OF THE CITY OF DOWNEY
JANUARY 8TH, 1962
The City Council of the City of Downey held a regular meeting in the
Council Chambers of the Downey City Hall at 7:30 P.M., January 8, 1962, Mayor
Scott E. Temple presiding.

Reverend Austin Coe of the Downey Memorial Christian Church delivered the
invocation.
Dr. Harry B. Silvers, County Health Officer, spoke on the small incidence
of tuberculosis in the City of Downey and urged Council to proclaim the week of
February 12, 1962, as the week for eradicating tuberculosis in Downey. The
Downey Woman's Club Juniors are spearheading the drive.
It was moved by Councilman Peavey, seconded by Councilman Giddings and passed
by the following vote that February 12 be designated as Eradication of T.B. Week in
Downey, and that the Mayor be authorized to issue a proclamation.

The Mayor announced that now is the time set for the hearing on the Downey
City Lighting District.
Mayor Temple asked the City Clerk if she had the Affidavit of Publication. The
City Clerk replied she had.
The Mayor asked if there was any written correspondence relative to this
lighting district. There was none.
Hal Durham, Traffic Engineer, presented a brief resume regarding this consolida-
tion of the lighting districts in the City of Downey and questions from the audience
were answered by Mr. Durham and the City Attorney.
It was moved by Councilman Corbin, seconded by Councilman Skinner and so
ordered that the hearing on the Downey City Lighting District, Annexation 3C, Zones 1
and 4 be closed.
RESOLUTION NO. 923
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ORDERING CERTAIN LIGHTING FIXTURES: APPURTENANCES, AND
APPLIANCES ON CERTAIN STREETS AND PUBLIC PLACES OF SAID
CITY TO BE MAINTAINED AND ELECTRIC CURRENT TO BE FUR-
NISHED, ALL IN ACCORDANCE WITH RESOLUTION NO. 905 OF
SAID CITY ( DOWNEY CITY LIGHTING DISTRICT, ANNEXATION 3C,
ZONE 1)
The resolution was read by title only. It was moved by Councilman Corbin,
seconded by Councilman Giddings and so ordered that further reading be waived.

RESOLUTION NO. 924

Mayor Temple announced that now is the time and place set for the hearing
on the Comprehensive Zoning Ordinance amendments -- Planning Resolution No. 58.
Mr. Sherman Griselle outlined the amendments of the sections of the Zoning
Ordinance affected by them.
Mayor Temple inquired if the City Clerk had the Affidavit of the Publication
of the notice of hearing. The City Clerk replied she had.
The Mayor then inquired if there was any written correspondence regarding these
amendments. City Clerk replied there was none.
Mayor Temple then asked for oral communications from the audience. Mr. H. E.
Black, 8052 E. Alameda Street, submitted a request for additional amendments to
the Comprehensive Zoning Ordinance, requesting that Council study the proposed
amendments further before adopting an ordinance approving said amendments.
Mr. Black's report was ordered received and filed..
It was moved by Councilman Skinner, seconded by Councilman Peavey and so ordered
that the hearing on the proposed amendments to the Comprehensive Zoning Ordinance be
closed.
ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DOWNEY
AMENDING THE DOWNEY MUNICIPAL CODE BY AMENDING SECTIONS
9105.58, 9115.1, 9133, 9133.5, 9129.14 RELATING TO THE
COMPREHENSIVE ZONING ORDINANCE
The ordinance was read by title only. It was moved by Councilman Peavey,
seconded by Councilman Skinner and so ordered that the ordinance be taken under
submission for further study.
Councilman Skinner requested that copies of Mr. Black's report be submitted
to each councilman and planning commissioner.
Mayor Temple announced that now is the time and place set for the hearing on
the appeal to Zone Change #76. Mr. Griselle gave a resume of this zone change
request.
Mr. Olson, representing appellant, presented a letter from Emma L. Grabe and
Deran Kerian, consenting to dedicate the North 20 feet involved in Zone Change #76
for alley purposes, should the zone change be granted. This was marked Exhibit A
and ordered received and filed.
Also speaking for the Zone Change were Chris Parr, Realtor, Ray Noxsel,
Coordinating Director for the Board of Directors of the Downey Chamber of Commerce,
speaking on behalf of the Chamber, stating they wish to reiterate that some
commercial use be made of this property in question.
.Speaking against the zone change were Mr. Edgar Hatfield, Dorothy Hatfield,
properties owners north of the property in question; Leonard Reseck of the Downey
Home Owners Association, who stated he believes it best if cases of this kind go
through zone exception procedure. Milton Stern, 8125 Dinsdale, also spoke against
the zone change.
It was moved by Councilman Skinner, seconded by Councilman Peavey and so
ordered that the hearing on Zone Change #76 be closed.
After considerable discussion, it was moved by Councilman Peavey, seconded by
Councilman Giddings and passed by the following vote to refer Zone Change #76 to
the Planning Commission for consideration as a zone exception, with the request
that the Commission report back to Council with an inclusion of such conditions as
it would recommend to attach to such zone exception.

