MINUTES OF THE CITY COUNCIL
OF THE CITY OF DOWNEY
FEBRUARY 13TH, 1962
The City Council of the City of Downey held a regular adjourned meeting
in the Council Chamber of the Downey City Hall at 7:30 P.M., February 13, 1962,
Mayor Scott E. Temple presiding. The regular meeting held February 12, 1962,
had been adjourned to this date and time by the City Clerk due to lack of a
quorum.

Mayor Temple introduced Boy Scout Troop #972 from Roger Casier School and
Troop #686 from the Ed C. Lewis School, who led the presentation of colors in
honor of Boy Scout Week. Representatives of the troops thanked the Mayor and
Councilmen for giving them the opportunity of presenting the colors at the Council
Meeting.
Chief Ivan A. Robinson reported on the completion of four police officers
of the City of Downey of courses at the Los Angeles Police Academy under the State
of California Peace Officers Standards and Training Commission program. He stated
that these four are the first Downey Police Officers to be certificated under this
new program and that this is the first step in the State Peace Officers' Associa-
tion to establish law enforcement as an accredited and accepted profession in the
State of California. Mayor Temple was asked to present certificates to the follow-
ing four officers: William B. Harris, Jr., Clayton E. Dyrr, Richard C. Dorn and
Ronald L. Arrington. Mayor Temple congratulated the officers on behalf of the Council.
Mayor Temple requested the City Clerk to present the petition regarding the
widening of Fifth Street. The City Clerk reported she had received a petition
signed by 47 owners and taxpayers on Fifth Street between Paramount Boulevard and
Downey Avenue; a petition from owners on Fifth Street between Downey Avenue and
Lakewood Boulevard with 42 signatures and a second petition from owners on Fifth
Street between Downey Avenue and Lakewood Boulevard with 78 names and attached
thereto, protesting the widening of Fifth Street, a petition from 88 property
owners on Sixth Street, protesting alteration of the traffic regulations on their
street. It was understood this runs from Paramount across to Lakewood.
Councilman Peavey stated that City Council has made no move to widen any .
part of Fifth Street between Paramount and Downey Avenue, the narrow portion of
that end, and it has been found that most of the frontage that could possibly be
needed belonged to the County. When the City was incorporated it was transferred
to the City. Someone has "jumped the gun" and spread an alarm - -there has been no
width mentioned. It is understood that it had been mentioned that the street
might even be widened 80 feet which would be mostkm'ealistic. Parking has been cut
off on one side and should really be cut off on both sides from the Mdhodist Church
to Paramount Boulevard. He recommended that the property owners in that area and
only that area meet with the City Manager for further discussion. Mayor Temple
suggested that a meeting be arranged after the study is completed.
Mr. King reported that a preliminary investigation of Fifth Street between
Paramount and Downey disclosed that the street could be widened to the minimum of
40 feet as approved by other streets by the Division of Highways. It appears that
a 40 -foot street from Paramount to Downey could be constructed without materially
hurting any of the residences in that area.

