Temple presiding. PRESENT: COUNCILMEN: Corbin, Giddings, Peavey, Skinner, Temple ALSO PRESENT: Oren L. King, City Manager Royal M. Sorensen, City Attorney Sherman Griselle, Director of Planning Lee Leavitt, Acting Director of Public Works A. C. Gabriel, Director of Finance Hal Durham, Traffic Engineer Robert Gain, Fire Chief Bill Fritsche, Senior Building Inspector Don Robison, Administrative Assistant Della Doyle, City Clerk Alberta Pfeiffer, Deputy City Clerk Mayor Temple requested the City Manager to assist in the presentation of certificates to a number of personnel upon their completion of a 14 -week training course on Public Works Administration. Certificates were presented by the Mayor to the following personnel: Lee Leavitt, City Engineer Hal Durham, Traffic Engineer Sherman Griselle, Director of Planning Ben Menamide, Assistant Civil Engineer Mel Harldson, Maintenance Superintendent Bob Buonodono, Assistant Civil Engineer Witold Hrynewicki, Associate Civil Engineer Bill Clark, Assistant Civil Engineer Dave Brown, Senior Maintenance Man Robert Vollmer, Senior Administrative Assistant Bob DeSio, City Forester Reverend Emory Ackerman, Christ Lutheran Church, presented the invoeati.ou. Mayor Temple announced that now is the time and place for the public hearing set on Planning Resolution #63, Zone Change #78. Sherman Griselle, Director of Planning, gave a resume of the case. The Mayor inquired of the City Clerk if she had the Affidavit of Publication. The,City Clerk answered in the affirmative. Mayor Temple inquired if there were any written protests. City Clerk replied there were none. Mrs. L. H. Phillips, 11652 Coldbrook Avenue, applicant for the Zone Change, stated that of 32 parcels on the east and west sides of Coldbrook Avenue between Stewart and Gray Road and Hall Road, 31 property owners are requesting this zone change as they feel they could get better use of their property if they had multiple dwellings on them. There were no persons wishing to speak in opposition of Zone Change #78. It was then moved by Councilman Giddings, seconded by Councilman Corbin and so ordered that the hearing be closed. :1.349 ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE ZONING MAP ADOPTED BY SECTION 9107 OF THE DOWNEY MUNICIPAL CODE (PLANNING RESOLUTION NO. 63 - ZONE CHANGE #78) (Phillips -- Coldbrook) The ordinance was read by title only. It was moved by Councilman Skinner, seconded by Councilman Peavey and so ordered that further reading be waived. It was moved by Councilman Skinner, seconded by Councilman Giddings and passed by the following vote that the ordinance be introduced. AYES: 5 Councilmen: Corbin, Giddings, Peavey, Skinner, Temple NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None The City Clerk reported there was a Planning Resolution restricting parking at all times on one side of Coldbrook and stated, if acceptable to Council, and by their direction, it would be prepared for next Council Meeting. Councilman Skinner requested Mr. Griselle to state his thinking as to the passage of the planning resolution. Mr. Griselle reported there is restricted parking at the present time during peak hours, and since it will be some time before construction of apartment buildings on the properties, when they are erected, Council could then pass the resolution. It was moved by Councilman Skinner, seconded by Councilman Peavey and passed by the following vote to table Planning Resolution #65 until the traffic warrants its passage. Mr. Griselle presented a resume in which he stated the applicant requested C -1 zoning and after the hearing before the Planning Commission, it was recommended for C -1 zoning on the front portion of the property, leaving a portion in a parking zone. Applicant has dedicated access rights to Tristan Drive at the north end of the property which means the public would not be able to enter from Tristan Drive or exit into Tristan Drive from applicant's proper- ty. The Mayor inquired of the City Clerk if she had the Affidavit of Mailing. The City Clerk replied she had the affidavit. Mayor Temple asked if there were any written protests. The City Clerk replied there were none. Leslie Olson, 10022 Tristan Drive, spoke for applicant. There were no other oral comments. It was then moved by Councilman Corbin, seconded by Councilman Peavey and so ordered that the hearing be closed on Planning '^ Resolution #64, Zone Change #80 - Rockwell -- Lakewood Boulevard. 13bO ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE ZONING MAP ADOPTED BY SECTION 9107 OF THE DOWNEY MUNICIPAL CODE (PLANNING RESOLUTION NO. 64, ZONE CHANGE #80) (Rockwell - Lakewood Boulevard) The ordinance was read by title only. It was moved by Councilman Peavey, seconded by Councilman Giddings and so ordered that further reading be waived. It was moved by Councilman Peavey, seconded by Councilman Corbin and passed by the following vote that the ordinance be introduced. Mr. Griselle presented a resume of the case. Mayor Temple as- certained that the City Clerk had the Affidavit of publication. Councilman Skinner inquired if there would be sufficient parking for 1z to 1, and if not, whether applicant will be required to provide suf- ficient parking. Mr. Griselle replied that applicant will have to meet the requirements of the zoning ordinance for parking facilities, 12 to 1. Leslie Olson spoke for the applicant. There were no other oral comments. There were no additional oral comments. It was moved by Councilman Corbin, seconded by Councilman Giddings and so ordered that the hearing on Planning Resolution #66, Zone Change #81, Minch -- Stewart and Gray Road, be closed. ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY AMENDING THE ZONING MAP ADOPTED BY SECTION 9107 OF THE DOWNEY MUNICIPAL CODE (PLANNING RESOLUTION NO. 66 -- ZONE CHANGE 481) (Minch -- Stewart and Gray Road) The ordinance was read by title only. It was moved by Councilman Giddings, seconded by Councilman Corbin and so ordered that further reading be waived. It was moved by Councilman Corbin, seconded by Councilman Skinner and passed by the following vote that the ordinance be introduced. AYES: 5 Councilmen: Corbin, Giddings, Peavey, Skinner, Temple NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Mayor Temple announced that this is the time and place set for the public hearing on an appeal to Zone Exception #267. Mr. Griselle presented a resume reporting that originally an application for Lot Split had been filed ( #219) requesting a three -way split on a 75' parcel. This original split is now on appeal again and an original zone exception is on appeal for Planning Commission's denial and recommendation to split the lot into two 37 -1/2' parcels. R -1 zone requires dimensions of 50' x 75'. Evidently these lots were sold separately without prior lot split approval. Mayor Temple inquired if the City Clerk had an Affidavit of Publication. The City Clerk replied she did have the affidavit. The Mayor inquired if there were any written protests. The City Clerk replied she had received none but it was her understanding the Planning Director was in receipt of protests. A petition was directed to Planning Commission and not to Council. Councilman Skinner inquired of Mr. Griselle if all those in protest have 25' lots. Mr. Griselle replied he did not know. Councilman Peavey inquired if these three lots had been subdivided as 25' lots. The City Attorney advised thkt under the ordinance it is provided that even though they may have been subdivided into 25' lots, subse- quently coming into one ownership, then there must be a lot split for a sell -off and there must be an exception for them to build on less than ;fi'fty -foot' 16t's.. Speaking in favor of the exception were the following persons: Fred J. Olson, 15126 Rosecrans, La Mira, representing appellants: Streety Homes, Inc., Virginia Beverly and Ruth Wells Dave Streety, Contractor Virginia Beverly, 7973 Harper Street, Downey Speaking in opposition was Mrs. O'Donnell, 13611 Dempster who stated she had attended the last meeting of the Planning Commission and submitted a petition, and that she has again obtained names of property owners protesting this zone exception. Originally this 75' had been held by one owner. She feels a row of houses on 25' lots would downgrade the neighbor - hood. Her petition was ordered received and filed by Mayor Temple. Mr. Olson spoke in rebuttal after which it was moved by Councilman Corbin, seconded by Councilman Peavey and so ordered that the hearing on Zone Exception #267 be closed. Councilman Corbin remarked that according to the ordinance, a 50' lot is required. Applicant filed for an exception and in the absence of an exception, will be required to be 50' lots. Councilman Peavey inquired if the lot split had been asked for by the original property owner who owned three lots. Mr. Griselle replied that according to the tax rolls, the 1tst owner of record is the name applied to such applications. These lots have sold, however, without benefit of due processing. Councilman Giddings inquired if the lots were sold before the ordinance or after its adoption. Mr. Griselle replied it had been approximately 6 or 7 months ago that the original application had been made. The City Attorney remarked that the lot split ordinance had been adopted in April, 1957, and the Zoning Ordinance was adopted almost a year ago. He stated further that Mrs. Beverly is wondering what to do with a 25' lot, but that the lots were sold and purchased, knowing there would have to be an exception in order to build on them. If the property was sold prior to the zoning and lot split ordinance, then he would say the owners would have a case, but now it just boils down to what is good for the area. It was moved by Councilman Skinner, seconded by Councilman Corbin and passed by the following vote to uphold the decision of the Planning Commis- sion and deny the appeal of Streety, Beverly, Wells in Zone Exception Case #267 which would approve the property for two lots of 37 -1/5' widths. 