed relative to Brookshire improvements from Eucalyptus to Imperial Highway as she had been reluctant to sign the petition in setting up an assessment district for this improvement. Fifty -two percent of the property owners had signed in favor of this project. It now appears that Mrs. Reed will dedicate right of way to the City in exchange for curbs, gutters and paving. Construction could then start possibly the latter end of 1962, providing the petition is completed and in during April. 1370 Mr. King read a letter in full addressed to Mrs. Reed which stated the City approves assuming the cost of the improvements (curbs, gutters and paving) in exchange of right of way. It was moved by Councilman Skinner, seconded by Councilman Peavey and so ordered to approve the letter as to form and forward to Mrs. Reed. The City Manager reported the City of Lynwood had won the All American City award and recommended sending a letter of congratulations. It was moved by Councilman Corbin, seconded by Councilman Peavey and so ordered that a letter of congratulation to the City of Lynwood for having won the All American Cities Award. Mr. King announced remodeling of the Council Chamber will begin this week for the purpose of enlarging, and completion is expected in approxi- mately 30 days. The members of the City Council unanimously reiterated their support of the American Heritage book shelf and their support for the books on Americanism in the City Library, and commenddd Mayor Temple on his staunch stand in this connection. Councilman Giddings stated he feels the Council should step into the hospital matter and investigate as there is need of a larger one and this need is much more important to him than some things. He feels Council shouldconsider taking an action, possibly appointment of a committee to make a study, and see just what can be done to get a community hospital on its way. Councilman Giddings also urged the City Council to take a little more positive action with regard to obtaining a municipal water system. The City Manager brought City Council up -to -date on the Park Water Company matter. Meetings had been held with Mr. Wheeler and his attorney and a proposal was submitted to them by the City which appeared agreeable. However, Mr. Wheeler has to obtain agreement or approval of his trust and this has not yet been forthcoming. Mayor Temple announced that May 13 -16 is the United States Conference of Mayors and hopes there will be a representative from the City of Downey attending. It was moved by Councilman Peavey, seconded by Councilman Corbin and passed by the following vote to authorize any councilman who can do so to make the trip to the U. S. Mayors Conference May 13 -16 with necessary ex- penses allowed. AYES: 5 Councilmen: Corbin, Giddings, Peavey, Skinner, Temple NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None The Mayor reported receipt of Resolution #42 which is a Senate Resolution requesting a Federal income tax on municipal and school bonds, etc. It was moved by Councilman Peavey, seconded by Councilman Skinner and so ordered that the City Attorney be instructed to draw a resolution oppos- ing this Senate Resolution #42. Mayor Temple announced that the City of Downey has been chosen for a student visit from the University of Guadalajara and that the two Sister City Committees have been requested to assist in this visit which will occur during Easter vacation. Consul General Horn has been informed that the City of Downey will cooperate in this event. 1,371 Councilman Giddings announced that the son of one of the officials of Guadalajara who is majoring in chemistry, has requested permission to work in Downey this summer and will be assigned to the Cee Bee Chemical Company. The Mayor reported a letter had been received from Mrs. Ruth Kelly in regard to the Miss California contest, requesting the City of Downey's participation was referred to the Chamber of Commerce. The City Manager was requested to review with the Chief of Police and the Judges the time spent by police officers in jCourt. Phyllis Gardea, 8112 Quoit Street, speaking for Downey High School student, Kent Hallmeyer, conveyed thanks to members of the City Council for making available to him and other students the Freedom and Free Enter- prise Shelf in the City Library There being no further business to come before Council, the meeting adjourned at 10:40 A.M.