Prior to any further studies or preliminary decisions, each person will be
notified by post card to hear the preliminary discussion.
Mayor Temple suggested including in the study the possibility of
making a one -way street of Fifth Street.
Councilman Corbin suggested finding out first what the width of the
street will be. He also agrees that the people should be notified - -to date,
there is nothing to be done other than making a study - -there is nothing
definite at this time.
Mr. Ted Kilpatrick, 8117 Fifth Street, corner of Fifth and Western,
which is an R -3 zone; the south side, R -2, stated an 80 -foot width would
almost irreparably damage his property. If the street is widened appreciably
it would cause considerable traffic. Once it is widened from Paramount to
Downey it will be a further hazard, more than the congestion at the present,
and there will then be increased pressure to widen it further on to Lakewood.
He stated he felt the time to protest was before any definite plans were made.
Mayor Temple stated he is glad to see the citizens are alert.
The Mayor announced that now is the time and place set for the public
hearing on Zone Exception #254, 9245 E. Florence for the new Methodist Church.
The Mayor inquired if the City Clerk had the Affidavit of Publication. The
City Clerk replied she had the affidavit.
Mayor Temple inquired if there were any written protests. The City Clerk
replied she had received a letter from Mr. Kirklen which the Mayor stated he
would have read into the minutes later.
Mr. Griselle presented a resume of the case, after which Mayor Temple
asked representatives for appellant to speak.
Leslie Olson, 10022 Tristan Drive, spoke for appellant, stating they
are asking for a zone exception to build and establish a church. He displayed
a picture of the proposed church building.
Reverend David Foster, 6929 Arbutus, Huntington Park, and Jim Strayer,
10242 Lakewood Boulevard also spoke for the zone exception's being granted in
favor of the church.
The City Clerk read into the minutes the letter from City Wide Taxpayers
Association signed by H. L. Dougan, Chairman, favoring Zone Exception #254.
Speaking for the opponents were George Clark., 9226 E. Dinsdale, Guy Hill,
9232 Dinsdale and Gordon Hower, 9248 Otto Street. Pictures of their property
back of the proposed church site were presented by Messrs. Guy Hill and George
Clark.
A request by Mr. Hower that the majority of the church roster must reside
in the City of Downey be written in as one of the conditions upon granting such
exception was stated to be invalid by the City Attorney. Mr. Sorensen stated
it Gould be presented for Council's consideration, if they so desire, but could
not be made a part of any conditions which might be set.
- Mr. Hower commended the Planning Commission and hopes they will continue
to do the same fine job.
Mayor Temple instructed the City Clerk to read into the minutes the letter
from Mr. William R. Kirklen protesting Zone Exception #254.

and so ordered that the hearing be closed.
Councilman Skinner inquired to what use the house and the other build-
ings on the property proposed for the church site are to be put. Mr. Olson
replied they would be occupied and used by the minister and his family. The
buildings could be removed if the Commission so requires.
Councilman Peavey inquired as to the construction of a wall on the
church property. Mr. Olson stated it would be a six -foot wall. Councilman
Corbin inquired if it would be on three sides of the property and a 5'11" wall.
Mr. Olson replied it would be.
Councilman Skinner inquired about sidewalks, and was informed sidewalks
are already in. Also questioned was whether or not there might be a drainage
problem in this area. Mr. Olson replied there is no drainage problem as it
could be drained to Florence.
Councilman Corbin inquired about the type building existing in the rear
of the property. He was informed it was a garage type building and would be
revamped.
Councilman Skinner suggested and recommended that Council make a further
study and view the buildings existing on the proposed church site.
It was moved by Councilman Corbin, seconded by Councilman Skinner and
passed by the following vote to take under submission Zone Exception Case #254
in order to observe the buildings on the property.

Mayor Temple announced that this is the time and place for the public
hearing for protests or objections against the assessment for improvement of
Sixth Street and Lakewood Boulevard as described in Resolution of Intention No.
815 and amended by Resolution No. 925.
The Mayor asked the City Clerk if she had the Affidavitsof Publication,
Posting and Mailing. The City Clerk stated she had the affidavits.
It was moved by Councilman Peavey, seconded by Councilman Skinner and so
ordered that the affidavits of publication, posting and mailing be received and
filed.
Mayor Temple inquired of the City Clerk if she had received any letters of
protest against the assessment, the improvement as constructed or the proceedings.
The City Clerk replied she had not. There were no oral protests.
It was moved by Councilman Corbin, seconded by Councilman Peavey and so
ordered that the hearing be closed.
RESOLUTION NO. 933
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
CONFIRMING THE ASSESSMENT FOR THE IMPROVEMENT OF SIXTH
STREET AND LAKEWOOD BOULEVARD (AD 12)
The resolution was read by title only. It was moved by Councilman Peavey,
seconded by Councilman Skinner and so ordered that further reading be waived.