1352 AYES: 5 Councilmen: Corbin, Giddings, Peavey, Skinner, Temple NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None It was moved by Councilman Peavey, seconded by Councilman Giddings and so ordered that the minutes of the Council Meeting of February 27, 1962, be approved as written. The City Clerk reported on the following written correspondence: (1) A letter from Emma L. Grabe regarding Zone Change Case #76, requesting that it be held in abeyance until plot plans and elevations for developments can be submitted as requested by City Council. It was moved by Councilman Peavey and so ordered that Zone Change Case #76 be tabled. (2) A letter from C. P. Gullickson complaining against the Planning Department. Mr. Griselle informed Council that there has been an alleged violation of the zoning ordinance and he is not sure if a violation does exist. On a violation, he stated, the department likes to bend over backward to reach an amicable agreement, and the last thing wished to be done is filing of a formal complaint. Perhaps it has taken a little more time in this case, but delays do give the people a little more time to conform with the ordinance and it was stated this is the reason the Plan- ning Department has taken its time. Mr. C. P. Gullickson, 13669 Laureldale Avenue, reported that for over a year and a half he has tried to get the Planning Commission to do some- thing about the unsightly condition of that property. Council requested the City Manager to investigate the program and Councilman Skinner asked that he be kept informed. (3) A letter from Supervisor Frank G. Bonelli, in response to a re- quest from the City of Downey that money be appropriated for certain proposed extensions of Storm Drain Project No. 615 and he reported that it had been suggested that the City of Downey wait until a determination of savings from the overall program can be made before proceeding with its supplemental project. Also, it was suggested that City officials meet with the Chief Engineer or Chief Deputy Engineer or both to explore the matter further. (4) A letter from the Building Contractors Association regarding amendments to the Zoning Ordinance, and the reply to them written by Mr. King. It was reported the matter was being taken care of. (5) A petition filed by Mr. Walter Gruber, 9157 Brookshire Avenue relative to the parking restrictions. The petition was ordered received and filed. (6) A letter from the City of La Mirada extending an invitation to members of the City Council and Civil Defense Officers to attend a meet- ing of the Survival Engineering Consulting Organization on Tuesday, March 13, at 7:30 P.M., in the La Mirada Council Chambers located at 15008 South Lutwieler:, The City Manager was directed to arrange for someone to attend from the City of Downey. (7, 8, and 9) Letters protesting the Weed Abatement program, one from R. P. Stemmler, one from Angelo Perry (owner of 8819 Dalen Street, Downey), and one from Clarence J. Trollope, 9641 E. Imperial Highway. The City Manager reported that the first discing will be done in about 3 or 4 weeks. Mr. Leavitt explained the program and the manner of 3.i3 notifying persons wanting to disc their own property and keeping them alert before having the City go ahead. Councilman Giddings remarked that it was not so much what the City charges but the damage occurring and the poor job the people feel has been done. After further dis- cussion and a request by Mr. George Rockwell that anything outside weeds should be bid on and the people notified, and that there should be a set price for cleaning each lot, the City Manager stated there will be an endeavor to inform people of the cost and starting date. Ed Reinke stated after an incidence of unwarranted cleanup on some lots on which a backstop is maintained for youngsters, he would advise that someone seethe lots at least a day before the City goes in, in order to see if the lots have been already cleaned. Councilman Corbin stated he concurs with Mr. Reinke with the idea that the lots should be checked beforehand where a cleanup job will be of any consequence. The City Manager reported that the weeds are always a problem in every city but that perhaps this year there can be a closer inspection and the property owners given more of a chance to clean up property before the City goes in to do it. The City is going to do the utmost possible to work it out with them. He feels there was a pretty good city -wide cleanup last year and hopes a better job can be done next year. Bob DeSio, who is in charge of the Weed Abatement program, stated the situation this year will differ due to the great amount of rain. He also explained the reason for two discings per year instead of one. After a summation of the bids for Cash Contract #78 for weed abate- ment, it was recommended that the contract be awarded to the lowest and best bidder, John C. Werner, at the unit price as listed, and that notification to property owners where the cost is over $25.00 be given and that close inspections by the Public Works Department be undertaken. It was moved by Councilman Giddings, seconded by Councilman