Mayor Temple announced that this is the time set for the hearing on Sixth
Street, A.D. #12, relative to work change. A report on the work change was given
by Le Leavitt.
The Mayor inquired if the City Clerk had the Affidavit of Publication. City
Clerk replied she had.
As there were no written protests and no oral communications regarding this
.—, work change on Sixth Street, A.D. #12, it was moved by Councilman Corbin, seconded
by Councilman Giddings and so ordered that the hearing be closed.
RESOLUTION NO. 925
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DOWNEY
ORDERING CERTAIN MODIFICATIONS OF THE WORK TO BE DONE
IN ASSESSMENT DISTRICT NO. AD 12 (SIXTH STREET AND
LAKEWOOD BOULEVARD)

A report was given by Mr. Griselle regarding parking available for
the apartment area on the east side of Brookshire Avenue north of Gallatin Road.
Speaking for allowing parking on the west side of Brookshire was Wm. Brining,
9200 Brookshire.
James Hand, 9229 Brookshire, Walter Gruber, 9157 Brookshire, Eleanor Marchese,
9203 Brookshire, and Raymond Durling, property owners on the west side of Brookshire,
spoke in behalf of prohibiting all parking in front of their homes.
After rebuttal by Wm. Brining, it was moved by Councilman Corbin, seconded by
Councilman Giddings and so ordered that the hearing be closed.
Councilman Giddings stated he feels there is a real problem existing but
there does not seem to be any way to correct the situation. The best possible
solution is as it is at present; therefore, no action was taken by Council and
the parking remained as previously ruled.
Mr. Griselle gave a report on Lot Split #219. Mr. Fred Olson, speaking for
Streety Homes, Inc., Beverly and Wells, again requested that inasmuch as there
were 3 separate deeds on this property consisting of 75' total, the split of the
lots three ways be granted. He did not see how the three owners could split the
75 -foot in half.
The City Attorney read Section 9114.3 of the Zoning Ordinance. Council
recommended and advised the Council had no authority to grant these 25 -foot lots
according to the ordinance. Council recommended a review of the ordinance to see
if a 25 -foot minimum could be established in certain areas. No action was taken
by Council but it was recommended that the applicants apply to the Planning Com-
mission for a zone exception and, if so granted, they then could apply for the
Lot Split.
Mr. Griselle reported on Zone Change #61, Woodruff buffer zone.
ORDINANCE NO.

AMENDING THE ZONING MAP ADOPTED BY SECTION 9107 OF THE
DOWNEY MUNICIPAL CODE (ZONE CHANGE CASE #61)

A report was presented by Mr. Griselle on the appeal of Lot Split #90.
Mr. Ray P. Biby, appellant, again urged that Council grant this lot split.
Mr. Olson spoke in behalf of Mrs. Jennie Mancini and Mrs. Josephine Hook and
requested that no actirn be taken at this time to enable further negotiations
with the property owners in the area in the hope that an assessment district
could be formed to improve all the property uniformly. Others speaking in

favor of delaying action were Ruth Ball for Mr. Joseph E. Brain, W. W. Christensen,
9951 Brookshire, Morris Watson, speaking for Mrs. Mancini, and Charles Hook,
9943 Brookshire.
It was moved by Councilman Giddings, seconded by Councilman Peavey and so
ordered that Lot Split #90 be taken under submission in order that the affected
"-ft property owners may further negotiate.
Mr. Griselle presented the legal description of property owned by Mrs. Marian
Wilson Jones consisting of a portion of Lot Split #196, as requested by Council and
reported that the Planning Commission requests clarification of Council's orders.
It was moved by Councilman Temple that the Council initiate a zone change on
that property described in the Inter - Office Memo to Della Doyle from Sherman W.
Griselle dated December 21, 1961, Subject: Legal Description of property owned by
Mrs. Marian Wilson Jones, and that the change of zone be from the existing R -3 to
C -1. The motion died for lack of a second.
Mr. Griselle presented the Planning Commission's request for a 60 -day extension
of time to make a report on Zone Change #72 (Caldwell), allowing them time to pre-
pare for a public hearing in order to make a complete report to Council.

by the following vote to grant a 60 -day extension of time in which the Planning
Commission is to report to City Council on Zone Change Case #72 (Caldwell).

The City Clerk reported on the written correspondence: eleven letters relative
to Planning Commission appointment, and two communications regarding the library
shelf. The City Clerk reported that Councilman Skinner had handed her a letter from
Mr. & Mrs. Herbert A. Grow, 8425 Devenir Street, Mr. & Mrs. Adrian D. Gooch, 8431
Devinir, and Mr. & Mrs. Richard A. Vaughn, 8431 Lyndora St., Downey, relative to
traffic controls at Belder and Imperial Highway. Councilman Skinner reported that he
had investigated the situation and from his observations, feels it is urgent that
traffic controls be installed at Imperial Highway and Brookshire Avenue at the
earliest opportunity to alleviate the traffic problem in this area. Mr. King re-
ported that this traffic control is presently under consideration for installation
as early as possible.