It was moved by Councilman Corbin, seconded by Councilman Peavey and so
ordered that the minutes of the Council Meeting of January 23, 1962 be approved
as amended.
The City Clerk reported on the following written correspondence:
(1) A letter from Byron T. White requesting permission to circulate a
petition to improve Rives Avenue from Firestone Boulevard to Stewart and Gray
Road, including curbs, gutters, sidewalks, street paving and street lighting.
It was further requested that the City contribute to the assessment district
to cover the cost of the paveout and sidewalks.
Mr. King suggested that the City Council authorize circulating petitions
for these improvements and that the City pay for the cost of paveouts.
It was moved by Councilman Skinner, seconded by Councilman Peavey and
passed by the following vote to authorize the circulation of petitions and
the City pay the cost of paveouts and that the matter be referred to the
Director of Public Works for proper preparation of the petitions.

(2) A letter from the Downey Chamber of Commerce recommending that any
decision regaling the construction of a Civic Auditorium be put before the
voters. The letter was ordered received and filed.
(3) A letter accompanied by a resolution from the City of Bell urging
the return of the "Cheli Air Force Base" to the Chanslor Western Oil Company,
so that this may be developed for heavy industry. Councilman Peavey asked the
City Attorney to check the resolution before being adopted by the City of Downey.
(4) A letter from Attorney Robert C. Gustaveson representing Mr. William
Brining regaling the Parking problem on Brookshire. Ordered received and filed.
Mr. Gustaveson asked to present the facts as he sees them regarding the parking
problem and after his presentation requested another public hearing, although
there had been two others previously, in order to possibly obtain a "balancing
of equities." He was informed Council would not need to set a public hearing
but that he make a formal request for reconsideration of the matter.
The City Attorney referred back to the resolution submitted by the City
of Bell. The resolution was read by title only.
It was moved by Councilman Peavey, seconded by Councilman Corbin and so
ordered that further reading of the resolution be waived.
It was moved by Councilman Peavey, seconded by Councilman Corbin that the
resolution be adopted. The Mayor asked for clarification of the junior college
portion. Mr. King stated that studies for a junior college in this area are too
nebulous to be considered at this time.
Councilman Peavey amended his motion to strike the junior college portion
of the resolution. The City Attorney was again asked to revise the proposed
resolution.

(5) The City Clerk reported a claim had been received from
Mr. Lawrence Uffer on which the City Attorney had the complete information.
Also received was a claim -- Jenison vs. County of Los Angeles. The City
Attorney reported that this latter claim was with regard to ad valorem taxes
of the City and inasmuch as the County Tax Collector handles collections for
the City of Downey, the case will be handled through the County Counsel's
Office on behalf of the County of Los Angeles and as representative for the
City of Downey.
In the claim of Uffer, for personal injuries incurred by reason of
defective conditions in the parkway area, the City Attorney recommended that
Council deny the claim and refer it to the City's insurance carrier.
It was moved by Councilman Peavey, seconded by Councilman Skinner and
so ordered that the claim for personal injuries filed by Lawrence Uffer be
denied and the matter referred to the insurance carrier for the City.
(6) A request from Mrs. Marie Stephens to appear before Council.
Mrs. Stephens, 12044 Bellflower Boulevard, requested left -hand turning bays
at Stewart and Gray Road and Bellflower, and also at Garfield Street and
Firestone Boulevard.
Councilman Skinner remarked that the intersection of Garfield and
Firestone would not be within the City of Downey.
Mr. King stated that the channelization of Firestone should alleviate
many of the problems and that there is a need for about 10 feet of additional
pavement at Stewart and Gray Road at Bellflower Boulevard. Hal Durham, Traffic
Engineer, was asked for a report regarding this matter. He stated that at the
northwest portion of the intersection pavement is needed on this particular
corner to provide lefthand turning.
Councilman Skinner requested Mrs. Stephens to call him in order that
an appointment may be set up to investigate the problem reported by her.
The City Attorney reported he had stricken from the resolution requested
by the City of Bell, the reference to a junior college district and again read
the resolution by title only.
RESOLUTION NO. 940