Corbin and passed by the following vote to award the contract for weed abatement, Cash Contract #78, to the lowest and best bidder, John C. Werner, at the unit price listed, that property owners be notified where the cost is over $25.00, and that close inspection be made by the Public Works Department. Councilman Skinner advised he has not been contacted regarding this matter but he would be happy to meet with the property owners to discuss this problam. The City Clerk reported she had received an application from the Downey Athletic Association for a parade permit for May 19 at 11 :00 A.M., which parade is to last 20 minutes. Approval had been granted by the City Manager and Ivan Robinson, Chief of Police. It was moved by Councilman Peavey, seconded by Councilman Skinner and so ordered to authorize permission for the parade as requested by the Downey Athletic Association. The City Attorney reported that an ordinance was adopted forming an off - street parking district and by the time his office got into filing the complaint, it was discovered that there were certain typographical and certain clerical errors relating to some phases of it in the descriptions primarily. He does not believe this invalidated the ordinance at all but did leave it open for perhaps a question in one or two instances. Therefore it was recommended that a new ordinance be adopted clearing up these errors and repealing the original Ordinance No. 171. The new ordinance makes no changes in the properties or boundaries. ORDINANCE NO. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY FINDING AND DETERMINING THAT THE PUBLIC INTEREST AND CONVENIENCE REQUIRE ORDERING THE ACQUISITION AND IMPROVE - MENT FOR VEHICLE PARKING DISTRICT NO. 1 OF SAID CITY AND ESTABLISHING THE BOUNDARIES OF SAID DISTRICT AND REPEALING ORDINANCE NO. 171 The City Attorney read the ordinance by title only. Councilman Peavey excused himself from the Council Chamber in order to abstain from voting on this matter. He stated he feels the property owners will go along with the City and pave the road from the curb to the blacktop now existing. Councilman Skinner's card was given to Mr. Riley for the purpose of setting up an appointment to discuss the matter with other property owners in the area. 1355 RESOLUTION NO. 945 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY REQUESTING AN ALLOCATION FROM THE PUBLIC UTILITIES COMMISSION CROSSING PROTECTION FUND The resolution was read by title only. AYES: 5 Councilmen: Corbin, Giddings, Peavey, Skinner, Temple NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None The City Manager announced that the landscaping project on Firestone Boulevard in concurrence with reconstruction by State Division of Highways to rebuild the shoulders to support heavy truck traffic and generally improve the street to provide for four lanes of traffic and left -turn pockets throughout the entire length, from the west City limits to Lakewood Boulevard, was now ready for approval of plans and specifications. Bob DeSio was asked to explain the plantings. The City Manager stated that just about every business owner had been in to see the plans and specifications showing left -turn bays, and everyone, as far as he knows, is happy with these plans. The first phase of the Firestone project will be curbs and islands; second, the sprinklers (for night sprinkling); and third, actual planting with the entire project being completed approximately the first part of December. Councilman Skinner suggested working toward having a large sign at the west end of the entrance into Downey designating "City of Downey ". This was concurred with by Councilman Corbin. It was moved by Councilman Giddings, seconded by Councilman Peavey and passed by the following vote to approve plans and specifications for Cash Contract #61, Firestone Boulevard Center Median Planting. It was moved by Councilman Peavey, seconded by Councilman Skinner and so ordered to approve preliminary plans and authorize circulation of peti- tions for DaCosta Street Improvement to be known as A.D. #76, opening and improvement of street westerly from Brookshire Avenue. It was recommended Council confirm employment of Ervin Spindel as Director of Public Works at $1200 per month, effective April 1, 1962. The Personnel Board and City Manager had approved the selection and recommenda- tion. It was moved by Councilman Peavey, seconded by Councilman Skinner and so ordered confirming the employing of Ervin Spindel as Director of Public Works at $1200 per month, effective April 1, 1962. It was moved by Councilman Corbin, seconded by Councilman Giddings and so ordered to confirm the appointment of A. C. Gabriel to the position of Director of Finance at the rate of $875 per month, effective March 1, 1962. City Engineer Lee Leavitt reported that construction of sanitary sewers under PC #5482, Birchcrest Road, have been satisfactorily completed and recommended their acceptance for maintenance and use by the public. It was moved by Councilman Peavey, seconded by Councilman Skinner and passed