AMENDING SECTIONS 4210 AND 4211 OF THE DOWNEY MUNICIPAL
CODE WHICH SAID SECTIONS RELATE TO THE VACCINATION OF

amendment of this section of the Downey Municipal Ordinance is merely to conform
to State codes. It was moved by Councilman Giddings, seconded by Councilman Skinner

URGING THE LOS ANGELES COUNTY BOARD OF SUPERVISORS TO
ADOPT A POLICY ESTABLISHING A MORE EQUITABLE DISTRIBUTION
OF HIGHWAY USES TAX FUNDS RECEIVED BY THE COUNTY AND THE
CITIES WITHIN THE COUNTY.

The City Attorney stated that a resolution previously adopted must now be
readopted in order to change one of the legal descriptions relative to acquisition

ordered that authority be granted to circulate petitions for A.D. #77, improve-
ments on Stewart and Gray Road.

ordered to accept for public use the sanitary sewers constructed under P.C. #6007
on Rose Avenue.

passed by the following vote to ratify the employment of a Planning Technician
for the Planning Department. Mr. King reported that the Personnel Advisory
Board has approved this action.

The Civil Defense Advisory Committee recommendations werepresented.
It was moved by Councilman Giddings, seconded by Councilman Skinner and
passed by the following vote to authorize the City Manager to take the necessary
action to secure bids upon a Scream - Master system of sirens, and present a
financial report to Council of his findings including State or Federal participa-
tion.

Mr. Wendell Wiser, Chairman of the Civil Defense Advisory Committee, advised
that the Committee is opposed to the County plan for fallout shelters and feels
that the citizens of Downey can build their own shelters better, cheaper and
sooner. He recommended contacting the Downey Unified School District and Downey
Park and Recreation District to arrange a meeting with the City Council in an
endeavor to provide suitable shelters for the entire population of Downey, pos-
sibly on school property.
Mr. Edwin Powell, Deputy Director of Civil Defense, and Le Leavitt, City
Engineer, reported on the storm drain survey and engineering progress being made
relative to use of these drains as fallout shelters.
Mrs. Carl Toro, 7938 Cole Street, requested that the meeting of the Civil
Defense Advisory Committee, Sch ®1 District and Park District_ and the City Council
be open to the public.

The Council directed the City Manager /to follow through on the recommenda-
tion of the Civil Defense Advisory Committee to investigate all possibilities
of shelter construction.

The-City Clerk requested authority from Council to employ the firm of
Martin and Chapman as suppliers for the forthcoming election on April and also
--� authority to consolidate County precincts on the basis of approximately 3 to 1
as has been done in previous elections.
It was moved by Councilman Corbin, seconded by Councilman Giddings and
passed by the following vote to authorize employment of the firm of Martin and
Chapman as suppliers for the Municipal Election to be held on April 10, 1962,
and authority to consolidate County precincts as recommended by the City Clerk.

The City Attorney reported regarding the question of placing the lease -
option arrangement for construction of a Municipal Auditorium on the ballot as
of April 10, that there is no specific authorization for Council's placing such
a matter on the ballot; however, it has been fairly generally held that if there
is a city -wide election, there is nothing to prohibit placing the item on a city-
wide ballot. However, since there are only two councilmanic districts on the
1962 election, it would mean the spending of additional sums of money which would
double the election cost simply to put on the ballot an advisory measure. There
is no specific authorization and no true function to be performed and to call a
city -wide election for this purpose would not be feasible.
Mr. King presented a report on the .Sewer Maintenance in the City of Downey,
along with a summation of the cost for maintaining this operation by the City.
^ A letter was then read by Mr. King, directed to .Supervisor Bonelli, requesting
refund of sewer district maintenance funds at such time as the City of Downey
withdraws from this district, and the City begins its own maintenance program of
sanitary sewers. Council approved the letter as presented and authorized the
Mayor to sign.

It was moved by Councilman Corbin, seconded by Councilman Skinner and so
ordered to authorize sending a letter to Supervisor Bonelli requesting aid from
Highways Through Cities Funds on Downey Avenue improvements.
It was moved by Councilman Peavey, seconded by Councilman Corbin and so
ordered to approve sending a letter to Supervisor Bonelli requesting approval and
allocation of the remaining $92,000 left over from the award of bids on the
current storm drain projects to be used to continue the storm drain from its
present termination at Fifth and Western northerly on Western to Seventh and
easterly on Seventh to Downey Avenue. Also, to request approval of extension of
this project to include a lateral storm drain on Second Street from Myrtle Street
to LaReina Avenue.
Held under submission were the matters of re- landscaping of the City Hall
building and the proposed enlarging of the Council Chambers,-

Mrs. Carl Toro, 7938 Cole Street, announced the appearance.of General Walker
at a rally at the Sports Arena and presented a booklet and tickets.to Councilmen
able to attend the rally on Thursday night.
Councilman Peavey recommended setting to a meeting with the Park Water
Company official to endeavor to reach some kind of agreement relative to the pur-
chase of the Water Company. Council authorized the City Manager to arrange for
this meeting in the near future.
It was moved by Councilman Peavey, seconded by Counc roan Corbin and so
ordered to authorize members of the City Council who are able to do so, to attend
the Metropolitan Government meeting on February 1 and 2 in Sacramento.