The City Attorney reported there is an emergency ordinance and a rep-
resentative from the County Health Department, Mr. Walter Kinsey, was present
to explain the reasons for the need for this emergency ordinance. Mr. Kinsey
reported that the State Legislature had repealed a section dealing with sani-
tation and recommended adoption of the ordinance as a curbing measure.
The City Attorney inquired of Mr. Kinsey if he had read the emergency
clause in the proposed ordinance. The reply was in the affirmative. Then the
City Attorney inquired if he had found the ordinance correct and that it should
be adopted as an emergency measure. The reply was affirmative.
Councilman Corbin inquired if the ordinance was being adopted due to the
requests made by citizens with reference to a specific situation. Mr. Kinsey
replied that it was not and that there were other situations such as stables,
backyard poultry which might be in need of an enforc :Mg measure. Mayor Temple
stated that the ordinance is a tool to be used if necessary.

ORDINANCE NO. 192
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AMENDING THE DOWNEY MUPICIRRAL CODE BY ADDING THERETO A
NEW SECTION RELATING TO INSANITARY PREMISES
The ordinance was read in full by the City Clerk. The City Attorney advised
that a motion should be made, adopting the emergency clause of the ordinance.
It was moved by Councilman Peavey, seconded by Councilman Skinner and passed
by the following vote to approve and adopt the emergency clause in Ordinance No.192.

A brief rundown was made of five sections proposed to be amended in the
Comprehensive Zoning Ordinance to clarify the intent and eliminate questions con-
cerning interpretations due to loose wording.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AMENDING THE DOWNEY MUNICIPAL CODE BY ADDING THERETO A
NEW SECTION TO BE DESIGNATED SECTION 8306.1 AND RELATING
TO THE DEMOLITION OR REPAIR OF UNSAFE BUILDINGS
The ordinance was read by title only. Ray Lake, Director of Building and
Safety, explained the need and purpose of the proposed ordinance. The amendment
provides for a public hearing to be held at the owner's request, on any building
or structure deemed by the Director of Building and Safety to be an unsafe build-
ing as defined in Section 203 of the Building Code. In the event that the City
finds that legal action is necessary to remove any such hazardous budding, after
said public hearing, it provides the means for the owner to permit the City to
remove the structure, placing a lien against the property, without court action.

Roy Kechter, 1540 W. 140th, Los Angeles, also protested the change in
the ordinance to require the housemover to clear the foundation as it is a
separate operation, requiring equipment separate from housemoving, and
therefore not in their category.
Mr. Lake reported that it was not the houses moved for freeway purposes
that were the ones he was discussing, but rather the private buyers, sellers
and movers.

ordered that the ordinance be referred to the City Attorney for clarification
and report at the next Council Meeting.
John Wood, President of the House Buyers and Sellers questioned if this
meant removal of foundations on a number of houses recently purchased for free-
way purposes in two weeks. He was advised to the contrary and that merely the
ordinance was to be studied and a report be brought to Council in two weeks,

The Mayor requested Mr. King to explain the purpose of the next resolu-
tion regarding request for a census. It was reported that further investigation
has resulted in the belief that the population of the City of Downey is
approximately $8,000. This estimate is based upon current surveys by the Civil
Defense Daytime and Nighttime Population Survey as well as the Los Angeles
County Regional Planning Commission figures. If this should be the case and
could be supported by a new census, it would result in an increase in popula-
tion of approximately 5,500 people which would result in an annual increase
of approximately $35,000 from Gas Tax Funds and In Lieu Taxes.