by the following vote to accept the sanitary sewers of PC #5482 on Birchcrest Road for maintenance and use by the public. AYES: 5 Councilmen: Corbin, Giddings, Peavey, Skinner, Temple '�" NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None Lee Leavitt reported that sewer construction by property owners on Lakewood Boulevard have been paid for by two property owners on that street and that it is now being requested that authorization be granted by Council to collect from the remaining owner to reimburse proportionately the owners who had paid for the entire construction. Only one property owner has not paid and is now ready to be connected. It was moved by Councilman Corbin, seconded by Councilman Skinner and passed by the following vote to approve the authorization to distribute sewer connection fees. It was moved by Councilman Peavey, seconded by Councilman Giddings and passed by the following vote to set a public hearing on Planning Resolution #68, Zone Change #82 (Helen Sachs, 9547 Lakewood Boulevard) at the hour of 8:00 A.M., March 27, 1962, in the Council Chamber of the Downey City Hall. AYES: 5 Councilmen: Corbin, Giddings, Peavey, Skinner, Temple NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None 1358 Councilman Peavey requested the illustration of the new Downey Exchange Center to be built at the corner of Downey and Firestone Boulevard to give the opportunity to view it by anyone in the audience who possibly had not been able to do so earlier. He stated he is very proud Downey is going to have this development. ^� The City Manager reported that attention has been called to license fees for solicitors within the City of Downey, employed by local business establishments which were reported as not being comparable with those charged in other cities in the area. A survey of these other cities was made and it appeared from this survey that the City of Downey is charging an excessive amount for solicitors employed by local establishments. It was, therefore, recommended that the inequity be corrected and that Section 6236 be changed by adding the sentence: "No fee shall be required from a person who is employed by a local business which has been estab- lished within the City for at least six months and has a current license pursuant to this Chapter." The City Attorney asked that this matter be referred to him as there was a matter in the State wherein it was determined that a time limit of that nature was improper. He would like to review it and report to Council. A. C. Gabriel, Director of Finance, advised this would in no way restrict licenses or permits issued by the Police Department. The City Manager reported that according to the City Treasurer's Report as of March 1, there was in the various banks throughout the City of Downey deposits amounting to $1,644,814.19. A recap of all departments indicates all are well within their budgets and he feels the year will end in a very good cash status. Councilman Giddings asked by this "cash status" would the City Manager be able to state any amount. The City Manager reported it should be approximately between $800,000 and $1,000,000. - Councilman Corbin stated he was glad to see the post office site being cleared of old buildings as it is one project which had been worked on for a long time and he is very glad to finally see it get started. Councilman Giddings reported that he had received many phone calls indicating he was supporting someone running for Council and he wanted to have the press print that he is not supporting anyone, and that if and when he is supporting someone, he will be the first one to say so, but as of this day he is neutral, though he may not be in the future. Councilman Peavey reported that in conjunction with planning and zoning he has been appointed by the League of California Cities of Los Angeles County to work with various cities in the county and to try to work up a uniform zoning ordinance so this city and any surrounding city might know what the zoning is. This committee has used a large portion of the Downey Ordinance in the proposed ordinance being drawn by the members of the com- mittee. He reported that Milton Breiwogel, County Planning Commissioner, is on the committee; and he is proud that the Downey Ordinance is thought of highly enough to have parts of it submitted to other cities in the Los Angeles County. This type ordinance would be very helpful for anyone coming into the City of Downey in knowing the zoning existing here as well as other areas in the county. He is happy to have been appointed to this committee. •-� This was started long before Downey was incorporated and will take about another year, perhaps more, to complete such a uniform code. Mayor Temple stated he is proud Councilman Peavey is to represent the City of Downey and advised he could depend on an able Planning Director for assistance. 