RESOLUTION NO. 937
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
PROHIBITING PARKING ON BOTH SIDES OF HALL ROAD, A
POINT 200 FEET EAST OF COLDBROOK AVENUE TO BELLFLOWER
BOULEVARD
The resolution was read by title only. It was reported by Mr. King
that a petition from approximately 60% of the residents of Hall Road in
the subject area had requested a restriction of parking so as to eliminate
the all -day parkers generated by Aerojet General Corporation employees. A
resolution originally was submitted to Council calling for the prohibition
of parking from a point 200 feet east of Coldbrook Avenue to Bellflower. The
City Council held this resolution in abeyance for further study at the request
of Councilman Skinner who had received a complaint from the owners of apart-
ment house units in the area. It is now felt that relief as requested can
be accomplished by eliminating all -day parkers without inconveniencing the
apartment dwellers by posting only those areas that are immediately adjacent
to Aerojet General Corporation. The attached resolutiaicovers slightly more
than this area; however, the Department of Public Works will post only those
areas necessary to control parking.
Clinton Parrish, 9105 Hall Road, protested the no parking signs on Hall
Road as he has 2 rentals and would only be provided one parking space. He
was advised that since he did not request the prohibition of parking, there
would be no signs posted in front of his property. Also Mr. Lovely, 9413
Hall Road and Mr. Herbert Senz, 9107 Hall Road were advised that no one who
did not request the no parking signs would have them posted in front of their
property.

Councilman Skinner stated it would seem advisable that Aerojet could
at least park on the north side and he inquired if the resolution could not
be amended to designate and delineate by footage those areas to be posted.
The City Attorney was asked to revise the resolution to this effect.

The Acting Director of Public Works reported the work required of Sulley-
Miller Contracting Company in their Contract #75 -A with the City to improve a
portion of the Public Works Yard around the Aerial Tower has been satisfactorily
completed. It was recommended that Council accept these improvements and
authorize filing a Notice of Completion.

so ordered to accept the improvements under Cash Contract No. 75 -A, Public
Works Yard Paving around drill tower, and to authorize filing a Notice of Com-
pletion.
It was reported that specifications have been prepared for Cash Contract
No. 78. Council was requested to approve specifications and grant authority
to advertise for bids.

authorize advertising for bids for award of contract.
The Acting Director of Public Works reported on Cash Contract No. 65
Dalen Street between Ardis Avenue and Bellflower Boulevard, an extension of
time of 12 working days has been requested, dine to inclement weather.

After a summation of bids on Cash Contract #66, Paramount Boulevard, it
was recommended that the contract be awarded to the lowest and best bidder,

The City Clerk reported that the next item for consideration on the
agenda is the petition from owners and residents of apartment house units
on Marbel Avenue relative to their parking problem,reporting that
Hal Durham, Traffic Engineer, was ready to present his findings after a
survey had been made of the area.
The Traffic Engineer read his report from the Traffic Committee.
The recommendation of the Traffic Committee is that the petition for head -in
parking on the cul de sac be denied and a proposal for reconstruction of the
cul de sac at the cost of the property owners to allow for additional parking.
Robert Reed, 10005 Pico Vista, presented a sketch showing head -in parking
stating there are two driveways which could be utilized for turning around.
Mr. Harold Collins, 10728 Marbel, added that fire trucks could use these
driveways or, in fact, could drive entirely around the building.
It was Mr. Kings suggestion that an investigation of this sketch be made
and a report be brought to the next Council Meeting.
Councilman Peavey suggested painting by the fire plug and recommended
giving every assistance and working out the problem for the benefit of the
property owners if at all possible.
Councilman Skinner stated that it appears to him that some of the parking
problems are going to have to be worked out by the property owners themselves.
He favored giving the matter further study.

ordered to give the petition relative to the parking problem on Marbel Avenue
further study.
The City Attorney reported that he had ready the proposed easement for
the .Southern California Edison Company which provides that the company may put
facilities on Lots 19, 20 and 21 of Tract No. 24197 and that they will remove
them when needed for public use.

has been no problem.

It was reported that E. D. Caldwell, representing owners of property
in Zone Change #72, requested of the Planning Commission to withdraw this zone
change. All proceedings therefore pertaining to Zone Change #72 have been
withdrawn by the Commission as requested.
Mr. King reported that construction will begin on Wednesday for the
current contract for storm drains.
Recommended by the City Manager was Council's authorization or approval
at least tentatively for the City's cooperation in paving Old River School
Road - -the area from where the church is to be located to the intersection of
Stewart and Gray on Old River School, providing curbs, gutters and sidewalks
are put in by the owners. This could complete and iron out the difficulties
which have arisen in this area. The property owner is still requesting zoning
to C -1, which is their responsibility, and the request will have to be sub-
mitted by them to the Planning Commission. The City will use 3/16 State - shared
gas tax funds for the pavement only on Old River School Road as well as
Stewart and Gray. The indication is that dedication of one property on Haro
will be forthcoming as the information from them is that if the City will
participate in the paving, they will dedicate right of way. Council was
advised that there will be no money spent until the deeds are in escrow.

It was reported by the City Manager that upon completion of construction
in A.D. #10 ,KLondyke Avenue et al., there was left a considerable grade dif-
ferential between the newly constructed curb and parkway with reference to
existing grade on Edison Company property, and as a result, fence constructed
along Laureldale Avenue south of Gardendale Street, has been seriously under-
cut. The Edison Company are considering building a small retaining wall along
this area to prevent damage to this existing fence. It is being considered to
construct this retaining wall immediately along the outside of the existing
fence, which would be in the public right of way (approximately 6 "). It was
recommended that the City Council authorize or approve an 8" easement to con-
struct this 6" retaining wall to hold up the fence.

The City Manager recommended that the motion relative to the paving on
Stewart and Gray Road be amended to include paving to the west property line
of Lot #14 westerly of Susan Avenue, provided the citizens participate in
this district by providing curbs and gutters.
The motion was re- stated by Councilman Peavey to authorize the City's
participation from 3/16 aid to cities gas tax funds for the paving of Old
River School Road approximately 500' north on Stewart and Gray to continue south
on Old River School Road to the south property line of Lot #4, west of Stewart

Councilman Corbin inquired about the park budgeting done by the City for
which service the Park Department is to reimburse the City. Mr. Gabriel, Acting
Director of Public Works, advised that a clari -fication of this budget operation
is being planned in the next proposed budget.
Councilman Corbin reported there are many bad spots in the various city
streets which need repair. Lee Leavitt reported that these conditions are
mostly due to the inclement weather and the fact that many of them are the
older streets which are beginning to fail.
Councilman Peavey commended the emergency hospital facilities of the
Downey Community Hospital where he was attended recently.
Councilman Skinner presented pictures showing the hold at cross gutters
at Imperial Highway at Lakewood Boulevard. Due to the very low west cross
gutter on Lakewood, the normal rains tie up traffic, stall cars and make
Imperial ineffective as a cross city- county highway, thereby causing heavy
traffic on Firestone, Gardendale and Rosecrans. Also, this involves extra
police and tow -truck work.
It was recommended that a study be made on this corner and as it includes
Lakewood, it would appear to be a state, county and city project. This would
improve the traffic flow at this corner until ultimate storm drain is installed
sometime in the future.

and so ordered to study the drainage problem at the intersection of Lakewood
Boulevard and Imperial Highway.
Mayor Temple wished to commend the Street Maintenance Division for the
many good comments received as a result of the around - the -clock shifts, answer-
ing complaints from citizens throughout the City, repairing damaged streets,
and patrolling for danger areas, aiding stalled vehicles in the flooded area
during the recent rains. A rundown of the men on alternate duty during this
period of time was given by Mayor Temple as follows: Mel Harldson, Bill Huyck,
Nick D'Amore, Paul Hamilton, Paul Ellis, Keith Rasmussen, Bill Arguella,
Ernest Arness, Kenneth Sem, Art Maier, Darrell Vaughan, Myles Sprague.
Mayor Temple reported that the City has been asked by Dodger Stadium to
participate in its grand opening and that the City has been invited to compete
in the beauty contest for the selection of a Miss Angel or Miss Dodger.
Dr. O'Toole, chairman of the Downey Rose Float Association, has been appointed
chairman to select beauty queen candidates from Downey for the Contest.
There being no further business to come before Council, the meeting was
adjourned by the Mayor at 11:20 P.M.