1359 A report was made by Hal Durham, Traffic Engineer, on Fifth Street Parking and the recommendation submitted by the Traffic Committee was that the parking regulations be altered along all of Fifth Street between Lakewood Boulevard and Downey Avenue to allow parking during the peak hours on weekends and holidays, except where parking is presently pro- hibited at all times. RESOLUTION NO. 949 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY PROHIBITING PARKING ON THE SOUTH SIDE OF FIFTH STREET, BETWEEN LAKEWOOD BOULEVARD AND BIRCHDALE AVENUE; AND ON THE NORTH SIDE OF FIFTH STREET, LAKEWOOD BOULEVARD TO DOWNEY AVENUE; ON THE SOUTH SIDE OF FIFTH STREET, BROOKSHIRE AVENUE TO DOWNEY AVENUE The resolution was read by title only. It was moved by Councilman Skinner, seconded by Councilman Giddings and so ordered that further read- ing be waived. It was moved by Councilman Giddings, seconded by Councilman Corbin and passed by the following vote that Resolution No. 949 be adopted. AYES: 5 Councilmen: Corbin, Giddings, Peavey, Skinner, Temple NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None The City Attorney reviewed for City Council that at the last meeting he was asked what could be done relative to Zone Case #53. He stated he referred to the minutes of the Council dated November 28 and at that meet- ing Council referred to Planning Commission for the purpose of holding a hearing. The Planning Commission, following referral, took the matter under submission and is presently holding it under submission for the purpose of awaiting development of the Master Plan. If the Council wishes to take some action upon this, a formal motion submitted to each of them by him effectively provides that Council would recall the matter before the City Council and request the Planning Commission to forward it to Council. Once back in the hands of the Council, it can take steps it may desire. Councilman Peavey remarked that he had asked for that information but inasmuch as it seems to be getting into the matter of politics, he would prefer it stay right where it was, unless someone else wants to take some action in the matter. Councilman Corbin stated he agrees with Councilman Peavey. No action was taken. A very complete and conclusive progress report on the Master Plan was presented by the Planning Director, Sherman Griselle. He guaranteed that the plan would be completed by next February or before -- hoping that it may be by the end of the year, which is 10 months away. He went into the State Planning Law which sets forth the basic requirements that go into the making up of a Master Plan. The land view, field survey is already completed a month ahead of schedule. Councilman Giddings stated he would like to clear up a question as to whether there is anything a Councilman can do to speed up the progran and asked if it were not true that everything that can be done is being done to get the plan finished just as quickly as possible. Mr. Griselle reported that he had heard the comment "it should be speeded up," but there is no way he feels it can be done and come up with a workable plan which will have lasting value to the community. Councilman Skinner inquired if Council could do anything to further help by getting assistance - -money or personnel, and requested that when the plan is 1360 Mr. Griselle advised Council that Lot Split #219 in coijunction with Zone Exception Case #267 (Streety Homes, Inc., Beverly and Wells) on which the decision of the Planning Commission was upheld, and that such action, in effect, has also denied Lot Split #2X9, He recommended Council take action on this matter. It was moved by Councilman Skinner, seconded by Councilman Peavey and passed by the following vote to grant Lot Split #21f9 to the effect of making two 37 -1/2 foot lots and denying the request for three 25 foot lots. AYES: 5 Councilmen: Corbin, Giddings, Peavey, Skinner, Temple NOES: 0 Councilmen: None ABSENT: 0 Councilmen: None The Mayor reviewed his request that an investigation be made by the City Attorney regarding various citizens coming into the City of Downey and setting up business in stores, trailers, or other businesses, as income tax consultants. The City Attorney stated that there is nothing covering this except insofar as the use of trailers may be concerned - -he does not recall juBt what it is, but it prohibits use of trailers for business or residential purposes except in the proper zones. As far as setting up this type business in clothing or grocery stores, it is in a proper zone, is just another business, and regardless of the fact it will be there for 2 or 3 months instead of 2 or 3 years, or 20 to 40 years, this does not constitute any changes. They are not prohibited from operating a business as long as they have a business license. The City Attorney was asked to submit a further report on whether or not a period of time can be set to determine whether a business is permanent or itinerary. Bob Brazleton, 10029 Birchdale, came forward from the audience to state he generally concurs with the action of the Council taken with regard to Zone Change #53 and wished to congratulate Mr. King and the rest of the people who have had a hand in the Greschner development.
